In "The Law of Peoples", John Rawls proposes a set of principles for international relations, his "Law of Peoples." He calls this Law a "realistic utopia," and invites consideration of this Law from the perspectives of non-Western cultures. This paper considers Rawls's Law from the perspective of Engaged Buddhism, the contemporary form of socially and politically activist Buddhism. We find that Engaged Buddhists would be largely in sympathy with Rawls's proposals. There are differences, however: Rawls builds his view from the (...) idea of independent nation--states, while the Buddhists see the world more in terms of a single humankind, the members being highly interdependent with one another, and also with the physical world. The Buddhists would also push harder than Rawls for global structures building multilateralism, restrict more severely justifications for war and behavior in war, stress economic justice more heavily, and insist on all the human rights in the Universal Declaration of Human Rights. To that end, this article urges those who teach foundational health law and policy courses to do three things. First, to teach the Simkins case. Second, to swap out the usual Medicare signing ceremony picture for one that includes W. The contemporary Thai Theravada Buddhist monks Buddhadasa Bhikkhu and Phra Prayyudh Payutto espouse a version of natural law thinking in which the norms of good behavior derive from the nature of the world, specifically its features of conditionality, causality, karma and interdependence. An ethic which stresses non-egoic harmony is the result. Between 2010 and 2016, the percentage of uninsured higher education students dropped by more than half. All the Affordable Care Act's key access provisions contributed, but the most important factor appears to be the Medicaid expansion. This article is the first to highlight this phenomenon and ground it in data. It explores the reasons for this dramatic expansion of coverage, links it to theoretical frameworks, and considers its implications for the future of health reform. Drawing on Medicaid universality scholarship, I (...) discuss potential consequences of including the educationally privileged in this historically stigmatized program. Extending this scholarship, I argue that the student experience and its reverberating effects portend support for emerging proposals to make Medicare a more common option. Woven into both analyses is the role of the Trump-era retrenchment, notably the administration's promotion of Medicaid “work or community engagement” requirements and of cheap, skimpy plans. Higher education students were an afterthought in the ACA's debates, and yet the law has profoundly impacted their coverage options. Students are now much more likely to have health insurance, and for it to be comprehensive. Looking to the next decade, the student experience harbingers support for both Medicaid universality and Medicare commonality. (shrink)

Living fossils, taxa with similar members now and in the deep past, have recently come under scrutiny. Those who think the concept should be retained have argued for its epistemic and normative utility. This article extends the epistemic utility of the living fossils concept to include ways in which a taxon’s living fossil status can serve as evidence for other claims about that taxon. I will use insights from developmental biology to refine these claims. This paper argues that, despite appearances to the contrary, Kant and contemporary analytic metaphysicians are interested in the same kind of metaphysical dependence relation that finds application in a range of contexts and that is today commonly referred to as grounding. It also argues that comparing and contrasting Kant’s and contemporary metaphysicians’ accounts of this relation proves useful for both Kant scholarship and for contemporary metaphysics. The diversity of state confidentiality laws governing public health data presents a significant challenge for public health initiatives. This challenge is further complicated by the array of confidentially laws that are relevant within a state as disclosure and usage standards vary depending upon data holder, type, and source. These laws often have not been updated to address modern confidentiality risks such as unlawful data linkage or breach, leaving many public health organizations without clear guidance in the contentious area of individual (...) privacy. To address these challenges, public health organizations have increasingly turned to the science of de-identification, but whether de-identification adequately meets the many and varied state confidentiality legal requirements remains an unanswered question. Sellars and McDowell, among others, attribute a prominent role to the Myth of the Given. In this paper, I suggest that they have in mind two different versions of the Myth of the Given and I argue that Kant is not the target of one version and, though explicitly under attack from the other, has resources sufficient to mount a satisfactory response. What is essential to this response is a proper understanding of (empirical) concepts as involving unifying functions that can (...) take sensations as input and deliver normative representations as outputs. By understanding concepts in this way, one need not, as the second version of the Myth of the Given maintains, take sensations to be both natural and normative. Instead, they can be understood as the natural effects of external objects on us, but natural effects that can nonetheless play a role in a normative process because the concepts that are responsible for the normativity of the results can require that such natural effects be present as inputs into the process. However, providing a detailed explanation of even the main structure of his argument (not to mention the specific arguments that fill out this structure) is not a trivial enterprise. While it is clear that Kant’s Critique of Pure Reason (1781), his Metaphysical Foundations of Natural Science (1786), and (...) his unpublished (and incomplete) Opus postumum should in some way constitute the core of this justification, it is less clear how each of these works does so in detail. In this paper I shall first argue that the standard view of the relationship between the Critique of Pure Reason and the Metaphysical Foundations of Natural Science (hereafter simply Metaphysical Foundations) is mistaken. I shall then present my own interpretation of how the Metaphysical Foundations contributes to the justification of Newtonian science. Finally, I shall conclude by considering an important interpretation of the argument of the Metaphysical Foundations developed by Michael Friedman. However, it is first necessary to present briefly Kant’s conception of science (in particular what conditions a body of knowledge must satisfy for Kant in order to be considered science proper) as well as Kant’s own understanding of the relevant differences between his projects in the first Critique, the Metaphysical Foundations, and the Opus postumum.Kant’s conception of science is rather strict if measured by contemporary standards. In other words, satisfaction of the first condition immediately implies satisfaction of the second condition as well.6 Accordingly, these three conditions (and the first one in particular) imply that natural science proper requires (or rather presupposes) a justification by something distinct from it that Kant calls a metaphysics of nature.7 But what exactly does a metaphysics of nature encompass? Kant distinguishes two different parts of the metaphysics of nature: a transcendental part and a special part. Phylogenetic models traditionally represent the history of life as having a strictly-branching tree structure. However, it is becoming increasingly clear that the history of life is often not strictly-branching; lateral gene transfer, endosymbiosis, and hybridization, for example, can all produce lateral branching events. There is thus motivation to allow phylogenetic models to have a reticulate structure. One proposal involves the reconciliation of genealogical discordance. Briefly, this method uses patterns of disagreement – discordance – between trees of different genes to add (...) lateral branching events to phylogenetic trees of taxa, and to estimate the most likely cause of these events. I use this practice to argue for: (1) a need for expanded accounts of multiple-models idealization, (2) a distinction between automatic and manual de-idealization, and (3) recognition that idealization may serve the meso-level aims of science in a different way than hitherto acknowledged. During the last twenty years, Kant's theory of biology has increasingly attracted the attention of scholars and developed into a field which is growing rapidly in importance within Kant studies. The volume presents fifteen interpretative essays written by experts working in the field, covering topics from seventeenth- and eighteenth-century biological theories, the development of the philosophy of biology in Kant's writings, the theory of organisms in Kant's Critique of the Power of Judgment, and current perspectives on the teleology of nature.

Philosophers of science have paid close attention to climate simulations as means of projecting the severity and effects of climate change, but have neglected the full diversity of methods in climate science. This paper shows the philosophical richness of another method in climate science: the practice of using paleoclimate analogues to inform our climate projections. First, I argue that the use of paleoclimate analogues can offer important insights to philosophers of the historical sciences. Rather than using the present as a (...) guide to the past, as is common in the historical sciences, paleoclimate analogues involve using the past as a guide to the future. I thereby distinguish different methods in the historical sciences and argue that these distinctions bear on debates over whether the historical sciences can produce generalizations or predictions. Second, I suggest that paleoclimate analogues might actually be considered a type of climate model, and, as such, their use expands on common characterizations of models to include those that are full-scale, naturally occurring, and non-manipulable. This is one (...) of at least ten places in this brief work in which he associates himself with “letters” or “literature”—as compared to at most four associations with philosophy. The moral to be inferred is not that Hume considered himself not to be a philosopher. Rather, he conceived of philosophy as a kind of literature. The Treatise was itself a “literary attempt.” Indeed, opposition between the “literary” and “philosophical” aspects of a text would have been foreign to Hume and his contemporaries—a notion for a later age, despite his occasional loose distinction between the relevant genres, as in his list of writings “historical, philosophical, or literary” in “My Own Life” (E-MOL: xxxvi).Yet despite Hume’s own understanding of the continuity between philosophy and literature, broadly conceived, it is still common for contemporary philosophers to ignore literary questions in their examination of Hume’s work, or to presume that one can easily distinguish the “philosophical” parts from the “literary” ones. Tim Milnes’s The Testimony of Sense is therefore a welcome addition to the Hume literature (pun intended). With training in both philosophy and literature, as well as established expertise on Romanticism and its own essays, Milnes is well-qualified for the task. The Testimony of Sense includes sustained engagement with Hume’s contemporaries and successors, but for the purposes of this review, I engage the book primarily as a Hume scholar for Hume scholars.Milnes’s story plays out in three acts. The first establishes the need for public trust created by a skeptical crisis, itself a product of Hume’s criticism of the epistemic program of thinkers in the Cartesian and Lockean traditions. The second explains how the essays of the long eighteenth century constitute a response to that need in various ways. The third reveals in detail how the Romantic essayists, particularly William Hazlitt and Charles Lamb, both respond to and deviate from the “neoclassical” essayists, typified by Hume and Samuel Johnson.The first chapter, “Self and Intersubjectivity,” lays the groundwork by articulating how Hume, Adam Smith, Thomas Reid, and Dugald Stewart identify the need for what we now call intersubjectivity. Milnes describes the common thread as a kind of “natural transcendentalism.” In what sense are these thinkers properly understood as [End Page 175] transcendentalists? The correct reading of Thomson is that she argues by counterexample, showing that arguments against abortion are unsound. The remainder of the paper highlights the lessons learned from Thomson once we read her aright.

Genome‐wide identification of transcription factor binding sites with the ChIP‐seq method is an extremely important scientific endeavor − one that should ideally be performed for every transcription factor in as many cell types as possible. A major hurdle on the way to this goal is the necessity for a specific, ChIP‐grade antibody for each transcription factor of interest, which is often not available. Here, we describe CETCh‐seq, a recently published method utilizing genome engineering with the CRISPR/Cas9 system to circumvent the (...) need for a specific antibody. Using the CETCh‐seq method, targeted genomic editing results in an epitope‐tagged transcription factor, which is recognized by a well‐characterized, standard antibody, efficacious for ChIP‐seq. We have used CETCh‐seq in human cancer cell lines as well as mouse embryonic stem cells. We find that roughly 60% of transcription factors tagged using CETCh‐seq produce a high quality ChIP‐seq map, a significant improvement over traditional antibody‐based methods. (shrink)

Entry into mitosis is driven by the activity of kinases, which phosphorylate over 7000 proteins on multiple sites. For cells to exit mitosis and segregate their genome correctly, these phosphorylations must be removed in a specific temporal order. This raises a critical and important question: how are specific phosphorylation sites on an individual protein removed? Traditionally, the temporal order of dephosphorylation was attributed to decreasing kinase activity. However, recent evidence in human cells has identified unique patterns of dephosphorylation during mammalian (...) mitotic exit that cannot be fully explained by the loss of kinase activity. This suggests that specificity is determined in part by phosphatases. In this review, we explore how the physicochemical properties of an individual phosphosite and its surrounding amino acids can affect interactions with a phosphatase. These positive and negative interactions in turn help determine the specific pattern of dephosphorylation required for correct mitotic exit. (shrink)

The philosophy of the geosciences is an emerging subfield in philosophy of science. Although past and present geoscientific disciplines differ substantially, we argue that they frequently face common epistemological and ethical problems. We survey several of these problems that have already attracted sustained philosophical interest, related to the use of measurements, data, and models to study relatively inaccessible target phenomena, responses to (epistemic) injustices, and the management of epistemic risks.

In this paper, I explore our common-sense thinking about the relation between moral value, moral merit, and well-being. Starting from Ross’s observation that welfarist axiologies ignore our intuitions about desert, I focus on axiologies that take moral merit and well-being to be independent determinants of value. I distinguish three ways in which these axiologies can be formulated, and I then consider their application to the issue of punishment. The objection that they recommend penalties in circumstances in which intuitively we would (...) judge them to be unjustified is examined, and I suggest that it can be met by incorporating temporal information into the way in which value, well-being and moral merit are linked. Today we consider ourselves to be free and equal persons, capable of acting rationally and autonomously in both practical and theoretical contexts. The essays in this volume show how this conception was first articulated in a fully systematic fashion by Immanuel Kant in the eighteenth century. Twelve leading scholars shed new light on Kant's philosophy, with each devoting particular attention to at least one of three aspects of this conception: autonomy, freedom, and personhood. Some focus on clarifying the philosophical content (...) of Kant's position, while others consider how his views on these issues cohere with his other distinctive doctrines, and yet others focus on the historical impact that these doctrines had on his immediate successors and on our present thought. Using process philosophy, especially its view of nature and its ethic, we develop a process-based environmental ethic embodying minimalism and beneficience. From this perspective, we criticize the philosophy currently underlying public policy and examine some alternative approaches based on phenomenology and ethnomethodology. We conclude that process philosophy, minus its value hierarchy, is a powerful tool capable of supporting both radical and n10derate changes in environmental policy.
