It has been argued that neural data are an especially sensitive kind of personal information that could be used to undermine the control we should have over access to our mental states, and therefore need a stronger legal protection than other kinds of personal data. The Morningside Group, a global consortium of interdisciplinary experts advocating for the ethical use of neurotechnology, suggests achieving this by treating legally ND as a body organ. Although the proposal is currently shaping ND-related policies, it (...) is not clear what its conceptual and legal basis is. Treating legally something as something else requires some kind of analogical reasoning, which is not provided by the authors of the proposal. In this paper, I will try to fill this gap by addressing ontological issues related to neurocognitive processes. The substantial differences between ND and body organs or organic tissue cast doubt on the idea that the former should be covered by bodily integrity. Crucially, ND are not constituted by organic material. Nevertheless, I argue that the ND of a subject s are analogous to neurocognitive properties of her brain. I claim that s’ ND are a ‘medium independent’ property that can be characterized as natural semantic personal information about her brain and that s’ brain not only instantiates this property but also has an exclusive ontological relationship with it: This information constitutes a domain that is unique to her neurocognitive architecture. One of the most prominent ethical concerns regarding emerging neurotechnologies is mental privacy. This is the idea that we should have control over access to our neural data and to the information about our mental processes and states that can be obtained by analyzing it. A key issue is whether this information needs more stringent protection than other kinds of personal information. I will articulate and support the view, underlying recent regulatory frameworks, that mental privacy requires a special treatment because (...) of its relation to relevant aspects of personal identity. It has been suggested that this approach could be supported by the idea that mental privacy constitutes a fundamental psychological dimension of privacy. The connection between this psychological view of privacy and identity can be traced back to Irwin Altman’s idea that privacy is an interpersonal boundary regulation process. However, it is not clear whether this notion of privacy can be associated with a conception of identity that is relevant in contemporary neuroethics. I will suggest that the narrative and relational approach to identity, a prominent view in recent ethical discussions of neurotechnology, lines up with key aspects of Altman’s proposal. I suggest that if mental privacy is an essential component of identity, the latter could be affected by technological mind-reading. (shrink)

The current human rights framework can shield people from many of the risks associated with neurotechnological applications. However, it has been argued that we need either to articulate new rights or reconceptualise existing ones in order to prevent some of these risks. In this paper, we would like to address the recent discussion about whether current reconceptualisations of the right to mental integrity identify an ethical dimension that is not covered by existing moral and/or legal rights. The main challenge of (...) these proposals is that they make mental integrity indistinguishable from autonomy. They define mental integrity in terms of the control we can have over our mental states, which seems to be part of the authenticity condition for autonomous action. Based on a fairly comprehensive notion of mental health (ie, a notion that is not limited to the mere absence of illness), we propose an alternative view according to which mental integrity can be characterised both as a positive right to (medical and non-medical) interventions that restore and sustain mental and neural function, and promote its development and a negative right protecting people from interventions that threaten or undermine these functions or their development. We will argue that this notion is dissociated from cognitive control and therefore can be adequately distinguished from autonomy. (shrink)

The proposed changes to the Common Rule, described in the recent Advanced Notice of Proposed Rulemaking, come more than 20 years after the U.S. Department of Health and Human Services adopted the Rule in 1991. Since that time, human subjects research has changed in significant ways. Not only has the volume of clinical research grown dramatically, this research is now regularly conducted at multiple collaborative sites that are often outside of the United States. Research takes place not only in academic (...) medical centers, but also at outpatient clinics, community hospitals, and other nontraditional venues. In addition, technological advances, such as sophisticated computer software programs, the Internet, social media, new research methods, and mobile applications have exponentially increased the volume of data available and the possibilities for accessing, analyzing, and sharing that data. Following a brief introduction, the second section delves into various overarching topics regarding Mark Textor’s work The Disappearance of the Soul and the Turn against Metaphysics. Specifically, it examines certain omissions within Textor’s portrayal of the history of philosophy of mind, notably the oversight of Freud and Du Bois-Reymond, and considers some general issues concerning Brentano’s understanding of the mind. In the subsequent third section, the paper advocates Mach’s neutral monism from an (...) epistemological perspective, aiming to circumvent potential metaphysical problems associated with the concept of mind. A história da filosofia é a história das ideias. Porém, para Herman Dooyeweerd, a história da filosofia imanentista é a história de antíteses teóricas radicadas em dialéticas religiosas insolúveis. O objetivo do presente artigo é apresentar o conceito de “motivos básicos religiosos” no pensamento de Herman Dooyeweerd. Em primeiro lugar, será apresentado a concepção de religião em Dooyeweerd e, em seguida, serão apresentados o conceito e o desenvolvimento dos “motivos básicos religiosos” no pensamento ocidental. As conclusões do texto são que (...) esse conceito contribui em demonstrar que há uma dimensão tácita e comunitária na reflexão filosófica e que a impossibilidade de síntese teórica entre polos de “motivos básicos religiosos” imanentistas diz respeito à “dialética religiosa”. Experiments in cognitive neuroscience build a setup whose set of controlled stimuli and rules elicits a cognitive process in a participant. This setup requires researchers to decide the value of quite a few parameters along several dimensions. We call ‘’contextual factors’’ the parameters often assumed not to change the cognitive process elicited and are free to vary across the experiment’s repetitions. Against this assumption, empirical evidence shows that many of these contextual factors can significantly influence cognitive performance. Nevertheless, it is (...) not entirely clear what it means for a cognitive phenomenon to be context-sensitive and how to identify context-sensitivity experimentally. We claim that a phenomenon can be context-sensitive either because it is only triggered within a specific context or because different contexts change its manifestation conditions. Assessing which of these forms of context-sensitivity is present in a given phenomenon requires a criterion for individuating it across contextual variations. We argue that some inter-level experiments that, within the mechanistic approach to explanation, are required to identify relations of constitutive relevance between a phenomenon and a mechanism, are also necessary for individuating the phenomenon across its contextual variations. We articulate a criterion according to which behavioral variations across contexts indicate different phenomena if and only if the mechanistic activities, components and/or organizational properties recruited in each context are different. We support this approach by showing how it is applied in paradigmatic studies addressing cognitive performance differences resulting from contextual variations of task features, such as stimulus type and response modality. Finally, we address the challenge that a form of context-sensitivity possessed by the so-called ‘multifunctional mechanisms’ is incompatible with our proposal because it entails that the same mechanism can be recruited in different contexts to produce different phenomena. We examine key cases of multifunctionality and argue that they are consistent with our proposal because a single mechanism can have different components, activities and/or organizational properties in different contexts. Thus, these modifications may not affect the identity of a mechanism, and they could explain how it produced different phenomena in those contexts. (shrink)

Na segunda unidade, apresenta-se a relação feita por Kuyper entre calvinismo, ciência e filosofia política. Por fim, na última unidade, expõe-se a articulação entre calvinismo, cultura e artes. (...) O quarto volume da obra "Ordem e História" de Eric Voegelin, intitulado de "A Era Ecumênica", marca a última mudança no pensamento do filósofo alemão. Voegelin rejeita uma concepção linear da história e sugere que as "irrupções espirituais" das civilizações se tornem o objeto de análise para identificar a "ordem da história". A partir disso, Voegelin rejeita os sistemas imanentistas da modernidade, notadamente, ideologias, como "revoltas egofânicas" que trazem desequilíbrio no Intermédio ou "metaxia" entre o cosmos e o além. O (...) objetivo do presente artigo é identificar a concepção de história e a crítica às ideologias modernas na obra "A Era Ecumênica" de Eric Voegelin. Adota-se metodologia exploratória e abordagem qualitativa na investigação do objetivo proposto. O trabalho conclui que, apesar da importante crítica voegiliniana à perda de fundamento transcendente da política moderna, a filosofia política do "último Voegelin" de "A Era Ecumênica" tem pouco a dizer sobre a política concreta, revelando-se uma filosofia da consciência apolítica em sentido normativo. The debate between the amodal and the grounded views of cognition seems to be stuck. Their only substantial disagreement is about the vehicle or format of concepts. Amodal theorists reject the grounded claim that concepts are couched in the same modality-specific format as representations in sensory systems. The problem is that there is no clear characterization of format or its neural correlate. In order to make the disagreement empirically meaningful and move forward in the discussion we need a neurocognitive criterion (...) for representational format. I argue that efficient coding models in computational neuroscience can be used to characterize modal codes: These are codes which satisfy special informational demands imposed by sensory tasks. Additionally, I examine recent studies on neural coding and argue that although they do not provide conclusive evidence for either the grounded or the amodal views, they can be used to determine what predictions these approaches can make and what experimental and theoretical developments would be required to settle the debate. The essay has been written to contribute to the debate on Dooyeweerd’s social philosophy. The goal is to argue that the central focus of his social philosophy is the “problem of order,” not communitarian issues. This article emphasizes that Dooyeweerd’s social theory was not oriented by communitarian concerns, but in comprehending the relation between creational order and social order.

Objetiva-se expor o pensamento de Herman Dooyeweerd (1894-1977), prolífico jusfilósofo holandês, no que diz respeito à maneira como destaca o aspecto jurídico da realidade e formula sua concepção de enciclopédia da ciência do Direito. Problematiza-se em que medida a teoria dooyeweerdiana permite o desenvolvimento de um conceito de Direito relevante para a teoria da decisão judicial. Neste afã, após exposição sintética das bases de seu pensamento, verticaliza-se o estudo do aspecto jurídico da realidade e da noção-base de sua Enciclopédia da (...) Ciência do Direito. Explora-se a original perspectiva filosófica dooyeweerdiana sobre a positivação do direito e a interpretação jurídica, ambas limitadas seja pelo inafastável núcleo distintivo do aspecto jurídico (a retribuição), seja pelo dever de considerar o todo dos aspectos da experiência humana e das esferas sociais envolvidas. Conclui-se que o conceito de enciclopédia jurídica em Dooyeweerd, à luz de uma densa e intrigante filosofia cosmonômica, enriquece sobremaneira a clássica discussão jusfilosófica que envolve o papel do direito positivo e os limites da interpretação jurídica, na medida em que oferece valioso prisma integrativo do aspecto jurídico frente aos demais aspectos da experiência humana, colaborando para uma visão jurídica não reducionista, preservadora da irredutibilidade do Direito e conferidora de limites mais claros à decisão judicial. A pesquisa é qualitativa, eminentemente bibliográfica, tendo sido utilizado o método hipotético dedutivo. (shrink)

Although it has been argued that mechanistic explanation is compatible with abstraction, there are still doubts about whether mechanism can account for the explanatory power of significant abstract models in computational neuroscience. Chirimuuta has recently claimed that models describing canonical neural computations must be evaluated using a non-mechanistic framework. I defend two claims regarding these models. First, I argue that their prevailing neurocognitive interpretation is mechanistic. Additionally, a criterion recently proposed by Levy and Bechtel to legitimize mechanistic abstract models, and (...) also a criterion proposed by Chirimuuta herself aimed to distinguish between causal and non-causal explanation, can be employed to show why these models are explanatory only under this interpretation. Second, I argue that mechanism is able to account for the special epistemic achievement implied by CNC models. Canonical neural components contribute to an integrated understanding of different cognitive functions. They make it possible for us to explain these functions by describing different mechanisms constituted by common basic components arranged in different ways. (shrink)

Herman Dooyeweerd (1894-1977) foi um filósofo neerlandês que, em diálogo com a filosofia alemã e o pensamento neocalvinista, desenvolveu uma reflexão original sobre as leis e a ordem do cosmos. A filosofia de Dooyeweerd é conhecida como “Filosofia da Ideia de Lei” ou “Filosofia da Ideia Cosmonômica”. A partir de sua teoria modal – que identifica quinze aspectos ônticos em que coisas concretas, eventos, relações e esferas sociais funcionam ou existem – Dooyeweerd desenvolveu uma filosofia político-social crítica às teorias sociais (...) individualistas e universalistas. O problema da presente pesquisa é: que objeto teórico caracteriza a filosofia político-social de Herman Dooyeweerd? A hipótese de investigação é que a preocupação político-social dooyeweerdiana diz respeito ao “problema da ordem”, i.e., a identificação teórica da ordem político-social nos limites das normas transcendentais divinas. O objetivo é analisar a concepção de Herman Dooyeweerd sobre a ordem político-social. Argumenta-se que a filosofia política de Dooyeweerd nem é nem se preocupa em ser comunitarista. O interesse de Herman Dooyeweerd é apreender teoricamente, a partir da análise da estrutura dos modos de experiência, quais são os princípios, as estruturas, as funções e a natureza das coisas, dos eventos e das relações e esferas sociais. Dooyeweerd busca compreender a estrutura típica de cada relação social, a fim de compreender os princípios de uma ordenação política plural e harmoniosa. Conclui-se que a preocupação da filosofia político-social de Herman Dooyeweerd é a compreensão da ordem dentro dos parâmetros cosmonômicos da criação divina. (shrink)

This paper aims at understanding the concept of convention in mechanics as a notion transferred from the field of jurisprudence. This enables us to clarify it as a new epistemic category having a pertinent role in the transformation of mechanics in the nineteenth century. Such understanding permits a separation from linguistic and arbitrary conventions, thus highlighting its epistemic features and not transforming fundamental principles into mere arbitrary agreements. After addressing the main references in the literature discussing the role of convention (...) in mechanics, we analyze its classical use as a concept originating from law. Then we explain its use by Carl G. Jacobi, Ferdinand F. Reech, and J. Henri Poincaré. Here we also show how their uses conform to the features analyzed regarding conventions in jurisprudence. Finally, we try to explain how the use of this concept, among other factors, contributed to the transformation of mechanics. (shrink)

It has been argued that the approximate number system (ANS) constitutes a problem for the grounded approach to cognition because it implies that some conceptual tasks are performed by non-perceptual systems. The ANS is considered non-perceptual mainly because it processes stimuli from different modalities. Jones (2015) has recently argued that this system has many features (such as being modular) which are characteristic of sensory systems. Additionally, he affirms that traditional sensory systems also process inputs from different modalities. This suggests that (...) the ANS is a perceptual system and therefore it is not problematic for the grounded view. In this paper, I defend the amodal approach to the ANS against these two arguments. In the first place, perceptual systems do not possess the properties attributed to the ANS and therefore these properties do not imply that the ANS is perceptual. In the second place, I will propose that a sensory system only needs to be dedicated to process modality-specific information, which is consistent with responding to inputs from different modalities. I argue that the cross-modal responses exhibited by traditional sensory systems are consistent with modality-specific information whereas some responses exhibited by the ANS are not. (shrink)

In the introduction to his famous book, La Science et l’hypothèse, Poincaré remarks on the necessary role and legitimacy of hypotheses. He establishes a triple classification of hypotheses, dividing them into verifiable, useful, and apparent. However, in chapter 9, entitled ‘Les hypothèses en physique’, he gives a slightly different triadic classification: natural hypotheses, indifferent hypotheses, and real generalizations. The origin of this second classification is a lecture given at the International Congress of Physics, Paris, 1900. What are the similarities and (...) differences between these two classifications? My main purpose is to provide a possible equivalence between the two classifications in order to clarify the role of hypotheses in Poincaré’s epistemology of natural science. The discussion will be based on the two fundamental texts mentioned above and on the contrast between Poincaré’s use of the notion of hypothesis and that of some of his contemporaries. (shrink)

Barsalou has recently argued against the strategy of identifying amodal neural representations by using their cross-modal responses (i.e., their responses to stimuli from different modalities). I agree that there are indeed modal structures that satisfy this “cross-modal response” criterion (CM), such as distributed and conjunctive modal representations. However, I argue that we can distinguish between modal and amodal structures by looking into differences in their cross-modal responses. A component of a distributed cell assembly can be considered unimodal because its responses (...) to stimuli from a given modality are stable, whereas its responses to stimuli from any other modality are not (i.e., these are lost within a short time, plausibly as a result of cell assembly dynamics). In turn, conjunctive modal representations, such as superior colliculus cells in charge of sensory integration, are multimodal because they have a stable response to stimuli from different modalities. Finally, some prefrontal cells constitute amodal representations because they exhibit what has been called ‘adaptive coding’. This implies that their responses to stimuli from any given modality can be lost when the context and task conditions are modified. We cannot assign them a modality because they have no stable relation with any input type. (shrink)

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. En las últimas décadas han proliferado un conjunto de planteamientos teológicos cristianos que, por primera vez, incorporan a su reflexión sobre Dios la perspectiva de las personas con género, orientación o identidad sexual minoritarias. Bebiendo en algunos casos de los desarrollos de la teología de la liberación (especialmente en autores procedentes de Iberoamérica) y en otros casos de la teología feminista, estas teologías pretenden hablar de lo divino desde y para las realidades del conjunto de personas que a menudo se (...) agrupan bajo el acrónimo LGTBIAA (lesbianas, gays, transexuales, bisexuales, intersexuales, asexuales y aliados). El propósito de nuestra comunicación es, en primer lugar, trazar un panorama general de cuáles son las principales aportaciones que se han hecho al pensamiento sobre Dios desde estos ámbitos. Para ello, examinaremos brevemente el modo en que las filosofías constructivistas de género (no necesariamente vinculadas a lo divino) han incidido en este tipo de pensamiento sobre lo divino. En segundo lugar, abordaremos un planteamiento crítico de las fortalezas, debilidades, amenazas y oportunidades que presenta este tipo de reflexión teológica. Por último, sugeriremos algunas posibles vías de desarrollo futuro de este tipo de teologías, así como de aportaciones que pueden hacer a otras esferas (filosóficas, éticas, sociales, eclesiales, políticas, etc.). In this paper I will defend the idea of the success of post-truth as one of the main features of hypermodernity. In order to understand such a claim, I will start by defining “post-truth” and showing the key differences that separate it from simple manipulation or lies. I will explain how post-truth characterizes a whole new way of understanding the difference between truth and falsity: a new attitude of indifference to the sharp distinction that moderns and ancients had placed between (...) these two notions. I will contend that this new attitude had been announced by the work of at least three recent philosophers: Harry Frankfurt, Gianni Vattimo and Mario Perniola. They give different names to “post-truth”, though, and attribute it to different causes (from anti-intellectualism to the new media and to sheer carelessness). After that, I will explore how two key aspects of hypermodernity (according to Gilles Lipovetsky), i.e. hyperindividualism and hyperconsumption, cohere with this spread of post-truth. Finally, I will summarily refer to some political and geopolitical events that corroborate the relevance of post-truth in our hypermodern world. (shrink)

The aim of this paper is to argue that there existed relevant interactions between mechanics and geometry during the first half of the nineteenth century, following a path that goes from Gauss to Riemann through Jacobi. By presenting a rich historical context we hope to throw light on the philosophical change of epistemological categories applied by these authors to the fundamental principles of both disciplines. We intend to show that presentations of the changing status of the principles of mechanics as (...) a mere epiphenomenon of the emergence of non-Euclidean geometries are inaccurate, that the relations between the two disciplines were richer than what is usually considered in the literature. These claims will be based on historical and philosophical arguments, starting from the fact that disciplinary boundaries at the time were not rigid as we are used today. It is widely known that the main figures we target worked in different areas, which is a first piece of evidence for the plausibility of our main thesis. (shrink)

Busca-se apresentar a leitura de MacIntyre sobre o emotivismo moral presente no último capítulo de A Short History of Ethics, suas críticas a essa concepção ética nos capítulos dois e três de After Virtue, os argumentos de Bruce Waller e Nicholas Unwin em defesa de uma reformulação do emotivismo moral e as críticas (...) de John Lemos a essa sugestão. Espera-se que o texto contribua na apresentação dos principais argumentos do debate entre MacIntyre e o emotivismo moral, a fim de servir de orientação para outras discussões na área da metaética. We intend to analyze the plausibility of the two kind of ethical justifications that are most commonly used in order to defend the concept of an “intellectual property” of copyrights. Firstly, we will examine justifications of property based on natural law, like the one originally provided by John Locke. We will argue, with the help of authors like Lysander Spooner, that the same arguments that Locke uses for property in general are entirely applicable to intellectual property, although this is certainly (...) a peculiar kind of property. Secondly, we will examine whether or not we can apply to intellectual property the same two arguments that Utilitarian authors use for justifying property in general: the “tragedy of the commons” argument and the scarcity argument. We will claim that the first one is fully pertinent here, and that the second one is not: but this is a problem of that kind of justification of property in general, and not a problem of intellectual property as such. O objetivo do presente artigo é comparar as perspectivas de Friedrich von Hayek e Hannah Arendt sobre a relação entre liberdade e política. A perspectiva de Hayek é chamada de liberdade da política devido a seu pessimismo quanto à capacidade da ação política estatal ampliar a liberdade individual. E a perspectiva de Arendt é chamada de liberdade na política devido a sua aceitação positiva do espaço político enquanto campo para o exercício da ação e da liberdade dos indivíduos. A conclusão (...) é que a liberdade na política pressupõe alguma liberdade da política, mas não se contenta com a liberdade negativa. A concretização da liberdade exige participação nos assuntos públicos e vida ativa na esfera pública. (shrink)

Una importante amenaza para la comunicación intercultu-ral es el relativismo: la idea de que cada cultura es tan diferente a las demás que resulta imposible entender nada de una de ellas desde cualquier otra. Se trata, de hecho, de una noción que cobró cierto éxito en diversas áreas del saber durante el siglo XX. Para oponerse a ella, los filósofos a menudo han intentado encontrar qué es lo que sí tienen todas las culturas en común, con el propósito de que (...) sirva de punto de apoyo para la comprensión mutua. En este artículo, empero, intentamos mostrar cómo cabe refutar las ideas del relativismo sin tener a la vez que comprometerse con una u otra idea de lo que presunta-mente puedan tener todas las culturas en común. El pensamiento de Richard Rorty será el que nos sirva de guía para ello. Veremos por qué, según este autor, el relativismo puede considerarse en realidad una idea incomprensible y, por tanto, que puede ser abandonada; y por qué, aunque nos confesemos etnocéntricos (como él se confesaba), ello no nos cierra a la comunicación con otras culturas, sino que, bien al con-trario, nos invita a entenderlas y a ampliar con ello nuestra propia comprensión de nosotros mismos. El uso de argumentos filosóficos tomados tanto de la epistemología elaborada por Donald Davidson, como de la historia del liberalismo político, nos resultarán fecundos en ambos empeños. (shrink)

A new strategy for moving forward in the characterization of the Global Neuronal Workspace (GNW) is proposed. According to Dehaene, Changeux and colleagues, broadcasting is the main function of the GNW. However, the dynamic network properties described by recent graph-theoretic GNW models are consistent with many large-scale communication processes that are different from broadcasting. We propose to apply a different graph-theoretic approach, originally developed for optimizing information dissemination in communication networks, which can be used to identify the pattern of frequency (...) and phase-specific directed functional connections that the GNW would exhibit only if it were a broadcasting network.
