This article is concerned with developing a philosophical approach to a number of significant changes to academic publishing, and specifically the global journal knowledge system wrought by a range of new digital technologies that herald the third age of the journal as an electronic, interactive and mixed-media form of scientific communication. The paper emerges from an Editors' Collective, a small New Zealand-based organisation comprised of editors and reviewers of academic journals mostly in the fields of education and philosophy. The recent interest in wisdom in professional health care practice is explored in this article. Key features of wisdom are identified via consideration of certain classical, ancient and modern sources. Common themes are discussed in terms of their contribution to ‘clinical wisdom’ itself and this is reviewed against the nature of contemporary nursing education. The distinctive features of wisdom (recognition of contextual factors, the place of the person and timeliness) may enable their significance for practice to be promoted in more (...) coherent ways in nursing education. Wisdom as practical knowledge (phronesis) is offered as a complementary perspective within the educational preparation and practice of students of nursing. Certain limitations within contemporary UK nursing education are identified that may inhibit development of clinical wisdom. These are: the modularization of programmes in higher education institutions, the division of pastoral and academic support and the relationship between theory and practice. (shrink)

This article examines the excitement that Adam Smith's Theory of Moral Sentiments generated in France during the French Revolution, focusing particularly on the writings of political theorists, participants and commentators such as the abbé Sieyès, Pierre-Louis Rœderer, the Marquis de Condorcet and Sophie de Grouchy Condorcet, who were dismayed at their political opponents’ use of Rousseau, and looked to Smith for an understanding of the passions that was compatible with democratic sovereignty and representative government. My hope has been to persuade readers that Hobbes's mighty thought experiment of the state of nature distorts our conceptual learning because it ignores the second morality. Instead, it inflates the first morality as the whole of morality. This inflation arises from Hobbes's exclusive preoccupation with universalizable reason. As important as universal reason undeniably is, it does not encompass the whole of moral reality. To suppose that it does is to distort moral reality. Like so many Enlightenment figures, Hobbes would (...) have political theory be more like logic than life.To refer once again to the Enlightenment allows me to observe that the drive to universality through reason is a distinctive feature of European civilization. To proceed along this line might lead to the conclusion that the pursuit of the universal is a cultural artifact. It is itself culturally relative. I am in no position to argue that point here at the end of the day, but did not the universal criteria propounded by the Enlightenment prove serviceable in the justification of European imperialism? By the universal standards of the Enlightenment only Europe was civilized.Reason is often a weapon. Alasdair MacIntyre has termed the search for rationality in moral philosophy a masquerade. MacIntyre sees the quest for rationality to be a quest for authority. They attack. The inexperienced hunters are enthusiastic. The seasoned hunters take their time. The quarry defends. An arbitrary time limit ends the combat, and after tea it is someone else's turn. Can anyone say that this is the best way to search out alternatives, weigh experience, assess implications, evaluate assertions? My title “The Government of Reason” is deliberately ambiguous. On the one hand it might mean governing according to the light of reason. This was, of course, the avowed aim of the Enlightenment. The conduct of political life would follow the bright line of reason. On the other hand, the title could mean governing reason, taking control of reason and using it as a weapon. Here we may be forgiven for thinking of Michel Foucault on the use of knowledge as power. The ambiguity of the title is meant to reflect the ambiguity of reality where both alternatives have occurred. Only half of the moral realm has been made the subject of political theory. (shrink)

Since the U.S. Supreme Court's decision in Dobbs vs. Jackson Women's Health Organization, a growing web of state laws restricts access to abortion. Here we consider how, ethically, doctors should respond when terminating a pregnancy is clinically indicated but state law imposes restrictions on doing so. We offer a typology of cases in which the dilemma emerges and a brief sketch of the current state of legal prohibitions against providing such care. We examine the issue from the standpoints of (...) conscience, professional ethics, and civil disobedience and conclude that it is almost always morally permissible and praiseworthy to break the law and that, in a subset of cases, it is morally obligatory to do so. We further argue that health care institutions that employ or credential physicians to provide reproductive health care have an ethical duty to provide a basic suite of practical supports for them as they work to ethically resolve the dilemmas before them. In light of Ruth Wilson Gilmore’s call that abolition means to “change everything,” how might we understand an abolitionist literary method? An abolitionist literary method dials into the language of critiquing prisons. This essay contends that recent developments in U.S. discourse concerning prison reform and prison abolition rely on the distinction between metaphor and metonymy. As rhetorical tropes, metaphor and metonymy both operate by means of figurative language. Metaphor creates a parallel formation between terms, popular in prison reformist language (...) (i.e. “prison as labor,” “prison as slavery,” “schools as prisons,” or “black holes as prisons”), while metonymy demonstrates a network between materially related sites, persons, and objects (as in “flesh,” “black holes,” or “the Prison Industrial Complex”) more central to the rhetoric of prison abolition. Following Emily Apter’s critique of Fredric Jameson’s “carceral metaphors,” I demonstrate these distinctions between metaphor-reform and metonymy-abolition through textual analysis of a Black feminist archive by considering the work of Ruth Wilson Gilmore, Hortense Spillers, Saidiya Hartman, George Jackson, Evelynn Hammonds, and Assata Shakur. These different thinkers employ metonymy to illuminate theoretical possibilities for abolition through economics, flesh, motherhood, intimacy, sexuality, and physics over a period of thirty years. That being said, none of these writers define their work by the principal status given to metonymy, and this essay seeks to bring together their interventions through this rhetorical trope. I propose that abolition’s stretch through metonymy is central to an abolitionist literary method, provoking the animated reconsideration of language-use by scholars and activists. While not eliding metaphor entirely, this historical materialist work demonstrates that the careful elaboration of words and phrases becomes more robustly anti-carceral when one indexes where, how, and why metaphor and metonymy contract or extend imaginative political possibility. Argument is a pervasive feature of human interaction, and in its natural contexts of occurrence, it is organized around the management of disagreement. Since disagreement can occur around any kind of speech act whatsoever, not all arguments involve a claim supported by reasons; many involve standpoints attributed to someone but claimed by no one. And although truth and validity are often at issue in naturally occurring arguments, these do not exhaust the standards to which arguers are held. Arguers hold one (...) another accountable for cooperating in the management of disagreement, infusing argumentation with a natural normativity that exists apart from any theorized appraisal standard applied to the claim-reason relationship. Argumentation’s natural normativity is visible not only in how arguments unfold in interaction but also in how humanity continuously strives to improve its methods of disagreement management. Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

Correctly understood, teleosemantics is the claim that “representation” is a function term. Things are called “representations” if they have a certain kind of function or telos and perform it in a certain kind of way. This claim is supported with a discussion and proposals about the function of a representation and of how representations perform that function. These proposals have been retrieved by putting together current descriptions from the literature on neural representations with earlier explorations of the features common to (...) most things we are inclined to call representations as these were assessed in Millikan. Of interest is the degree to which these independent sources converge. I conclude that there is no need to employ any new or technical sense of the term “representation” for it to play an important role in neuroscience. (shrink)

On 26 February 2020, the German Constitutional Court rejected a law from 2015 that prohibited any form of ‘business-like’ assisted suicide as unconstitutional. The landmark ruling of the highest federal court emphasised the high priority given to the rights of autonomy and free personal development, both of which constitute the principle of human dignity, the first principle of the German constitution. The ruling echoes particularities of post-war Germany’s end-of-life debate focusing on patient self-determination while rejecting any discussion of active assistance (...) to die through a lethal injection administered by a doctor. While Statius' decision to treat events in landlocked Thebes offered limited opportunity to integrate into his poem a maritime episode, which had become a staple epic ingredient by the first centurya.d.,theThebaidis dotted with references to the Argonauts' quest for the Golden Fleece, including a narrative flashback of the crew's time at Lemnos (Theb. 5.335–498). Following in a long tradition of cross-contamination between Argonautic and Theban literary texts (as shown by, for example, the ApollonianArgonautica's use of Antimachus'Thebaid), Statius' poem also evokes (...) works of literature which narrate the legend, notably theArgonauticasof Apollonius Rhodius and Valerius Flaccus. A lack of scholarly focus on this latter area has generally led to a piecemeal scrutiny of individual allusive passages rather than a systematic treatment. However, Stover's recent paper paves the way for a more productive approach through its contention that theThebaidmakes widespread use of the mythic subject matter: ‘It … appears that Statius frequently appropriates the Argonautic tradition and that he does so largely to present the Argives as quasi Argonauts. This paper compares ethics in countries with different cultural dimensions based on empirical data from 12 countries. The results indicate that dimensions of national culture could serve as predictors of the ethical standards desired in a specific society. The author divided societal cultural practices into desired and undesired practices. According to this study, ethics could be seen as the means for achieving a desired state in a society: for reducing some societal characteristics and increasing others. Finally, a model of the (...) impact of cultural dimensions on desired ethical standards is proposed. (shrink)

In this 60th anniversary of Business & Society essay, we seek to make three main contributions at the intersection of governance and artificial intelligence. First, we aim to illuminate some of the deeper social, legal, organizational, and democratic challenges of rising AI adoption and resulting algorithmic power by reviewing AI research through a governance lens. Second, we propose an AI governance framework that aims to better assess AI challenges as well as how different governance modalities can support AI. At the (...) heart of our framework lies the governance forces that apply to institutions, organizations, and individuals, who ultimately provide, regulate, and use AI decision-making. We discuss how businesses may harness AI’s economic power through governance solutions without creating or amplifying societal biases and inequalities. Third, as part of our section on future research, we identify a set of governance trade-offs in AI adoption, suggest future research avenues to conceptually strengthen research on the governance of AI, and lay out key policy recommendations. Since the last issue of Feminist Legal Studies, we editorial board members have had lots of conversations about comfort, displacement and alienation. As we developed the programme for #FLaK2016 we thought about it as a kind of pulling ourselves out of our comfort zone, if academic events and journals ever have a comfort zone. Drawing on a mix of feminist live performance methods and a science and technology studies-type curiosity for objects of experimentation, we tried out a kitchen table method (...) of hosting a live research conversation with activists, artists and academics over two days. But we had not fully anticipated the way that the Brexit result would contribute to and complicate discomfort. A fuller analysis of FLaK awaits a later moment, but here we pick out this one aspect of our gathering—feelings of discomfort – as they animate the contributions to this issue in interesting ways. ABSTRACT This paper examines a relationship between heresy and utopianism forged in nineteenth- and early twentieth-century socialist histories to reveal a significant, pervasive fault-line in the ideological construction of anarchism. It first looks at Marxist narratives which trace the lineages of socialism back to medieval religious dissent and argues that a sympathetic assessment of European heretical movements was qualified by a critique of utopianism, understood as the rejection of materialist ‘science’. It then argues that strands of this narrative have been (...) woven into anarchism, looking at three examples: E.V. Zenker’s Anarchism (1897), James Joll’s The Anarchists (1964/1979) and Saul Newman’s From Bakunin to Lacan (2001). The dominant theme is that anarchism promises the transformation of corrupted nature and aims to achieve it though ecstatic violence, cataclysmic revolution and future perfection. Although this Millenarian anarchism is a ‘straw man’, rather than jettison ‘heresy’ as an investigative tool, I prefer an alternative conception of heresy derived from Martin Buber’s analysis of utopianism in Paths in Utopia (1949) and Michael Bakunin’s critique of political theology. I relate utopianism to the rejection of perfection and heresy with faith. By reframing of heresy in this way I seek to correct a long-standing distortion of anarchist ideas. (shrink)

How we experience space by listening: the concepts of aural architecture, with examples ranging from Gothic cathedrals to surround sound home theater. We experience spaces not only by seeing but also by listening. We can navigate a room in the dark, and "hear" the emptiness of a house without furniture. Our experience of music in a concert hall depends on whether we sit in the front row or under the balcony. The unique acoustics of religious spaces acquire symbolic meaning. Social (...) relationships are strongly influenced by the way that space changes sound. In Spaces Speak, Are You Listening?, Barry Blesser and Linda-Ruth Salter examine auditory spatial awareness: experiencing space by attentive listening. Every environment has an aural architecture.The audible attributes of physical space have always contributed to the fabric of human culture, as demonstrated by prehistoric multimedia cave paintings, classical Greek open-air theaters, Gothic cathedrals, acoustic geography of French villages, modern music reproduction, and virtual spaces in home theaters. Auditory spatial awareness is a prism that reveals a culture's attitudes toward hearing and space. Some listeners can learn to "see" objects with their ears, but even without training, we can all hear spatial geometry such as an open door or low ceiling. Integrating contributions from a wide range of disciplines—including architecture, music, acoustics, evolution, anthropology, cognitive psychology, audio engineering, and many others—Spaces Speak, Are You Listening? establishes the concepts and language of aural architecture. These concepts provide an interdisciplinary guide for anyone interested in gaining a better understanding of how space enhances our well-being. What does it mean to say that ethics committees that provide prospective review of research involving human beings should be “independent”? In the United States, IRBs—which are typically located within and review research protocols at the institution for which most of their members work—cannot really be considered independent. Yet separating the IRB from the research institution may in turn mean less independence from a trial’s sponsors, as this kind of IRB is commercially motivated and paid directly by the sponsor. One (...) possible answer is to create independent IRBs that are not for profit, but how this model would attract financial and administrative support is unclear. (shrink)

PurposeThe purpose of this paper is to contribute to the literature on age and the digital divide by examining the uses of and attitudes toward information and communication technologies by 26 politically senior citizens.Design/methodology/approachThe approach taken involved in‐depth face‐to‐face interviews.FindingsThe majority of the respondents are informed and balanced cyber‐enthusiasts who have embraced the opportunities afforded by ICTs to enhance their lives in general, including their political activities.Originality/valueThese findings destabilize the dominant image of older people and their attitudes to and experiences (...) of ICTs that appears in most of the literature on age and the digital divide. Those aged 65 and over represent the last cohort, in Western societies at least, for whom age as such is likely to be a decisive factor in their relationship to ICTs. For Tarski talk about the truth in a language, and not generate contradictions, it requires doing it from a different language with greater expressive power: the metalanguage. So, a metalanguage is a language that is used to talk about another language. In scientific language this distinction is very important. In physics, the notion of symmetry is shown through the language used within physical theories. In this way, through algebraic language ─automorphism─ we shown the symmetry ─invariancia, order, equilibrium─ finding (within the (...) language of these theories) the use of the notion sometimes as a principle and sometimes as argument. The distinction in use of the notion of symmetry, on the part of physics, allows us to glimpse symmetry as a term of the metalanguage. Through a brief historical reconstruction ─from the Greeks to present time─ we show the notion of symmetry as a metalanguage term distinguishing the use ─principle and argument─ that physics makes of the concept.
