Moral agency is limited, imperfect, and structurally constrained. This is evident in the many ways we all unwittingly participate in widespread injustice through our everyday actions, which I call ‘structural wrongs’. To do justice to these facts, I argue that we should distinguish between summative and formative moral criticism. While summative criticism functions to conclusively assess an agent's performance relative to some benchmark, formative criticism aims only to improve performance in an ongoing way. I show that the negative sanctions associated (...) with summative responses are only justifiably imposed under certain conditions when persons exercise their agency wrongly — conditions that do not always hold for structural wrongs. Yet even in such cases we can still use formative responses, which are warranted whenever agents fall short of moral ideals. Expanding our repertoire of moral criticism to include both summative and formative responses enables us to better appreciate both the powers and limitations of our agency, and the complexity of moral life. In the ongoing debate concerning the nature of human racial categories, there is a trend to reject the biological reality of race in favour of the view that races are social constructs. At work here is the assumption that biological reality and social constructivism are incompatible. I oppose the trend and the assumption by arguing that cladism, in conjunction with current work in human evolution, provides a new way to define race biologically. Defining race in this way makes sense when (...) compared to the developments in other areas of systematic biology, where shared history has largely replaced morphological similarity as the foundation of a natural biological classification. Surprisingly, it turns out that cladistic races and social constructivism are compatible. I discuss a number of lessons about the way human biological races have been conceptualized. (shrink)

The first principle of chemical composition is that elements are actually present in their compounds. It is a golden thread running through the history of compositional thinking in chemistry since before the chemical revolution. Opposed to this principle, which I call Actually Present Elements (APE), is the idea that elements are merely potentially present in their compounds: although not actually present, it is possible to recover them. In this paper I follow that golden thread, and then discuss the status of (...) APE itself: is it true? What arguments were there for it, and when? I argue that APE is a metaphysical principle, albeit at a lower level of generality and abstraction than the term ‘metaphysical’ usually suggests. I critically examine a range of different views on how metaphysical principles might be involved in research programmes in empirical science, and conclude by endorsing Elie Zahar’s view that metaphysical principles such as APE are to be found at the very heart of science. Moreover, they can be recipients of empirical support just like other parts of scientific theory. (shrink)

This paper investigates whether gender affects ethically sensitive decisions of a personal or business nature. Data from 51 practicing accountants from both public accounting and private industry suggest that while differences exist between female and male accountants in responses to specific situations, overall responses are quite similar. Statistically significant differences were found for only five of the sixteen ethically sensitive situations. Further, when personal and business situations of a similar nature were paired together, two of the eight differences between personal (...) and business responses were significantly different between females and males. Taken as a whole, the results refute the suggestion that the ethical decision making of organizations may be enhanced as more women enter the business field. (shrink)

One of the most important students of Franz Brentano was Anton Marty, who made it his task to develop a philosophy of language on the basis of Brentano’s analysis of mind. It is most unfortunate that Marty does not receive the attention he deserves, primarily due to his detailed and distracting polemics. In the analysis presented here his philosophy of language and other aspects of his thought, such as his ontology , are examined first and foremost in their positive rather (...) than critical character. The analysis is moreover supplemented by translations of four important works by Marty, including his entire work On the Origin of Language. These are in fact the first English translations of any substantial writings by him. The resulting picture that emerges from the analysis and translations is that Marty has much to say that proves to be of enduring interest for the philosophy of language on a range of topics, especially the meanings of statements, of emotive expressions, and of names as regards both their communicative and their ontological aspects. The volume will be of interest not only to philosophers and historians of philosophy, but also to historians of linguistics and psychology. (shrink)

Can room be found in between the matter and void of a Newtonian universe for an immaterial and immortal soul? Can followers of Locke with his agnosticism about the nature of substances claim to know that some of them are immaterial? Samuel Clarke, well versed in Locke's thought and a defender both of Newtonian science and Christian orthodoxy, believed he could do both and attempted to prove his case by means of some hard-boiled reductionism. Anthony Collins, a deist whose only (...) lapse from materialism concerned God himself, rejected Clarke's argument. In this paper I discuss their controversy' in order to bring out the state of debate about material systems and consciousness among people influenced by Locke and Newton in the early eighteenth century, and I also assess Clarke's reductionist premise, as he himself frequently invites "the impartial reader" to do. For sociologist Emile Durkheim, the “sacred” constitutes all those things “set apart and forbidden.” Within Evangelical Christianity, and to a lesser degree Protestantism in general, the sacred has arguably centered on the individual believer and her/his personal relationship with God and scripture. Recently, however, a growing movement within Evangelical Christianity has emphasized the sacred nature of relationships and community, culminating in the mantra “God is love.” This shift has set community above the personal in the hierarchy of sacred Evangelical things, (...) and is reminiscent of earlier progressive forms of Evangelicalism, such as Social Gospel Christianity. Rob Bell, an Evangelical author, pastor, and Oprah Network star, possibly best exemplifies this change and its ramifications, which extend from a postcolonial critique of mission work and evangelism to a move to more inclusive and even Universalist soteriology. Such efforts that have left Bell labeled as a heretic in some Evangelical circles. (shrink)

The rapid implementation and continuing expansion of forensic DNA databases around the world has been supported by claims about their effectiveness in criminal investigations and challenged by assertions of the resulting intrusiveness into individual privacy. These two competing perspectives provide the basis for ongoing considerations about the categories of persons who should be subject to non-consensual DNA sampling and profile retention as well as the uses to which such profiles should be put. This paper uses the example of the current (...) arrangements for forensic DNA databasing in England and Wales to discuss the ways in which the legislative and operational basis for police DNA databasing is reliant upon continuous deliberations over these and other matters by a range of key stakeholders. We also assess the effects of the recent innovative use of DNA databasing for “familial searching” in this jurisdiction in order to show how agreed understandings about the appropriate uses of DNA can become unsettled and reformulated even where their investigative effectiveness is uncontested. We conclude by making some observations about the future of what is recognized to be the largest forensic DNA database in the world. (shrink)

We consider connections between number sense—the ability to judge number—and the interpretation of natural language quantifiers. In particular, we present empirical evidence concerning the neuroanatomical underpinnings of number sense and quantifier interpretation. We show, further, that impairment of number sense in patients can result in the impairment of the ability to interpret sentences containing quantifiers. This result demonstrates that number sense supports some aspects of the language faculty.

For every finite n ≥ 4 there is a logically valid sentence φ n with the following properties: φ n contains only 3 variables (each of which occurs many times); φ n contains exactly one nonlogical binary relation symbol (no function symbols, no constants, and no equality symbol): φ n has a proof in first-order logic with equality that contains exactly n variables, but no proof containing only n - 1 variables. This result was first proved using the machinery of (...) algebraic logic developed in several research monographs and papers. Here we replicate the result and its proof entirely within the realm of (elementary) first-order binary predicate logic with equality. We need the usual syntax, axioms, and rules of inference to show that φ n has a proof with only n variables. To show that φ n has no proof with only n - 1 variables we use alternative semantics in place of the usual, standard, set-theoretical semantics of first-order logic. (shrink)

When the delivery of a baby at the edge of viability is imminent, gestational age is usually the primary indi­cator for resuscitation. However, four other variables—female sex, antenatal corticosteroid therapy, singleton birth, and increased birth weight—are also associated with better infant survival and neurologic outcome in intensive care, and the combination of all five variables provides a stronger prognostic tool. An ethical framework is provided here for use in determining whether proposed treatments are likely to defend the dignity and sanctity (...) of a fragile periviable life. The framework is based on the principle of ordinary/propor­tionate and extraordinary/disproportionate medical treatment. The author recommends using the most recent outcome data and this ethical framework together to make perinatal resuscitation decisions. Purpose This paper aims to provide a non-academic perspective on the research reports of the JICES “Post-Snowden” special edition, from the viewpoint of a privacy advocate with an IT background. Design/methodology/approach This paper was written after reviewing the country reports for Japan, New Zealand, PRC and Taiwan, Spain and Sweden, as well as the Introduction paper. The author has also drawn on online sources such as news articles to substantiate his analysis of attitudes to technical privacy protection post-Snowden. Findings Post-Snowden, (...) the general perception of threats to online privacy has shifted from a predominant focus on commercial threats to a recognition that government activities, in the sphere of intelligence and national security, also give rise to significant privacy risk. Snowden’s disclosures have challenged many of our assumptions about effective oversight of interception capabilities. Citizens’ expectations in this regard depend partly on national experience of the relationship between citizen and government, and can evolve rapidly. The tension between legitimate law enforcement access and personal privacy remains challenging to resolve. Originality/value As a “viewpoint” paper, this submission draws heavily on the author’s experience as a privacy and technology subject-matter expert. Although it therefore contains a higher proportion of opinion than the academic papers in this issue, his hope is that it will stimulate debate and further research. (shrink)

Holmes Rolston's case for holding that it is sometimes right to let people starve in order to save nature is argued to be inconclusive at best; some alternative responses to population growth are also presented. The very concept of development implies that authentic development, being socially and ecologically sustainable, will seldom conflict with saving nature (sections 1 and 2). While Rolston's argument about excessive capture of net primary product is fallacious, his view should be endorsed about the wrongness of 'development' (...) in areas where sustainable development is impossible, but not unqualifiedly endorsed about those areas where it is feasible (section 3). Important as policies promoting sustainable levels of population are, representing population growth as a cancer is misguided, and could engender indifference to suffering (sections 4 and 5). The neo-Malthusian paradigm (which makes population growth the cause of both poverty and environmental degradation) appears to conflict with a considerable body of empirical evidence; the kind of policies needed in Third World countries are ones which enlist people's energies for producing food and preserving nature alike (section 6). While Hermann Lotze's philosophy was widely received all over the world, his views on abstraction and Platonic ideas are of particular interest because they were to a large extent adopted by one of the most eminent philosophers of the twentieth century, namely Edmund Husserl. In this paper these views are examined in three distinct aspects. The first of these aspects is to be found in Lotze's thesis that there is a mental process, prior to abstraction, whereby "first universals" are apprehended. (...) The second one lies in his view that there is yet a higher level of apprehension, as found in the process of abstraction itself. According to Lotze, abstraction is not to be identified with the mere removal of particular features, but rather the replacement of these with first universals, resulting in "general images" and ultimately concepts. In addition to Lotze's analysis of the cognition of universals, there is finally a third thesis (an ontological one) which is examined in this paper, namely that the universals are Platonic Ideas in the sense that they have "validity" (Geltung) independently of their corresponding particulars and also of the mind which grasps them. The three claims in question are examined here in detail. Also, an attempt is made to point out some of the connections between Lotze and Husserl on the topic under discussion. (shrink)

To address longstanding workforce shortages, increase efficiency and control the costs associated with the modern health-care provision, there has been a worldwide policy to promote increased flexibility within the health-care workforce. This is being done primarily by extending the ‘scope of practice’ of existing occupational roles into what is referred to as ‘advanced’ practice. The development of the advanced practice nurse (APN) has occurred within the context of a shortage of medical staff, and the need to control cost. However, the (...) means by which substantially repurposed occupational groups such as these, are incorporated into complex, hierarchical organisations such as the UK national health service (NHS) remains poorly understood. Using modern sociological theory, the development of the APN role has been examined in terms of power, control, professional identity and gender relations. Each of the theoretical approaches used adds to the quality of the discussion, although none provide a comprehensive picture. However, when synthesised, they do provide an enhanced insight into the evolution of the role. It is argued here that by critically examining the development of the APN role, this will enable both a better understanding of, and the means to influence, its future direction of travel. (shrink)

Possible environmental and related impacts of human activity are shown to include the extinction of humanity and other sentient species, excessive human numbers, and a deteriorating quality of life (I). I proceed to argue that neither future rights, nor Kantian respect for future people's autonomy, nor a contract between the generations supplies a plausible basis of obligations with regard to future generations. Obligations concern rather promoting the well-being of the members of future generations, whoever they may be, as well as (...) of current generations. Future benefits and costs should only be discounted where there are special reasons for doing do so (e.g. relevant opportunity costs) (II). A sustainable economy is held to be necessary for intergenerational equity. This granted, principles of equity are introduced concerning: compensation for long-term risks and for resource depletion; conserving the stock of resources, resource diversity, and assimilative capacity; equal options and opportunities for each generation; and remedying past failures to conserve environmental quality. Rules and policies considered include: an efficient, diversified, and ecologically sustainable economy; no increase of risk of irreversible environmental change; and action despite uncertainty to avert serious future outcomes (the Precautionary Principle). These policies are argued to require rectification of current injustices within and between current generations (III). Finally, the recently resuscitated metaphysical model of society as a partnership between generations is held to imply the view of each generation as trustees rather than owners of the planet. This trusteeship view is independently credible, and supportive of the principles and policies earlier introduced; and its adoption by successive generations could turn the partnership model into a reality (IV). Techniques for constructing the tensor product of two generalized sample spaces which admit unital sets of dispersion-free weights are discussed. A duality theory is developed, based on the 1-cuts of the dispersion-free weights, and used to produce a candidate for the tensor product. This construction is verified for Dacification manuals, a conjecture is given for other reflexive cases, and some adjustments for nonreflexive cases are considered. An alternate approach, using graphs of interpretation morphisms on the duals, is also presented.

These collected papers construct a distinctive view of classical Athens and of Athenian democracy, a view which takes seriously the evidence of settlement archaeology and of art history. This evidence both casts new light on traditional questions and enables new questions to be asked, questions concerning the experience of being an Athenian citizen, how the institutions of democracy affected the Athenian economy, and how the rituals of religion related to the rituals of democratic politics.
