Ten countries have established quotas for female representation on publicly traded corporate and/or state-owned enterprise boards of directors, ranging from 33 to 50 %, with various sanctions. Fifteen other countries have introduced non-binding gender quotas in their corporate governance codes enforcing a “comply or explain” principle. Countless other countries’ leaders and policy groups are in the process of debating, developing, and approving legislation around gender quotas in boards. Taken together, gender quota legislation significantly impacts the composition of boards of directors (...) and thus the strategic direction of these publicly traded and state-owned enterprises. This article outlines an integrated model of three institutional factors that explain the establishment of board of directors gender quota legislation based on the premise that the country’s institutional environment co-evolves with gender corporate policies. We argue that these three key institutional factors are female labor market and gendered welfare state provisions, left-leaning political government coalitions, and path-dependent policy initiatives for gender equality, both in the public realm as well as in the corporate domain. We discuss implications of our conceptual model and empirical findings for theory, practice, policy, and future research. These include the adoption and penalty design of board diversity practices into corporate practices, bottom-up approaches from firm to country-level gender board initiatives, hard versus soft regulation, the leading role of Norway and its isomorphic effects, the likelihood of engaging in decoupling, the role of business leaders, and the transnational and international reaction to board diversity initiatives. In Children, Religion and the Ethics of Influence, John Tillson sets out a clear and convincing case for the view that children ought not to be initiated into religious faith by their parents or others with the relevant ‘extra-parental responsibilities’. However, by predicating his thesis on an understanding of illegitimate religious influence that largely equates initiation into faith with the inculcation of a distinctive type of propositional content, I contend that Tillson misses some of the potential harms such initiation may (...) engender. Here I briefly explain why this is a problem before suggesting three ways he might respond to the criticism. (shrink)

Robert Alexy develops his influential theory of legal reasoning exploring the nature of legal argumentation and its relation to practical reasoning. In doing so he sheds light on fundamental questions of law and rationality, which are as crucial to practising lawyers and law students as they are to scholars of legal theory.

The study draws attention to the transfer of management theories and practices from traditional capitalist countries such as the USA and UK to post-socialist countries that are currently experiencing radical change as they seek to introduce market reforms. It is highlighted that the efficacy of this transfer of management theories and practices is, in part, dependent upon the extent to which work-related attitudes and values vary between traditional capitalist and former socialist contexts. We highlight that practices such as Human Resource (...) Management (HRM) and Organization Development (OD) are inextricably associated with conceptions surrounding culture and society, as well as to variables such as job satisfaction and organisational commitment. The main aim of this study is to compare various attitudes and values of employees in traditional capitalist countries and post-socialist countries. On the basis of the findings of an attitudinal survey of (N = 5914) workers in 15 countries we conclude that certain aspects of the attitudes and values of workers in post-socialist countries and traditional capitalist countries differ significantly. Specifically, these differences were found in respect of context-related and job-related attitudes, and also in relation to the importance that the respondents attached to the subject of ethics more generally. The implications of the study are discussed particularly in relation to the transfer of management theory and practices between traditional capitalist and post-socialist contexts. (shrink)

What does it mean to say that ethics committees that provide prospective review of research involving human beings should be “independent”? In the United States, IRBs—which are typically located within and review research protocols at the institution for which most of their members work—cannot really be considered independent. Yet separating the IRB from the research institution may in turn mean less independence from a trial’s sponsors, as this kind of IRB is commercially motivated and paid directly by the sponsor. One (...) possible answer is to create independent IRBs that are not for profit, but how this model would attract financial and administrative support is unclear. (shrink)

During the last decade and a half, Estonia has concentrated predominantly on economic development in its narrowest sense. Currently, the emphasis is gradually moving towards a broader approach, including an increasingly social agenda. The research question here concerns the awareness of corporate social responsibility among Estonian owners and managers. Empirical research in Estonia indicates that there has been a shift towards recognizing the importance of social responsibility, but this primarily concerns the “lower layers” of social responsibility, recognizing the importance of (...) economic responsibility and in some respects also public responsibility. Responses in interviews show a certain amount of personal initiative, but these are single examples rather than a general trend and are not enough to change the overall picture. Still, in any assessment of the current situation regarding social responsibility in Estonia, emphasis should be laid on the fact that changes are taking effect and will continue to do so. In transition economies, including Estonia, we should not overlook the fact that, at least in the early years of transition, the focus is on a rapid economic development where the social side will inevitably be left in the background and economic development will take place at the expense of social and environmental development. ABSTRACT:I argue that there are, according to Aristotle, two importantly different kinds of goals or ends in the domain of human agency and that one of these two kinds has been frequently, though not universally, overlooked. Apart from psychological goals, goals that agents adopt as their purposes, there are also, I submit, goals that actions have by being the kinds of actions they are and, in some cases, by occurring in the circumstances in which they do. These latter goals belong (...) to suitable actions whether or not agents adopt them as purposes and whether or not agents are aware of them. There is evidence both in Aristotle's ethical writings and in his discussion of chance and luck in Physics II.4–6 that he recognizes goals of this latter kind. (shrink)

It is argued that if the non-unitary measurement transition, as codified by Von Neumann, is a real physical process, then the ‘probability assumption’ needed to derive the Second Law of Thermodynamics naturally enters at that point. The existence of a real, indeterministic physical process underlying the measurement transition would therefore provide an ontological basis for Boltzmann’s Stosszahlansatz and thereby explain the unidirectional increase of entropy against a backdrop of otherwise time-reversible laws. It is noted that the Transactional Interpretation of quantum (...) mechanics provides such a physical account of the non-unitary measurement transition, and TI is brought to bear in finding a physically complete, non-ad hoc grounding for the Second Law. One important and consistent thread of Charles Taylor’s thought that has not yet received the attention it deserves is his philosophy of freedom. Taylor’s 1979 defense of positive liberty in response to Isaiah Berlin’s “Two Conceptions of Liberty” is, of course, well known. But there is a way of seeing reflection on freedom as a thread that runs, sometimes silently but always significantly, through his whole body of work. Taylor can be seen as asking what freedom means, how many varieties (...) it has, what it (or they) require, how it (or they) are supported and promoted, or threatened and diminished. Throughout his work, Taylor tacitly encourages us to think about what types of freedom are possible and desirable for embodied entities. (shrink)

This book conveys an understanding of China’s educational development from within and provides unique insights into Chinese society. It does so through portraits of eleven influential educators whose ideas have shaped the educational reforms initiated by Deng Xiaoping in 1978. The book makes Chinese civilization concrete through the drama of the real lives of educators and provides glimpses into the educational context of China’s recent move onto the world stage.

The intuitive notion of a statistical explanation has been explicated in different ways; recently it has even been claimed that there are no statistical explanations at all. In an attempt to clarify the disputed issue, the approaches adopted by Hempel, by Jeffrey, Salmon and Greeno, and by Stegmuller are analyzed critically, as far as they are concerned with the explanation of particular events. A solution of the controversy is proposed on the basis of a concept of explanation which refers essentially (...) to a causal analysis of the explanandum. The possibility of statistical explanations, then, becomes contingent upon the existence of indeterministic causation. In conclusion, therefore, a conception of causality is sketched which shows that indeterminism and causal connection are compatible, at least from an epistemological point of view, so that statistical explanation can be seen to represent a specific and possibly irreducible scientific activity. Narrativism, as represented by Hayden White and Frank Ankersmit, can fruitfully be analyzed as an inversion of two brands of positivism. First, narrativist epistemology can be regarded as an inversion of empiricism. Its thesis that narratives function as metaphors which do not possess a cognitive content is built on an empiricist, "picture view" of knowledge. Moreover, all the non-cognitive aspects attributed to narrative as such are dependent on this picture theory of knowledge and a picture theory of representation. Most of (...) the epistemological characteristics that White and Ankersmit attribute to historical narratives therefore share the problems of this picture theory.The article's second thesis is that the theories of narrative explanation can also fruitfully be analyzed as inversions of positivist covering-law theory. Ankersmit's brand of narrativism is the most radical in this respect because it posits an opposition between narrative and causal modes of comprehension while simultaneously eliminating causality from narrativist historical understanding. White's brand of narrativism is more of a hybrid than is Ankersmit's as far as its theory of explanation is concerned; nevertheless, it can also be fruitfully interpreted as an inversion of covering-law theory, replacing it by an indefinite multitude of explanatory strategies.Most of the striking characteristics of both White's and Ankersmit's narrativism presuppose positivism in these two senses, especially their claim that historical narratives have a metaphorical structure and therefore no truth-value. These claims are hard to reconcile with the factual characteristics of debates by historians; this problem can be tracked down to the absence in "metaphorical" narrativism of a conceptual connection between historical narratives and historical research. In this lecture I argue that it is not possible for social scientists or others engaged in making causal claims about the world to be neutral with respect to the question of what causation is. One need not be in possession of a full-blown account, but one must know whether or not, in saying that something is the cause of a given outcome, one intends to say that it has actively produced or generated that outcome. Following Brian Ellis, I refer (...) to accounts according to which the answer would be ‘No’ as ‘passivist’. One is free to be a passivist, but it is not possible to be neither a passivist nor an anti-passivist. (shrink)

In these seven essays published from 1986 to 2008, philosophy is portrayed as an activity in which one gives an account of the experiences that one has and transmits through acting and speaking. A dialogical principle is an essential element of this account: in the I-role," one acts and speaks, while in the you-role," one passively experiences and understands. Only through learning from one another can the mutually dependent qualities of individuality and sociality gradually develop. ".

This article discusses the status of transcripts in Conversation Analysis. Repeatedly, the function and the epistemic state of transcripts have been the subject of discussions and reflections in Conversation Analysis. Drawing on a range of empirical examples taken from various authors, this article discusses the question of how present forms of visuality and multi-modality in the data material or the handling of artifacts can be captured in transcripts and how the problem of ‘representation’ of complex and interactive situations can be (...) solved. It turns out that the evolution of recording media along with the medium shift in Conversation Analysis has altered the status of transcripts, effecting a twofold ‘in-between-ness’: transcripts inhabit the conceptual space between orality and literacy on the one hand and between artwork and figure on the other hand. This oscillating hybrid nature proves to be the central property of transcripts in present-day Conversation Analysis. Transcripts are described as scientific ‘objects of knowledge’ and discussed with respect to their methodological and epistemic status. (shrink)

There has been a long tradition of women’s ministry in Baptist Churches in the UK. This article outlines this hidden story, from the pioneering days of women preachers, through the rise of the Deaconess Order, to women’s ordination and the present day. Reports from the Baptist Union show a lively debate, against the backdrop of changing times in the twentieth century. The article looks at women’s representation on national decision-making bodies and in national office. Women were seen as ‘complementary’ to (...) men in nature and ministry, but often did not fit the expected roles. It ends with a call to reclaim the radical non-conformity of the Baptist tradition, with its focus on the call of God as the authority for all ministries. (shrink)

Modem science and technology tend to create one global civilization. To what extent and how can cultural pluralism be preserved under these conditions? Neither inherent limitations of natural science and technology nor alternative lines of developing them offer a promising road for pluralism. But it is to be expected that the unifying trend will not carry over into the realm of the human and social sciences; these are rather to be construed as "locally dispersed", i.e. uncapable of being developed into (...) a unified theory of human nature, whereas natural science refers to a unified picture of non-human nature. Thus, modest hopes for preserving pluralism seem to be justified. (shrink)

This paper presents a formal characterization of a two stage decision rule. This characterization involves three conditions which, together, are satisfied by any choice function that can be represented as a two-tier choice function. And any choice function satisfying these three conditions can be represented as a two-tier choice function. The first condition identifies particular features of two-tier choice functions when they violate Property α. The other two conditions are essentially existence claims, required to ensure that the two tiers of (...) a choice function can be represented as (pseudo-) rationalizable choice functions. My aim is to offer a formal result that provides insight into the nature of two-tier decisions. The more we understand how a particular decision procedure operates, the more we should expect to predict its results accurately, and the more we should be able to understand the circumstances under which its use is (and is not) appropriate.
