:Complicity in an immoral, and even criminal, activity, such as robbery or murder, is itself regarded as involving responsibility for those acts. What should the position be of health professionals who are expected to participate in actions that they believe are morally wrong? Professional responsibilities may clash with private conscience. Even referring a patient to someone else, when what is in question may be assisted suicide, or euthanasia, seems to involve some complicity. This is a live issue in Canada, but (...) similar dilemmas occur elsewhere. Physicians and others should not be coerced into involvement of any kind in what they regard as wrong. Such coercion goes against the very principles of liberal democracy. Conscience matters. Reasonable accommodation should be given to those whose moral judgment may be at variance with prevailing professional norms. Moral questions should still be given weight within medicine, and disagreements respected. Abstract:In recent years, the field of animal rights has increasingly focused on trying to change the legal status of animals from things to rights-bearing legal persons. This has most prominently been seen in the work of Steven Wise and the Nonhuman Rights Project (NhRP). The NhRP has initiated various habeas corpus proceedings on behalf of certain animals who it argues are entitled the status of legal persons and the fundamental right to bodily liberty. The NhRP appeals to existing principles of (...) common law. It argues that its animal clients are 'practically autonomous,' which, it asserts, is sufficient for them to be entitled to the status of legal persons and to the fundamental right to bodily liberty. Herein, the author argues that whilst Wise and the NhRP have garnered a significant amount of mainstream attention in the animal rights field, less mainstream attention has been paid to understanding how our treatment of some groups of humans and all animals are connected, and how having a deeper understanding of this could assist in producing better strategies for legal change. In this article, the author considers the status quo treatment of animals by reference to the concept of dualistic thinking and explores how the status quo is underpinned by anthropocentrism. In light of these observations, the author critiques the work of Steven Wise and the NhRP by considering how this approach perpetuates the same anthropocentric ideals that underpin the status quo treatment of animals. The author ultimately advocates for an intersectional approach to seeking legal reform and discusses what legal change might look like if an intersectional approach is adopted. (shrink)

Relativism has always proved tempting when people who had previously lived a settled and complacent life have suddenly been confronted with new and different ideas or practices. The obvious example is the ferment produced in ancient Athens when the contrast with Eastern ideas chronicled by Herodotus showed vividly that not everyone thought like the Athenians, or even the Greeks. The result was a far-reaching scepticism. Protagoras, according to Plato, maintained that man is the measure of all things and anything ‘is (...) to me as it appears to me and is to you as it appears to you’. (shrink)

The later Wittgenstein has been accused of veering into relativism. A stress on concepts, as expressed in language, can leave even science looking like one social practice amongst alternatives. What is the relation of the biological to the social sciences? Fierce battles are being currently fought over this question and much hangs on the answer. If society (or culture) is taken as an irreducible category which can only be understood in its own terms, the social sciences can feel safe from the sinister designs of other disciplines. Yet it is a commonplace that cultures vary, and we humans are prone to look at the differences rather than the similarities between (...) them. The result can be a thoroughgoing relativism. If culture cannot be understood by means of any non-cultural categories, cultural differences themselves can be accepted as the ultimate truth about man. When everything is cultural, even the notion of a non-cultural category can seem to be a ludicrous contradiction in terms. The categories with which we think are the product of our culture, or so we are told. Instead of our being able to understand culture in terms of anything beyond itself, our understanding appears totally moulded by the society to which we belong. Any theory can thus be seen as merely the expression of the beliefs of a particular society. (shrink)

In the days before the Third Programme changed its name and nature to those of Radio 3, there were occasional broadcast discussions by a group called the Epiphany Philosophers. Since 1966 they have been publishing a journal whose title and sub-title point to the large questions with which the group has continued to be concerned: Theoria to Theory: An International Journal of Science, Philosophy and Contemplative Religion. The editors are conscious of the risks but also of the need to take (...) them:‘We are not now seen as so “way out” as we used to be, because more people are realizing that one has got to go “way out”, and that what is “in” is culturally more dated than some powerful forces would have us believe’. The latest issue is also to be the last, though there is hope of continuing the good work in other ways. The journal itself may be revived ‘in a new form as a much cheaper production’. There is also a plan under which the publishers, Gordon and Breach, will publish a series of books designed to ‘promote the exploration of new ideas and new applications in philosophy and science through continuing co-operation between philosophers and scientists in different disciplines’. Among the halfpromised volumes is one on The Athletics of Old Age, ‘seen as a spiritual as well as a mental and physical matter’.
