When Congress passed HIPAA, it did not intend to constrain public health's data sharing in the same way as clinical or payers. In fact, HIPAA recognizes data sharing with public health as a matter of national priority and shields this function from its reach. However, a health department may offer services that bring it within HIPAA's purview, such as running a Children's Health Insurance Program or a laboratory that bills electronically. When this is the case, HIPAA requires all information and (...) departments be subject to HIPAA unless the public health authority chooses to hybridize. Health departments might re-assess their coverage and elect to become a hybrid entity, thereby restricting HIPAA to only where required and removing barriers to information sharing with communities. The diversity of state confidentiality laws governing public health data presents a significant challenge for public health initiatives. This challenge is further complicated by the array of confidentially laws that are relevant within a state as disclosure and usage standards vary depending upon data holder, type, and source. These laws often have not been updated to address modern confidentiality risks such as unlawful data linkage or breach, leaving many public health organizations without clear guidance in the contentious area of individual (...) privacy. To address these challenges, public health organizations have increasingly turned to the science of de-identification, but whether de-identification adequately meets the many and varied state confidentiality legal requirements remains an unanswered question. In this article, we apply the literature on the ethics of choice-architecture (nudges) to the realm of virtual reality (VR) to point out ethical problems with using VR for empathy-based nudging. Specifically, we argue that VR simulations aiming to enhance empathic understanding of others via perspective-taking will almost always be unethical to develop or deploy. We argue that VR-based empathy enhancement not only faces traditional ethical concerns about nudge (autonomy, welfare, transparency), but also a variant of the semantic variance problem (...) that arises for intersectional perspective-taking. VR empathy simulations deceive and manipulate their users about their experiences. Despite their often laudable goals, such simulations confront significant ethical challenges. In light of these goals and challenges, we conclude by proposing that VR designers shift from designing simulations aimed at producing empathic perspective-taking to designing simulations aimed at generating sympathy. These simulations, we claim, can avoid the most serious ethical issues associated with VR nudges, semantic variance, and intersectionality. (shrink)

Using process philosophy, especially its view of nature and its ethic, we develop a process-based environmental ethic embodying minimalism and beneficience. From this perspective, we criticize the philosophy currently underlying public policy and examine some alternative approaches based on phenomenology and ethnomethodology. We conclude that process philosophy, minus its value hierarchy, is a powerful tool capable of supporting both radical and n10derate changes in environmental policy.

[Sally Haslanger] In debates over the existence and nature of social kinds such as 'race' and 'gender', philosophers often rely heavily on our intuitions about the nature of the kind. Following this strategy, philosophers often reject social constructionist analyses, suggesting that they change rather than capture the meaning of the kind terms. However, given that social constructionists are often trying to debunk our ordinary (and ideology-ridden?) understandings of social kinds, it is not surprising that their analyses are counterintuitive. This article (...) argues that externalist insights from the critique of the analytic/synthetic distinction can be extended to justify social constructionist analyses. /// [Jennifer Saul] Sally Haslanger's 'What Good Are Our Intuitions? Philosophical Analysis and Social Kinds' is, among other things, a part of the theoretical underpinning for analyses of race and gender concepts that she discusses far more fully elsewhere. My reply focuses on these analyses of race and gender concepts, exploring the ways in which the theoretical work done in this paper and others can or cannot be used to defend these analyses against certain objections. I argue that the problems faced by Haslanger's analyses are in some ways less serious, and in some ways more serious, than they may at first appear. Along the way, I suggest that ordinary speakers may not in fact have race and gender concepts and I explore the ramifications of this claim. (shrink)

Once relegated to the margins of the responsibility debate, moral influence theories have recently been rehabilitated. This paper offers a moral influence theory with two parts: a theory of responsibility as influenceability and an act-consequentialist justification of blame. I defend this account against six concerns commonly raised both by opponents and by advocates of similar views. Some concerns target act consequentialism, claiming that it 1) permits blaming innocents; 2) permits coercion, manipulation, and other objectionable forms of influence; and 3) fails (...) to capture intuitions about desert. Other concerns target responsibility as influenceability, claiming that influenceability accounts are 4) unsophisticated, 5) make ascriptions of responsibility dependent on assessments of permissible blame, and 6) have various counterintuitive implications. It is often claimed both that forgiveness is elective and that forgiveness is something that we do for reasons. However, there is a tension between these two central claims about the nature of forgiveness. If forgiving is something one does for reasons, then, at least sometimes, those reasons may generate a requirement to forgive or withhold forgiveness. While not strictly inconsistent with electivity, the idea of required forgiveness strikes some as antithetical to the spirit of the concept. They argue that (...) forgiveness is essentially elective. In this paper, I dispute these arguments. I argue that the intuitive plausibility of the position diminishes upon reflection and that the best arguments fail to explain why reasons to forgive, unlike most other reasons for action, cannot generate requirements. How does an object persist through change? How can a book, for example, open in the morning and shut in the afternoon, persist through a change that involves the incompatible properties of being open and being shut? The goal of this reader is to inform and reframe the philosophical debate around persistence; it presents influential accounts of the problem that range from classic papers by W. V. O. Quine, David Lewis, and Judith Jarvis Thomson to recent work by contemporary philosophers. (...) The authors take on the question of persistence by examining three broad approaches: perdurantism, which holds that change over time is analogous to change over space; exdurantism, according to which identity over time is analogous to identity across possible worlds; and endurantism, which holds that ordinary objects persist by enduring. Each of these approaches appears to be coherent, but each also has its own metaphysical problems. Persistence includes papers that argue for perdurantism, exdurantism, or endurantism, as well as papers that explore some metaphysical difficulties challenging each account. Sex is probably the best example of stable biological variation within the human species. Scientists have tried to account for the origin of sex differences in biological terms using evolutionary theory. Although Charles Darwin derived his theories of natural and sexual selection with no consideration for sex, he assumed that the differences he observed in male and female human and animal behavior were variations related to biology. This chapter examines the link between sex and evolution by reflecting on the various (...) resonances between cultural and social norms one the one hand, and biological theory on the other. It first considers scientific explanations of women's nature, or womanhood as a subject of science, before turning to research on female choice and the animal/woman divide in the early twentieth century. The chapter also discusses the use of human and animal models of “natural” sexual behavior after World War II, sexual selection and biological determinism in the 1970s, and efforts to bridge the gap between feminism and evolutionary theory. In Echoes, John Sallis mobilizes the figure of echo, used by Heidegger to characterize originary thinking, as the motif around which to organize a radical reading of Heidegger's most important texts.

Wrongdoing is inescapable. We all do wrong and are wronged; and in response we often blame one another. But if blame is a defining feature of our social lives, so is ceasing to blame. We might excuse, justify, or forgive an offender; or simply let the offence go. Each mode of ceasing to blame is a social practice and each has characteristic norms that influence when and how we do it, as well as how it’s received. We argue that how (...) we relinquish blame, and how effective we are, depends on many circumstances only partially within our control. Like any norm-governed practice, one can do it well or poorly, appropriately or inappropriately, successfully or unsuccessfully. To successfully participate in a practice, one’s action must be done for the right reasons and secure uptake. We argue that social and material circumstances can compromise one’s ability to effectively cease to blame in the manner one prefers. But if one can fail, then one can lack access to particular ceasing to blame practices if one is regularly prevented from effectively relinquishing blame. However, uncooperative social and material circumstances do not only arise by chance. Our central argument is that circumstances of oppression can systematically compromise one’s ability and opportunities to effectively perform a variety of ceasing to blame practices. This deprivation is an insidious facet of oppression that is neglected both in theories of oppression and of forgiveness but which has significant implications for how we understand the power and purpose of forgiveness. By conceptualizing place-making as a dynamic process, this essay explores the history of two field sites that house long-term research projects in animal behavior: the Amboseli Baboon Project, cofounded by Jeanne Altmann in 1971, and Kay Holekamp’s Mara Hyena Project, which began in 1988. It highlights scientific place-making as crucial to the production of knowledge within behavioral ecology and invests our historical understanding of field sites with an appreciation for the intellectual processes that have transformed land into places for the (...) generation of scientific data. When we forgive, we do so for reasons. One challenge for forgiveness theorists is to explain which reasons are reasons to forgive and which are not. This paper argues that we forgive in response to a perceived change of heart on the part of the offender. The argument proceeds in four steps. First, I show that we forgive for reasons. Second, I argue that forgiveness requires the right kind of reason. Third, I show that these two points explain a common (...) distinction between forgiving and letting go and, in doing so, solve a problem facing many accounts of forgiveness. Finally, I consider candidate reasons to forgive and argue that all of them are either the wrong kind of reason or are instances of a more general reason of the right kind, namely, a perceived change of heart. Most philosophers acknowledge ways of overcoming blame, even blame directed at a culpable offender, that are not forgiving. Sometimes continuing to blame a friend for their offensive comment just isn't worth it, so we let go instead. However, despite being a common and widely recognised experience, no one has offered a positive account of letting go. Instead, it tends to be characterised negatively and superficially, usually in order to delineate the boundaries of forgiveness. This paper gives a more complete and (...) systematic account of this important practice. We argue that the basic distinction between forgiving and letting go of blame follows from distinctions that many philosophers already accept. We then develop a positive account in terms of the reasons one has to let go rather than forgive and show that letting go is as valuable a part of our shared moral lives as forgiveness. (shrink)

This long awaited volume of The Collected Writings of John Sallis presents his lectures on Martin Heidegger's monumental Being and Time. The lectures were presented during the 1985-86 academic year at Loyola University of Chicago and during the fall semester of 1999 at Pennsylvania State University. The fourteen years separating the beginning of the two courses is significant in that many of the Gesamtausgabe volumes appeared in that interval, as well as a second translation of Being and Time. While the (...) additional Gesamtausgabe volumes make no appearance in the Sallis lectures, there is certainly an awareness of them. This book is a synthesis of the manuscripts of the two separate lecture-courses. This volume makes Being and Time accessible to students, while the most advanced scholars will also profit from it. Theorists analyzing the concepts of race and gender disagree over whether the terms refer to natural kinds, social kinds, or nothing at all. The question arises: what do we mean by the terms? It is usually assumed that ordinary intuitions of native speakers are definitive. However, I argue that contemporary semantic externalism can usefully combine with insights from Foucauldian genealogy to challenge mainstream methods of analysis and lend credibility to social constructionist projects.

Abolitionism is the view that if no one is responsible, we ought to abandon the reactive attitudes. This paper defends abolitionism against the claim, made by P.F. Strawson and others, that abandoning these attitudes precludes the formation and maintenance of valuable personal relationships. These anti-abolitionists claim that one who abandons the reactive attitudes is unable to take personally others’ attitudes and actions regarding her, and that taking personally is necessary for certain valuable relationships. I dispute both claims and argue that (...) this objection exaggerates the role of the reactive attitudes and underestimates the importance of non-reactive moral emotions. (shrink)

ABSTRACT In 1978, the evolutionary biologist Robert Trivers and Huey P. Newton, cofounder of the Black Panthers, began a collaboration exploring the evolution of self-deception. Together they published a brief paper that used their ideas about the naturalistic basis of deceit and self-deception to explain the crash of Air Florida Flight 90 in Washington, D.C. Given the continued power of the naturalistic fallacy in the modern life sciences, historical attention typically focuses on highly visible controversies with great popular traction. The conversations generated by the chapters in Music's Immanent Future grapple with some of music's paradoxes: that music of the Western art canon is viewed as timeless and universal while other kinds of music are seen as transitory and ephemeral; that in order to make sense of music we need descriptive language; that to open up the new in music we need to revisit the old; that to arrive at a figuration of music itself we need to posit its starting (...) point in noise; that in order to justify our creative compositional works as research, we need to find critical languages and theoretical frameworks with which to discuss them; or that despite being an auditory system, we are compelled to resort to the visual metaphor as a way of thinking about musical sounds. Drawn to musical sound as a powerful form of non-verbal communication, the authors include musicologists, philosophers, music theorists, ethnomusicologists and composers. The chapters in this volume investigate and ask fundamental questions about how we think, converse, write about, compose, listen to and analyse music. The work is informed by the philosophy primarily of Gilles Deleuze and Felix Guattari, and secondarily of Michel Foucault, Julia Kristeva and Jean-Luc Nancy. The chapters cover a wide range of topics focused on twentieth and twenty-first century musics, covering popular musics, art music, acousmatic music and electro-acoustic musics, and including music analysis, music's ontology, the noise/music dichotomy, intertextuality and music, listening, ethnography and the current state of music studies. The authors discuss their philosophical perspectives and methodologies of practice-led research, including their own creative work as a form of research. Music's Immanent Future brings together empirical, cultural, philosophical and creative approaches that will be of interest to musicologists, composers, music analysts and music philosophers. This article examines how weblog authors present their online gender identity, in order to establish how these modes of presentation fit into the research landscape about gender identity and computer-mediated communication. After a preliminary descriptive analysis of a sample of Dutch and Flemish weblogs, the authors conduct a qualitative content analysis of four of these `blogs'. They conclude that these weblog writers present their gender identity through narratives of `everyday life' that remain closely related to the binary gender system. However, (...) their performance of `masculinity' and `femininity' is more diffuse and heterogeneous than some theories in the field of gender and CMC would assume. In addition, the act of diary writing on weblogs can be understood as challenging the masculine connotation of the weblog as an ICT, demonstrating that the use of a technology is pivotal in shaping the ways in which technologies themselves are conceived of as `masculine' or `feminine'. Paul Ingram is professor of religion at Pacific Lutheran University in Tacoma,Washington. Both are past presidents of the Society for Buddhist-Christian Studies. There is some irony that they have won this award named after Fred Streng, one of the founders of the Society for Buddhist-Christian Studies, for a volume that is a essentially a festschrift honoring the work of Fred Streng. Following is an edited interview with both of the winners.Buddhist-Christian Studies: What made each of you want to put together this collection of essays?Paul Ingram: Before I met Fred at the first "East-West Religions in Encounter" meeting organized by David Chappell in 1980 in Hawai'i, I was well acquainted with his work in history of religions. Fred by this time was recognized as one of the most important scholars in the field, and I deeply admired his work, particularly his book on Nagarjuna. As it turns out, he had read some of my work on Pure Land Buddhism and was as interested in meeting me as I was in meeting him. We became friends and colleagues. Because of our mutual interest in interreligious dialogue in general and in Buddhism in particular, he suggested that we should co-edit a volume of selected papers from the 1980 conference. This volume, Buddhist-Christian Dialogue: Mutual Renewal and Transformation, was subsequentlypublishedby the Universityof Hawai'i Press in 1986 and is still in print.Sallie King: I had long admired Fred's book on Nagarjuna, which uniquely and powerfullyopenedup the religiousmeaningof Nagarjuna'swork.I later metFred through the Society for Buddhist-Christian Studies and discovered that this admirable scholar was also a most admirable human being. We had lengthy, in-depth conversations when our paths crossed at various conferences. Neither Paul nor I hesitated. The authoranalyzes the types of metaphors that are used to describe the Internetin issues of Wired magazine from before and after the dot-com collapse to understand the perceptions and expectations of some of the actors involved in the shaping of the Internet. In addition, the metaphors deployed in economics and geophysiology are used to demonstrate how metaphors can influence public debate, policy, and theory. The author argues that metaphors do not simply have a descriptive function but that they also carry (...) normative connotations. Language, alongside social practices and material objects, is an important tool in attempts to construct the future. Six overlapping metaphorical themes are identified: revolution, evolution, salvation, progress, universalism, and the “American dream.” A critical analysis of these metaphors, informed by a critique of the metaphors used in economics and geophysiology, leads the author to challenge the universalist claims made by some Internet enthusiasts for the inclusive potential of the Internet. It is always awkward when someone asks me informally what I’m working on and I answer that I’m trying to figure out what gender is. For outside a rather narrow segment of the academic world, the term ‘gender’ has come to function as the polite way to talk about the sexes. And one thing people feel pretty confident about is their knowledge of the difference between males and females. Males are those human beings with a range of familiar primary and (...) secondary sex characteristics, most important being the penis; females are those with a different set, most important being the vagina or, perhaps, the uterus. Enough said. Against this background, it isn’t clear what could be the point of an inquiry, especially a philosophical inquiry, into “what gender is”. (shrink)
