On a version of consent theory that tempts many, predatory sexual relations involving significant power imbalances (e.g. between professors and students, adults and teenagers, or employers and employees) are wrong because they violate consent-centric norms. In particular, the wronged party is said to have been incapable of consenting to the predation, and the sexual wrong is located in the encounter’s nonconsensuality. Although we agree that these are sexual wrongs, we resist the idea that they are always nonconsensual. We argue instead (...) that it is possible for students, teenagers, employees, etc. to fully consent to sexually predatory encounters; denying as much renders survivors of predation vulnerable to compounding harms. Survivors face a dilemma: give up either their understanding of their experience as wrong, or their self-conception as an agent capable of consenting. We call the latter phenomenon agential demotion. AMONG THEOLOGICAL WRITERS, MANY HAVE SUSPECTED THAT JOHN Rawls's writings on justice add up to a de facto manifesto of secularism. His writings especially provoke anxiety about the potential exclusion of theological affirmations from public political discourse. Much of this anxiety focuses on his concept of the "original position" from which principles of justice are negotiated. Consideration of the anxiety provoked by this concept, however, suggests that it is theologically richer than Rawls's critics allow. A turn to Søren Kierkegaard's The (...) Concept of Anxiety enables interpretation of the original position as a device of representation that identifies every individual with the fact of original sin. Crucial to this interpretation is Kierkegaard's description of original sin in terms of anxiety that arises from the innocence that is ignorance in the comparable original position of Adam. Where anxiety arises, sin follows. Where sin arises, the need for justice follows. Reading Rawls and Kierkegaard together consequently offers insight into the relevance of the history of the doctrine of original sin to contemporary theorization of justice. (shrink)

Francis Bacon's reflections on atomism have generally been misunderstood because they have never been systematically studied in relation to the speculative chemical philosophy which he developed in the interval between about 1592 and his death in 1626. This philosophy, in many respects unknown to historians until quite recently, was the only body of positive science which Bacon ever accepted. The speculative philosophy was, on the whole, chemical and non-mechanical, and consequently not consistent with atomist doctrines. In fact, Bacon never at (...) any time accepted the principal atomist tenets. It is therefore necessary to explain why he was interested in atomism at all. Of the several reasons for his interest one is especially important—namely, his belief that the speculative and atomic philosophies had affinities. In particular, he believed that of all the ancient philosophies atomism alone approached the ideals associated with the key notion of ‘subtlety’—ideals represented in their highest form in the speculative philosophy. For most of the twentieth century, anthropologists understood themselves as ethnographers. The art of anthropology was the fieldwork-based description of faraway others—of how social structures secretly organized the living-together of a given society, of how a people had endowed the world surrounding them with cultural meaning. While the poetics and politics of anthropology have changed dramatically over the course of a century, the basic equation of anthropology with ethnography—as well as the definition of the human as a social and cultural (...) being—has remained so evident that the possibility of questioning it occurred to hardly anyone. In After Ethnos Tobias Rees endeavors to decouple anthropology from ethnography—and the human from society and culture—and explores the manifold possibilities of practicing a question-based rather than an answer-based anthropology that emanates from this decoupling. Disclosure in clinical practice is aimed at promoting patient autonomy, usually culminating in patient choice (e.g., to consent to an operation or not, or between different medications). In medical ethics, there is an implicit background assumption that knowing more about (X) automatically translates to greater, or more genuine, autonomy with respect to one's choices involving (X). I challenge this assumption by arguing that in rare cases, withholding information can promote a patient's autonomy (understood as the capacity for rational choice in (...) alignment with one's values and goals). There has never been a time when ‘following the science’ has been more important for humanity. At no other point in history have we had such advanced knowledge and technology at our fingertips, nor had such astonishing capacity to determine the future of our planet. But the decisions we must make on how science is applied belong outside the lab and should be the outcome of wide public debate. For that to happen, science needs to become part of our common (...) culture. Science is not just for scientists: if it were, it could never save us from the multiple crises we face. For science can save us, if its innovations mesh carefully into society and its applications are channelled for the common good. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. On its first appearance in 1960, J.O. Urmson's _Concise encyclopedia of Western philosophy and philosophers_ established itself as a classic. Its contributors included many of the leading philosophers of the English-speaking world: Ryle, Hare, Strawson, Ayer, Dummett, Williams and many others. They wrote with an authority and individuality which made the _Encyclopedia_ into a lively and engaging introduction to philosophy as well as a convenient reference work. For this edition, supervised by Jonathan Rée, the original articles have been revised and (...) updated, and eighty articles by thirty one new authors have been added. The aim of this literature-based study is to explore the influence of socio-cultural factors on business ethics in post-soviet countries with dissimilar cultural contexts. Specifically, this article seeks to identify and compare contextual influences on informal norms of morality in business in transitional post-soviet societies. In order to pursue this investigation, the countries of Belarus and Estonia were identified as being among the most noteworthy examples of culturally different post-soviet countries in transition. The study reveals contradictory manifestations of mixtures of (...) business norms in both Estonia and Belarus, which are conditioned by the merger of an autocratic bureaucratic soviet system with more participative and empowering forms of western management. The most persistent changes relate to moves from patriarchal and paternalistic types of relationship and low work motivation. The significance of these differences, which include nationality and religious legacies, will almost inevitably be overlooked should the countries be placed under the general umbrella of'former soviet states' when considering business ethics in these contexts. Revonsuo makes a provocative and interesting claim: that currently available neurophysiological recording techniques will be unable to discover the neural basis of consciousness in the brain. Although the title refers exclusively to functional brain imaging, Revonsuo considers MEG, EEG, ERP and measurements of firing rate in single cell electrophysiology all in principle incapable of discovering consciousness in the brain. This conclusion is reached by assuming that only one particular type of physical entity constitutes awareness.

This article treats Stalin's contributions todialectical and historical materialism. It argues that the latterfound his theses of the `enormous' role of ideas, and of theexistence of social phenomena that do not belong either to thebasis or to the superstructure, in Georgij Plekhanov's `monism'.Nevertheless, Stalin did add some new points of his own.Furthermore, his adopting Plekhanov's monism also helps usunderstand the apparent contradiction between Stalin's emphasison non-economic and non-class factors in human history and hisrejection of `idealist' rudiments in dialectics.

Widely regarded as the most influential proponent of the truth of original sin in the twentieth century, Reinhold Niebuhr worked hard to excise any "literalistic" element from his interpretation of the doctrine. In his attempt to "correct" the Augustinian tradition on original sin by purging it of all "literalistic errors," however, Niebuhr assumed as his starting point the most characteristically modern objection to the doctrine: that birth is a thoroughly natural, animal, and morally meaningless event. As a result, Niebuhr unnecessarily (...) constrained his vision of the dimensions of human freedom, and hence his description of the dynamic of anxiety and freedom that energizes sin. Through a careful reading of Reinhold Niebuhr's writings on original sin, in light of the truth that the end of human life is inseparable from its origins, a reappraisal and recovery of the meaningfulness of the assertion of original sin as a literal inheritance is possible. The result of such a reappraisal and recovery is an amplified insight into the existential anxiety that Niebuhr otherwise described so convincingly. (shrink)

Professor Hayek'S book is a massive contribution to the persistent question of the limits of state action. It runs counter to prevailing notions about the role of government in economic and social matters to such an extent that a common reaction to its publication has been to simply shrug it off as eccentric or antediluvian. But the rarity of any fundamental discussion of our political ideals and the assumptions of our social policy ought of itself to ensure a wide welcome (...) for a work that constitutes a formidable challenge to accepted standards in this realm. Superficially, citizenship appears relatively simple: a legal status denoting political membership. However, critical citizenship studies scholars suggest that citizenship is first and foremost a political practice. When non-citizens, such as irregularised migrants, constitute themselves as citizens through their actions, irrespective of legal status, these practices of citizenship have transformational potential because they are extra-legal. Yet, there is an ambivalence here: rights-claiming migrants tend to frame their key demands within the terms of the law often by calling for the regularisation of (...) their status. This article addresses this ambivalence by adopting a ‘deconstructive method’ to investigate the legal dimensions of citizenship as sites of theoretical and political intervention. It is argued that practices of rights-claiming by irregularised migrants are important to grasp because they mobilise the paradoxes inherent to the fact that universal rights are enshrined in the constitutional texts of modern citizenship in order to generate new legal meanings and horizons of justice. This hypothesis is explored through a series of illustrative examples of rights-claiming taking place within and beyond the formal confines of legal orders. In so doing, the article sets out a novel conceptual framework for analysing how migrants’ claims to justice strategically negotiate citizenship in its legal form. (shrink)

Drawing on early work on ethical leadership, we argue that when leaders engage in leader moral hypocrisy (i.e., ethical promotion without ethical demonstration), followers can experience psychological reactance—a negative response to a perceived restriction of freedom—which can have negative downstream consequences. In a survey of employee–manager dyads (study 1), we demonstrate that leader moral hypocrisy is positively associated with follower psychological reactance, which increases follower deviance. In two subsequent laboratory experiments, we find similar patterns of results (study 2) and explore (...) potential alternative mechanisms (study 3). We demonstrate in a final experiment with working adults that the relationship between leader moral hypocrisy and psychological reactance is partly explained by increased perceptions of a leader’s use of power (study 4). We discuss the implications of our findings and advocate for further understanding of the risks associated with psychological reactance in response to leaders and other workplace situations. Just Shelter: Gentrification, Integration, Race, and Reconstruction is a work of political philosophy that examines the core injustices of the contemporary U.S. housing crisis and its relation to enduring racial injustices. It posits that what is required to achieve justice in social-spatial arrangements—what is otherwise called “spatial justice”—is to prioritize, in the crafting and enforcement of housing policy, individual moral equality and liberty; distributive justice; equal citizenship; and, due to history and continuing practice and effects of racial discrimination in housing (...) policy and the housing market in the United States, corrective justice in the form of rectification programs to address the history of racism in housing policy that should be implemented by local, state, and federal governments. To arrive at and illustrate this conclusion, it investigates aspects of the housing crisis closely related to the history of American racial injustice, such as gentrification, segregation, desegregation, integration, and, to a lesser extent, homelessness, and offers liberal reform gestures toward a broad view of reconstructive justice.
