An intriguing work that considers the shared tradition of Canadian political philosophy.

From Lucretius throwing a spear beyond the boundary of the universe to Einstein racing against a beam of light, thought experiments stand as a fascinating challenge to the necessity of data in the empirical sciences. Are these experiments, conducted uniquely in our imagination, simply rhetorical devices or communication tools or are they an essential part of scientific practice? This volume surveys the current state of the debate and explores new avenues of research into the epistemology of thought experiments.

In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. In this book we argue that chimpanzees are persons because they are autonomous. (shrink)

In this brief, we argue that there is a diversity of ways in which humans (Homo sapiens) are ‘persons’ and there are no non-arbitrary conceptions of ‘personhood’ that can include all humans and exclude all nonhuman animals. To do so we describe and assess the four most prominent conceptions of ‘personhood’ that can be found in the rulings concerning Kiko and Tommy, with particular focus on the most recent decision, Nonhuman Rights Project, Inc v Lavery.

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

This paper motivates, explains, and defends a new account of the content of thought experiments. I begin by briefly surveying and critiquing three influential accounts of thought experiments: James Robert Brown’s Platonist account, John Norton’s deflationist account that treats them as picturesque arguments, and a cluster of views that I group together as mental model accounts. I use this analysis to motivate a set of six desiderata for a new approach. I propose that we treat thought experiments primarily as (...) aesthetic objects, specifically fictions, and then use this analysis to characterize their content and ultimately assess their epistemic success. Taking my starting point from Kendall Walton’s account of representation (Mimesis as make-believe, Harvard University Press, Cambridge, 1990), I argue that the best way to understand the content of thought experiments is to treat them as props for imagining fictional worlds. Ultimately, I maintain that, in terms of their form and content, thought experiments share more with literary fictions and pictorial representations than with either argumentation or observations of the Platonic realm. Moreover, while they inspire imaginings, thought experiments themselves are not mental kinds. My approach redirects attention towards what fixes the content of any given thought experiment and scrutinizes the assumptions, cognitive capacities and conventions that generate them. This view helps to explain what seems plausible about Brown’s, Norton’s, and the mental modelers’ views. (shrink)

This impressive volume includes most of the material on the philosophy of religion that the author has published in the last fifteen years, together with some additional items. Philosophy of religion has close links with other areas of philosophy, for instance metaphysics, epistemology, ethics, and the philosophy of mind; and several papers argue that theistic belief consorts well with otherwise acceptable positions in these areas. The author roundly contests the view that has recently been in vogue, that there is no matter of fact about the existence and nature of God, and that as a consequence human religious phenomena are the only religious subject matter available for such studies as are to claim academic respectability. He is vehemently 'realist' in this matter. Whatever our beliefs about the issue, he insists, God exists or does not exist, is omnipotent or is not omnipotent, and so forth. The author's realism is combined with what he sees as a moderate scepticism. It is liable to be objected that scepticism naturally and inevitably leads to subjectivism and anti-realism, but this, according to 756 BOOK REVIEWS the author, is a mistake. After all, the assumption, made by persons of common sense and by most philosophers, that physical objects exist and have the properties that they do have independently of our perceiving and thinking about them, implies that there is a gap between objects and our apprehensions of them, which is such that we can never he totally certain of their reality by way of any possible experience. 'This gap inevitably introduces a greater or smaller degree of unprovability into our beliefs about the objectively real. Realism thus goes naturally with some kind of scepticism, and with a need for faith.' This consorts well with the author's view that in matters of religion, as in most matters of concern to philosophers, conclusive proof is impossible, for all that beliefs on these topics may he more or less reasonable, and firm convictions may be appropriate. Thus, while there are no knock-down proofs for the existense of God, the traditional arguments have, and deserve to have, some persausive force, especially when considered cumulatively. Most of the papers here are meant to contribute at least indirectly to such a cumulative case for the existence of God, clearing away some objection, or putting some aspect of theistic belief in a more favorable light than that in which it often appears. The hook is divided into four sections, on faith, the problem of evil, God and ethics, and the metaphysics of theism. While all of the papers display admirable learning and philosophical skill, I was particularly intrigued by the last one, 'Flavors, Colors and God'. As the editor remarks in her "Introduction," it is not so long ago that the analytical philosophy of religion consisted very largely of discussions of the meaningfulness of religious language, and of arguments about the existence of God. Nowadays it is more adventurous, ranging over such topics as creation, providence, and God's responsibility for sin. According to Robert Merrihew Adams, the statement "truth is subjectivity," though one of the most famous, is also one of the most misunderstood in Kierkegaard's writings. He argues that, taken in context within the Concluding Unscientifu: Postscript, the statement is by no means incompatible with the objective truth of religious belief. From the point of view of the Postscript, a member of an idolatrous community who prays to her God with "the entire passion of the infinite" has more of the truth than one who prays in a false spirit from within Christendom; but this implies that the latter does have some truth. Whatever the deficiencies in her faith, she is clearly admitted to be in possession of the true concept of God objectively speaking (223 ). Adams maintains, quite rightly in the reviewer's opinion, that the Postscript is excessively pessimistic about the integration of the ideals of subjectivity and objectivity, of passionate commitment on the one side and rational assessment of evidence on the other, in religious faith (21). A useful distinction is made by Scott MacDonald between "occurrent" and "dispositional" belief; this seems to resolve some of the more puzzling paradoxes about the relation of the more cognitive and propositional side of faith to other aspects which may be thought essential to it. The demons alluded to by St. James (2:19) might believe dispositionally that their highest fulfillment BOOK REVIEWS 499 was to be found in obeying the divine will, and so performing acts of charity and service to other creatures. But to avoid the inconvenience of acting in such a way, they could think of God occurrently as just a powerful being who makes burdensome demands (55). For MacDonald, the cognitive component of faith has only two elements, belief that certain propositions are true, and belief that the kind of response of the will which is also essential to faith may be grounded on these (56). "We can make sense of Christian faith if we think of it simply as belief that Christianity is true plus an appropriate volitional response to that truth" (69). Recently, many scientists have become concerned about an excessive number of failures to reproduce statistically significant effects. The situation has become dire enough that the situation has been named the ‘reproducibility crisis’. After reviewing the relevant literature to confirm the observation that scientists do indeed view replication as currently problematic, I explain in philosophical terms why the replication of empirical phenomena, such as statistically significant effects, is important for scientific progress. Following that explanation, I examine various diagnoses of the reproducibility (...) crisis, and argue that for the majority of scientists the crisis is due, at least in part, to a form of publication bias. This conclusion sets the stage for an assessment of the view that evidential relations in science are inherently value-laden, a view championed by Heather Douglas and Kevin Elliott. I argue, in response to Douglas and Elliott, and as motivated by the meta-scientific resistance scientists harbour to a publication bias, that if we advocate the value-ladenness of science the result would be a deepening of the reproducibility crisis. Considers the legacy of Thomas Merton and his relevance for contemporary times. With the publication of The Seven Storey Mountain in 1948, Thomas Merton became a bestselling author, writing about spiritual contemplation in a modern context. Although Merton (1915–1968) lived as a Trappist monk, he advocated a spiritual life that was not a retreat from the world, but an alternative to it, particularly to the deadening materialism and spiritual vacuity of the postwar West. Over the next twenty years, Merton wrote (...) for a wide audience, bringing the wisdom of Christianity, Buddhism, and Sufism into dialogue with the period’s contemporary thought. In Thinking through Thomas Merton, Robert Inchausti introduces readers to Merton and evaluates his continuing relevance for our time. Contemporary pragmatists frequently claim to be pluralists, but infrequently say what this commitment means. The authors argue that pragmatism is inconsistent with any commitment that can plausibly be called pluralism.

This article examines corporate responsibility in the supply chains of four of the largest Scandinavian multinational corporations - IKEA, Nokia, Novo Nordisk, and StatoilHydro - and offers two key findings. First, these Scandinavian companies have all implemented responsible supply chain practices where suppliers in developing nations, and the communities of these suppliers, are engaged as key stakeholders and treated as partners. Second, these supply chain practices all share the common bond of having honesty and the establishment of trust-based relationships at (...) their foundation. Recently, information retrieval is shown to be a science by mapping information retrieval scientific study to scientific study abstracted from physics. The exercise was rather tedious and lengthy. Instead of dealing with the nitty gritty, this paper looks at the insights into how computer science can be made into a science by using that methodology. That is by mapping computer science scientific study to the scientific study abstracted from physics. To show the mapping between computer science and physics, we need (...) to define what is engineering science which computer science belongs to. Some principles and assumptions of engineering science theory are presented. To show computer science is a science, we presented two approaches. Approach 1 considers computer science as simulation of human behaviour similar to the goal of artificial intelligence. Approach 2 is closely related to the actual activities in computer science, and this approach considers computer science based on the theory of computation. Finally, we answer some of the common outstanding issues about computer science to convince our reader that computer science is a science. (shrink)

ABSTRACT While Jeffrey Friedman’s Power Without Knowledge offers a welcome corrective to the technocratic statism that dominates modern politics, Wittgenstein’s view of language suggests that the problem of ideational heterogeneity is less worrisome than Friedman maintains. In addition, Friedman’s “exitocracy” is as epistemically demanding as ordinary technocracy and thus cannot provide an alternative to it. Anarchism, however, might provide a more consistent alternative to technocracy.

Notre Dame, Indiana: University of Notre Dame Press, 1989. xiv + 304 pp. $29.95. One looks forward to the writings of James Burtchaell not only because his judgments are almost always on the side of the angels hut also because his mastery of the English language often enables him to say in a few (...) words what writers of lesser skill say in volumes. This is a collection of previously-published essays on a wide range of topics including contraception, abortion, the use of biotechnology in human reproduction, the use of fetal tissue in medical therapy, law in a pluralist society, liberation theology, the morality of terrorism and the relationship of religion to politics. In its own way, this hook poses well the moral questions of how we and " nature " are to relate to the newly emerging generation of technology. Because the articles are so diverse, it is not possible to give a detailed account or critique of each of them, and rather than doing that I will focus attention only on the issue of ethics and the newly emerging technology which will have a profound impact on not only our personal lives, hut also our society and politics. And to an even greater extent, newly emerging technological developments will have an enormous impact on the way in which our race regenerates and orients itself in the future. On a case-by-case basis, Burtchaell raises these issues with great force and clarity, even though his understanding of nature and technology is not entirely clear. He suggests that nature is far more subtle and vital than we commonly assume and that it has its own ways of fighting hack against our technological assaults against it. Our attempts to control and manipulate nature through technological means provide nature with an opportunity to protect itself hy striking hack at us in ways previously unimagined. Using technology to bend nature to our will is much like the Australian Aborigine who vainly tried to throw away his boomerang! What is most striking about this hook is the contradictory way in which Burtchaell employs the concept of nature to determine the morality of certain enterprises. This contradiction is seen most clearly hy comparing his assessments of artificial contraception and technological transmission of human life. The contrast is so sharp that the issue of the foundations of his thought can he called into question. When one compares his favorable assessment of artificial contraception to his critical evaluation of technological reproduction of human life, one wonders if there is an underlying principle guiding his moral deliberations or whether it is merely his intuitions, likes and dislikes (strongly 734 BOOK REVIEWS colored and shaped by his cultural setting) that determine his evaluations. In "'Human Life' and Human Love", Burtchaell vigorously criticizes the substance, form and arguments of the encyclical Humanae Vitae. For him, the great flaw in this encyclical was the weight it gave to the distinction between natural and artificial contraception and the absolute condemnation visited upon the latter. Seeing little difference between more natural methods of contraception like natural family planning and the use of the pill, Burtchaell argues that artificial contraception should have been given some kind of moral permissibility by Pope Paul VI (P. 99). But it is not clear why he gives limited support to artificial birth control after one reads his harsh criticisms of it: But the venture of technology overshot its original goals in several unforeseen ways. America now has the highest rate of teenage pregnancy in what we like to call the developed world. The incidence of sexual prom· iscuity, venereal disease, abortion, marital collapse, fatherless children, child abuse and abandonment, wanton breeding by the thriftless (and dusky) poor is probably higher than at any time in our national history. The founders [Margaret Sanger and Marie Stopes] did concede that their program might not immediately achieve its desired results. But that was because of the lack, in their time, of an ' ideal ' contraceptive. Its development was to be expected from further assiduous scientific research. On the other side, he presents the PDM as an alternative to the soft theism of thinkers like Hans Kiing and as a promising approach in contemporary epistemological debates involving Thomas Kuhn, Richard Rorty, Joseph Margolis, and many others. The historians (...) of philosophy will have to take up the critique of Matteo and Marechal on the many figures which they survey in PDM and QA. No one writer can cover so much ground without raising the ire of the specialists in particular thinkers or epochs. I shall simply say that the overview is helpful and that Matteo deserves credit for putting Marechal's readings to the test of his own reading of the works at issue. QA presents and evaluates this history with remarkable brevity, a virtue which can have its vicious side. I found the brevity to be a particular problem in the handling of Kant and of Marechal. The Critique of Pure Reason and PDM are elaborate analyses of thought, and Matteo proceeds in such summary fashion towards the big conclusions that he does less than justice to these analyses. Being so summary turns out to be a problem in showing that PDM can escape the accusations of subjectivism and relativism made by its scholastic attackers and that it has a way around those problems in present-day controversies. I myself am a partisan of the epistemology and metaphysics Marechal and Matteo advocate, but I find many of my doubts about the project unresolved by its presentation in QA. My particular concerns here center on conceptual relativism and theistic objectivity, hut anyone who can resolve those doubts definitively will have done a monumental service not just for the reviewer but for humankind. Marechal himself had intended a sixth volume more straight-forwardly along the Aristotelian-Thomist line, something which bad health prevented. We should wish Matteo the good health to develop the ideas of PDM and QA at the greater length required to achieve fully the promise claimed for them in this fine book. MICHAEL J. In recent years, we have seen a number of attempts to recapture the natural law doctrines of Thomas Aquinas. This book is another such BOOK REVIEWS 157 attempt, and in it Nelson attempts to do two things. First, he tries to show that prudence is the most important of the virtues and is prior to nature in the process of determining the moral character of actions. Prudence is undoubtedly a highly important virtue because it is the train that carries the agent to the moral good and it must stay on track for the agent to realize fully the aims of morality. But it is not clear that it is prior to other virtues, or to nature itself, as Nelson contends, and a strong case can he made that charity is first among the virtues, and that prudence is determined by charity. Prudence is prior to the other virtues in the sense that they are all weakened by prudential failures, hut prudence wanders aimlessly, not only in the absence of the guidance of the other virtues, hut also without the guidance of nature itself. Cut loose from its secure grounds in nature, prudence and the other virtues collapse, and they need not only the secure standards provided by justice, fortitude, and charity, hut also of nature to he authentic. Second, he is trying to show that Aquinas is not so much a natural law moralist as he is a rationalist and a virtue theorist. To do this, he argues that nature serves merely an explanatory and foundational function for morality, and provides no information about moral judgments (p. 100). He subordinates nature to reason in order to resolve disputes between modern deontologists and consequentialists, hut in doing this he transforms Aquinas from a natural law moralist to a rationalist. The philosopher Hans Blumenberg whose hundredth anniversary was celebrated last year is known above all for wide-ranging historical studies: onmyth, on philosophical metaphors, on the idea of secularization and the genealogy of the modern age. He is less well known as a critical reader and commentator of Husserl’s phenomenology. The article surveys and reviews Blumenberg’s ‘phenomenological writings’, now available in four separate volumes, by examining a number of prominent motifs in Blumenberg’s unfinished engagement with Husserl. First, his preoccupation with Husserl’s (...) shift from suspending the natural attitude to subsequent efforts to account for its recalcitrance; then his qualifications concerning Husserl’s notion of the pure subject and the lifeworld. This book offers a discussion of issues involved in evaluating welfare reforms, and applies those principles to the evaluation of reform in Wisconsin. It opens with an overview of the different types of program evaluation and summarizes the basic issues that are involved in their conduct. A discussion of general evaluation strategies for the reforms, such as the selection and use of counterfactuals, is followed by consideration of both implementation and impact evaluations of the Wisconsin program. We distinguish two conceptions of confinement – the agential conception and the comparative conception – and show that the former is intimately related to use in a way that the latter is not. Specifically, in certain conditions, agential confinement constitutes use and creates a special relationship that makes neglect or abuse especially egregious. This allows us to develop and defend an account of one important way in which agential confinement can be morally wrong.
