It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. El presente artículo tiene como objetivo mostrar, a través de los textos confucianos y de sus intérpretes, cuál ha sido la posición de la mujer en la filosofía china clásica. Se analizará el papel que en las Analectas de Confucio, en los textos rituales, en el “Clásico de Poesía” y en Mencio juega la mujer, así como las interpretaciones que sobre estos pasajes, en ocasiones demasiado escuetos para posicionarse claramente sobre ellos, han realizado los comentaristas, desde la Antigüedad hasta finales (...) de la Época Imperial. Un examen atento mostrará que el confucianismo, a pesar de no preocuparse excesivamente de la cuestión, supo desafiar la “concience collective” y resaltar el papel de la mujer en la historia y en la sociedad. Finalmente, a través de una breve comparación con lo que la filosofía clásica occidental tiene que decir sobre la cuestión del género, se concluirá con unas observaciones sobre el papel del confucianismo en las sociedades modernas asiáticas y su relevancia para la formación de un discurso feminista autóctono. Mudanza (2010) es el primer libro de Verónica Gerber (1981), un libro donde la autora narra la migración que cinco artistas realizaron desde la literatura al arte. En este libro podemos encontrar una suerte de programa de los modos en que la autora ha pensado los traslados entre escritura y visualidad a lo largo de todo su trabajo. En Mudanza, los textos abren una zona de intervalo, de indeterminación, una suerte de tierra de nadie en el corazón de la palabra (...) y de la imagen, como si los escritores devenidos artistas sacrificaran los resultados de esa mudanza para poder explorar todo lo que acontece en ese traslado. Con esa misma ambigüedad escribe Gerber, componiendo textos a medio camino entre la literatura, el ensayo, la autobiografía, la escritura visual. Este artículo indaga en la pregunta por aquello que acontece cuando las imágenes y las palabras salen de sí mismas, perfilando lo que podríamos llamar una escritura figural que hace del intervalo el lugar de una potencia que trabaja en contra del estereotipo y el sentido unívoco. This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

The subject of this article is Leibnizian interpretation of the principle of reason. Although the German philosopher called it principium grande of his philosophy, we do not find its systematic exposition in Leibniz’s works. The main aim of my paper is to present a short exposition of the principle. The article consists of three parts: in the first I present systematic exposition of the principle of reason with particular emphasis on explication of terms “principle” and “reason,” in the second, I (...) show the origins of the principle, finally, in the third part, I discuss in detail three forms of it: the principle of sufficient reason, the principle of determining reason and the principle of rendering reason. I accept two main theses: firstly, a proper interpretation of this principle requires taking into account the whole context of Leibnizian philosophy, i.e. one cannot limit oneself (as it is usually happens among researchers) to only one discipline, e.g. logic. Secondly, the ultimate methodological and heuristical foundation of the principle of reason is Leibnizian metaphysics, especially natural theology. (shrink)

The debate between the amodal and the grounded views of cognition seems to be stuck. Their only substantial disagreement is about the vehicle or format of concepts. Amodal theorists reject the grounded claim that concepts are couched in the same modality-specific format as representations in sensory systems. The problem is that there is no clear characterization of format or its neural correlate. In order to make the disagreement empirically meaningful and move forward in the discussion we need a neurocognitive criterion (...) for representational format. I argue that efficient coding models in computational neuroscience can be used to characterize modal codes: These are codes which satisfy special informational demands imposed by sensory tasks. Additionally, I examine recent studies on neural coding and argue that although they do not provide conclusive evidence for either the grounded or the amodal views, they can be used to determine what predictions these approaches can make and what experimental and theoretical developments would be required to settle the debate. Este artigo propõe mostrar como a arqueologia agambeniana se realiza por meio de um movimento duplo que, a um só tempo, exibe a tradição a partir de um paradigma excepcional. É possível pensar aqui em um jogo de palavras, já que, habitualmente, a palavra paradigma é usada como sinônimo de modelo e, nesse sentido, a exceção foi o que modelou aquilo que a tradição transmitiu e, igualmente, recalcou. No entanto, com seu gesto característico, Agamben remete a palavra paradigma ao seu (...) sentido etimológico, como “aquilo que se mostra ao lado”, e confere a ela um sentido estratégico na sua arqueologia. Como o exemplo, o paradigma exibe o funcionamento e o pertencimento de algo sem que pertença a isso que é exibido, mostrando-se ao lado, subtraindo o seu pertencimento a uma regra. Isso que ele exibe é a estrutura excepcional da tradição, remetendo também a palavra exceção ao seu sentido etimológico, “capturada fora”. Esse sentido, que define a exceção enquanto tal, é usado para caracterizar a maneira como a tradição operou pressupondo uma origem. Essa pressuposição de uma dimensão originária, anterior a toda suposição, destinou como um fundamento subjacente, o sub iectum, isto é, o problema do sujeito. (shrink)

This article suggests itself as a movement towards a theory of thinking in photography – that is to say, of thinking photographs. The notion of art as related to thinking is by no means a contemporary one. Within this tradition that has its roots in the advent of modernity, artworks – and particularly paintings – have long been viewed as a form of both thought and thinking. Photography’s place within this tradition, however, is not an easy one. Many of the (...) philosophical accounts surrounding thinking in painting focus on the devices through which painting is said to be thinking. Hubert Damisch and Gilles Deleuze offer the two most comprehensive accounts on this topic, but are the thinking devices proposed by them applicable to photography? Through the discussion of these theories, this article maps the existing philosophical landscape vis-à-vis the thinking image: locating photographic thought within that landscape is the first step towards understanding the peculiarities of photographic thinking. Argumento, por el contrario, que no hay buenas razones para pensar que la condición de seguridad es insuficiente. Empleando algunos conceptos de Greco y Pritchard y Kallestrup para caracterizar (...) a las habilidades cognitivas y el caso del mentiroso consistente de Lackey, argumento que TEMP, el caso clave de Pritchard para mostrar que puede haber seguridad sin habilidad, no funciona porque el proceso cognitivo relevante constituye una realización legítima, aunque anómala, de una habilidad. Pritchard maintains that the ability and the safety conditions impose independent demands on knowledge, i.e., that satisfying only one of them is not sufficient to acquire knowledge. I argue that there are no good reasons to suppose that the safety condition is not sufficient. I claim that TEMP, the key case proposed by Pritchard to show that there can be safety without ability, fails because therelevant cognitive process constitutes a legitimate, although anomalous, realization of a cognitive ability. The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

The two leading theoretical approaches to tort law — economic analysis and corrective justice — are blind to distributive considerations. Moreover, even the main distributive approaches to tort law — loss-spreading and fairness — fail to emphasize egalitarianism as a distributive consideration. This article argues that egalitarianism should influence the normative evaluation of one’s conduct as negligent or not. It first explains why normatively negligence law should be sensitive to the egalitarian concern, suggesting three different accounts for this claim, based (...) on needs, equality, and desert as criteria for distribution. Second, it argues that egalitarianism is commensurate with the basic understanding of negligence law as reflecting corrective justice and notions of fault. The notion of fault is, therefore, reformulated from within, in order to accommodate egalitarianism. Third, I maintain that in order for egalitarianism to accommodate notions of corrective justice, egalitarian concerns should matter also at the stage of the standard of care. While the egalitarian concern can and should be integrated into the duty stage, I argue that such integration is insufficient. A correct and full understanding of the egalitarian concern and the tort of negligence requires a conclusion that the normative evaluation of one’s action as negligent or not cannot be separated from the distributive results that this action entails. The egalitarian concern works at the duty stage as an excuse for not imposing liability for wrongful activity. In contrast, at the standard stage, it works as a justification that turns an otherwise wrongful activity into a legitimate one. My claim is that morally we should usually expect more care from the better-off than from the disadvantaged. Findings of negligence are based on the failure to balance properly between one’s interests and those of another. In deciding to what extent the defendant should burden herself in order to prevent a loss to potential victims, one morally relevant criterion is the relative ability of the injurer and victim to bear precaution costs and expected accident loss, respectively. Se examina cómo, para Alberto Magno, la materia del hilemorfismo como pura potencia no permite explicar el cambio sustancial, por lo cual redefine los principios metafísicos del aristotelismo. Considera necesario que la forma sustancial pre-exista como forma incoada en la materia prima, para que el cambio sea continuo y teleológico. Estas formas incoadas, llamadas formae materiae o formae partis se comportan como habitudo y virtus formativa, y actualizan únicamente la materia, no la totalidad del compuesto.

The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. It is widely known that the main figures we target worked in different areas, which is a first piece of evidence for the plausibility of our main thesis. (shrink)

Apoyándonos en la rehabilitación por Antoni Domènech del concepto de fraternidad, pretendemos señalar la necesidad de reintepretar hoy a la luz del mismo el pensamiento político de Marx. Tanto sus escritos de juventud como los de madurez brindan una teoría crítica del Estado y del Derecho que estaría animada por una insobornable inspiración ética. Esta nada tendría que ver con la tan denostada “moralización” de la política. Más bien, en la estela de Levinas, tenderemos a leerla como una an-arquía de (...) lo político que nos obligaría a complementar la tradición histórica del republicanismo. (shrink)
