The bounded confidence model has become a popular tool for studying communities of epistemically interacting agents. The model makes the idealizing assumption that all agents always have access to all other agents’ belief states. We draw on resources from network epistemology to do away with this assumption. In the model to be proposed, we impose an explicit communication network on a community, due to which each agent has access to the beliefs of only a selection of other agents. A much-discussed (...) result from network epistemology shows that densely connected communication networks are not always preferable to sparser networks. The aim of this paper is to investigate whether there are any noteworthy network effects in a version of the bounded confidence model augmented with communication networks, and in particular whether the aforementioned result from network epistemology can be replicated in that version. When defending his doctoral dissertation, Umberto Eco was accused of narrative fallacy because he presented his research as if it were a detective novel. He should have presented only his conclusions. However, this criticism inspired Eco to claim that “[e]very scientific book should be... the report of a quest for some Holy Grail” (Eco, 2011, p. 7). A quest presupposes engagement on both sides of the knowledge exchange. Building upon our own research, we have produced a model-theoretic scheme for management (...) studies in support of the practicability of Eco’s claim. The idea is to re-create the engagement when establishing problem-solving competence in managerial learning: We start with an analysis of real-life cases of successful managerial problem solving (“best practices”). Next, we attempt to find the common denominator of those successful solutions. Lastly, we instantiate the principles found in the previous step in new problem situations, and thus provide new uses for them. (shrink)

The article discusses main contributions and results of the monograph Enrichment: A Critique of Commodities, written by the French sociologists Luc Boltanski and Arnaud Esquerre. Boltanski and Esquerre focus on the strategy to transform ‘the past’ (patrimony, luxury objects, tradition, collections) into new sources of richness. The book focuses on valuation forms and valuation discourses. Enrichment links Boltanski’s work again to the socio-economic movement of the economics and sociology of conventions (in short, EC/SC), which is part of the new French (...) social sciences and regards conventions as logics of valuation and interpretation. This approach of EC/SC is introduced as a frame to evaluate the recombination of pragmatism and structuralism which is proposed by Boltanski and Esquerre. Finally, open questions and desiderata are addressed from the standpoint of EC/SC. (shrink)

Is there an anthropological difference within the basic style by which human beings exist ‘in’ world? The central problem of Gregor Samsa’s metamorphosis and the specific status of his animality can be focused by this question. Perhaps this difference manifests itself only when the human being has become estranged from any normal relation to world: when it has been changed into a shape of subjectivity that no longer shares the common net of a world of sense, and remains only an (...) ‘animal.’ The moment is tragic in that the attempt to live an alternative style of worldly being results in the ‘animalyzed’ subject’s condemnation to death. Research on cognition and emotion during the past 30 years has made reasonable progress in theory, methods and empirical research. New theories of the cognition–emotion relation have been proposed, emotion research has become more interdisciplinary, and improved methods of emotion measurement have been developed. On the empirical side, the main achievement of the past 30 years is seen to consist in the reduction of the set of serious contenders for a theory of emotions. Still, several important issues are not fully (...) resolved, including the computational implementation of appraisal processes, the nature of emotions, and the link between emotions and actions. Also, quantitative theories of the cognition–emotion relation need to be refined and tested, and improved theories of the link between emotions and bodily and facial expressions need to be developed. To counter the dangers of theoretical fragmentation and knowledge loss, more efforts should be devoted to the analysis, reconstruction, comparison and integration of important theories and hypotheses in the field of emotion, as well as to the systematization of arguments in favor and against these theories and hypotheses. In a highly interesting study, Dam and Dam-Jensen (2010) put forward the idea that the indicative and the subjunctive mood in Spanish complementizer phrases can be explained by the instructions they convey. The indicative instructs the addressee to locate the situation created by the verb relative to the situation of utterance, whereas the subjunctive instructs the addressee not to locate the situation described by the verb relative to the situation of utterance. Although this explanation is most appealing, the present paper (...) argues that it also may create explanatory problems. Thus, it is claimed that the notion ofdominioncan explain the semantic meaning of the Spanish subjunctive mood. This verbal mood designates events that are located outside the conceptualizer’s dominion, either in terms ofepistemic controlor in terms ofeffective control. (shrink)

_Contexts of Justice,_ highly acclaimed when it was published in Germany, provides a significant new intervention into the important debate between communitarianism and liberalism. Rainer Forst argues for a theory of "contexts of justice" that leads beyond the narrow confines of this debate as it has been understood until now and posits the possibility of a new conception of social and political justice. This book brings refreshing clarity to a complex topic as it provides a synthesis of traditions and (...) theories that leads to a truly original approach. Forst makes a four-part distinction to decipher the debate between communitarianism and liberalism. These four parts concern the constitution of the self, the neutrality of law, the ethos of democracy, and the opposition between universalism and contextualism. He shows that a comprehensive theory of justice needs to take these different contexts adequately into account. He discusses recent debates about discursive democracy and feminist critiques of liberalism, and addresses such topics as multiculturalism and civil society. (shrink)

Over the past 15 years, Rainer Forst has developed a fundamental research programme within the tradition of Frankfurt School Critical Theory. The core of this programme is a moral account of the basic right of justification that humans owe to one another as rational beings. This account is put to work by Forst in articulating - both historically and philosophically - the contexts and form of justice and of toleration. The result is a powerful theoretical framework within which to (...) address issues such as transnational justice and multicultural toleration. In this volume, Forst sets out his ideas in an extended essay, which is responded to be influential interlocutors including: Andrea Sangiovanni, Amy Allen, Kevin Olson, Anthony Laden, Eva Erman and Simon Caney. This paper argues for a conception of transnational justice that provides an alternative to globalist and statist views. In light of an analysis of the transnational context of justice, a critical theory is suggested that addresses the multiple relations of injustice and domination to be found in this context. Based on a universal, individual right to reciprocal and general justification, this theory argues for justifiable social and political relations both within and between states. In both of these contexts, it distinguishes (...) between minimal and maximal justice and stresses the interdependence of domestic and transnational justice. On both levels, minimal justice calls for a discursive structure of justification, whereas maximal justice implies a fully justified basic social structure. (shrink)

Mental-threshold egalitarianism, well-known examples of which include Jeff McMahan’s two-tiered account of the wrongness of killing and Tom Regan’s theory of animal rights, divides morally considerable beings into equals and unequals on the basis of their individual mental capacities. In this paper, I argue that the line that separates equals from unequals is unavoidably arbitrary and implausibly associates an insignificant difference in empirical reality with a momentous difference in moral status. In response to these objections, McMahan has proposed the introduction (...) of an intermediate moral status. I argue that this move ultimately fails to address the problem. I conclude that, if we are not prepared to give up moral equality, our full and equal moral status must be grounded in a binary property that is not a threshold property. I tentatively suggest that the capacity for phenomenal consciousness is such a property, and a plausible candidate. (shrink)

In this article, I address the various objections raised by Simone Chambers, Stephen White and Lea Ypi concerning my version of a critical theory of politics. I explain the basic assumptions that inform my account of a critique of relations of justification, its particular method and aims.

Research on a wide range of medical and non-medical conditions has demonstrated the power of the placebo effect but also calls for the necessity to better understand its psychological mechanisms. The placebo effect appears to be elicited by meaning and expectation. However, expectations have been explored by accounts based on conscious thoughts . In this paper, a functionally oriented approach is introduced which favors the functional properties of mental systems whose operations need not be conscious. It is maintained that only (...) one specific mental system, called extension memory, qualifies to produce the placebo effect since it consists of implicit, parallel-holistic networks integrating aspects and providing self-regulatory mechanisms. On the basis of this line of reasoning, experimentally testable research ideas are presented. (shrink)

We first present a reconstruction of James’s theory of emotion (JATE) and then argue for four theses: (a) Despite constructivist elements, James’s views are overall in line with basic emotions theory. (b) JATE does not exclude an influence of emotion on intentional action even in its original formulation; nevertheless, this influence is quite limited. It seems possible, however, to repair this problem of the theory. (c) Cannon’s theory of emotion is a centralized version of JATE that inherits from the latter (...) theory a potentially fatal flaw, the insufficient physiological differentiation of emotions. The concept of toleration plays a central role in pluralistic societies. It designates a stance which permits conflicts over beliefs and practices to persist while at the same time defusing them, because it is based on reasons for coexistence in conflict - that is, in continuing dissension. A critical examination of the concept makes clear, however, that its content and evaluation are profoundly contested matters and thus that the concept itself stands in conflict. For some, toleration was and is an (...) expression of mutual respect in spite of far-reaching differences, for others, a condescending, potentially repressive attitude and practice. Rainer Forst analyses these conflicts by reconstructing the philosophical and political discourse of toleration since antiquity. He demonstrates the diversity of the justifications and practices of toleration from the Stoics and early Christians to the present day and develops a systematic theory which he tests in discussions of contemporary conflicts over toleration. We invoke the ideal of tolerance in response to conflict, but what does it mean to answer conflict with a call for tolerance? Is tolerance a way of resolving conflicts or a means of sustaining them? Does it transform conflicts into productive tensions, or does it perpetuate underlying power relations? To what extent does tolerance hide its involvement with power and act as a form of depoliticization? Wendy Brown and Rainer Forst debate the uses and misuses of tolerance, an (...) exchange that highlights the fundamental differences in their critical practice despite a number of political similarities. Both scholars address the normative premises, limits, and political implications of various conceptions of tolerance. Brown offers a genealogical critique of contemporary discourses on tolerance in Western liberal societies, focusing on their inherent ties to colonialism and imperialism, and Forst reconstructs an intellectual history of tolerance that attempts to redeem its political virtue in democratic societies. Brown and Forst work from different perspectives and traditions, yet they each remain wary of the subjection and abnegation embodied in toleration discourses, among other issues. The result is a dialogue rich in critical and conceptual reflections on power, justice, discourse, rationality, and identity. (shrink)

Fragen der Korruption von Vertragsärzten sind seit längerer Zeit höchst umstritten: Nach dem so genannten „Herzklappenskandal“ sind in den vergangenen Jahren wiederholt Pharma-Konzerne mit dem Vorwurf der Bestechung von Ärzten in die Schlagzeilen geraten. Das Thema wirft nicht nur juristische oder sozialpolitische, sondern auch ethische Fragen auf. Bislang gab es dazu in Deutschland jedoch nur wenig Reflexion. Bewertungen wurden von der Ärzteschaft vor allem Politikern und Juristen überlassen. Dabei bleibt die Frage der strafbaren Bestechlichkeit im Kern ein Problem, das Ärzteschaft (...) und Medizinethik betrifft. Im Alltag ist es oft schwer zu entscheiden, wann es sich bei Zuwendungen um mögliche Bestechung handelt. Die Übergänge zwischen dem unproblematischen Annehmen kleiner Geschenke und Korruption sind fließend. Es bleibt fast ausschließlich dem moralischen Empfinden der Ärzte überlassen, die Grenze zwischen Kooperation und Korruption im Umgang mit Pharmaunternehmen zu ziehen: Unausweichlich vorhandene Konflikte zwischen privaten und berufsethischen Interessen müssen von den Ärzten angesichts unzureichender allgemeingültiger Richtlinien für angemessenes Verhalten individuell gelöst werden. Das Bewusstsein für die sozialpolitische und berufsethische Bedeutung von Interessenkonflikten unter Ärzten und Studierenden sollte erhöht werden. Eine offensivere Auseinandersetzung mit der Frage der Bestechlichkeit in der Medizin ist wünschenswert und erforderlich. (shrink)

European citizenship is a nested membership in a multilevel polity that operates at member state and union levels. A normative theory of supranational citizenship will necessarily be informed by the EU as the only present case and will be addressed to the EU in most of its prescriptions, but should still develop a model sufficiently general to potentially apply to other regional unions as well. The Article first describes three basic characteristics of such a polity — democratic representation at the (...) supranational level, internal freedom of movement between member states, and regional limits to external geographic expansion — and argues that a multiplication of such regional unions would contribute to a more just and peaceful international order. Building on this modification of Kant’s model for a global confederation of republics, the contribution explores three alternative approaches for strengthening democratic citizenship in the European Union: a statist approach that aims at transforming the EU into a federal state, a unionist approach whose goal is to strengthen union citizenship vis-a`-vis member state nationality, and a pluralist one that specifies citizenship norms for each level and balances them with each other on the basis of the current state of federal integration. These approaches are then compared with regard to their implications for three policy questions: general status differences and inequality of rights amongst EU citizens living in their country of nationality, EU citizens residing in other member states, third-country nationals, and EU citizens residing outside the territory of the Union; voting rights in European, national, and local elections; and access to Union citizenship and to member state nationality. In this collection of essays, the first translation into English of the ground-breaking 'Normativität und Macht' (Suhrkamp 2015), Rainer Forst presents a new approach to critical theory. Each essay reflects on the basic principles that guide our normative thinking.
