Chinese translation courtesy of Zhuanxu Xu. We want to know what gender is. But metaphysical approaches to this question solely have focused on the binary gender kinds men and women. By overlooking those who identify outside of the binary–the group I call ‘genderqueer’–we are left without tools for understanding these new and quickly growing gender identifications. This metaphysical gap in turn creates a conceptual lacuna that contributes to systematic misunderstanding of genderqueer persons. In this paper, I argue that to better (...) understand genderqueer identities, we must recognize a new type of gender kind: critical gender kinds, or kinds whose members collectively resist dominant gender ideology. After developing a model of critical gender kinds, I suggest that genderqueer is best modeled as a critical gender kind that stands in opposition to `the binary assumption', or the prevalent assumption that the only possible genders are the binary, discrete, exclusive, and exhaustive kinds men and women. It is commonly observed that we live in an increasingly polarised world. Strikingly, we are polarised not only about political issues, but also about scientific issues that have political implications, such as climate change. This raises two questions. First, why are we so polarised over these issues? Second, does this mean our views about these issues are all equally ir/rational? In this chapter I explore both questions. Specifically, I draw on the literature on ideologically motivated reasoning to develop an answer (...) to the first question. Put briefly, we exhibit “directional biases” in our information processing: we try to assimilate new information into our existing webs of beliefs. This means that those who are predisposed to accept the case for climate change end up accepting it, whereas those who are predisposed to reject it end up rejecting it. Based on this answer, I then address the second question. I look at some reasons for thinking that, because we all exhibit such biases in our thinking, we are all equally rational (or, as the case may be, irrational). I also suggest some ways you might try reject these reasons. (shrink)

Skeptical invariantism isn’t a popular view about the semantics of knowledge attributions. But what, exactly, is wrong with it? The basic problem is that it seems to run foul of the fact that we know quite a lot of things. I agree that it is a key desideratum for an account of knowledge that it accommodate the fact that we know a lot of things. But what sorts of things should a plausible theory of knowledge say that we know? In (...) this paper I sketch an answer to this question and then apply it to skeptical invariantism. I start by distinguishing between a “radical” skeptical invariantist position (on which the standards for knowing are so high that we rarely if ever satisfy them) and a more “moderate” skeptical invariantist position (on which the standards are very hard, but not impossible, to satisfy). I then argue that, while radical forms of skeptical invariantism are clearly not going to do a good job of satisfying the key desideratum, more moderate forms can do quite well with respect to it. In particular, I argue the version of moderate skeptical invariantism defended by Davide Fassio can plausibly satisfy it. (shrink)

Remember how Kim Mental causation, Clarendon Press, Oxford, 1993b) used to argue against non-reductive physicalism to the effect that it cannot accommodate the causal efficacy of the mental? The argument was that if physicalists accept the causal closure of the physical, they are faced with an exclusion problem. In the original version of the argument, the dependence holding between the mental and the physical was cashed out in terms of supervenience. Due to the work or Fine and others, we have (...) since come to realize that modal notions are not well-suited to perform the work of properly characterizing dependence. As a consequence of this, an increasingly larger community of contemporary metaphysicians prefer to spell out mental-physical dependence in terms of a non-causal and non-reductive notion called grounding, which is intended to target a particular sort of metaphysical relation that takes us from ontologically less fundamental features of the world to that which is more fundamental. In this paper I join forces with those who think that this shift in focus is on the right track. More specifically, I will argue that the grounding physicalist can solve the exclusion problem in a way that is preferable to the supervenience-based nonreductive physicalist solution, as well as in a way that is compatible with the externalist picture of the mental. In this paper, I offer some reasons for thinking that knowledge is a social phenomenon. My argument is based on Helen Longino’s work on scientific knowledge, in particular her 2002 book The Fate of Knowledge. Longino’s basic idea is that a scientific hypothesis or theory is justified when it emerges (relatively) unscathed from social interactions between scientists. If we accept – as Longino and many others do – that knowledge requires justification, it follows that scientific knowledge is a social phenomenon. (...) I argue that much the same goes for other forms of empirical knowledge, such as historical knowledge, various forms of collective knowledge and our knowledge of the ‘social world’. But does it go for empirical knowledge in general? I offer some – admittedly far from conclusive – reasons for thinking that it might. I also argue that, even if it doesn’t, we still need to distinguish between two kinds of knowledge, one of which is constitutively social and the other of which isn’t. Scientific knowledge is a paradigm example of the former and simple perceptual knowledge is a paradigm example of the latter. The end result is a form of pluralism about knowledge. (shrink)

Arrogance is traditionally regarded as among the worst of human vices. Kant’s discussion of one kind of arrogance as a violation of the categorical moral duty to respect other persons gives familiar support for this view. However, I argue that what Kant says about the ways in which another kind of arrogance is opposed to different kinds of self-respect reveals how profoundly vicious arrogance can be. As a failure of self-respect, arrogance is the Ur-Vice that corrupts moral agency and rational (...) judgment. As its contrary, self-respect is thus morally vital: it is the first condition of the possibility of genuine moral agency and judgment. There are also important gender dimensions to arrogance: although women are called haughty, supercilious, disdainful, even imperious or presumptuous, they are rarely called arrogant, perhaps because arrogance is an exercise of power. I consider, then, whether despite the Kantian condemnation of it, something that is properly called "arrogance" might be, in contexts of oppression, a liberatory virtue of self-respect that oppressed peoples ought to cultivate. The first principle of chemical composition is that elements are actually present in their compounds. It is a golden thread running through the history of compositional thinking in chemistry since before the chemical revolution. Opposed to this principle, which I call Actually Present Elements (APE), is the idea that elements are merely potentially present in their compounds: although not actually present, it is possible to recover them. In this paper I follow that golden thread, and then discuss the status of (...) APE itself: is it true? What arguments were there for it, and when? I argue that APE is a metaphysical principle, albeit at a lower level of generality and abstraction than the term ‘metaphysical’ usually suggests. I critically examine a range of different views on how metaphysical principles might be involved in research programmes in empirical science, and conclude by endorsing Elie Zahar’s view that metaphysical principles such as APE are to be found at the very heart of science. Moreover, they can be recipients of empirical support just like other parts of scientific theory. (shrink)

In this paper, I explore the ways that phenomenological concepts like intercorporeality and mutual incorporation offer new tools in trying to make sense of human experiences via mediating systems. In particular, I think about how the COVID-19 pandemic hastened a large population into mediated interactions, and what is lost, perhaps contingently or perhaps intrinsically, when human experiences are mediated in this way. I look to research in presence, skillful interaction, and enactive social cognition to argue that there remains something ineffable (...) or at least extremely hard to pin down about intercorporeality, and embodied togetherness has not yet been replicated in the mediating systems we currently embrace. We prove that everyn-modal logic betweenKnandS5nis undecidable, whenever n ≥ 3. We also show that each of these logics is non-finitely axiomatizable, lacks the product finite model property, and there is no algorithm deciding whether a finite frame validates the logic. These results answer several questions of Gabbay and Shehtman. The proofs combine the modal logic technique of Yankov–Fine frame formulas with algebraic logic results of Halmos, Johnson and Monk, and give a reduction of the representation problem of finite relation (...) algebras. My paper is motivated by two thoughts: that there’s significant overlap between J. G. Herder’s romanticism and, what I call, the ‘late’ conceptualism of John McDowell; that recognizing this helps to settle a dispute in contemporary epistemology concerning the contents of perception. I argue, on the basis of that overlap, that “romantic conceptualism” avoids two pressing criticisms of conceptualism: It offers a reply to the argument from the fineness of grain of perceptual experience and it explains the relationship between human (...) perceptual experience and the perceptual experiences of non-human animals. I start with the interpretation of McDowell’s views, tracing the significant revisions in the period following the publication of Mind and World; then I try to compare his views with Herder’s, trying to establish a framework for responding to the more trenchant criticisms of McDowell’s non-conceptualist opponents, and the explanatory force of conceptualist hypotheses beyond the context of contemporary epistemology. The first arc of the paper, therefore, traces the evolution of McDowell’s thought concerning perceptual contents. The second attempts to demonstrate where that view converges with a romantic philosophy of mind. (shrink)

It is widely held that moral obligations to non-human beings do not involve considerations of justice. For such a view, nonhuman interests are always prone to be trumped by human interests. Rawlsian contractarianism comprises an example of such a view. Through analysis of such theories, this essay highlights the problem of reconciling the claim that humans have obligations to non-humans with the claim that our treatment of the latter is not a matter of justice. We argue that if it is (...) granted that the basic interests of non-human beings sometimes count for more than the peripheral interests of humans, then our understandings of obligation and of justice must be aligned, so that what we say about obligation is not countered by assumptions about the invariable priority of humans in matters of justice. We further consider whether such a conclusion can be endorsed by those who adopt certain alternative theories to contractarianism. We conclude that adherents of a range of theories including sentientism and biocentrism must accept that human interests can sometimes be superseded by animal interests, and that this applies not least in matters of justice. For Kant and for feminists, self-respect is a morally central and morally powerful concern. In this paper I focus on some questions about the relation of self-respect to two other stances toward the self, humility and arrogance. Just as arrogance is usually treated as a serious vice, so humility is widely regarded as an important virtue. Indeed, it is supposed to be the virtue that opposes arrogance, keeping it in check or preventing it from developing in the first place. I’ve (...) argued elsewhere that, on Kant’s account, arrogance is a vice of disrespect for other people and for oneself. Humility is not, however, unproblematic from a Kantian perspective, and he is more concerned to identify bad forms of it than to praise it as a virtue or recommend it as a cure for arrogance. Feminist ethics draws our attention to the ways in which character traits, attitudes, beliefs, and stances take on differential moral valences in contexts of oppression, and what might be a virtue for members of dominant groups can be vices for members of subordinate groups. How, then, are we to understand and assess humility? The upshot of Kantian and feminist analyses is two-fold: First, humility is not the virtue opposing arrogance; rather, self-respect is. Second, humility is at best an ancillary, instrumental, contextual virtue and the servant of self-respect; but at worst, it is as serious a vice as arrogance, indeed, an aspect of it. (shrink)

During the last 25 years, rape law has undergone a profound transformation, as the articles in this symposium clearly show. To mention just three of the more striking doctrinal reformations: All states have repealed the most egregious aspects of die marital rape exception; most have abandoned the “utmost resistance” requirement; and all have enacted rape shield laws to protect complaining witnesses from intrusive inquiries into their sexual history. All three reforms were the product of feminist agitation, all three were aimed (...) toward the general end of redirecting rape law toward the protection of women's, rather than men's, interests, and all three did, to some degree, broaden and democratize the scope of the law's protection: Wives, prostitutes, promiscuous girls, and women not inclined to risk their deaths by fighting off their rapists “to the utmost” are now protected by the law of rape against sexual assault, at least in theory, and at least to the same degree as non-wives and non-prostitutes, fighters, and virgins. All of this, virtually every contributor to this symposium agrees, is very much to the good. (shrink)

After a clarification of the concept of concept the project of analysing the concept of man is defended (I), and it is concluded that to be human involves being both of a certain anatomical structure and a member of a race most of whose members are capable of theoretical and practical reasoning (II). Since further the development of essential capacities is necessary for members of a species to flourish, the ability to exercise the essential human capacities for theoretical and practical (...) reasoning is necessary for a man to live well (III). Besides its bearing on ideals of human flourishing, this conclusion would have a crucial bearing on moral issues, were it granted that there is an internal relation between morality and human flourishing (IV). Finally the conclusions of III are sustained against further objections (V). Educational and other practical implications of these conclusions are remarked upon throughout. (shrink)

The last quarter of the twentieth century saw a resurgence of realism in various areas of philosophy, including metaphysics and the philosophy of religion, and this trend has continued in the first decade of the twenty-first century. In philosophy of religion this led to explorations of the philosophical coherence of orthodox doctrines, such as the Christian doctrines of the Trinity and the Incarnation. In metaphysics, there was renewed interest in debates concerning persistence, composition, the relation between mind and body, time (...) and necessity, among others. The purpose of this article is to illustrate the links between these two strands of realist inquiry, focusing on some metaphysical issues raised by the Incarnation. It ends with some suggestions as to how recent developments in metaphysical debate might inform our understanding of this most central of Christian beliefs. (shrink)

This article investigates the essay the Descriptio Silentii (Description of Silence) by Celio Calcagnini, a humanist scholar from Ferrara, an essay written in the early sixteenth century and published in 1544. The article provides the first English translation of the essay, describes its inspiration and sources and reviews the content of the essay in order to assess Calcagnini’s contribution to the philosophy of silence from the Renaissance and before. Calcagnini’s essay is an ekphrasis of a picture supposedly located in the (...) ruins of the Roman temple of Fortuna Primigenia in Praeneste, the inspiration for its format is the late Hellenistic text the Tabula Cebetis, and the principal content is an appeal for the virtues of silence in human affairs and the castigation of the garrulous following the example of Plutarch’s essay De Garrulitate from the Moralia. However, this appeal to the virtues of silence is a prelude to the deeper theme and purpose of the essay: the theme of mystical silence, a silence by which it is possible to approach and understand the god-head and the divine, and which can only be expressed in non-verbal language, riddles or poetic imagery. In the consolidated cases Altitude Express v. Zarda, Bostock v. Clayton County, and R.G. & G.R. Harris Funeral Homes v. EEOC, the Supreme Court will decide whether or not Title VII prohibits discrimination on the basis of sexual orientation or gender identity. Although the parties disagree as to the appropriate formulation of a but-for test to determine whether or not there was a discriminatory outcome, all parties do agree to the use of such a test, which asks “whether the evidence (...) shows ‘treatment of a person in a manner which but for that person’s sex would be different.’” City of Los Angeles, Dep’t. of Water and Power v. Manhart, 435 U.S. 702, 711 (1978). However, but-for tests confuse more than they clarify the inquiry; a discriminatory outcome cannot be explained by appeal to just a discrete characteristic of a particular person. Individuals are not discriminated against because of these characteristics per se. Rather, they are discriminated against because of the social meanings and expectations that attach to these characteristics. Beyoncé and Taylor Swift illustrate the difference between individual-level causation and social explanation in two separate songs, “If I Were a Boy” and “The Man.” The explanation for why the counterfactual ‘male’ Beyoncé and Swift are evaluated differently than their current ‘female’ versions does not lie in individual-level features considered apart from the social world, but in social-level roles and expectations associated with those features. For this reason, a social explanation test—one that asks whether the social meanings of sex characteristics, rather than the characteristics per se, explain the outcome in question—is more suitable for determining whether or not Title VII has been violated. A new field of biomedical ethics is opening up, concerning what should be done to reduce the direct and indirect impacts of greenhouse gas emissions on human health. Some of these impacts could be described as ‘direct’, in the form of fatalities and illnesses due to the increasingly frequent heatwaves in many countries of recent years, ascribable to anthropogenic climate change. Other impacts are mediated through the air pollution that results from emissions from vehicles in the form of a cocktail (...) of carbon oxides including carbon monoxide, nitrogen dioxide and particulates. Most of the world’s cities have streets with unsafe pollution levels, and one child’s death in Britain has been officially ascribed to air pollution (BBC 2020). This presentation aims to validate the above claims about the impacts of emissions on health, and to suggest remedies. The early phasing out of vehicles powered by internal combustion engines is the ultimate remedy for the latter set of impacts, while the urgent replacement of energy generated from fossil-fuel sources with renewable energy is the best way to remediate the former set. More immediate remedies for air pollution include restricting the use of roads and streets in urbanised areas by vehicles to bicycles and light vehicles with small engines. Medical and nursing education should include the diagnosis and treatment of pulmonary conditions resulting from increased levels of carbon oxides, nitrogen oxides and particulates. Medical and nursing practice should focus on the early identification of vulnerable adults and children at risk from air pollution, and warnings against walking, running or cycling along the most polluted thoroughfares. Paul Thompson argues that current synthetic biology amounts to synthetic genomics, comprising a ‘platform’ technology, and that Christopher Preston's deontological objections based on its supposed rejection of the historical process of evolution miscarry. This makes it surprising that Thompson's normative ethic consists in a deontological appeal to Kantian duties of imperfect obligation. Construed as obligations subject to choice, such constraints risk being excessively malleable where the ethical objections to deployment of this technology concern land rights and/or exploitation. Thompson's advocacy of (...) processes ‘more beneficial’ well illustrates another vulnerability; processes more beneficial than ones that undermine livelihoods could be best avoided themselves, although ones more beneficial than the status quo may not. He well argues that non-deontological arguments should not be confined to human survival, but neglects stances that are either biocentric, consequentialist, or both. Yet a truly synthetic bioethics would be likely to embody these characteristics. (shrink)

The book shows the development and continued dominance of the naturalistic position in philosophy. The book also shows the (...) increasing efforts by contemporary philosophers to make a creative use of the history of philosophy in order to engage with contemporary naturalism and to appropriate what is of value in it and in other philosophical traditions in moving forward. The book suggests how various strands of idealism and pragmatism may have much to contribute in formulating alternatives to or enriching philosophical naturalism. (shrink)

Environmental ethics calls into question whether moral obligations invariably arise within relationships and communities, and whether wrong can only be done if some identifiable party is harmed. The aim of this paper is to appraise these assumptions, to argue for negative answers, and to draw appropriate conclusions about the scope of moral standing (or moral considerability). Its findings include the conclusions that our moral obligations (or responsibilities) extend to people and non-human creatures of the foreseeable future, as far as the (...) impacts of present actions and policies can themselves be foreseen, that, that moral standing attaches to the possible people and other living creatures of the future, and (with Derek Parfit) that ethics is to some degree impersonal, being concerned with future quality of life for whoever lives in future centuries, whether they are currently identifiable or not. This in turn requires sustainable forms of social practice and of the human population. Another conclusion is that these findings are compatible with the approach of stewardship which the author has defended elsewhere, since stewardship need neither be anthropocentric nor managerial, and precludes current and future human agents treating the natural world as we please.
