The purpose of this paper is to analyse the concept of 'best interest' in order to give nurses, who use it to justify their actions, a clear picture of what this means, and to identify the skills needed for doing so. The process for concept analysis developed by Walker and Avant was used in the analysis of data generated from the literature. Themes were identified from which the defining attributes, antecedents and consequences emerged. The congruence of the findings with (...) current values in nursing, such as promotion of patient autonomy, and the nurse as advocate, are discussed, together with the underpinning ethics theory. The skills needed for nursing practice are identified and recommendations for nurse education are made. (shrink)

Belief is the affirmation of reality, but not all affirmations of reality are beliefs, for if we have, or have had, perceptual experience of a reality, we do not say, “I believe,” but “I see, hear, perceive, or remember.” Similarly, of the realities involved in our inner experience, we say, “What I had in mind, desired, hoped, or felt was…” or else say, more simply, “I was much moved, was in pain, felt affection or hatred, longed for, was thinking about, (...) knew.” On the other hand, there are realities of the perceptual order in which we may express belief, as when we say, “I believe that New Zealand exists, that nitrogen is a gas, that the earth is round, that William the Conqueror crossed the Channel in 1066, that Jesus Christ suffered under Pontius Pilate, was crucified, died, was buried, and rose again.” The realities in which we thus express belief are not realities which we ourselves have observed, but are such that they could have been observed by a person appropriately situated in time and in place. Hence in this case it is not the nature of the realities affirmed that differentiates belief from experience of either the perceptual or the inner type. The difference lies elsewhere. When we affirm a reality of which we ourselves have, or have had, perceptual experience, it is the reality itself, present to our perceiving mind, which alike determines the content of our affirmation and justifies us in making it. The Ismailis, among whom are the followers of the Aga Khan, rose to prominence during the fourth Islamic/tenth Christian century. They developed a remarkably successful intellectual programme to sustain and support their political activities, promoting demands of Islamic doctrine together with the then newly imported sciences from abroad. The high watermark of this intellectual movement is best illustrated in the writings of the Ismaili theoretician Abu Ya´qub al-Sijistani. Using both published and manuscript writings of al-Sijistani that have hitherto been (...) largely hidden, forgotten or ignored, Dr Paul Walker reveals the scholar's major contribution to the development of philosophical Shiism. This article examines whether people share the Gettier intuition (viz. that someone who has a true justified belief that p may nonetheless fail to know that p) in 24 sites, located in 23 countries (counting Hong Kong as a distinct country) and across 17 languages. We also consider the possible influence of gender and personality on this intuition with a very large sample size. Finally, we examine whether the Gettier intuition varies across people as a function of their disposition to (...) engage in “reflective” thinking. (shrink)

In the remainder of this article, we will disarm an important motivation for epistemic contextualism and interest-relative invariantism. We will accomplish this by presenting a stringent test of whether there is a stakes effect on ordinary knowledge ascription. Having shown that, even on a stringent way of testing, stakes fail to impact ordinary knowledge ascription, we will conclude that we should take another look at classical invariantism. Here is how we will proceed. Section 1 lays out some limitations of previous (...) research on stakes. Section 2 presents our study and concludes that there is little evidence for a substantial stakes effect. Section 3 responds to objections. The conclusion clears the way for classical invariantism. In order to be doing something intentionally, must one know that one is doing it? Some philosophers have answered yes. Our aim is to test a version of this knowledge thesis, what we call the Knowledge/awareness Thesis, or KAT. KAT states that an agent is doing something intentionally only if he knows that he is doing it or is aware that he is doing it. Here, using vignettes featuring skilled action and vignettes featuring habitual action, we provide evidence that, in (...) various scenarios, a majority of non-specialists regard agents as intentionally doing things that the agents do not know they are doing and are not aware of doing. This puts pressure on proponents of KAT and leaves it to them to find a way these results can coexist with KAT. (shrink)

Placeholder essentialism is the view that there is a causal essence that holds category members together, though we may not know what the essence is. Sometimes the placeholder can be filled in by scientific essences, such as when we acquire scientific knowledge that the atomic weight of gold is 79. We challenge the view that placeholders are elaborated by scientific essences. On our view, if placeholders are elaborated, they are elaborated Aristotelian essences, a telos. Utilizing the same kinds of experiments (...) used by traditional essentialists—involving superficial change (study 1), transformation of insides (study 2), acquired traits (study 3) and inferences about offspring (study 4)—we find support for the view that essences are elaborated by a telos. And we find evidence (study 5) that teleological essences may generate category judgments. (shrink)

Looking back we often take the Second Vatican Council as the point where change began. However, the seeds of what flowered at the council and have continued to bear (...) fruit after it were planted well before it. The future is not clear, yet we can expect that significant change will be part of it. As we reflect on our changing situation, it would be helpful to keep in mind another comment of Dean Inge: 'There are two kinds of fools: one says, "This is old, therefore it is good"; the other says, "This is new, therefore it is better" '. Does the Ship of Theseus present a genuine puzzle about persistence due to conflicting intuitions based on “continuity of form” and “continuity of matter” pulling in opposite directions? Philosophers are divided. Some claim that it presents a genuine puzzle but disagree over whether there is a solution. Others claim that there is no puzzle at all since the case has an obvious solution. To assess these proposals, we conducted a cross-cultural study involving nearly 3,000 people across twenty-two countries, speaking eighteen (...) different languages. Our results speak against the proposal that there is no puzzle at all and against the proposal that there is a puzzle but one that has no solution. Our results suggest that there are two criteria—“continuity of form” and “continuity of matter”— that constitute our concept of persistence and these two criteria receive different weightings in settling matters concerning persistence. A comprehensive and stimulating study which presents the views of 71 leading theorists on the underlying mechanisms and functions of the primary visual cortex.

It was a novel, among other things, which originated the atomic bomb. H. G. Wells dedicated The World Set Free, published in 1913, to Frederick Soddy, a pioneer in the exploration of radioactivity. Using Soddy’s research as a base, Wells predicted the advent of artificial radioactivity in 1933, the year in which it actually took place; and he foresaw its use for what he named the “atomic bomb.” In Wells’ novel these bombs are used in a world war that erupts (...) in mid-century and is so catastrophic that a world government is formed, initiating a new age powered by the peaceful use of the atom. The physicist Leo Szilard, a long-time admirer of Wells, read this novel in 1932, the year before he first intuited the possibility of a nuclear chain reaction. The novel seems to have become part of his own mental chain reaction. One that took place at an almost unconscious level during the spring that Szilard spent at the Strand Palace Hotel in London, by his own admission doing nothing. He would only monopolize the bath from around nine to twelve in the morning, since “there is no place as good to think as a bathtub.”1 The theories that resulted from this prolonged immersion were introduced by references to Wells; and Szilard, having realized the atomic bomb, spent the rest of his life trying to realize the world government which, in the Wells novel, was its consequence.Literature, which was part of the genesis of nuclear weaponry, continues to be an inextricable aspect of its nature. For Derrida, in fact, we are facinga phenomenon whose essential feature is that of being fabulously textual, through and through. Nuclear weaponry depends, more than any weaponry in the past, it seems, upon structures of information and communication, structures of language, including non-vocalizable language, structures of codes and graphic decoding. But the phenomenon if fabulously textual also to the extent that, at the moment, a nuclear war has not taken place: one can only talk and write about it.2The linguistic nature of the arms race, of peace talks and negotiations, has been thoroughly analyzed. Likewise there is a growing number of books on the nature of nuclear war. But there is also a growing body of novels, poems, and plays making up a literature of nuclear holocaust. As the example of Wells’ novel shows, this is not altogether unprecedented; nuclear literature predates Hiroshima. But the subject of nuclear war has, up till now, mainly served the purposes of science fiction; only rarely—as in the cases of A Canticle for Leibowitz and On the Beach—have science fiction authors risen above the lowest common denominator of that genre. In the 1980s, every year sees the publication of works which demand serious attention both as literature and as fictive strategies for comprehending a subject that is commonly called “unthinkable.” Russell Hoban’s Riddley Walker, Bernard Malamud’s God’s Grace, Maggie Gee’s The Burning Book, Tim O’Brien’s Nuclear Age—these works explicitly preoccupied with nuclear holocaust may be supplemented by other works of the eighties with a persistent apocalyptic undertone, works such as Doris Lessing’s Canopus in Argos series, Umberto Eco’s Name of the Rose, and Mario Vargas Llosa’s War of the End of the World. And these are only the literary manifestations of a widespread movement in all the arts aimed at expressing the dominant condition of our time.3 1. Early intervention aims to identify children or families at risk of poor health, and take preventative measures at an early stage, when intervention is more likely to succeed. EI is concerned with the just distribution of “life chances,” so that all children are given fair opportunity to realize their potential and lead a good life; EI policy design, therefore, invokes ethical questions about the balance of responsibilities between the state, society, and individuals in addressing inequalities. We analyze a corpus of (...) EI policy guidance to investigate explicit and implicit ethical arguments about who should be held morally responsible for safeguarding child health and well-being. We examine the implications of these claims and explore what it would mean to put the proposed policies into practice. We conclude with some remarks about the useful role that philosophical analysis can play in EI policy development. (shrink)

Background Ethical and scientific principles require that clinical trials address an important question and have the resources needed to complete the study. However, there are no clear standards for review that would ensure that these principles are upheld.Methods We conducted semi-structured interviews with a convenience sample of nineteen experts in clinical trial design, conduct, and/or oversight to elucidate current practice and identify areas of need with respect to ensuring the scientific value and feasibility of clinical trials prior to initiation and (...) while ongoing. We used a priori and grounded theory to analyze the data and constant comparative method to induce higher order themes.Results Interviewees perceived determination of scientific value as the responsibility of the investigator and, secondarily, other parties who review or oversee research. Interviewees reported that ongoing trials are rarely reevaluated due to emerging evidence from external sources, evaluation is complex, and there would be value in the development of standards for monitoring and evaluating evidence systematically. Investigators, IRBs, and/or data monitoring committees (DMCs) could undertake these responsibilities. Feasibility assessments are performed but are typically inadequate; potential solutions are unclear.Conclusions There are three domains where current approaches are suboptimal and in which further guidance is needed. First, who has the responsibility for conducting scientific review, whether it be the investigator, IRB, and/or DMC is often unclear. Second, the standards for scientific review (e.g., appropriate search terms, data sources, and analytic plan) should be defined. Third, guidance is needed on the evaluation of ongoing studies in light of potentially new and evolving evidence, with particular reference to evidence from outside the trial itself. (shrink)

on writing prescriptions.[2] These two reasons indicate why there are obvious repercussions for those who do not have reasonable access to physicians’ services. Of course, the word ‘reasonable’ is important here. After all, there is the old joke—for those who enjoy gallows humor—that the U.S. has universal access to healthcare so long as one is willing to commit a crime to see the county jail’s physician, or make one’s self sick enough to qualify for emergency services. Putting aside such extraordinary (...) measures, at least some deficit in accessing physicians’ services can be made up through consulting written medical knowledge. Many libraries have medical textbooks, and the Internet has many good sites that contain medical knowledge. Of course, all the knowledge in the world is not going to do much good if treatment requires a prescription. The physicians’ monopoly on writing prescriptions means that nothing (legal[3]) can be done in terms of treatment if one does not have access to the services of a qualified physician. This state of affairs is unjust. A just society cannot have it both ways: legislation cannot say both that the expertise of physicians is so precious that only they can prescribe medicine AND not everyone is guaranteed reasonable access to their services. If there is no guarantee of reasonable access then physicians should not have a monopoly on writing prescriptions, and if there is a monopoly on writing prescriptions then people should have reasonable access to their services. In this paper I attempt to trace some entanglements of an event documented in my PhD research, which contests dominant modes of enquiry. This research takes place with a group of Grade 2 learners in a government school in Cape Town, South Africa. It is experimental research which resists the human subject as the most important aspect of research, the only one with agency or intentionality. In particular, the analysis focuses on the process of the making of the circle, and (...) how integral it is in contributing to building the Community of Enquiry, the pedagogy of Philosophy with Children. A critical posthuman analysis is offered which engages with the material-discursive entanglements of the making of the circle. Also, how this making of a circle can be a democratising practice, by including in the concept of democracy, the more-than-human. The analysis also focuses on the placing of the chairs by the children, as a deliberate pedagogical practice, and how this works to disrupt the adult /child binary. There is a move beyond the linguistic turn by paying attention to not only the discursive in the transcriptions but also the intra-actions in between human and more-than-human, the circle, the chairs and the materiality of place. By scholarly consensus, extant fragments from, and testimony about, Aristotle’s lost dialogue Eudemus provide strong evidence for thinking that Aristotle at some point defended the human soul’s unqualified immortality (either in whole or in part). I reject this consensus and develop an alternative, deflationary, speculative, but textually supported proposal to explain why Aristotle might have written a dialogue featuring arguments for the soul’s unqualified immortality. Instead of defending unqualified immortality as a doctrine, I argue, the Eudemus was most likely offering (...) a dramatically engaging propaedeutic to the sort of philosophical inquiry about the soul and its prospects that Aristotle pursues more scientifically in the De anima and Parva naturalia. This reappraisal of the geographical aspects of philosopher Herbert Marcuse’s theories finds fresh meanings and contemporary applications in his work. The book reveals what they tell us about space and politics today, how they can interpret modern geopolitics and provide the tools to overturn the status quo.

Purpose: We sought to examine the ethical, legal, and social implications (ELSI) literature research and scholarship types, topics, and contributing community fields of training as a first step to charting the broader ELSI community’s future priorities and goals. Methods: We categorized 642 articles and book chapters meeting inclusion criteria for content in both human genetics or genomics and ethics or ELSI during a 5-year period (2003–2008) according to research and scholarship types, topics, and the area of advanced training of the (...) first-listed author. Research and scholarship type categories were developed and characterized through in-depth review of 95 randomly sampled publications from the larger group. Results: There is a single dominant approach to ELSI, which focuses on ethical and other social issues “downstream” of advances in genomics, the contributors to which predominately have advanced training in medicine or science fields other than social science. A comparatively low percentage of publications primarily offer policy recommendations, and these are much more likely to be written by those with advanced training in law than is the case for the literature as a whole. Social science studies predominately employ qualitative methods and vary significantly with respect to the extent and types of recommendations offered. Two further types of ELSI research and scholarship offer alternative models for so-called “normative” work in this field. Conclusion: Considering topics, training, and types of ELSI research and scholarship from the most recent past allows for a baseline perspective that is sorely needed in charting this field’s future course. We must critically rethink race and genetics in the context of the new genetic breakthroughs and haplotype mapping. We must avoid the slippery slope of turning socially constructed racial categories into genetic realities. It is a potentially dangerous arena given the history of racialized science in the United States and globally. Indeed, the new advances must be viewed in the context of a long history of racial inequality, continuing into the current period. This is more than a question of how (...) carefully we use categories of analysis such as race. Justice and equity must be core to our considerations. There is a community stake in this work that must be seriously considered and included in decision making. A progressive and critical analysis is in order. (shrink)

This thesis argues for the continuing possibility of Adorno set against the backdrop of a post-modern proliferation of affects. A major theoretical contention is the concept of the subject: a sticking point within philosophy. The thesis takes this up and offers a new pathway without falling into the cliché of a renewal of Adorno’s position. Drawing on Adorno’s theoretical thoughts on the subject the thesis contends that the subject is that which by turns dissolves all eventualities or more proportionally acts (...) like a place-holder for the newly emerging: structures that cannot be explained by recourse to the laws that govern its parts. These experiential structures present a surface, resistance, or solidarity that upon closer examination dissolve back into the ephemeral. Although such structures are profligate and prolific, the thesis adopts as its major concern artworks and aesthetics. Following Adorno, a claim is made for artworks that present open-ended possibilities. They are able for example to critically challenge the dominant hegemony the profundity that all too easily sides with the oppressors of life. What philosophy, a critical tool in furtherance of the good life, a concept restaged, here takes from art is not a sense of equivalence, art and philosophy are held apart in a creative and critical tension, but the sense of yearning that animates the nonconceptual side of art which the concept negates. The yearning, being experiential, is always embodied. Its fulfilment negates the immediacies, the mere appearance of life, particularly in its systematically reflexive form. The conclusion concurs with Adorno in the thought that affinity with the object is achieved not as the resultant of identity thinking, but through the act of definite negation of identifying schema.
