This volume analyses how forms of the "religious", especially from outside the Western European tradition, shape Lacanian theory. It examines how the universal desire for meaning always expresses the radical impossibility for any speech to communicate something of the Real that is necessarily obscured by our own political existences.

Perceptual experiences justify. When I look at the black laptop in front of me and my perceptual experience presents me with a black laptop placed on my desk, my perceptual experience has justificatory force with respect to the proposition that there is black laptop on the desk. The present paper addresses the question of why perceptual experiences are a source of immediate justification: What gives them their justificatory force? I shall argue that the most plausible and the most straightforward answer (...) to this question consists in what I call the phenomenological conception of perceptual justification. Perceptual experiences justify by virtue of their distinctive presentive phenomenology. This is a truly internalist conception that enjoys significant advantages over rival conceptions. Wie verhalten sich Freiheit und Staatlichkeit in Kants Rechtslehre? Und welche Bedeutung kommt hierbei seiner kritischen Moralphilosophie zu? Hirschs Untersuchung zeigt, dass bei Kant Recht und Staat notwendige Realisationsbedingungen individueller Autonomie sind. Erst als autonome und selbstzweckhafte Personen haben wir Freiheitsrechte, welche wir aber nur im Staat legitim behaupten können. Denn nur unter der Idee von Staatlichkeit als Vereinigung des gesetzgebenden Willens aller kann rechtliche Fremdverpflichtung als Selbstverpflichtung begriffen werden. Staatlichkeit dient damit der Verwirklichung individueller Autonomie und Freiheit. Hierin liegt (...) das Reformideal politischer Herrschaft. Doch Rechtsdurchsetzung gegen den Staat ist unmöglich, sodass aktiver Widerstand nie rechtens, aber mitunter entschuldbar ist. Damit gelingt es Hirsch erstmals, Kants Rechts- und politische Philosophie ausgehend vom kategorischen Imperativ als integralen Bestandteil seiner kritischen Moralphilosophie auszuweisen. Gleichzeitig lässt sich so erklären, wie Anerkennung individueller Freiheitsrechte, staatlicher Rechtszwang und unbedingte staatsbürgerliche Gehorsamspflicht als Ausdruck des politischen Liberalismus Kants miteinander vereinbar sind. Der Ausdruck eudaimonia bezeichnet vielmehr ein insgesamt gelungenes und glückliches Leben – ein Leben, auf das die Charakterisierungen eu zên und eu prattein zutreffen. Die Frage ›Was ist das Glück?‹ entspricht also der sokratischen Frage ›Wie soll man leben?‹.

Attention has a role in much of perception, thought, and action. On the erotetic theory, the functional role of attention is a matter of the relationship between questions and what counts as answers to those questions. Questions encode the completion conditions of tasks for cognitive control purposes, and degrees of attention are degrees of sensitivity to the occurrence of answers. Questions and answers are representational contents given precise characterizations using tools from formal semantics, though attention does not depend on language. (...) The erotetic theory proposes an integrated account of attention in cognitive control and of attentional focus in perception. The functional role of attentional focus on objects, properties, and locations has to do with picking out something that corresponds to what a task is ‘about’. The erotetic theory of attention opens new avenues in theorizing about the relationship between attention, representational content, phenomenal character, and practical reason. A novel representationalist account of salience is proposed. The theory also provides an account of distraction that suggests when distraction is a defect in practical reasoning. (shrink)

It is well known that Husserl considered phenomenology to be First Philosophy—the ultimate science. For Husserl, this means that phenomenology must clarify the ultimate phenomenological-epistemological principle that leads to ultimate elucidation. But what is this ultimate principle and what does ultimate elucidation mean? It is the aim of this paper to answer these questions. In section 2, we shall discuss what role Husserl’s principle of all principles can play in the quest for ultimate elucidation and what it means for a (...) principle to be ultimately elucidating and ultimately elucidated. We will see that the Husserlian thesis that originary presentive intuitions are an immediate and the ultimate source of justification qualifies as the ultimate epistemological principle. (shrink)

How can the friction between genesis and validity be understood? Is it possible to »dissolve« it? This paper argues that the genesis/validity-problem reflects the fundamental epistemological differences between History and Philosophy, and it takes Michel Foucault’s »Archeology« as a model case for this problem. Since Foucault’s »archaeological« methodology, i.e. his discourse analysis, is deeply affected by these tensions, I will show, firstly, that the epistemological model for Foucault’s anti-hermeneutical and genealogical approach was rooted not in philosophy, but in medicine, especially (...) in anatomy. Secondly, I will argue that the »paradoxical« position of discourse analysis, in Foucault’s eyes, is necessarily a political one – i.e. as a position within political struggles. (shrink)

In 2006, mountaineer David Sharp died on the slopes of Mount Everest. Sharp’s death led to public outrage after allegedly 40 climbers passed by the dying Sharp on their way to the peak, without stopping to help. But, since the slopes of Everest are a high-risk environment and rescuing Sharp would have entailed great risks for the rescuers, it is not clear whether the other mountaineers had a moral duty to rescue him. In a recent article, Patrick Findler introduces a (...) principle to analyse such cases which states that we have a duty to rescue under dangerous circumstances, if the involved risks are not higher than the risks we are already taking in the pursuit of our own, morally less worthy ends. However, Findler then rejects this principle as too demanding. In this paper I will defend the principle against its inventor and argue in favour of such a duty. And while it may be true that the other mountaineers were justified in passing Sharp for different reasons, the principle shows that not only climbers, but adventure-sport athletes in general and people who engage in high-risk endeavours, may have a duty to rescue that doesn’t apply to others. This book offers a phenomenological conception of experiential justification that seeks to clarify why certain experiences are a source of immediate justification and what role experiences play in gaining (scientific) knowledge. Based on the author's account of experiential justification, this book exemplifies how a phenomenological experience-first epistemology can epistemically ground the individual sciences. More precisely, it delivers a comprehensive picture of how we get from epistemology to the foundations of mathematics and physics. The book is unique as it utilizes methods (...) and insights from the phenomenological tradition in order to make progress in current analytic epistemology. It serves as a starting point for re-evaluating the relevance of Husserlian phenomenology to current analytic epistemology and making an important step towards paving the way for future mutually beneficial discussions. This is achieved by exemplifying how current debates can benefit from ideas, insights, and methods we find in the phenomenological tradition. (shrink)

Rapid, large-scale uptake of new vaccines against COVID-19 will be crucial to decrease infections and end the pandemic. In a recent article in this journal, Julian Savulescu argued in favour of monetary incentives to convince more people to be vaccinated once the vaccine becomes available. To evaluate the potential of his suggestion, we conducted an experiment investigating the impact of payments and the communication of individual and prosocial benefits of high vaccination rates on vaccination intentions. Our results revealed that none (...) of these interventions or their combinations increased willingness to be vaccinated shortly after a vaccine becomes available. Consequently, decision makers should be cautious about introducing monetary incentives and instead focus on interventions that increase confidence in vaccine safety first, as this has shown to be an especially important factor regarding the demand for the new COVID-19 vaccines. This article brings to bear findings from the debate on the boundary problem in democratic theory on discussions of workplace democracy to argue that workplace democrats’ focus on workers is unjustified and that more constituencies will have to be included in any prospective scheme of workplace democracy. It thereby provides a valuable and underdiscussed perspective on workplace democracy that goes beyond the debate’s usual focus on the clarification and justification of workplace democrats’ core claim. It also goes beyond approaches like (...) stakeholder theory in law and economics that determine decision-making rights without taking into account genuinely democratic considerations. My discussion proceeds by considering three principles for inclusion from democratic theory for the specific case of the corporation. I submit that two of them, the all-coerced and the all-subjected principle, are not appropriate for this specific case, because they cannot capture the distinguishing features of the corporation. The all-affected principle however is appropriate but has a very wide range. I further argue that this is not as big of a problem as it first might seem and that this principle is still the most appropriate for defining the demos of the democratic corporation. The article closes by pointing out the consequences of this result for the workplace democracy debate and for the legitimacy of the market as a coordination mechanism. (shrink)

Much recent philosophical work on social freedom focuses on whether freedom should be understood as non-interference, in the liberal tradition associated with Isaiah Berlin, or as non-domination, in the republican tradition revived by Philip Pettit and Quentin Skinner. We defend a conception of freedom that lies between these two alternatives: freedom as independence. Like republican freedom, it demands the robust absence of relevant constraints on action. Unlike republican, and like liberal freedom, it is not moralized. We show that freedom as (...) independence retains the virtues of its liberal and republican counterparts while shedding their vices. Our aim is to put this conception of freedom more firmly on the map and to offer a novel perspective on the logical space in which different conceptions of freedom are located. (shrink)

The aim of this paper is to shed light on and develop what I call a phenomenological conception of experiential justification. According to this phenomenological conception, certain experiences gain their justificatory force from their distinctive phenomenology. Such an approach closely connects epistemology and philosophy of mind and has recently been proposed by several authors, most notably by Elijah Chudnoff, Ole Koksvik, and James Pryor. At the present time, however, there is no work that contrasts these different versions of PCEJ. This (...) paper not only bridges this gap, but also reveals problems in current versions of PCEJ. Barnett and Block (Journal of Business Ethics, 2009 ) attack the heart of modern banking by claiming that the practice of borrowing short and lending long is illicit. While their claim of illegitimacy concerning fractional reserve banking can be defended, their justification lacks substance. Their claim is herein strengthened by a legal analysis of deposits and loans based on Huerta de Soto (Money, Bank Credit and Economic Cycles, 2006 ). A combined legal and economic analysis shows that while lending deposits (...) can be regarded as illicit, the maturity mismatching of loans is legitimate contrary to Barnett and Block’s claim. No over-issuance of property rights is involved with this practice once the distinction between present and future goods is taken into account. However, while the practice is not illicit per se , it is greatly assisted and developed through the presence of a fractional reserve banking system, and can sometimes breed detrimental effects. As is well known, the late Husserl warned against the dangers of reifying and objectifying the mathematical models that operate at the heart of our physical theories. Although Husserl’s worries were mainly directed at Galilean physics, the first aim of our paper is to show that many of his critical arguments are no less relevant today. By addressing the formalism and current interpretations of quantum theory, we illustrate how topics surrounding the mathematization of nature come to the fore naturally. Our (...) second aim is to consider the program of reconstructing quantum theory, a program that currently enjoys popularity in the field of quantum foundations. We will conclude by arguing that, seen from this vantage point, certain insights delivered by phenomenology and quantum theory regarding perspectivity are remarkably concordant. Our overall hope with this paper is to show that there is much room for mutual learning between phenomenology and modern physics. (shrink)

This chapter examines the neo-republican thesis of the compatibility between freedom and the state under conditions of ‘equally shared control’. It first considers the neo-liberal conception of the relation between freedom and the state as well as the socialist-social-democratic criticism of the neo-liberal understanding of freedom. It then discusses the neo-republicanism of Philip Pettit and the ‘republican thesis’ that freedom and political order are not contradictory to each other. It also analyses Robert Nozick's libertarianism and Friedrich Hayek's liberalism, along with (...) their argument that all actions of a government should be in strict accordance with the rule of law. Furthermore, it looks at the political philosophy of neo-liberalism, the implications of nondomination and the ‘neo-republican thesis’ that even a state's power and interferences can be controlled by its citizens. In 1981, David Hubel and Torsten Wiesel received the Nobel Prize for their research on cortical columns—vertical bands of neurons with similar functional properties. This success led to the view that “cortical column” refers to the basic building block of the mammalian neocortex. Since the 1990s, however, critics questioned this building block picture of “cortical column” and debated whether this concept is useless and should be replaced with successor concepts. This paper inquires which experimental results after 1981 challenged the building (...) block picture and whether these challenges warrant the elimination “cortical column” from neuroscientific discourse. I argue that the proliferation of experimental techniques led to a patchwork of locally adapted uses of the column concept. Each use refers to a different kind of cortical structure, rather than a neocortical building block. Once we acknowledge this diverse-kinds picture of “cortical column”, the elimination of column concept becomes unnecessary. Rather, I suggest that “cortical column” has reached conceptual retirement: although it cannot be used to identify a neocortical building block, column research is still useful as a guide and cautionary tale for ongoing research. In the past decade, the fields of machine learning and artificial intelligence (AI) have seen unprecedented developments that raise human-machine interactions (HMI) to the next level.Smart machines, i.e., machines endowed with artificially intelligent systems, have lost their character as mere instruments. This, at least, seems to be the case if one considers how humans experience their interactions with them. Smart machines are construed to serve complex functions involving increasing degrees of freedom, and they generate solutions not fully anticipated by humans. (...) Consequently, their performances show a touch of action and even autonomy. HMI is therefore often described as a sort of “cooperation” rather than as a mere application of a tool. Some authors even go as far as subsuming cooperation with smart machines under the label ofpartnership, akin to cooperation between human agents sharing a common goal. In this paper, we explore how far the notion of shared agency and partnership can take us in our understanding of human interaction with smart machines. Discussing different topoi related to partnerships in general, we suggest that different kinds of “partnership” depending on the form of interaction between agents need to be kept apart. Building upon these discussions, we propose a tentative taxonomy of different kinds of HMI distinguishing coordination, collaboration, cooperation, and social partnership. (shrink)

ABSTRACTWhat is the relation between ethical reflection and moral behavior? Does professional reflection on ethical issues positively impact moral behaviors? To address these questions, Schwitzgebel and Rust empirically investigated if philosophy professors engaged with ethics on a professional basis behave any morally better or, at least, more consistently with their expressed values than do non-ethicist professors. Findings from their original US-based sample indicated that neither is the case, suggesting that there is no positive influence of ethical reflection on moral action. (...) In the study at hand, we attempted to cross-validate this pattern of results in the German-speaking countries and surveyed 417 professors using a replication-extension research design. Our results indicate a successful replication of the original effect that ethicists do not behave any morally better compared to other academics across the vast majority of normative issues. ABSTRACTFor Husserl, noetics is the most fundamental science and the centrepiece of a phenomenological epistemology. Since in his major works Husserl does not develop noetics systematically but uses its main ideas and achievements often in apparent isolation without clarifying their systematic unity, the significance of noetics is often overlooked. Although Husserl has repeatedly stressed the importance of a phenomenological epistemology, what the concrete theses of such an undertaking are supposed to be often remains obscure. We shall see that the best (...) way to clarify this is by providing a detailed account of Husserl’s noetics as it is developed in Husserl’s lecture courses “Introduction to Logic and Theory of Knowledge” and “Logic and General Theory of Science”. This is the main aim of the present paper. We will shed light on the significance, systematic unity, and concrete theses of noetics. There are widely differing views on the philosophical interpretation of Einstein’s Theory of Relativity. On this subject Bertrand Russell says: There has been a tendency, not uncommon in the case of a new scientific theory, for every philosopher to interpret the work of Einstein in accordance with his own metaphysical system, and to suggest that the outcome is an accession of strength to the views which the philosopher in question previously held.

Genesis and validity ( Genesis and Geltung ) can be distinguished and even separated: genesis would be a historical or empirical question; and validity a question of pure reason. But genealogy in Nietzsche's tradition has challenged this separation. What is the validity of genesis; and what is the genesis of validity? The constellation of genesis and validity are to be analysed. Therefore the theological background has to be remembered: the »original« identity of genesis and validity (in the narration of creation (...) like in salvation). This imaginary identity is dissociated in history. That is why genesis and validity are given »for us« only in difference. Than the pretention of identity is always a little imaginary: may it be the genealogical idea (the genesis is the validity) or vice versa the idea of pure reasons (validity is indifferent to genesis). Beyond the pretention of identity or separation, it is suggested to look for dialectic and furthermore chiastic relations of validity and genesis. Than the question arises: who is in position to draw the distinction between them? Who is »the souvereign« to define the limits of genesis and validity? Is their difference a question of genesis or a question of pure reasons? I suggest: the difference is made by symbolic power and interpretation, more exactly: the relation of genesis and validity is a question of »Deutungsmacht« (symbolic or interpretational power). Polysemous concepts with multiple related meanings pervade natural languages, yet some philosophers argue that we should eliminate them to avoid miscommunication and pointless debates in scientific discourse. This paper defends the legitimacy of polysemous concepts in science against this eliminativist challenge. My approach analyses such concepts as patchworks with multiple scale-dependent, technique-involving, domain-specific and property-targeting uses (patches). I demonstrate the generality of my approach by applying it to "hardness" in materials science, "homology" in evolutionary biology, "gold" in chemistry and "cortical (...) column" in neuroscience. Such patchwork concepts are legitimate if the techniques used to apply them produce reliable results, the domains to which they are applied are homogenous, and the properties they refer to are significant to describe, classify or explain the behavior of entities in the extension of the concept. By following these normative constraints, researchers can avoid miscommunication and pointless debates without having to eliminate polysemous patchwork concepts in scientific discourse. (shrink)

How ethical have recent banking practices been? We answer this question via an economic analysis. We assess the two dominant practices of the modern banking system – fractional reserves and maturity transformation – by gauging the respective rights of the relevant parties. By distinguishing the legal and economic differences between deposit and loan contracts, we determine that the practice of maturity transformation (in its various guises) is not only ethical but also serves a positive social function. The foundation of the (...) modern banking system – the holding of fractional reserves against deposits – is, however, problematic from economic, legal and ethical perspectives. Starting from a microanalysis of money's function, a reassessment of the current laws concerning the practice is encouraged, with the aim not only to rectify economic irregularities but also to realign depositors' rights with the obligations of the banking sector.
