The value-laden message of Western secular culture to people and traditional societies in many cases ill-prepared to evaluate it leads to widespread crisis, for example, in regard to marriage and family life. This technology can be a means for solving human problems, promoting the integral development of persons, creating a world governed by justice, peace, and love. It also can help men and women in their age-old search for self-understanding. Multi-stakeholder initiatives have become a vital part of the organizational landscape for corporate social responsibility. Recent debates have explored whether these initiatives represent opportunities for the “democratization” of transnational corporations, facilitating civic participation in the extension of corporate responsibility, or whether they constitute new arenas for the expansion of corporate influence and the private capture of regulatory power. In this article, we explore the political dynamics of these new governance initiatives by presenting an in-depth case study of an organization (...) often heralded as a model MSI: the Forest Stewardship Council. An effort to address global deforestation in the wake of failed efforts to agree a multilateral convention on forests at the Rio Summit in 1992, the FSC was launched in 1993 as a non-state regulatory experiment: a transnational MSI, administering a global eco-labeling scheme for timber and forest products. We trace the scheme’s evolution over the past two decades, showing that while the FSC has successfully facilitated multi-sectoral determination of new standards for forestry, it has nevertheless failed to transform commercial forestry practices or stem the tide of tropical deforestation. Applying a neo-Gramscian analysis to the organizational evolution of the FSC, we examine how broader market forces and resource imbalances between non-governmental and market actors can serve to limit the effectiveness of MSIs in the current neo-liberal environment. This presents dilemmas for NGOs which can lead to their defection, ultimately undermining the organizational legitimacy of MSIs. (shrink)

Over recent years, science and technology have been reassessed increasingly in ethical terms. Particularly for life science governance, ethics has become the dominant discourse. In the course of this ‘‘ethical turn’’ national ethics councils were set up throughout Europe and in the United States to advice politics in ethically controversial issues such as stem cell research and genetic testing. Ethics experts have become subject to traditional warnings against expertocracy: they are suspected to unduly influence political decision-making. However, any reliable (...) ethics expertise has to reflect societal disagreements in moral issues. Therefore, expert dissent is a normal feature of legitimate ethics expertise. Based on theoretical considerations we argue that in principle, expert dissent does not cause problems for political legitimacy; rather, it enhances the salience of politics: obviously decisions on ethical issues cannot be taken on the basis of expert knowledge alone. We therefore conclude that expert dissent, not consent, supports politics. Focussing on Germany and Austria, we show how politics deal with expert dissent in practice. While in Germany politics acknowledge dissent and use it to foster a fundamental political debate, Austrian politics attribute authoritative power to ethics expertise and try to construct an overall consensus. This illustrates how the drawing of boundaries between politic and expertise differs. (shrink)

This essay goes beyond the dominant conception of constituent power developed by Emmanuel Sieyès and Carl Schmitt by excavating an alternative through the practices of twentieth-century workers’ councils and the interpretations of council democracy by Cornelius Castoriadis and Hannah Arendt. Interpreters of the constituent power often agree on its fundamentally antagonistic relation to constituted power, hereby making constituent politics a momentary experience, which cannot be sustained in constituted politics. Council democracy, instead, discloses a modality of politics, which bridges (...) the gap between constituent power and political form in order to provide institutional means through which the spirit of revolution can survive the founding moment. With this alternative concept of council democratic constituent power, this essay contributes to radical democratic theory by stipulating ways in which institutions can be rethought radically democratic as a way in which constituent power (creativity, novelty, freedom) can be institutionally approximated and continually reexperienced. This case study provides a multi-perspective view on the power of political events as a strategy to influence public opinion-building regarding the European Union and the European Idea. To achieve this purpose, it examines one prominent political issue of 2007, namely the German Presidency of the Council of the EU. Looking at three different groups of actors, the German Government, the media, and the audience, the public perception of events is analyzed according to their varying degree of (...) mediatization. The case study compares the three main objectives of the German Presidency on the actors' agendas and describes how issues were framed during three different time periods. The findings suggest that the media agenda was heavily influenced by the government's scheduled events. Regarding the frames identified in the public sphere, the media offered different interpretations, somewhat varying from the political leaders' intentions and from the citizens' perceptions. Many interpreters of Plato's Laws have seen the introduction of the ‘nocturnal council’ towards the end of that dialogue as a return to the sort of philosophic dictatorship allegedly recommended in the Republic and thus as a betrayal of the principle of the rule of law evinced in most of the Laws. This paper defends the consistency of the council with the larger programme of the Laws by showing that its function is philosophic discussion and not rule. Its (...) influence will be the influence of philosophy on its members, who already occupy political offices in the city, and not direct rule as a body. In this way, the council provides a point of entry for the transpolitical good of philosophy into the city and thus offers an essentially legal regime the means of transcending some of its characteristic limitations. Previous research on gender and political leadership has narrowly defined gender consciousness, failing to account for the broader commitments, concerns, and loyalties held by women of color. In this article, the author calls for an intersectional approach to analyzing the gender consciousness of political leaders. She presents findings from four months of participant observation in a Latina candidate’s campaign for city council. The author finds that the campaign presented an intersectional consciousness in the candidate’s messages, using gendered (...) discourses to frame her commitment to issues of greatest concern to Hispanic and low-income communities. The campaign’s mobilization efforts targeted both women and Hispanics, but focused most of its resources into courting the vote of middle- and upper-class white women. Contrary to recent claims that intersectionality has outlived its usefulness as an analytic tool, the author argues that intersectionality remains an underutilized and much-needed framework for helping to close gaps in the understanding of political life. The principle of the responsibility to protect (RtoP) conceives of a broad set of measures that can be employed in preventing and responding to atrocity crimes. Nevertheless, the UN Security Council remains an important part of the implementation architecture, given what the International Commission on Intervention and State Sovereignty referred to as its authoritative position in international society as the “linchpin of order and stability.” As part of the roundtable “The Responsibility to Protect in a Changing World Order: Twenty (...) Years since Its Inception,” this review of the Council's role in fulfilling its responsibility to protect advances two somewhat contrasting arguments about the original ICISS report. First, it suggests that the commissioners may have underestimated the Council's potential contribution, by concentrating on the authorization of coercive means to address crises of human protection. Over the past two decades, the Security Council has not only employed various diplomatic, political, and humanitarian measures to address atrocity crimes but also adjusted the purposes and practices of peace operations to advance protection goals and more subtly shaped discourses and expectations about state responsibilities for protection. However, I also argue that the willingness of the ICISS to identify potential alternatives to the Security Council when its members are paralyzed appears in retrospect to have been both bold and forward looking, in light of the Council's failures to act in a timely and decisive manner to protect amid crises and the contemporary realities of geopolitical rivalry. The article concludes by suggesting that future efforts to protect populations from atrocity crimes should focus not only on the herculean task of trying to change the behavior of P5 members of the Council but also on encouraging a new institutional balance between the Security Council and other intergovernmental bodies. “The political form at last discovered under which to work out the economic emancipation of labor.” With these words, Marx described the Paris Commune of 1871. It “was formed of the municipal councillors, chosen by universal suffrage in the various wards of the town, responsible and revocable at short term […] a working, not a parliamentary body, executive and legislative at the same time.” The political tradition of the Commune was inherited by the Russian soviets and inspired Lenin, (...) who explained the role of those governing bodies as a “reversion to primitive democracy.” Arthur Rosenberg, professor of Ancient History at Berlin University, tried in his book Democracy and Class Struggle in the Ancient World to offer historical ground for the ideas developed by Lenin in State and Revolution and compared ancient Athenian democracy to the contemporary German and Russian councils. During the 1920s, as a communist leader and MP, Rosenberg, recalling his ideas on Athenian democracy, criticized the political degeneration of the Russian workers’ State. He stressed how Soviet Russia, in limiting the power of the councils, had suppressed the governing body of socialist direct democracy. In his work Workers’ Councils, Dutch revolutionary Anton Pannekoek renewed Rosenberg’s criticism at the end of World War II, returning to the image of ancient democratic Athens as a forerunner of the socialist councils. This article traces a discontinuous tradition of council thought from the Dutch and German council communist tendencies of the 1920s to its re-emergence in the writings of three important mid-twentieth-century political theorists: Cornelius Castoriadis, Claude Lefort, and Hannah Arendt. It connects an intellectual history of the council concept in post-war Europe with a political history of the small revolutionary groups that fostered council-related political activity during this era. It claims that, as the experience (...) of the European council movements began to be interpreted within a new political context, this gave rise to several radically altered forms of council thought. In this more subjectivist and praxis-oriented tradition, the councils became a utopian placeholder for theorists to explore their particular interests in human creativity (Castoriadis), self-limiting power (Lefort), and political freedom (Arendt). The Forest Stewardship Council (FSC) is a global private governance system overseeing the sustainability and biodiversity of the world forestry system through certification of forests and forestry processes and products, and is perceived as the strongest of the various certification schemes available (Domask, Globalization and NGOs: Transforming Business, Government, and Society , 2003 ; Gulbrandsen, Global Environmental Politics , 2004 ). It has seen more success in developed than developing countries in terms of amount of forest certified and number (...) of chain-of-custody certificates issued, raising questions as to its ability to promote biodiversity Gulbrandsen, Global Environmental Politics , 2004 ). A number of challenges have risen to the pragmatic and moral legitimacy of the FSC as a global governance system: alternative certification schemes, output and market access, cost of certification, plantations, and illegal logging. I examine each of these challenges as they pertain to the dimensions of pragmatic and moral legitimacy of the FSC. I conclude with a discussion of theoretical implications for global governance systems using ecolabel schemes, as well as a discussion of practical implications for the FSC in particular. (shrink)

This article explores the different moral and legal arguments used by protagonists in the debate about whether or not to conduct a humanitarian intervention in Darfur. The first section briefly outlines four moral and legal positions on whether there is (and should be) a right and/or duty of humanitarian intervention: communitarianism, restrictionist and counter-restrictionist legal positivism and liberal cosmopolitanism. The second section then provides an overview of the Security Council's debate about responding to Darfur's crisis, showing how its policy (...) was influenced by both normative concerns and hard-nosed political calculations. The article concludes by asking what Darfur's case reveals about the legitimacy and likelihood of humanitarian intervention in such catastrophes and the role of the UN Security Council as the primary authorising body for the use of international force. The authors argue that this case demonstrates that for the cosmopolitan/counter-restrictionist case to prevail pivotal states need to put humanitarian emergencies on the global agenda and express a willingness to act without Council authorisation, though the question of how to proceed in cases where the Council is deadlocked remains vexed. ABSTRACT Cornelius Castoriadis is one of the most important democratic thinkers in the second half of the twentieth century, and his theory of autonomy and the self-instituted character of society are fundamental to many post-Marxist theories of democracy. The role of the council system in Castoriadis' work, though, has rarely been investigated, and his analysis of the twentieth century workers' councils of has seldom been connected to his important concepts of autonomy and the instituting power. The article remedies this (...) lack of engagement with Castoriadis' analysis of the council system and argues that the emergence of workers' councils in Castoriadis' own lifetime, during the Hungarian Revolution of 1956, provided a crucial impetus for his formulation of a theory of autonomy. Moreover, the article argues that the role of the council system in Castoriadis' work provides a privileged vantage point in order to nuance the critique – voiced by for example Jürgen Habermas and Claude Lefort – that Castoriadis exclusively valorise constituent politics without properly appreciating the importance of ordinary politics. Contrary to this interpretation, the article demonstrates how Castoriadis look to the councils to understand how democratic politics entails both freedom to act anew and the need for institutional structure. Nursing and midwifery is, in the UK, regulated by the Nursing and Midwifery Council (NMC). Regulatory duties include establishing standards for education, and from January 2019, new educational programmes will be approved against standards detailed in the document Future nurse: Standards of proficiency for registered nurses (NMC, 2019—hereafter “the standards”). This publication lists “the knowledge and skills that registered nurses must demonstrate when caring for people” (NMC, 2019, p.3), and from September 2020, registration (licence) will require the successful completion (...) of programmes that have been ratified against these standards. The importance of this document in a UK context cannot be understated. However, less parochially, learning outcomes contained in section 7 of the standards raise questions that require educator attention whenever politically sensitive topics (broadly conceived) are discussed. This study explores these questions insofar as they relate to the stance (neutrality or partisanship) that educators adopt in politicized discussion, and the management of student speech/expression. Daniel Davis (bio)Approximately two weeks before what was to have been its final meeting, the White House dissolved the President’s Council on Bioethics by terminating the appointments of its 18 members. The letters of dismissal, dated 10 June 2009, informed the members that their service on the Council would end with the close of business the next (...) day.The Council’s term was set to expire on 30 September 2009. After President Obama’s election in November and during the transition, we were advised to proceed on the assumption that the Council would be permitted to cease on that date. Reasons for the abrupt move to disband the Council are unknown. We have accepted the fact that we Council members served at the pleasure of the President and that he simply exercised his rightful prerogative. No explanation is therefore required.Some observers have speculated that the action was retaliatory. They related to the fact that several members of the Council disagreed with the President’s stem cell policy in a signed statement published in the Hastings Center’s Bioethics Forum. Others have speculated that the move was pre-emptive. At its final meeting, scheduled for 25–26 June, the Council was set to sign-off on two of its final publications. One was a comprehensive report on the ethics of organ transplantation, and the other a white paper entitled Health Care and the Common Good. The aim was immediately to release the latter as a contribution to the intensifying debate about health care reform. Health Care and the Common Good could well have aided rather than impeded the President’s drive to better control health care costs and achieve universal coverage. The Council report attempted to ground both goals in the ethical framework of, as the title indicates, the common good of all Americans.In his letter terminating the members’ appointments, Assistant to the President for Presidential Personnel Don Gips said that the President “recognizes the values of having a commission of experts in bioethical issues to provide objective and non-ideological bioethics advice to his administration.” Gips went on to say that the President is “currently rethinking the purposes and goals of such a bioethics commission, and is carefully considering a revitalized mission and mandate.” And, [End Page 309] responding to media enquiries, White House press officer Reid Cherlin explained that the President’s Council was terminated because it was a “philosophically leaning advisory group” and, according to a New York Times account by Nicholas Wade, “because it favored discussion over developing a shared consensus.” As for the ultimate outcome of the President’s “rethinking,” Cherlin indicated that President Obama will appoint a new commission with the mandate of offering “practical policy options” in bioethics.In the light of our experiences with the Council, we leave it with hopes that certain questions of national importance will be addressed. How should such a commission be constituted—with what sorts of individuals? And what is the nature of the expertise that they individually and collectively bring to the commission’s functions? This article reveals the implications that made the Lithuanian Council to step aside allowing the Temporary Government to continue the further process of restitution of Lithuania, immediately after becoming the central constitutional state institution. Prior to that, Lithuanian (State) Council had managed to declare the independence of Lithuania on the 16th of February 1918 under extremely difficult political circumstances and established the statehood on the 2nd of November of the same year. Under the will of the Vilnius (...) conference of Lithuania that took place in autumn of 1917, all Lithuanian political streams of these days have been represented in the Lithuanian Council. However, the Council itself has not managed to save the representative ability by agreeing with the resignation of its left element and by continuing the expansion and distance from the community of Lithuania. Hannah Arendt’s On Revolution offers a critique of modern representative democracy combined with a manifesto-like treatise on council systems as they have arisen over the course of revolutions and uprisings. However, Arendt’s contribution to democratic theory has been obscured by her commentators who argue that her reflections on democracy are either an aberration in her work or easily reconcilable within a liberal democratic framework. This paper seeks to provide a comprehensive outline of Arendt’s writing on the council system (...) and a clarification of her work outside the milieu of the post-cold war return to Arendt. Her analyses bring to light a political system that guarantees civil and political rights while allowing all willing citizens direct participation in government. Framing her discussion within the language of the current renewed interest in constituent power, her council system could be described as a blending together of constituent power and constitutional form. Arendt resists the complete dominance and superiority of either element and argues that the foundation of a free state requires nothing less than the stabilisation and persistence of constituent power within an open and fluid institution that would resist either the bureaucratisation of politics or its dispersal into a revolutionary flux. Although one may conclude that her institutional suggestions are far from flawless, her political principles allow a conceptualisation of democracy in more substantial ways than current liberal political philosophy. In On Revolution and other writings, Arendt expresses her enthusiasm for the council system, a bottom-up political structure based on local councils that are open to all citizens and so allow them to participate in government. This aspect of her thought has been sharply criticized – ‘a curiously unrealistic commitment’ (Margaret Canovan), ‘a naiveté’ (Albrecht Wellmer) – or, more often, simply ignored. How, her readers generally wonder, could Arendt in all seriousness advocate the council system as an (...) alternative to parliamentary democracy? In this paper, I will pursue two distinct but related aims. First, I want to show that Arendt’s ideal of council politics is an integral element of her thought. It is connected to – indeed, follows from – some of her most central notions, namely her concept of freedom, her valuation of ‘public happiness’ and her distinction between opinion and interest. Second, I want to defend the ideal in the face of the criticisms that have been levelled against it. The report of the President's Council on Bioethics, Human Cloning and Human Dignity, addresses the central ethical, political, and policy issue in human embryonic stem cell research: the moral status of extracorporeal human embryos. The Council members were in sharp disagreement on this issue and essentially failed to adequately engage and respectfully acknowledge each others' deepest moral concerns, despite their stated commitment to do so. This essay provides a detailed critique of the two extreme views on the (...) Council (i.e., embryos have full moral status or they have none at all) and then gives theoretical grounding for our judgment about the intermediate moral status of embryos. It also supplies an account of how to address profound moral disagreements in the public arena, especially by way of constructing a middle ground that deliberately pays sincere respect to the views of those with whom it has deep disagreements. We develop a utilitarian framework to assess different decision rules for the European Council of Ministers. The proposals to be decided on are conceptualized as utility vectors and a probability distribution is assumed over the utilities. We first show what decision rules yield the highest expected utilities for different means of the probability distri- bution. For proposals with high mean utility, simple bench- mark rules (such as majority voting with proportional weights) tend to outperform rules that have been proposed (...) in the political arena. For proposals with low mean utility, it is the other way round. We then compare the expected utilities for smaller and larger countries and look for Pareto- dominance relations. Finally, we provide an extension of the model, discuss its restrictions, and compare our approach with assessments of decision rules that are based on the Penrose measure of voting power. (shrink)

The Health Council of the Netherlands is an independent scientific advisory board to the Dutch government in matters of public health. In this article we argue that even for an independent body such as the Health Council there seems to be no escape from the increasing intertwinement of scientific and societal processes. In order to produce a serviceable truth for policymaking, the council needs to reflect on what goes on in its socio-political surroundings. On the other (...) hand, how could we ever come to understand the legitimacy of the council when notions of scientific objectivity dissolve in such a reflexive, inherently political stance? In a situation where science and society are thoroughly interrelated, the Health Council somehow succeeds in bringing about or re-claiming some sense of objectivity. Our central question will be how to conceptualise this notion of 'objectivity' without having to rely on idealized notions of objectivity that are criticized in philosophical, sociological and historical studies of science and society. In order to do so, we will regard the objectivity of advisory reports of the Health Council as being constructed out of heterogeneous elements and under complex circumstances. The theoretical point will be empirically underpinned with case material drawn from activities of the Health Council in the period 1985-2002 in predominantly the subject areas healthcare and medical technology. Drawing on published materials from the Committee of Ministers, Assembly and expert working groups of the Council of Europe, this paper investigates the distinctive contribution made to the framing of women's rights over the last two decades by this regional organisation, which recent studies of the `Europeanisation' of public policies have largely neglected. Elements of congruence are identified between the major mobilising themes of second wave feminism and the Council's emphasis on protecting individual rights, and its sensitivity to (...) the incompleteness and shortcomings of `actually existing' democratic institutions and practices. The relative openness of its agenda-setting processes is also underlined. The Council's flag ship policies for women are shown to have centred since the mid-1980s on a `politics of presence' frame and the (contested) concept of `parity democracy', and the tensions between these and the more recent turn to gender mainstreaming are explored. But the paper also points to the Council's role in diffusing into the E.U. governance arena women's claims to equal participation and presence in the policy process, and notes recent French and U.K. legislation as testifying to the continuing salience of these claims at the national level. Brazil's health councils appear to offer inspiring examples of what Fung and Wright term “empowered participatory governance.” But what happens in practice? This article narrates an episode in the life of a municipal health council in northeast Brazil, in which democracy itself came under deliberation. It seeks to locate normative assumptions embedded in theories of deliberative democracy and participatory governance in everyday conduct in one of these institutions. It suggests that assessing the democratizing potential of the myriad new spaces (...) that now populate governance landscapes the world over calls for far closer attention to be paid to power, political culture, and politics. The Spanish Federal Council of the European Movement (SFCEM), founded as a Spanish organization to favour the integration of Spain in Europe, was composed of representatives of various political organizations of the Republican government in exile. Correspondence between the President, Salvador de Madariaga, and the members of the Basque and Catalonian delegations discloses one of the most critical issues of the time: how to organize the Spanish regions after the fall of Franco’s regime. This article explores how the (...) ideas of a Spanish federation – defended by Madariaga – and the interest of the nationalist groups collided during the decades of 1950s and 1960s. The result was a harsh debate on separatism between the Basques and Catalans, who saw Franco’s Spain as the representation of centralism and repression of their identities, and other Spanish exiles. The fundamental article of my political creed, declared John Adams, is that despotism, or unlimited sovereignty, or absolute power is the same in a majority of a popular assembly, an aristocratical council, an oligarchical junto, and a single emperor. Equally arbitrary, cruel, bloody, and in every respect diabolical. The consequences of this article for Adams' thought are nowhere better articulated than in this anthology, which presents his remarkable attempts at constructing a complete political system based on constitutional, (...) balanced, representative government. In the wake of colonial fragmentation and genocide, Indigenous ‘Khoisan resurgence’ movements in South Africa have mobilised subversive forms of authenticity, including heteroglossic and inventive translanguaging from fragments of Khoekhoegowab. In our analysis of video ethnographic texts produced in collaboration with the Gamtkwa Khoisan Council (GKC) in Hankey, the birthplace of Sarah Baartman, we explore how memory, language politics, and environmental activism are interwoven in acts of linguistic citizenship that constitute the ‘rememorying’ of a history that has remained persistently (...) obscured. We argue that rememorying advances a politics of reminding which counters the Rainbow Nation’s institutionalised politics of forgetting, as well as anthropological accounts that consider Indigenous activist invocations of history as merely ‘therapeutic’. Through an engagement with the memory activism of the GKC, we identify how reconstructing word-histories, reliving historical traumas, retelling histories of sites of memory, seeing oneself mirrored in one’s ancestors, and the nexus of land, memory, and time form the basis for shared meaning-making, bringing impetus, focus, and intergenerational continuity to struggles for environmental and land justice. Não obstante a parcimó­nia das fontes coevas, e até alguns exemplos contraditórios, parece inquestionável que em vários momentos críticos as decisões políticas do monarca foram influenciadas pela opinião do­minante no Conselho de Estado. A finalizar, o artigo apresenta uma biografia colectiva dos 73 indivíduos que foram (...) nomeados conselheiros de Estado efectivos entre 1833 e 1910 – e que po­demos definir como o núcleo central da elite governante –, focando algumas características sociodemográficas (naturalidade, idade, educação, profissão, títulos nobiliárquicos) e tipos de experiência política. This book provides an in-depth introduction to, and analysis of, the issues relating to the implementation of the recent Responsibility to Protect principle in international relations The Responsibility to Protect has come a long way in a short space of time. It was endorsed by the General Assembly of the UN in 2005, and unanimously reaffirmed by the Security Council in 2006 and 2009. UN Secretary-General Ban Ki-moon has identified the challenge of implementing RtoP as one of the cornerstones (...) of his Secretary-Generalship. The principle has also become part of the working language of international engagement with humanitarian crises and has been debated in relation to almost every recent international crisis âe" including Sudan, Sri Lanka, Myanmar, Georgia, the Democratic Republic of Congo, Darfur and Somalia. Concentrating mainly on implementation challenges including the prevention of genocide and mass atrocities, strengthening the UNâes capacity to respond, and the role of regional organizations, this book introducing readers to contemporary debates on R2P and provides the first book-length analysis of the implementation agenda. Abstract1 June 2018 marked a historic moment in Spanish politics, when the Spanish Socialist Workers’ Party (Partido Socialista Obrero Español, PSOE) announced a cabinet with the largest proportion of female ministers in the world. This announcement received extensive coverage in the traditional media. The objective of this research was to measure whether the news had an equivalent impact on Twitter users. To this end, we analyzed the reaction to the appointments based on the popularity of the hashtags #GobiernoSanchez (“Sanchez Government”), (...) #GobiernoFeminista (“Feminist Government”) and #ConsejoMinistras (“Council of Female Ministers”). The most significant findings are that women had even less visibility than they were given in traditional media because of what is not retweeted does not exist, and that the extreme polarization of political life and the media in the public sphere appears to extend to the digital environment of Twitter. : The President's Council on Bioethics has tried to make a distinctive contribution to the methodology of such public bodies in developing what it has styled a "richer bioethics." The Council's procedure contrasts with more modest methods of public bioethical deliberation employed by the United Kingdom's Warnock Committee. The practices of both bodies are held up against a backdrop of concerns about moral and political alienation, prompted by the limitations of moral reasoning and by moral dissent from (...) state policy under even the most democratic of governments. Although the President's Council's rhetoric is often scrupulously conciliatory, recurring features of its argumentative practice are regrettably divisive. They order these things better in Britain. In a two-tier decision-making system such as the EU Council of Ministers, if the number of constituencies (member-states) is sufficiently large (say, 15 or more), Penrose’s Square-Root rule can be implemented to a high level of approximation by a simple weighted decision rule at the top level (the Council) with any given quota q smaller than the total weight. This leaves one degree of freedom: the value of q as a free parameter, to be determined by some additional (...) condition. I propose to survey and discuss critically the most important considerations for fixing this value – some of which have actually been used by theoreticians or practitioners: efficiency, transparency, sensitivity (total voting power of citizens), mean majority deficit, giving certain ‘privileged’ coalitions blocking status. Some of these considerations are reasonably compatible; others less so. Some kind of compromise is clearly needed. But which? This is essentially a political matter; but a political decision ought to be made in a theoretically enlightened way. (shrink)

This paper examines the globalization process of German core export metalworking industries, to show how the globalization of national corporations has different effects on domestic economies. Contrary to the prevalent views on the globalization of production, this paper holds that the outcomes and patterns of globalization vary, due mainly to the politics of the main actors inside and outside corporations. This paper compares Germany’s negotiated globalization with U.S. employer unilateralism. In most U.S. corporations, employers decide how to globalize based on (...) the short-term perspective of shareholder value. By contrast, in Germany, main industrial actors—including employers, works councils, and trade unions—collectively negotiate how to globalize. In this conflict-laden process of collective negotiation, German actors have created a political compromise that combines the upgrading of domestic production with globalizing overseas, whereas Americans have failed to do so. Furthermore, this paper emphasizes that divergent patterns of globalization are not predetermined by national institutions. To the contrary, the successful outcomes in German globalization come mainly from actors’ proactive readjustments in their traditional model of industrial relations, creating new practices, such as active union involvement in company-level bargaining, and the democratic bottom-up process instead of the traditional top-down process of negotiation.
