The capability approach is gaining momentum as a theory of corporate responsibility and business ethics at a time when the UN Guiding Principles have become a most important framework. A novel approach is now emerging that seeks to understand and specify human rights obligations of businesses within the framework provided by the capability approach. This article partially examines the triad corporate responsibility–human rights–capability approach by exploring the relationship between human rights and capabilities. Thus, it offers conceptual and practical implications for (...) a human rights perspective on corporate responsibility. The bulk of our thesis focuses on studying Nussbaum’s and Sen’s claim that human rights are entitlements to capabilities by means of a discussion of the notion of human dignity. In particular, we show the capability approach’s ability to dissipate theoretical and practical challenges posed by the notion of dignity. This article does not offer a detailed explanation of the implications of our investigation for human rights responsibilities of business. However, an outline of its potential contribution toward unfolding those obligations, conceptually and practically, is provided. (shrink)

The first aim of this article is to show the necessity of approaching differently the question of the origin of the hypothesis as pertaining to a purely deductive science or to an experimental one, such as biology. The paper also analyzes the rôle played by the hypothesis in: 1) the formation of definitions; 2) the establishment of laws; 3) explanations. It shows that in 1) and 2) the hypothetical character is relevant both to the amplifying induction and to the still (...) incomplete state of our biological knowledge. Finally, it distinguishes between the two different processes used in the hypothetico-deduction depending on the possibility - or impossibility - to link the phenomena to be explained to some known principles. This paper intends to explore an aspect of Blumenberg’s metaphorology as memory of mankind and the ethical commitment derived from it. It is seen as the culmination of the fight that the human being maintains against the senselessness of reality. It manifests itself and it is perceived by a human being as theimmensurability of world time and life time (i.e. that the human being is born and dies), that impedes the human being from having all of the world i.e. the (...) satisfaction of its infinite desires. In the fight against finity technology and money play a vital role. They have in common the power to enable an expansion of human capacities over the boundaries of factual existence: through technology and money the human being can do more or, do the same in less time. That is: tobring closer life time and world time. But in this process the instrumental character of technology and money causes homogenisation in the societies where they thrive. That’s one of the characteristics of globalization. This homogenisation is to be understood as the forgetting of other essential possibilities of the human creation of meaning. Thus, what technological and monetary processes construct on one side, come to be destroyed on the other side. Blumenberg’s metaphorology is the adequate response: it is understood both as the self-consciousness of the process of reason in its making sense of the universe, and as an “ideal store” of everything the human being has come to make in this process. For more than three decades, Integrative Social Contracts Theory (ISCT) has been lauded as a business ethics theory particularly well suited to the international arena, especially because of its alleged ability to reconcile respect for cultural idiosyncrasies and normative teeth. However, this theory has also faced various objections, many of which its authors have responded to with varying degrees of satisfaction. As a contribution to this debate, this article provides a unifying rationale for many of those objections by exploring their (...) rooting in the Separation thesis. It submits that this fact negatively impacts the theory with three major challenges, namely: significant limitations to correctly frame moral issues and situations; poor identification of hypernorms; and insufficient theoretical grounding of hypernorms. Rohden sustentou que esse conceito, apesar de se relacionar com o contexto estético, não se restringiria a este, implicando uma compreensão ampliada do conceito de humanidade. A partir de tal hipótese, poder-se-ia entender (...) também a sociabilidade legal como um pré-requisito para uma constituição política, no sentido de uma capacidade e disposição para se deixar guiar por princípios do direito. Nesse sentido, o direito constituir-se-ia na forma da sociabilidade legal e na possibilidade de expressá-la concretamente. ContextPeople with mental disorders can acquire long-term disabilities, which could impair their functioning and quality of life (QoL), requiring permanent care and social support. Systematic data on QoL and functioning, which could support a better management of these people, were not available.ObjectiveTo analyze the QoL, level of functioning and their association with sociodemographic and clinical factors of people with mental disorders who underwent deinstitutionalization using assisted living facilities.MethodsA Cross-sectional study was conducted between July 2018 and July 2019, through interviews using (...) the World Health Organization Quality of Life (WHOQOL-BREF) to determine the QoL scores, and the World Health Organization Disability Assessment Schedule (WHODAS 2.0) to determine the level of functioning. All adults (≥18 years old) with mental disorders, who underwent deinstitutionalization, users of assisted living facilities and assisted by the Psychosocial Assistance Centers III, in a city in the state of São Paulo, Brazil, were selected. For statistical analysis of the associated factors, Student’st-test was used for dichotomous variables and ANOVA for polynomial variables. Pearson correlation coefficient was used to measure the association between QoL and functioning scores.ResultsOut of 359 people who underwent deinstitutionalization with mental disorders, 147 met the eligibility criteria. The mean total score for the WHOQOL-BREF was 66.5 ± 13.4 and the mean score for WHODAS 2.0 was 10.4 ± 7.6. An association was found between people who were studying (n= 65.8; 95%CI, 63.5–68.1vs. n= 73.9; 95%CI, 67.5–80.3;p= 0.04) and better WHOQOL-BREF QoL scores or WHODAS 2.0 levels of functioning (n= 10.9; 95%CI, 9.6–12.2vs. n= 5.1; 95%CI, 2.5–7.7;p= 0.01). A weak negative correlation (r= 0.41) emerged between higher QoL scores and functioning improvement.ConclusionThis study indicates that the QoL of the sample is associated by their functioning levels, which, in turn, may reflect on their social interactions. Public policies that favor interventions increasing socialization of this population can result in better health outcomes. The QoL and functioning scores provide valuable insights to develop public policies more suited to this population profile. (shrink)

Le mouvement de réappropriation des espaces physiques et virtuels de parole pour dénoncer les injustices et ceux qui les commettent a pris des formes multiples : de l’occupation de places publiques à la libération de la parole contre les violences systémiques, sexistes et racistes en particulier, via des mouvements comme #MeToo et #OnVeutRespirer. Les féminismes contemporains s’inscrivent ainsi dans un contexte de mobilisation caractérisé par la défiance vis-à-vis d’une démocratie représentative perçue comme confisquée par les élites et par un horizon (...) de « convergence des luttes » ne recomposant pas l’hégémonie d’un critère ou d’une idéologie. Comment, au sein de la société française contemporaine, l’entrecroisement des urgences écologique, sociale et sanitaire questionne-t-il le rapport à l’engagement, en particulier féministe? Cette interrogation est appréhendée à partir d’une enquête qualitative, menée de juillet 2019 à août 2020, auprès de plus de 120 responsables associatifs féministes, anti-racistes, écologistes, antispécistes, pour la justice sociale et/ou de lutte contre la pauvreté, mais aussi d’activistes avec des affiliations plurielles et fluides. Après avoir abordé la manière dont la question du « faire commun » se pose à l’ère de la Covid-19 et des controverses autour de la « cancel culture », nous examinerons comment les féminismes contemporains sont mis à l’épreuve par l’horizon d’une émancipation partagée dans une interdépendance apaisée. Este trabalho se refere a um relato de experiência sobre a concepção do docente da educação básica a respeito da existência do bullying no ambiente escolar, especialmente, no que concerne ao aluno em situação de inclusão. Para isso, foram realizadas seis questões a um(a) professor(a) de Língua Portuguesa de uma escola pública municipal de Campo Grande-MS, sendo uma, exclusivamente, sobre a ocorrência de bullying contra aluno em situação de inclusão.

This article starts with an examination of Saul Kripke’s views of the semantics of modal logic and concludes by pointing to some epistemological and ontological consequences of those views that seem to be incompatible with the way empirical science in fact works and progresses. In dealing with the problem of identifying the same objects in different possible worlds, Kripke is led to develop his original positions on topics such as the theses of the fixation of the reference independent of meaning (...) (where he disagrees with Frege) and the noncoincidence between necessary and a priori truths (where he disagrees with Kant). In Kripke’s view, it is a particular type of knowledge – scientific knowledge – that determines what should be considered as essential or necessary. And the statements that represent these a posteriori scientific discoveries “are not,” in his words, “contingent truths, but truths that are necessary in the strictest possible sense.” Thus, in Kripke’s view, our (scientific) knowledge determines without distortion the essential properties of what is real, which turns his ontology into a direct function of the discoveries of empirical science. This “naturalization of ontology”, as shown in the conclusion of this article, is not compatible with recognition of the defeasibility of our semantic or scientific criteria and overloads scientific the endeavor with a metaphysical burden which science itself does not claim and is not capable of carrying. Background: Using lies, in dementia care, reveals a common practice far beyond the diagnosis and prognosis, extending to the entire care process. Objectives: In this article, we report results about the attitude and the behaviour of nurses towards the use of lies to patients with dementia. Research design: An epidemiological cross-sectional study was conducted between September 2016 and February 2017 in 12 elderly residential facilities and in the geriatric, psychiatric and neurological wards of six specialised hospitals of Italy’s Campania Region. Participants: In all, 106 nurses compiled an attitude questionnaire (A) where the main question was ‘Do you think it is ethically acceptable to use lies to patients with dementia?’, instead 106 nurses compiled a behaviour questionnaire (B), where the main question was ‘Have you ever used lies to patients with dementia?’ Ethical considerations: Using lies in dementia care, although topic ethically still controversial, reveals a common practice far beyond the diagnosis and prognosis, extending to the entire care process. Findings: Only a small percentage of the interviewed nurses stated that they never used lies/that it is never acceptable to use lies (behaviour 10.4% and attitude 12.3%; p = 0.66). The situation in which nurses were more oriented to use lies was ‘to prevent or reduce aggressive behaviors’. Indeed, only the 6.7% in the attitude group and 3.8% in the behaviour group were against using lies. On the contrary, the case in which the nurses were less oriented to use lies was ‘to avoid wasting time giving explanations’, in this situation were against using lies the 51.0% of the behaviour group and the 44.6% of the attitude group. Conclusion: Our results, according to other studies, support the hypothesis of a low propensity of nurses to ethical reflection about use of lies. In our country, the implementation of guidelines about a correct use of lie in the relationship between health operators and patients would be desirable. (shrink)

In the first part of my analysis, I wish briefly to clarify the different modes of relation found in the living being, and point out the multiplicity of disciplines in which biologists use (explicitly or implicitly) the notion of laws. In the second part, I shall analyse the notion of universal laws in biology and examine successively: (1) accidental generalizations; (2) non-causal biological correlations; (3) the meaning of 'necessity' in these correlations; and (4) causal connections. Finally, in the third part, (...) I shall examine statistical laws and probabilistic laws in biology, in particular: (1) chance in biology; (2) probabilistic theories; and (3) relations between logical probability and statistical probability. This implies that philosophical anthropology —as we find it in Gehlen, Plessner and others— achieves onthological standing, and is developed as a history of great metaphors, which supports the history of ideas.

Introduction: Motor evoked potentials (MEPs) to transcranial magnetic stimulation are known to be susceptible to several sources of variability. However, conflicting evidences on individual characteristics in relatively small sample sizes have been reported. We investigated the effect of age, height, and sex on MEPs of the motor cortex and spinal roots in a large cohort. Methods: A total of 587 subjects clinically and neuroradiologically intact were included. MEPs were recorded during mild tonic contraction through a circular coil applied over the (...) “hot spot” of the first dorsal interosseous and tibialis anterior muscles, bilaterally. Central motor conduction time (CMCT) was estimated as the difference between MEP cortical latency and the peripheral motor conduction time by cervical or lumbar magnetic stimulation. Peak-to-peak MEP amplitude to cortical stimulation and right-to-left difference of each parameter were also measured. Results: After Bonferroni correction, general linear (multiple) regression analysis showed that both MEP cortical latency and peripheral motor conduction time at four limbs positively correlated with age and height. At lower limbs, an independent effect of sex on the same measures was also observed (with females showing smaller values than males). CMCT correlated with both age (negatively) and height (positively) when analyzed by a single regression; however, with a multiple regression analysis this significance disappeared, due to the correction for the multicollinearity within the dataset. Conclusions: Physical individual features need to be considered for a more accurate and meaningful MEPs interpretation. Both in clinical practice and in research setting, patients and controls should be matched for age, height, and sex. (shrink)

We consider fragments of the relational logic RL(1) obtained by posing various constraints on the relational terms involving the operator of composition of relations. These fragments allow to express several non classical logics including modal and description logics. We show how relational dual tableaux can be employed to provide decision procedures for each of them.

The author of this paper discusses the theme of the "simulated body", that is the sense of "being there” in a body that is not one's own, or that does not exist in the way one perceives it. He addresses this issue by comparing Immersive Virtual Reality technology, the phenomenological approach, and Gerald Edelman's theory of Neural Darwinism. Virtual Reality has been used to throw light on some phenomena that cannot be studied experimentally in real life, and the results of (...) its simulations enrich the phenomenological discourse on the lived body. Virtual “Reality” seems to replicate—at least in part—the simulation mechanisms of our mind, thus favoring developments in the field of philosophy of mind. (shrink)

Je crois qu'il est utile, avant de passer à une étude historique des théories de l'évolution, de préciser quelques notions de sémantique. Aujourd'hui, on extend par « théorie scientifique » dans le domaine des sciences naturelles une explication soit d'une structure, soit d'un mécanisme, d'un lien causal, présentant un caractère plus ou moins hypothétique mais de toute façon basée sur les faits et vérifiée par eux. Or, la première grande théorie de l'évolution biologique, celle de Lamarck, se veut expérimentale mais (...) est en réalité beaucoup plus spéculative qu'expérimentée. Et pourtant cette explication lamarckienne est une des pièces les plus importantes de l'histoire de la théorie de l'évolution et ne saurait être négligée dans notre étude. Je n'ai pas l'intention de faire ici le procès de la valeur d'une théorie scientifique biologique mais je peux simplement souligner qu'il m'apparaît nécessaire d'élargir pour les besoins de la présente analyse la signification actuelle du terme « théorie », de restreindre les exigences de rigueur interne d'une démonstration et de savoir accepter à l'occasion ce qui—en regard de l'usage actuel du terme—ne peut être considéré que comme une intuition ou même une idée assez vague et imprécise. The essay aims to examine the concept of digital ekphrasis in virtual reality environments. The emergence of immersive narrative worlds, both in videogames and artistic expression, requires a reflection on the relationships between traditional narrative forms (literature and painting, as well as photography and cinema) and the possibilities that technological development brings to the evolution of artistic and expressive languages. Starting from the analysis of Alejandro González Iñárritu’s virtual reality installation "Carne y Arena", the essay questions the continuity/discontinuity relationship with (...) the semiotic and aesthetic universes conventionally summoned by ekphrasis. The transformation of the medium, which places the viewer immediately within the work, abolishes not only the distance between the involved expressive media, integrating them intermedially, but also the distance between work and spectator, according to a paradigm of aesthetic experience minority within aesthetics, attributable to a theoretical line that combines Merleau-Ponty and Deleuze. The resonance between forms of expressiveness significantly radicalizes the scope of ekphrasis, as visual discourse is no longer transposed to a discursive level, as traditionally occurred, but into other forms of the visual and the sensible that continually set the semiosis of the work in motion. In this book, the author proposes an understanding of corporate responsibility that can be captured in the answer to the following question: What are the implications for companies, as main drivers of economic activity (Part III), of the idea that the purpose of the economy is to create wealth (Part I) within the normative-ethical framework of human rights (Part II)? Enderle crafts a solid, well-thought and comprehensive account of corporate responsibility as a means to create wealth, understood in an expansive (...) manner. His notion of wealth encompasses social capital, natural, economic and human wealth, both at the public and private levels. To substantiate those dimensions, Enderle draws on the capability approach. Enderle proposes human rights – and, more specifically, the United Nations Guiding Principles for Business and Human Rights – as normative framework to guide corporate responsibility in its wealth creating endeavor. Enderle’s work is innovative in many respects. But, eventually, the book does not put forward a viable solution to major challenges affecting today’s world. By staying within the framework of voluntariness in an economic system driven by the profit motive and shareholder capitalism, his proposal falls short of the task. (shrink)
