Audits of the informed consent process are a key element of a clinical research quality assurance program. A systematic approach to such audits has not been described in the literature. In this paper we describe two components of the audit. The first is the audit of the informed consent document to verify adherence with federal regulations. The second component is comprised of the audit of the informed consent conference, with emphasis on a real time review of the appropriate communication of (...) the key elements of the informed consent. Quality measures may include preparation of an informed consent history log, notes to accompany the informed consent, the use of an informed consent feedback tool, and the use of institutional surveys to assess comprehension of the informed consent process. Irregularity may occur on the earth’s surface in the form of mountains due to the imperfection of the earth’s crust. To explore the influence of horizontally polarized shear waves on mountains, we considered the fluid-saturated porous medium over an orthotropic semi-infinite medium with rigid and soft mountain surfaces for wave propagation. The mountain surface is defined mathematically as a periodic function of the time domain. The physical interpretation of materials’ structure has been explained in rectangular Cartesian coordinate system originated at (...) the contact interface of layer and half-space. The displacement of the mountains has been derived by solving energy equations analytically. The influence of rigid and soft mountain surfaces on the phase velocity of shear waves has been demonstrated graphically. (shrink)

In this paper a uniform methodology to perform natural\ndeduction over the family of linear, relevance and intuitionistic\nlogics is proposed. The methodology follows the Labelled\nDeductive Systems (LDS) discipline, where the deductive process\nmanipulates {\em declarative units} -- formulas {\em labelled}\naccording to a {\em labelling algebra}. In the system described\nhere, labels are either ground terms or variables of a given {\em\nlabelling language} and inference rules manipulate formulas and\nlabels simultaneously, generating (whenever necessary)\nconstraints on the labels used in the rules. A set of natural\ndeduction style (...) inference rules is given, and the notion of a\n{\em derivation} is defined which associates a labelled natural\ndeduction style ``structural derivation'' with a set of generated\nconstraints. Algorithmic procedures, based on a technique called\n{\em resource abduction\/}, are defined to solve the constraints\ngenerated within a structural derivation, and their termination\nconditions discussed. A natural deduction derivation is then\ndefined to be {\em correct} with respect to a given substructural\nlogic, if, under the condition that the algorithmic procedures\nterminate, the associated set of constraints is satisfied with\nrespect to the underlying labelling algebra. Metaverse, sanal gerçeklik teknolojileriyle oluşturulan bir dünyadır ve insanların hayal edebilecekleri tüm eylemleri gerçekleştirebilecekleri sınırsız bir özgürlük alanı sunmaktadır. Çalışmamızda metaverse, insan beyninin çalışma yöntemi çerçevesinde bilimsel bir şekilde açıklanmaya çalışılmaktadır. İnsan beyninin hem sanal hem de gerçek dünya deneyimlerini ve duygularını algıladığı düşünüldüğünde, metaverse’de sanal ve gerçek dünya arasında keskin bir ayrımın olmayacağına vurgu yapılmaktadır. Ayrıca, sanal dünya ile gerçek dünya arasındaki sınırın kaybolması, insan eylemlerinin ve davranışlarının insan doğası açısından ontolojik bir değer taşıdığını göstermektedir. Çalışmamızda aynı zamanda metaverse’in (...) din, ahlak ve insanlık açısından önemli bir rol oynayacağına dikkat çekilmektedir. İlerleyen teknolojik gelişmelerin de etkisiyle, metaverse'in insan hayatında daha da etkili ve dinamik bir şekilde yer alacağına temas edilmiştir. Bu nedenle, metaverse’de ahlaki ve anlamlı bir yapı kurmanın önemine vurgu yapılmaktadır. Bu alanda dinin önemli bir rol oynaması gerektiği üzerinde durulmuş, dinden ve ahlaki kurallardan arınmış bir sanal dünyanın insanlar için acılarla dolu kaotik bir yer haline gelebileceği iddia edilmiştir. Müslüman kadınların İslami gelenekler tarafından bastırılmış mı özgürlüğe kavuşturulmuş mu olduğuna dair pek çok çalışma bulunmakta. Bu çalışmalardan bazıları başörtüsü gibi İslami geleneklerin bir baskı unsuru olarak görürken, bazıları da Müslüman kadınların bu gelenekleri uygularken kendi iradelerini ortaya koyduğunu, dolayısıyla bu geleneklerin bir baskı emaresi olarak görülemeyeceğini savunur. Bu çalışmada, Müslüman kadınların hayatlarının çok yönlü, ilişkisel ve mekân bağlamında şekillendiğini incelememizi sağlayacak, Deleuze felsefisi bağlamında ele alınan irade ve özgürlük kavramlarını kullanmak amaçlanmıştır. Diğer bir ifade ile Fransız filozof Gilles Deleuze (...) tarafından ortaya koyulan ilişkisel ontoloji Müslüman Kadın çalışmalarını sorgulamak için kullanılmaktadır. Bu ilişkisel ontoloji üzerinden, Müslüman kadınların dini söylemler çerçevesinde olumsuz resmedilmeleri sorgulanmakta ve bu kadınların deneyimlerine ve pratiklerine dair alternatif açıklamalar ortaya konulmaktadır. Böylece, Deleuze’in felsefesi bağlamında ele alınan irade ve özgürlük kavramları kullanılarak Müslüman kadınların dini katılım ve uygulamaları üzerinden pasif ve irade göstermeyen kadınlar olarak tasvir edilmesi sorgulanmaktadır. Müslüman kadınların durumsal uygulama ve deneyimlerini keşfedebilecek nitelikte akademik bir bakış açısı önerilmektedir. Özet: Bazı batılı kuruluşlar medeniyetler çatışması söylemini temel alarak tekil bir Müslüman dünyası tarif edip bu tek tipleştirilmiş tarifi Islama ve Müslümanlara karşı mücadele etmenin neden gerekli olduğunu gerekçelendirmek için kullanmaktadır. Müslüman kadınlar İslam gelenekleri ve Müslüman erkekler tarafından baskıya uğrayan bir gurup olarak resmedildiği için, bu söylemlerde Müslüman kadınlara dair konular önemli odak noktalarından birisi olmaktadır. Örneğin Müslüman kadın kimliğinin sembolü olarak görülen başörtüsünün bir baskı unsuru olup olmadığına dair tartışmalar görülür. Müslüman kadının başörtüsü ile bastırılmış mı özgürleştirilmiş mi olduğuna dair pek çok çalışma da bulunmaktadır. Bu çalışmalardan bazıları başörtüsü gibi İslami geleneklerin Müslüman kadınları baskıladığını ileri sürerken bazıları da kadınlar başörtüsü kullandığında bunu kendi iradeleri ile yaptığını tartışır. Örneğin Saba Mahmood irade, özgürlük, istek ve direnme gibi kavramların liberalizm temelinde anlaşılmasını sorgulayarak Müslüman kadınlar hakkındaki bu söylemlere karşı çıkar. Bu çalışmalardan bazıları da Müslüman kadınların ve onların iradelerini kullanmalarına dair konuların tarihsel ve mekânsal bağlamda yapılması gerektiğini savunur. Her ne kadar bu konuda yapılan çalışmalar olsa da, bu konu daha fazla araştırmaya ve yeniden ele alınmaya muhtaçtır. Bu çalışmada, bu konuyu çok yönlü, Müslüman kadınların deneyimlerini, isteklerini ve uygulamalarını ilişkisel ve mekânsal olarak ele alma imkânı vereceğinden, ilk olarak irade ve özgürlük kavramlarını Deleuze felsefesi temelinde ele alınmaktadır. Diğer bir deyişle, Fransız filozof Gilles Deleuze’a dayandırılan ilişkisel ontolojik bakış açısı Müslüman kadına dair tartışmalara uygulanmaktadır. Bu ilişkisel ontolojiye göre, dünya bedenlerin toplamından oluşur. Her varlık, biyolojik organizma, sosyal yapı ve soyut yapı bir bedendir. Bu bedenlerin her birisi, ister insan bedeni ister insana ait olmayan bir beden olsun, ister maddi ister madde dışı olsun, ister sosyal ister psikolojik yapılar olsun, ilişkilerin akımı ile şekillendirilir. İnsan bedeninin biyolojik, zihinsel, sosyal ve psikolojik bileşenlerini içine alan her yönü de çoklu ilişkiler ile oluşturulur. Bu yüzden, bir insan öznesi hakkında konuştuğumuzda, aslında karmaşık ve çoklu ilişkilere dair konuşuruz. Bedenin bu şekilde ele alınması irade kavramının da yeniden ele alınmasını gerektirir. İrade kavramının bu bağlamda ele alınması dikkati bedenleri üreten ilişkiler üzerine odaklar. Bedenler ilişkilerin akımı ile şekillendirildiği için, bedenlerin belirli şekillerde hissetme, davranma ve istemeye dair kapasiteleri de sahip oldukları ilişkilere göre şekillenir. Bu ilişkisel ontoloji temelinde, Müslüman kadınların bedenlerinin ilişkilerin akımı ile şekillenen çoklu elementlerin karmaşık bir araya gelişler olarak ele alınmalıdır. Bu kavramlaştırma Müslüman kadınların hayatının izole edilmiş dini gelenekler temelinde oluşmuş gibi resmedilmesini sorgulatmaktadır. Müslüman kadınların iradeleri, kapasiteleri ve sınırlılıkları kadar deneyimleri, pratikleri ve istekleri de sosyal-politik söylemler, aile içi ilişkiler, materyal yapılar ve ekonomik şartlar gibi çoklu faktörler ile kurulan ilişkiler üzerinden şekillenir. Diğer bir ifade ile bu kadınların belirli şekillerde davranmaya dair güçleri kendilerini çevreleyen bedenler ile kurdukları ilişkilere göre şekillenir. Bu bedenler dini veya seküler unsurlar olabilir, insan veya insana ait olmayan unsurlar olabilir, ya da maddi veya madde dışı faktörler olabilir. Sonuç olarak, Müslüman kadınların bedenleri ve irade gösterme şekilleri her zaman bir süreklilik içinde bağlantı kuran veya bağlantılarını koparan çeşitli elementler ile üretilmektedir. Deleuze felsefesi temelindeki bu beden ve irade kavramlaştırmaları Müslüman kadınların dini geleneklerine salt itaat temelinde resmedilmelerini sorgulamak için kullanılmaktadır. Bu kadınların hayatlarındaki çoklu yapısal denebilecek elementlerin aydınlatılması amaçlanmakta ve onların iradelerinin parçalı ve ilişkisel bir şekilde anlaşılması önerilmektedir. İlişkisel ontolojik lensler aracılığı ile Müslüman kadınlar resmedilirken görünmez kılınan veya fotoğrafın dışında bırakılan dinamik ve heterojen unsurlar tetkik edilmektedir. Bu amaç için, Deleuze felsefesi temelinde yapılan kavramlaştırılmalar 2018’de doktora çalışması için Başkent Kadın Platformunda yapılan bir röportaja ve Türkiye’deki bazı etnografik gözlemlere uygulanmaktadır. Ortaya konulan teorik bağlama daha uygun olacağından, bir gruptan ya da daha geniş bir çerçevede veri toplamak yerine, bu röportajdan elde edilen verilerin detaylı bir şekilde ele alınması amaçlanmaktadır. Bu ontolojik bakış açısını Müslüman Kadın konusuna uygulayarak, Müslüman kadınların hayatındaki çoklu ve ilişkisel etken güçlere odaklanılması amaçlanmaktadır. Müslüman kadının yalnızca dini söylemler temelinde negatif olarak tanımlanması sorgulanmakta ve Müslüman kadınların deneyimlerini ve uygulamalarını anlamak için alternatif modeller olabileceğine dikkat çekilmektedir. Diğer bir şekilde ifade etmek gerekirse Müslüman kadınların deneyimleri ilişkisel, çok yönlü, parçalı ve muayyen olarak ele alınmalıdır. Hayal edilen tekil bir grup yerine, çok yönlülüğün ve ilişkiselliğin keşfedilmesine ihtiyaç duyulmaktadır. Bu yüzden Müslüman kadınların belirli zeminler temelinde anlaşılmaya çalışılması önerilmektedir. Bu tur bir analizde, bir araştırmacının amacı Müslüman kadını çok yönlü bir özne ve irade anlayışı temelinde belirli zeminlerde keşfetmek olmalıdır ki iç içe geçmiş baskı ve özgürleşme şekilleri de anlaşılabilsin. Müslüman kadının kimliğinin kategorileştirilmesi ve marjinalleştirilmesi yerine, devam edegelen şekilde deneyimlerin ve uygulamaların oluşum ve yeniden oluşumlarının üzerinde durulmalıdır. (shrink)

Este trabajo tiene por objeto el estudio de la agravante de discriminación por razón de género recogida en el art. 22.4ª del C.P, por la Ley Orgánica 1/2015, de 30 de marzo. Nos vamos a centrar en el estudio del fundamento y elementos de la circunstancia agravante. Se prosigue, con el análisis de su compatibilidad con otras agravantes genéricas y su régimen de comunicabilidad a los partícipes del delito. Sin olvidar, el examen de las sentencias dictadas por el Tribunal Supremo.

Mimarlık diğer sanat dallarından iki bakımdan ayrılır. İlk olarak mimari yapıtlarla etkileşim kaçınılmazdır. Müzik dinlemeden, tiyatro veya sinemaya gitmeden, resim veya heykel sergilerini gezmeden yaşamımızı sürdürebiliriz ancak mimari yapılar olmadan bu olanaklı olmaz. Bu bakımdan mimarlık sanatlar içinde belki de insan yaşamını en fazla etkileyen daldır. İkinci olarak mimarlık bir yaşam gereksinimini karşılayan, böyle bir işlevi olan belki de tek sanat dalıdır. Örneğin resim, heykel, şiir, sinema veya tiyatro yapıtlarını sanatsal açıdan değerlendirirken hangi gereksinimimizi karşıladıkları sorusunu sormayız. Buna karşılık mimari (...) yapılar barınma başta olmak üzere bir dizi maddi gereksinimimizi karşılarlar. Hangi gereksinimi karşılamak amacıyla yapıldıkları sorusu onların sanatsal açıdan değerlendirilmesinde önem taşır. Bu yazıda mimarlığın sanatlar içindeki bu iki özgünlüğünü dikkate alan bir düşünürün, Ömer Naci Soykan'ın mimarlık konusundaki görüşlerini sırasıyla “mimarlıkta temel nitelikler”, “mimarlık etkinliği”, “mimarlık dili” ve “mimarlık estetiği” başlıkları altında ele alacağız. Çalışma Hıristiyanlığın Protestanlık mezhebinden doğan, özellikle Amerika Birleşik Devletleri’nde kümelendiği gözlemlenen, İsrail’i ve Yahudileri orantısızca desteklemesiyle bilinen ve aynı zamanda İslam’a ve Müslümanlara karşı düşmanca yaklaşımları haiz “Hıristiyan siyonistlerini” ele almaktadır. Hareketin mahiyeti, doğuşu, teolojisi, faaliyetleri ve kendisinde mündemiç olan antisemitizm ile anti-İslamizm olguları incelenmektedir. Bulgulara göre, Hıristiyan siyonizmi çeşitli açılardan bakıldığında bir anomali teşkil etmektedir. Bunlardan en önemlisi, Yahudilerin ve Hıristiyanların yüzyıllarca birbirlerine en üst seviyede düşmanlık etmiş olan iki topluluk oluşudur. Hıristiyan siyonistler dünya tarihini Mesih’in zuhuruyla birlikte kurulacak (...) olan bin yıllık küresel krallık öncesindeki yedi bölüm olarak ele alan, sınırları büyük ölçüde İngiliz-İrlandalı teolog John Nelson Darby tarafından çizilen ve “premillennial dispensationalism (premilenyal dispensasyonalizm)” olarak bilinen teolojinin öngördüğü kıyamet senaryosuna inanmaktadır. Bu senaryo hareketin varlık sebebini, amaçlarını, dostlarını ve düşmanlarını belirlemektedir. Dost-düşmanlar olarak Yahudilerin buradaki rolü bazı çelişkiler ve ihtilaflar barındırırken, düşmanlar olarak Müslümanların rolü açıkça olumsuz bir görünüm arz etmektedir. Bunun sonucu olarak Hıristiyan siyonistler Müslümanları şeytanlaştırma eğilimine girmektedir. Her ne kadar dindaşları tarafından ahlak, siyaset ve özellikle teoloji eksenlerinde ağır eleştirilere tabi tutulsalar da Hıristiyan siyonistler emperyalist güçlerle olan uzun ittifaklarının da bir meyvesi olarak dünya politikasında kayda değer bir güce sahiptir. Hıristiyan siyonizminin mahiyeti ve dahi antisemitizm ve anti-İslamizm ile irtibatı konusunda Türkçe yazılmış eserlerin azlığına binaen çalışma literatürdeki bu boşluğu kapatma amacı taşımaktadır. Özet: İçinde bulunduğumuz dönemde anti-İslamizm kavramı ele alınırken kendisine özellikle Amerika Birleşik Devletleri’nin (ABD) teopolitik dekorunda yer bulan “Hıristiyan siyonizmi” adlı grubun etkisine işaret edilmektedir. Bu grup literatür tarafından İsrail’i Yahudilerin vatanı olarak destekleyen Hıristiyanlar olarak tanımlanmaktadır. İsrail için Birleşen Hıristiyanlar (CUFI) gibi organizasyonlar aracılığıyla İsrail’in desteklenmesi noktasında etkin faaliyetler yürütmektedirler. Orta Doğu’da barışın tesis edilmesini inandıkları kıyamet senaryosunun önünde bir engel olarak gördükleri için kategorik olarak reddetmektedirler. Özellikle 19. yüzyılda başlayıp, 11 Eylül olayları ile birlikte ciddi bir ivme yakalayan ABD’deki anti-İslami hareketlerin büyük bir kısmı Hıristiyan siyonizmi ile ilişkilendirilen şahıslar tarafından başlatılıp desteklenmektedir. ABD’de yaklaşık 20 ila 30 milyon arasında Hıristiyan’ın bu ideolojiyi benimsediği tahmin edilmektedir. ABD dışında İngiltere, İskandinavya, Avustralya, Güney Afrika ve hatta Güney Kore ve Honduras gibi coğrafyalarda da taraftar bulmuşlardır. Birçok açıdan bakıldığında Hıristiyan siyonizmi bir anomali teşkil etmektedir. Bunun özünde Yahudilerin ve Hıristiyanların birbirlerine olan düşmanlıkları yatmaktadır. Yahudiler dini kaynaklarında Hıristiyanlığın en kutsal şahsiyetlerine ağır hakaretler ederken, Hıristiyanlar Yahudileri Tanrı katilleri olarak görmektedir. Ancak Hıristiyan siyonistlerin çoğunluğu İsrail konusunda adeta kraldan daha kralcı davranmaktadır. Hıristiyan siyonizminin teolojik zeminini incelemek isteyen bir araştırmacı eskatoloji (kıyamet bilimi), Armageddon savaşı, istiğrak, püritenler, premilenyalistler, dispensasyonalistler, fundamentalistler, restorasyonistler, evanjelistler, John Nelson Darby ve Cyrus I. Scofield gibi bazı kavram ve aktörlerle karşılaşacaktır. İrlandalı-İngiliz bir teolog olan Darby birçokları tarafından Hıristiyan siyonizminin kurucusu olarak görülmektedir. Hareket için hayati önem teşkil eden ikinci isim ise Cyrus Ingerson Scofield’dir. Scofield Reference Bible ’ı yayınlayarak Hıristiyan siyonizminin milyonlar tarafından benimsenmesine yol açmıştır. Hıristiyan siyonistler “premilenyal dispensasyonel teolojinin” gerçek olduğuna ve gerçekleşeceğine inanmaktadır. Buna göre dünya tarihi yedi çağdan oluşan doğrusal bir olgudur. İnsanlığın halihazırda altıncı çağda olduğuna, yedinci çağın ise çok yakında olduğuna inanmaktadırlar. Bu teolojinin öngördüğü kıyamet senaryosu Antichrist ’ın gelişi, Sahte Peygamber ve Şeytan ile birlikte cehennem teslisini kurması, Müslümanların da onlarla müttefik olarak hareket edip İsrail’e saldırmaları (Armageddon savaşı), Hz. İsa’nın gökten tekrar inerek İsrail’i kurtarması ve barışı tesis edeceği Milenyum Krallığı’nı kurması gibi öğeleri içermektedir. Siyonist olmayan Hıristiyan teologlar Hıristiyan siyonizminin teolojisini defaatle eleştiriye tabi tutmuştur. Yahudilerin seçilmiş ırk olarak görülmesi, Yeni Ahit’in bu ideolojiye destek vermemesi, “Armageddon savaşının” büyük mezheplerde karşılığının olmayışı ve hareketin Yahudi karakteri taşıması gibi sebepler yüzünden bazı Hıristiyan teologlar Hıristiyan siyonizmini heretik ilan etmiştir. Hıristiyan siyonizminin teolojisinin eleştirildiği bir diğer husus ise onun emperyal teoloji olarak yerine getirdiği işlev ile ilgilidir. Birçok düşünür Hıristiyan siyonizmi, Yahudi-Hıristiyan Batı anlatısı ve emperyalizm arasında sağlam bağlar olduğunu iddia etmektedir. Hıristiyan siyonizmi anomalisine bir açıklama getirmek isteyen şahıslar Hıristiyan siyonizmi içerisinde yer alan antisemitizme işaret etmektedir. Buna göre Hıristiyan siyonistler, Yahudilerin ve Yahudi devletinin kurulmasının gerçekleşmesinde hayati bir rol oynadığı kıyamet senaryolarını yürürlüğe koymak adına İsrail’i her şartta desteklerken, bu senaryo Yahudilerin kendisini Mesih gibi gösteren Antichrist tarafından yönetilmesini ve Yahudilerin çoğunluğunun Mesih’in gelişinden sonra ölmesini içermektedir. Aynı zamanda neredeyse daima İsrail yanlısı açıklamalar yapan bazı Hıristiyan siyonistlerin zaman zaman doğrudan antisemitik söylemlere başvurduğu gözlemlenebilmektedir. Bu sebeple Hıristiyan siyonistler ve Yahudiler arasındaki teopolitik ittifakın bir noktada bozulacak pragmatik bir ittifak olduğu iddia edilmektedir. Anti-İslamizm noktasındaki bulgulara göre Hıristiyan siyonistlerin %70’i Araplara karşı ya kayıtsız ya da düşmanca hisler beslemektedir. 11 Eylül’den sonraki dönemde İslam’ın şeytanlaştırılması operasyonu büyük ölçüde Robertson, Graham, Lindsey, Vines ve Falwell gibi Hıristiyan siyonistler tarafından gerçekleştirilmiştir. Yine İsrail’in 1948 yılında kuruluşu, Filistinliler için doğurduğu sonuçlara rağmen Hıristiyan siyonistlerin çoğu için bir kıyamet alametinin gerçekleşmesi anlamına gelmektedir. Hıristiyan siyonistlerin inandıkları kıyamet senaryosunda Müslümanlar ancak düşman saflarında savaşan Gog ve Magog olarak anlam bulabilmektedir. Onlar Şeytan, Antichrist ve Sahte Peygamber ’den oluşan cehennem teslisinin müttefikleridir. Filistinliler, Araplar ve Müslümanlar senaryonun gerçekleşmesi önünde doğrudan engel teşkil etmektedir. Bu hususlar birlikte değerlendirildiğinde halihazırda Hıristiyan siyonistlerin İslam’a ve Müslümanlara neden bu kadar olumsuz yaklaştıkları hususu açıklık kazanmaktadır. Pp. xxxi + 570. $ 39.95.Almost fifty years of letters to and from the very diversely brilliant James brothers: in this volume a generous, and probably ample, selection of 216 from a total of (...) 740 surviving letters or postcards, from an original total, according to the present editors, of twice as many. This volume of correspondence reflects the deep, unquestioned, unshakable familial (and virtually statutory) closeness of William and Henry who happened, as adults, to be seldom in the same place. There is, it must be said, very little explicit philosophy, narrowly or broadly defined, in these letters, but the philosophical reader will—or ought to—find much raw material for philosophical reflection. For example, a reasonable historicist thesis of how brotherhood, or family connection generally, plays itself out is supported by these documents. The nineteenth century is not the same as the twentieth. For example, here is William’s comment on the will of his sister, Alice, who left more to her companion and care-giver, Katherine Loring, a [End Page 479] women of extraordinary virtue and burden, than to her brother Robertson: “I can well sympathize with Alice’s desire to leave her something handsome; but I must say that her own consent (being apparently privy to the will) strikes me as tant soit peu lacking in delicacy. Surely no one of us would like to be in such a position in her family or any other” (271). This would be, in 1998, a rather unenlightened and ungenerous attitude, but is natural enough in 1892, even if not quite inevitable, not being shared by Alice herself. There is, incidentally, much discussion of wills and bequests, for the Jameses were of the genteel class, people with small family money and modest private incomes for whom the wherewithal to maintain homes with servants and to provide themselves with country houses and recuperative European vacations was always a faintly embarrassing, and occasionally a pressing, problem.It is probably also true that the much-discussed question of Henry’s homosexuality has, somehow, to be recast in historically relative terms. Here is an early report—1869—of Henry’s from Oxford: “As I walked along the river I saw hundreds of the mighty lads of England, clad in white flannel & blue, immense, fair-haired, magnificent in their youth, lounging down the stream in their punts or pulling in straining crews & rejoicing in their godlike strength” (41). This could not, the point is, be said by anyone, gay or straight, in 1998. Yet Henry is neither generally naive nor uncritically anglophile. He says of the Warwickshire scenery, which in a way he likes, that it is “too monotonously sweet & smooth—too comfortable, too ovine, too bovine, too English in a word.” And he adds, a little surprisingly: “It seems like a vast show region kept up at the expense of the poor” (41). This is only one of many appealing comments not sparsely scattered, but unpredictably, in letters of more ordinary news. Here’s one I liked occasioned by seeing theater in Paris: “We talk about it & write about it & criticize & dogmatize & analyse to the end of time: but those brave players stand forth & exemplify it & act—create—produce!” (66).Of course the “wit and wisdom” are not the monopoly of Henry. Here is William being wise: “We all learn sooner or later that we must gather ourselves up and more or less arbitrarily concentrate our interests, throw much overboard to save any” (55–56). Again: “It is a sweet world, in the interstices of its bedevilment & brutality” (321). And William being funny: “Boils are surely the most slowly evolving things in nature—Christian doctrine is nothing to them” (393). He is talking about his own boils and was subject, at every period, to ailments and infirmities: “Since writing to you, I have been swimming in deep seas of influenza, gout and Erysipelas of the face” (443). Indirect observation is a recent concept in systematic observation. It largely involves analyzing textual material generated either indirectly from transcriptions of audio recordings of verbal behavior in natural settings (e.g., conversation, group discussions) or directly from narratives (e.g., letters of complaint, tweets, forum posts). It may also feature seemingly unobtrusive objects that can provide relevant insights into daily routines. All these materials constitute an extremely rich source of information for studying everyday life, and they are continuously growing with the burgeoning (...) of new technologies for data recording, dissemination, and storage. Narratives are an excellent vehicle for studying everyday life, and quantitization is proposed as a means of integrating qualitative and quantitative elements. However, this analysis requires a structured system that enables researchers to analyze varying forms and sources of information objectively. In this paper, we present a methodological framework detailing the steps and decisions required to quantitatively analyze a set of data that was originally qualitative. We provide guidelines on study dimensions, text segmentation criteria, ad hoc observation instruments, data quality controls, and coding and preparation of text for quantitative analysis. The quality control stage is essential to ensure that the code matrices generated from the qualitative data are reliable. We provide examples of how an indirect observation study can produce data for quantitative analysis and also describe the different software tools available for the various stages of the process. The proposed method is framed within a specific mixed methods approach that involves collecting qualitative data and subsequently transforming these into matrices of codes (not frequencies) for quantitative analysis to detect underlying structures and behavioral patterns. The data collection and quality control procedures fully meet the requirement of flexibility and provide new perspectives on data integration in the study of biopsychosocial aspects in everyday contexts. The idea of a role in nursing that includes expertise in ethics has been around for more than 30 years. Whether or not one subscribes to the idea that nursing ethics is separate and distinct from bioethics, nursing practice has much to contribute to the ethical practice of healthcare, and with the strong grounding in ethics and aspiration for social justice considerations in nursing, there is no wonder that the specific role of the nurse ethicist has emerged. Nurse ethicists, expert (...) in nursing practice and the application of ethical theories and concepts, are well positioned to guide nurses through complex ethical challenges. However, there is limited discussion within the field regarding the specific job responsibilities that the nurse ethicist ought to have. The recent appearance of job postings with the title “nurse ethicist” suggest that some healthcare institutions have identified the value of a nurse in the practice of ethics and are actively recruiting. Discomfort about the possibility of others defining the role of the nurse ethicist inspired this paper (and special issue). If the nurse ethicist is to be seen as an integral part of addressing ethical dilemmas and ethical conflicts that arise in healthcare, then nurse ethicists ought to be at the forefront of defining this role. In this paper, we draw upon our own experiences as nurse ethicists in large academic healthcare systems to describe the essential elements that ought to be addressed in a job description for a nurse ethicist practicing in a clinical setting linked to academic programs. Drawing upon our experience and the literature, we describe how we perceive the nurse ethicist adds value to healthcare organizations and teams of professional ethicists. (shrink)

Philosophical discussion tends to converge on the view that narratives are at the center of the emotion of grief. In this article, I expand on this kind of view. On the one hand, I argue that key strands of phenomenological and neuroscientific studies suggest that grief consists in a complex emotional process of disconfirmation-and-updating of the narrative self-model. By heuristically drawing on an analogy between binocular rivalry and grief, I show that certain salient aspects of the phenomenology of grief, such (...) as self-alienation and ambiguity, are straightforwardly reflected by this account. On the other hand, I argue that this hierarchical approach has the resources to: (i) show that both narratable and unnarratable experiences of personal loss are both instances of grief; and (ii) differentiate between narratable and unnarratable experiences of grief, without compromising the view that self-constituting narratives are at the center of the phenomenon. The Birkhoff-Maltsev problem asks for a characterization of those lattices each of which is isomorphic to the lattice L(K) of all subquasivarieties for some quasivariety K of algebraic systems. The current status of this problem, which is still open, is discussed. Various unsolved questions that are related to the Birkhoff-Maltsev problem are also considered, including ones that stem from the theory of propositional logics.

This paper is a personal dialogue of maneuvering the landscape of scholarship in the United States as a nurse faculty. The principal thesis of this paper is that a discursive shift from margins to mainstream literature has occurred within nursing discourse during the past 20 years as the result of a growing body of work by nurse philosophers. I utilize my own work in nursing philosophy as an exemplar and provide a narrative situated in a feminist‐critical paradigm. This paper: (1) (...) presents a historical background through a critical‐feminist lens of the discursive shift using my own work and lived experiences as exemplars; (2) examines a contemporary mainstream ‘authoritative’ text as an exemplar of this discursive shift and (3) proposes both potential positive intersections and threats in the future development of nursing philosophy resulting from this discursive shift. In clinical ethics, there remains a great deal of uncertainty regarding the appropriateness of attempting cardiopulmonary resuscitation (CPR) for certain patients. Although the issue continues to receive ample attention and various frameworks have been proposed for navigating such cases, most discussions draw heavily on the notion of harm as a central consideration. In the following, I use emerging philosophical literature on the notion of harm to argue that the ambiguities and disagreement about harm create important and oft-overlooked challenges for the (...) ethics of CPR. I begin by elucidating the standard account of harm, called the Counterfactual Comparative Account (CCA). I then show that three challenges to the CCA—preemptive harms, the harm of death, and non-experiential harms—are particularly salient when assessing potential harms for candidates of CPR and likely impact-related decision-making and communication. I extend this argument to explore how the ambiguities of harm might extend to other realms of clinical decision-making, such as the use and limitations of life-sustaining treatments. To address these challenges, I propose two strategies for identifying and minimizing the impact of such uncertainty: first, clinicians and ethicists ought to promote pluralistic conversations that account for different understandings of harm; second, they ought to invoke harm-independent considerations when discussing the ethics of CPR in order to reflect the nuances of such conversations. These strategies, coupled with a richer philosophical understanding of harm, promise to help clinicians and ethicists navigate the prevalent and difficult cases involving patient resuscitation and many other harm-based decisions in the clinical setting. We motivate and introduce a new method of abduction, Matrix Abduction, and apply it to modelling the use of non-deductive inferences in the Talmud such as Analogy and the rule of Argumentum A Fortiori. Given a matrix $${\mathbb {A}}$$ with entries in {0, 1}, we allow for one or more blank squares in the matrix, say a i,j =?. The method allows us to decide whether to declare a i,j = 0 or a i,j = 1 or a i,j =? (...) undecided. This algorithmic method is then applied to modelling several legal and practical reasoning situations including the Talmudic rule of Kal-Vachomer. We add an Appendix showing that this new rule of Matrix Abduction, arising from the Talmud, can also be applied to the analysis of paradoxes in voting and judgement aggregation. In fact we have here a general method for executing non-deductive inferences. (shrink)

The paper investigates interpretations of propositional and firstorder logic in which validity is defined in terms of partial indices; sometimes called possibilities but here understood as non-empty subsets of a set W of possible worlds. Truth at a set of worlds is understood to be truth at every world in the set. If all subsets of W are permitted the logic so determined is classical first-order predicate logic. Restricting allowable subsets and then imposing certain closure conditions provides a modelling for (...) intuitionistic predicate logic. Women who had had breast cancer and had been enrolled in a large genetic breast cancer epidemiological study were interviewed about their experience of participation in the study, their attitudes to the confidentiality of data, and the feedback of personal and general research results. Collection of family history information seemed more salient in indicating the genetic nature of the study than the enrolment information sheet. There were no concerns about confidentiality.While participants would have welcomed general feedback about the results of (...) the study and were critical that this had not been provided, the feedback of personal information proved complicated and, sometimes, difficult. It is suggested that individual feedback of genetic test information in epidemiological studies should be undertaken only when there are specific reasons. (shrink)

This article proposes an alternative approach to social epistemology – a comprehensive approach. It argues that the dominant approaches to social epistemology, which it identifies as communitarian and veritistic, are inadequate. It observes that the nature of the emphasis that the communitarian approach places on the epistemic community foster mindless tolerance in epistemology, which makes the pursuit of the cognitive goal of truth difficult to attain. It also observes that the veritistic approach that seeks to refocus social epistemology on the (...) pursuit of the cognitive goal of obtaining truth does this at the expense of the affective goals of social epistemology. To overcome the inadequacies of the communitarian and the veritistic approaches and to ensure that social epistemology effectively pursues its cognitive and affective goals, this article offers the comprehensive approach. This approach absorbs the virtues of the communitarian and the veritistic approaches while avoiding their errors. Hence, it thrives on a view of truth that posits an objective and a subjective dimension of truth. The objective dimension ensures that the community only fosters and never impedes social epistemological projects such that social epistemology continues to pursue the cognitive goal of truth. The subjective dimension guarantees that the concern for truth does not lead to the neglect or abandonment of the pursuit of the affective goals of social epistemology. The rationale behind this approach is that for social epistemological projects and practices to remain truly epistemological and social, they must always take into consideration the cognitive and affective features of knowledge and knowers. In this paper I describe a novel application of contemplative techniques to software engineering with the goal of augmenting the intellectual capabilities of knowledge workers within the field in four areas: flexibility, attention, creativity, and trust. The augmentation of software engineers’ intellectual capabilities is proposed as a third complement to the traditional focus of methodologies on the process and environmental factors of the software development endeavor. I argue that these capabilities have been shown to be open to improvement through the (...) practices traditionally used in spiritual traditions, but now used increasingly in other fields of knowledge work, such as in the medical profession and the education field. Historically, the intellectual capabilities of software engineers have been treated as a given within any particular software development effort. This is argued to be an aspect ripe for inclusion within software development methodologies. (shrink)

Recent advancements in developmental biology enable the creation of embryo-like structures from human stem cells, which we refer to as human embryo-like structures (hELS). These structures provide promising tools to complement—and perhaps ultimately replace—the use of human embryos in clinical and fundamental research. But what if these hELS—when further improved—also have a claim to moral status? What would that imply for their research use? In this paper, we explore these questions in relation to the traditional answer as to why human (...) embryos should be given greater protection than other (non-)human cells: the so-called Argument from Potential (AfP). According to the AfP, human embryos deserve special moral status because they have the unique potential to develop into persons. While some take the development of hELS to challenge the very foundations of the AfP, the ongoing debate suggests that its dismissal would be premature. Since the AfP is a spectrum of views with different moral implications, it does not need to imply that research with human embryos or hELS that (may) have ‘active’ potential should be completely off-limits. However, the problem with determining active potential in hELS is that this depends on development passing through ‘potentiality switches’ about the precise coordinates of which we are still in the dark. As long as this epistemic uncertainty persists, extending embryo research regulations to research with specific types of hELS would amount to a form of regulative precaution that as such would require further justification. _The purpose _of the article is to introduce into scientific circulation works by Ukrainian scholar Taras Zakydalsky on the philosophy of Hryhorii Skovoroda. Taras Zakydalsky is a representative of the Ukrainian diaspora, philosopher, and member of Canadian NTSh (Shevchenko Scientific Society of Canada). _Theoretical basis._ We consider the uniqueness of H. Skovoroda’s philosophy, which stimulates not only intellectually but also spiritually enlightens the reader. The reasons for the complex perception and interpretation of Hryhorii Skovoroda’s philosophy are highlighted. We have verified (...) the main methods of its interpretation given in the works by Dmytro Chyzhevskyi. The influence of philosophical thought of thinkers of Antiquity and the Middle Ages: Aristotle, Epicurus, the Church Fathers, and Tertullian has been studied. We have comprehended H. Skovoroda’s interpretation of the Bible as a two-layer existence, the symbolic world that makes the foundation of his philosophy. The peculiarity of the thinker’s division of the heart into "internal" and "external" is analyzed. Hryhorii Skovoroda’s position on the Good and the evil is stated. The Good is identified with God, and the evil – with the real world, the man can choose between the two. Much attention is paid to the understanding of man as a microcosm – rational thinking, and thought is the fundamental cause of human activity, which generates all existence. Hryhorii Skovoroda’s philosophy of metaphysics as the existence of three worlds is highlighted: the first is the macrocosm (the whole surrounding world), the second is the microcosm (the man), and the third is the symbolic world (the Bible). "Monodualism" as a characteristic feature of H. Skovoroda’s work is analyzed. We have highlighted H. Skovoroda’s attitude to the transcendence of God, which is not separated from the world but is present in it directly. The understanding of faith as a forced act of self-love is analyzed because by loving ourselves we love God. The criteria for true and false faith have been clarified. The significance of H. Skovoroda’s aphorism that _what is necessary is useful, and not useful is unnecessary_ is considered. Examples of ethical principles in H. Skovoroda’s philosophy are considered. Peculiarities of the concept HAPPINESS are revealed. This concept is a universal means of existence of the Good, its source is gratitude to God. _Originality_ of the article is in the systematic presentation of the philosophy of the heart by Hryhorii Skovoroda and the analysis of the integrity of the "inner man", the true meaning of life as interpreted by Taras Zakydalsky. _Conclusions_ summarize the "anthropological pragmatism" of the philosopher, whose main idea is to apply practical skills for the benefit of society. Wittgenstein's treatment of private language is the dissolution of some of the major problems in traditional philosophy. Philosophical problems, for Wittgenstein, are the conceptual confusion arising due to the abuse of language. They can be fully dispensed with by commanding a clear view of language. Language, for Wittgenstein, is on the one hand, the source of philosophical problems while, on the other hand, it is a means to dispense with them.
