A collection of 22 interviews and one personal essay, _Julia Kristeva Interviews_ presents an intimate and accessible portrait of one of France's most important critical thinkers and intellectual personalities.

In the summer of 2008, the Spanish legislature resolved to grant great apes (though not all simians) basic human rights. While the decision to grant such rights came about largely through the lobbying efforts of the Great Ape Project (GAP), the decision has potential reverberations throughout the scientific world and beyond in its implications for shaping determinations of “what is human.” Such implications do not appear to be lost on various groupings of scientists who have spoken about their opinions about (...) the case and the project in general. These groupings of scientists, I argue, using the work of Mary Douglas and others, can be compared to “tribes” actively advancing and defending their classifications of the “human” in a bid for a retention or expansion of power. Patients have received experimental pharmaceuticals outside of clinical trials for decades. There are no industry-wide best practices, and many companies that have granted compassionate use, or ‘preapproval’, access to their investigational products have done so without fanfare and without divulging the process or grounds on which decisions were made. The number of compassionate use requests has increased over time. Driving the demand are new treatments for serious unmet medical needs; patient advocacy groups pressing for access to emerging treatments; internet platforms (...) enabling broad awareness of compelling cases or novel drugs and a lack of trust among some that the pharmaceutical industry and/or the FDA have patients’ best interests in mind. High-profile cases in the media have highlighted the gap between patient expectations for compassionate use and company utilisation of fair processes to adjudicate requests. With many pharmaceutical manufacturers, patient groups, healthcare providers and policy analysts unhappy with the inequities of the status quo, fairer and more ethical management of compassionate use requests was needed. This paper reports on a novel collaboration between a pharmaceutical company and an academic medical ethics department that led to the formation of the Compassionate Use Advisory Committee. Comprising medical experts, bioethicists and patient representatives, CompAC established an ethical framework for the allocation of a scarce investigational oncology agent to single patients requesting non-trial access. This is the first account of how the committee was formed and how it built an ethical framework and put it into practice. (shrink)

In this paper I chart the seismic shift that has occurred over the past three decades in attitudes towards the interpretation of visual images. My strategy implies the argument that the reading of visual images would appear to be an inevitability given the accelerating change of attitudes towards pictures as containers of determinate knowledge. French critical theorists (Foucault, Barthes, Derrida et. al.) dominated debate on interpretation of text and image in the 1980s, where my survey begins. Michel Foucault dismissed the (...) image (in Madness and Civilization 1959/1988) as a fascinating site for the madness of dreams but one standing outside of reasoned interpretation because of an inherent excess of meaning and deeply hidden attributes and allusions. Generally, however, when images were discussed using identifiable interpretive strategies in the 1980s the framework was a variant of semiotic analysis (Marin, Eco and Barthes – who famously, diverges from this mode in Camera Lucida). I use W. J. T. Mitchell’s Iconology: Image, Text, Ideology 1986 as a focal text from the 1980s and follow this with two of his publications on images, one from 1995 and another from 2005 to demonstrate the dramatic shift in the approach to pictures across almost three decades. Around these focal texts by Mitchell I reference other texts and trends that culminate in the more recent proliferation of texts related to visual studies and the re-emergence of aesthetics. Faith in this proposition is what motivates many of us to teach. But, alas...Allison Mitchell's argument for rethinking addiction intervention—in particular, rethinking twelve-step programs—is premised on this proposition. According to her argument, addicts function with an impoverished sense of self that is reflective of a grossly simplified form of philosophical materialism. By recognizing the limitations of this philosophically unconvincing view, and by, in effect, accepting a better, more complete materialism, addicts can come to modify their self-conception. This modification is instrumental to recovery.A careful consideration of the chain of events being proposed, and the problems with it, is helpful for understanding the limitations of her argument. There are four points that I consider in turn: (1) considering narratives can tell us something about the self-conception of addicts, (2) philosophical materialism can help us to understand and explain something about an addict's self-conception and how it is inadequate, (3) this sense of self is distinct from nonusers and the way in which it is distinct helps to understand the problem of addiction, and (4) a change in self-conception with respect to materialism helps recovery and, thus, our best intervention is one based on having addicts accept a full materialist theory of the self and not a pretheoretic one. [End Page 227]With respect to the first point, it should be noted that Mitchell's overall argument does not depend on whether or not it is true that narratives of addiction tell us something veridical about the self-conception of addicts. Such narratives may simply provide us with a potential theory—a possible worlds scenario—of how addicts conceive of themselves. Mitchell points this out herself. The narratives and the interpretation that she provides of these narrative, "are meant only to highlight a certain pattern of self-expression and conception that may in fact be common in persons who use mind-altering substances; the readings do not establish any empirical matters of fact or philosophical truths, nor do they prove any conclusions about how such persons (must) express themselves or conceive their nature" (Mitchell 2006, 214).Thus, what the argument is actually concerned with are the theoretical claims about the self-conception of addicts that are garnered from these narratives. The development of her position involves the following representative moves: In the first stage of her discussion, she highlights the possible presence of an implicit, untested, and potentially false proposition (...) underlying my general argument, namely, that proper theorizing about ourselves and the world may provoke changes in our beliefs and any behaviors based on them. In the second stage of her project, she expresses a paradigmatically analytic mode of skepticism; this doubt concerns a "chain of events" implicit in the development of my position, and it takes the form of a set of questions that bear a strong family resemblance. First, Ross questions the very possibility or intelligibility of using fictional discourse and philosophical theory to explore the ways in which addicts conceive of themselves and their circumstances. Next, Ross turns to a more psychological (and intellectually profitable) line of questioning: Do people struggling with drug abuse and addiction have similar self-conceptions that, moreover, are meaningfully distinct from those expressed by nonusers? Ross and I agree on two absolutely central concerns: First, her description of the proper significance of the language under study is perfectly apt, if ultimately irrelevant as a criticism of my work. Of course, I concede the obvious point that the narratives I consider are not perfectly veridical, reliable, or honest. Yet far from being a problem, these rhetorical features make the narratives appropriate and fruitful objects of study. Through the use of philosophical tools and literary-critical practice, I seek primarily to develop an understanding of the ways in which addicts portray their subjectively informed, culturally conditioned, and selectively edited self-observations. With the recent deaths of both Jean Baudrillard and Jacques Derrida, it is an opportune moment to consider their respective contributions to social and cultural theory. The purpose of this article is not to establish an unbridgeable gap which allows no communication between Baudrillard and Derrida's thought. Rather, I will argue that there is an underlying assumption which brings them into close proximity: the idea that the dialectical order of the social, and its relationship to human mortality, has been radically (...) altered by the media-technological systems through which `the real' is represented. Baudrillard's concept of simulation attempts to show how the mass media have become the exclusive condition through which the social is staged, and that there is nothing outside of their operational logics (including the performance of political responsibility and the temporality of history). Derrida's conception of the spectre, on the contrary, presents a `quasi-messianic' figure which haunts the system of simulation; it is s/he who arrives through the intensification of social performativity which Baudrillard understands as completely self-referential. My aim is to show that the most political way of approaching Baudrillard is to read him as a kind of `evil genius' of simulation; as a provocation to acknowledge the spectral bodies who hover between life and death within the system of the hyperreal. The purpose of the article is to evaluate the ethical and political conclusions that Ulrich Beck draws from his account of ‘civilization risks’. I have argued that the categories of ‘life’, ‘the organic’, and the ‘technological’ which are presented in Risk Society, presuppose a certain metaphysics of ‘natural’ human identity; and that it is the inscription of this identity in the politics of risk administration which opens the possibility of an absolutely legitimized regulation of nature, humanity, and society. Thus, in (...) order to evaluate the ‘risk’ entailed in the ethical and political strictures of Beck's ‘world risk society’, I have had recourse to the expositions of time, presence, identity and technology which Derrida has given in Of Grammatology and Specters of Marx. It is through these expositions that I have tried to work through the idea of an ecological politics that would remain sensitive to the events of difference and alterity precipitated by its own ‘cosmopolitan’ interventions. Sacrifice haunts the Phaedo. In this article, I argue that the mise-en-scène of the death scene of the Phaedo, as well as other sacrificial elements in the background of the dialogue, creates a nexus that positively integrates the birth, philosophical practice, and death of Socrates into the ritualized rhythm of the life of the city of Athens. A close reading of the death scene presented as a synopsis with Walter Burkert’s well-known analysis of Greek sacrifice reveals convergences and divergences between (...) the Phaedo and Greek sacrificial practice. Socrates appears as a willing victim who accepts the city’s sacrificial practice while remaining on his own terms. (shrink)

This essay reflects on arguments by Paul Ramsey, in The Patient as Person: Explorations in Medical Ethics (1970) and elsewhere, that continue to challenge policy‐makers and those doing clinical and translational research involving children. Ramsey argued that parents cannot morally authorize their child's participation in research unless the research is designed to benefit the child. He acknowledged that abiding by this position could have adverse impacts on improving child health, and he concluded, in a 1976 Hastings Center Report piece, that (...) researchers must “sin bravely.” Many philosophers and theologians, including Richard McCormick, have argued against Ramsey. The Ramsey‐McCormick debate played out in the bioethics literature and, by invitation, at the deliberations of the National Commission for the Protection of Human Subjects of Biomedical and Behavioral Research, which was tasked with developing an ethics framework and policies for human subjects protections. Although in its final recommendations, the commission sided with McCormick, the strict limitations on risks and harms to which a child can be exposed were clearly influenced by Ramsey. (shrink)

Healthcare decision making for children has adopted the best interest of the child standard, a principle originally employed by judges to adjudicate child placement in the case of parental death, divorce, or incompetence. Philosophers and medical ethicists have argued whether the best interest principle is a guidance principle (informing parents on how they should make healthcare decisions for their child), an intervention principle (deciding the limits of parental autonomy in healthcare decision making), or both. Those who defend it as only (...) a guidance principle often cite the harm principle as the appropriate intervention principle. In this article, I challenge current use of the best interest principle in pediatric decision making as a guidance principle and as an intervention principle. I propose a model that I call constrained parental autonomy, which focuses on promoting and protecting the child’s primary goods or basic needs. I show that constrained parental autonomy can serve as both a guidance principle and an intervention principle in making decisions. I conclude by examining a case study involving bone marrow donation by a young child to her sister. (shrink)

This article outlines current safe harbors in the law for healthcare practitioners who work in a disaster setting. It reviews available legal protection in crisis situations with respect to the Emergency Medical Treatment and Labor Act (EMTALA), criminal liability, and licensure.

ABSTRACT Although environmental and eco-centric efforts have been made in education, the sphere of influence and cogency of these efforts is limited by their anthropocentric framing of the environment. In order to subvert anthropocentric ideals, it is necessary to reposition humans in relation to other living and non-living forms. This study examines the anthropocentric tendencies perpetuated in environmental education efforts. The impetus of this work is to locate specific moments wherein human dominion is invoked within educational efforts that purportedly champion (...) environmentalism. I analyze the nature-based learning movement in particular, and illuminate these anthropocentric tendencies using critical discourse analysis. I take up variations of thematic, structural, and semiotic analyses in order to reveal how the environment is framed within a nature-based learning professional development webinar. This research poses implications for environmental educators broadly, nature-based learning instructors specifically, and researchers of posthumanist education as well. (shrink)
