Power and authority in terms of the Ten Commandments (TCs) are discussed. The paper reviews the TCs in Christianity, Judaism, and Islam. The treatment and basis for power and authority in each religion are clarified. Implications of power and authority using the perspective of the TCs are provided. The paper suggests that in today's business environment people tend to be selective in identifying only with certain elements of the TCs that fit their interest and that the TCs should be viewed (...) as general moral guidelines. Quons are particles characterized by the parameter q, which permits smooth interpolation between Bose and Fermi statistics; q = 1 gives bosons, q = -1 gives fermions. In this paper we give a heuristic argument for an extension of conservation of statistics to quons with trilinear couplings of the form ffb, where f is fermion-like and b is boson-like. We show that q f 2 = qb. In particular, we relate the bound on qγ for photons to the bound on (...) qe for electrons, allowing the very precise bound for electrons to be carried over to photons. The past two decades have seen an outpouring of work in legal theory that is self-consciously critical of aspects of American law and the institutions of the liberal state. In this lively volume, eminent scholars in philosophy, law, and political science respond to this recent scholarship by exploring what constitutes a "radical" critique of the law, examining such theories as critical legal studies, feminist theory and theories of "difference," and critical race theory. The authors consider whether the critiques advanced in (...) recent legal theory can truly be called radical and what form a radical critique of American law should take. Writing at the cutting edge of the critique of critical legal theory, they offer insights first on critical legal scholarship, then on feminist political and legal theory. Radical Critiques of the Law is particularly unique in presenting critical and feminist approaches in one volume-along with skeptical commentary about just how radical some critiques really are. In this tribute to the work of Robert Solomon, I address a topic that occupied him frequently in the last 20 years of his life, and about which he wrote a book and several articles: the relation(s) between the emotions and justice as a personal virtue. I hope to clarify Solomon’s views using three distinctions that seem implicit in his writings, among (1) justice as general virtue and justice as a particular virtue, (2) objective justice and justice as a (...) virtue, and (3) an emotion and a passion. Using these three distinctions and a fourfold schema of emotional objects that seems implied by the foregoing discussion, I argue that an account of emotions like Solomon’s, which construes emotions as in crucial ways like judgments, contains resources for grasping in some detail how particular emotions are related to the virtue of justice. Among these emotions, I pay special attention to compassion. (shrink)

Many philosophers of science and technology who see themselves as coming “after” Husserl also claim that their phenomenology is hermeneutical. Yet they neither practice the same sort of phenomenology, nor do they all have the same understanding of hermeneutics. Moreover, their differences often seem to be more a function of different pre-selected substantive commitments—say, to take a “material” turn or to be resolutely “empirical”—than the product of any serious effort to clarify what it is be hermeneutical. In this essay, after (...) some discussion of Dilthey’s reception among post-Husserlians (especially Patrick Heelan and Don Ihde), I consider how aspiring hermeneuts might make their own pre-possession of substantive and methodological commitments a hermeneutical topic. This is, of course, is not just a scholarly question of how post-Husserlian phenomenologists might make themselves more phenomenological. Without thoughtful self-awareness of these commitments, one’s assumptions about the use of technology, design, the place of science in the larger culture and in relation to conceptions of human flourishing—all of these assumptions are likely to pass through into technoscientific practice with insufficient critical consideration. Gert Goeminne’s paper is primarily concerned with “the politics of sustainable technology,” but for good reasons he does not start with this topic. He knows that technology studies as he conceives it must clear a space for itself in a philosophical atmosphere that discourages its pursuit. He therefore begins with a critique of this objectivistic and technocratically defined atmosphere, before moving on to embrace a postphenomenology of technological multistabilities, and then further to introduce what he calls (in an adaptation of (...) Rudolf Boehm) the “topical measure” of technoscientific life. The problem I raise is not about Goeminne’s aims, with which I mostly agree, but with his presentation of how to achieve them. I argue that if one were actually to follow his advice—that is, start with critique, move on to postphenomenology, and end with “political” evaluation of technoscientific life, the project would be doomed to failure. For in our world, no one Understands this pluralizing vision. According to the understanding we actually live through and speak from, some of postphenomenology’s multiple disclosures already arrive in our experience with significantly greater ontological power than others, and sincerity about topical measure notwithstanding, the very identification of something as an interest or “value,” especially if it allegedly comes from a “layperson,” already condemns it to secondary status. I approach the idea of empirical turns and transcendental theories indirectly. I do not start “post-“ or “neg-” anything; instead I begin pre-philosophically—that is, before everyone has a position and opposes other positions—with Heidegger’s “preparatory hermeneutical” question: As whom and with what concerns do empirically or transcendentally minded philosophers of technology respond to their experience of technoscientific life? For example, in his second Untimely Meditation, Nietzsche identifies his concern as one of “taking advantage” of historical knowledge “for life,” that is, (...) he understands himself to be motivated by a life-driven, not scientific “need.” But how are “needs” in Nietzsche’s sense to be distinguished? The question leads straight to Heidegger’s idea of a hermeneutics that comes “before philosophy”—a “hermeneutics of facticity” that considers “what goes on in [i.e., motivates] a philosophy before it becomes what it is”? I argue that once Nietzsche’s notion of need is expanded and deepened in Heidegger’s direction, we gain some clarity about how to appropriate any information “for life,” whether it is science-based, culturally operative, or phenomenological. I then consider Ihde, Stiegler, and the future prospects of empirical turns and transcendental theories in light of this idea. (shrink)

Developmental biology has resurfaced in recent years, often without a clearly central role for the organism. The organism is pulled in divergent directions: on the one hand, there is an important body of work that emphasizes the role of the gene in development, as executing and controlling embryological change; on the other hand, there are more theoretical approaches under which the organism disappears as little more than an instance for testing biological generalizations. I press here for the ineliminability of the (...) organism in developmental biology on explanatory grounds. I examine classical work concerned with growth and development, particularly in Drosophila and C. elegans. Some of this work is suggestive of modular development, and accordingly suggests a level below that of the organism as being explanatory. These are not the only type of case. There are other equally well-established results, which indicate greater integration in the developing organism. Though with a modular organization the organism can be thought of as made up of its constituent traits, and though the explanations of these traits may lie in terms of cells or genes, even with modular development the explanations of "genetic" differences require an appeal to the organism. With non-modular organization the organism has an even more central role. This does not mean that these genetic or cellular contributions are unreal in any way, or that development requires some sort of vitalistic contribution; but the genetic contributions make sense only as constituents of the organism, embedded in a larger organic context. A common question asked among egalitarians involves the extent to which responsibility should play a deciding factor in assessing the acceptability of inequalities. So-called luck egalitarians agree that instances of genuine choice are decisive in attributing responsibility for disadvantage, and in justifying unequal distributions of social goods. In this exciting new contribution to this literature, the author explores the correct place to locate the cut between choice and chance. In doing so, he lays out a novel approach for identifying inequalities (...) for which it is fair to hold one responsible, and those for which it is not. The argument--which builds on a thread of intellectual history that runs through Marx and Mill into more contemporary thinkers like Cohen and Rawls--provides a compelling case for rejecting a highly influential theory of strong property rights that has been inherited from Locke, and which we find in contemporary defenses of strong entitlements such as Robert Nozick's. The result is an egalitarian position which treats responsibility seriously, while maintaining our liberal commitments to impartiality and non-arbitrariness in the distribution of rights and responsibilities in contemporary society. Marc Van den Bosche suggests that Heidegger’s conceptions of Gestell and Gelassenheit, taken together with his analysis of Nietzschean Nihilism, depicts our era in a way that “supplements” Andrew Feenberg and Don Ihde’s work. Weaving these sources together, he sees the possibility of our becoming “technicians” that “live, in a released way, within the groundless.” Here, I raise some questions about whether the author has really fitted all these sources together and argue that his idea of becoming post-modern “technicians” appears (...) to require that we first practice a very un-Heideggerian kind of “renunciation.”. Observing people in a culture very different from our own, it would seem that we have to presuppose some such universality, just in order to understand them, but then we beg the very thesis in question.
