Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

Samantha Matherne defends a systematic interpretation of the philosopher Immanuel Kants theory of imagination. In contrast with more traditional theories of imagination, as a kind of fantasy that we exercise only in relation to objects that are not real or not present, Matherne argues that Kant theorizes imagination as something that we exercise just as much in relation to objects that are real and present. In short, she attributes to Kant a view of imagining as something that pervades our (...) lives. In order to bring out this pervasiveness, Matherne offers an account of what kind of mental capacity Kant takes imagination to be in general. She then explores Kants picture of how we exercise our imagination in perception, ordinary experience, the appreciation of beauty and sublimity, the production of art, the pursuit of happiness, and the pursuit of morality. However, she makes the case that Kants analysis of this wide range of phenomena is underwritten by a unified theory of what imagination is, as a remarkably flexible cognitive capacity that we can exercise in constrained and creative, playful and serious ways. Is there tension in a view of the conditions of being in a proper position to make aesthetic evaluations that is committed to aesthetic autonomy and norms of exposure? I define ‘aesthetic autonomy’ in terms of the Kantian idea that in order to make a proper aesthetic evaluation, one must rely on oneself rather than on any outside source. I define ‘norms of exposure’ in terms of the Humean idea that practice and aesthetic education are conditions of proper aesthetic evaluation. (...) Prima facie, these two commitments point toward competing accounts of whether exposure is a condition of being in a position to make proper aesthetic evaluations. However, I argue that a closer look at the Kantian position reveals that aesthetic exposure is a condition of being able to make aesthetic evaluations in an autonomous way in the Kantian framework. Pure mathematics can play an indispensable role explaining empirical phenomena if recent accounts of insect evolution are correct. In particular, the prime life cycles of cicadas and the geometric structure of honeycombs are taken to undergird an inference to the best explanation about mathematical entities. Neither example supports this inference or the mathematical realism it is intended to establish. Both incorrectly assume that facts about mathematical optimality drove selection for the respective traits and explain why they exist. The ontologies of Slavoj Žižek and Gilles Deleuze are incommensurable. Rather than appropriate one at the expense of the other, this essay uses Žižek’s notion of parallax to think the two philosophers together, without mediation. Both Deleuze and Žižek provide mirrored philosophical images, with the point of divergence being absolute lack. Deleuze argues that lack, or the being of negation, is an error of representational understanding, while Žižek conceives his philosophy as being driven by absolute lack. A stark opponent of (...) Žižek’s precursor, Hegel, Deleuze rejects opposition as a constitutive feature of reality. However, Žižek mirrors Deleuze’s very concepts in his Lacanian reading of Hegel, while said concepts retain identical terms. For instance, Žižek calls l’objet petit a “difference,” while his term for absolute negation is “repetition,” and finally, he refers to his philosophical system as the “non-All”. These singular concepts in Žižek’s thought share an identical language with that of Deleuze. Deleuze’s philosophy is one of “difference,” while its mode of proliferation is “repetition,” and finally, he often refers to his philosophy as the “One-All”. Mapping these common terms that do not denote a common language, but incommensurable, inverse logics, it becomes evident that Deleuze and Žižek are mirror images of one another, infinitely fragmenting across the expanse of their respective positions. Thus, by triangulating ontology from their unique perspectives, a new ontological shift emerges—one that resists mediation and admixture. (shrink)

Since pragmatic arguments for agnostic religious commitment do not require one to believe on insufficient evidence, they avoid one of the moral objections to pragmatic arguments for belief in God: the objection that one should not believe on insufficient evidence. However, I will argue that pragmatic arguments for agnostic religious commitment must deal with two related moral objections. First, if we have a duty to investigate the truth in matters of importance to our behavior, then making such a commitment turns (...) out to conflict to some extent with that duty, though not, I think, to an unacceptable degree. Second, some people have a conception of God and the religious life such that making an agnostic religious commitment may interfere with the person's ability to reflect on moral matters and act on her conclusions, thus putting her at greater risk of doing the wrong thing. The likelihood of an intervention’s success is rarely a zero-sum game, and an intervention’s risk-to-benefit ratio may be indiscernible without further information (often, a matter of time).

The Difference In Philosophic Standpoint Between Aristotle And St. Augustine In St. Augustine's philosophy the starting-point is the same as in the beginning of modern thought, namely, the certainty of inner experience. Not even the Skeptic, says St. Augustine, can doubt sensation as such; moreover, this very experience reveals not only the content that had formed the basis of relativistic or (...) positivistic interpretations, but also the conscious self, the perceiving subject. For Aristotle and his contemporaries, perception was essentially a cognitive process, apprehending the forms of sensible objects without the matter. Such apprehension of external objects was regarded as direct, the awareness as awareness of the objectively real character of things. A mind as such perceiving was foreign to their modes of thinking; the person, composite of body and soul, thinks and knows, was their view. There is ample evidence that self-consciousness was recognized by Plato in his theories of sensation; and that Aristotle made a psychological analysis of it as a mental phenomenon, though he utterly disregarded it in his metaphysics and epistemology. In the earlier period, therefore, mind was studied in its manifestations in nature and society; with the close of ancient speculation, the investigation was based predominantly on introspection and the analysis of mental operations of the individual thinker. It is accordingly an interesting inquiry how this change of viewpoint was effected and what were the consequent alterations in scientific method. Though such a development cannot be treated in isolation from the social life, the scope of this paper will allow only most general and cursory references to the social, political, and religious influences affecting the philosophic thought of the post-Aristotelian period. 2. This paper poses a series of objections to Sofia Jeppsson’s hard-line reply to Pereboom’s four-case manipulation argument. According to Jeppsson, the compatibilist can resist Pereboom’s argument by disregarding facts about what caused an agent to act (the ‘causal perspective’) and focusing primarily on the agent’s own perspective of their action (the ‘agential perspective’). Jeppsson argues that we have an obligation to disregard the causal perspective. This is for two reasons: (I) we must disregard the causal facts of the agent’s action, (...) including whether they have been manipulated, since the agent has reason to disregard them; and (II) the causal perspective is not obviously relevant to judgments of moral responsibility. In this paper, I show that both (I) and (II) can be undermined because the causal perspective provides information that is necessary for moral deliberations. This is because it would seem that at least one necessary condition for an agent to be considered morally responsible is that the agent’s actions are not fully controlled by someone else. Since this is information that we can only obtain via the causal perspective, we do not have an obligation to disregard this perspective and so need not accept the compatibilist’s hard-line account. Abstract25.6 Million people in the United States have Limited English Proficiency (LEP), defined as insufficient ability to read, write, or understand English. We will (1) Delineate the merits of approaching language as a social determinant of health, (2) highlight pertinent public health values and guidelines which are most relevant to the plight of populations with LEP and (3) Use the COVID-19 pandemic as an example of how a breakdown in public health ethics values created harm for populations and patients with (...) LEP. We define a framework to tease out public health responsibilities given some populations’ limited proficiency in a society’s predominant language. The American Public Health Association (APHA) public health ethics core values serve as a framework to interrogate current practices. We use the COVID-19 case to illustrate gaps between health policy and healthcare disparities experienced by populations with LEP. (shrink)

It is generally agreed that physicians should not provide futile interventions, for the obvious reason that an intervention without utility causes harm without benefit. However, despite efforts to standardize a definition, there is a lack of universal consensus as to what constitutes “futility.” Two recent policy statements object to the terminology of futility based on the lack of a universal definition. SAMANTHA GREY | : Prevailing connotations of reconciliation orbit concord or harmonious coexistence, meaning that concern for justice is necessarily subordinated to a more casually pragmatic peace. Bringing justice considerations to the fore means focusing on reparations as a key element of reconciliation’s suite of activities—but reparations are necessarily a matter of process, which precludes considering elements of the “package” in isolation from one another, as is the case with traditional evaluative criteria of motivation or proportion. Accordingly, this article (...) proposes that reparations are better framed as a considered reaction to the unjust allocation of burdens, so that subsequent reallocations serve justice by answering the needs and demands of survivors. ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more common versions of the Principle (...) of State Consent. Second, it endorses a qualified version of the Principle of Civil Society Participation, one that is much more restrictive and more critical of the democratic defects of civil society actors than most of its current supporters. In his Letters on the Aesthetic Education of Man, Friedrich Schiller draws a striking connection between aesthetic value and individual and political freedom, claiming that, ‘it is only through beauty that man makes his way to freedom’. However, contemporary ways of thinking about freedom and aesthetic value make it difficult to see what the connection could be. Through a careful reconstruction of the Letters, we argue that Schiller’s theory of aesthetic value serves as the key to understanding not only his (...) view of aesthetic engagement, but also his distinctive account of individual and political freedom. In Part I, we develop a reconstruction of Schiller's view that aesthetic value is the only path to individual freedom and in Part II we analyze how Schiller connects aesthetic value to political freedom. In the end, we show that Schiller defends a non-hedonic, action-oriented, communitarian theory of aesthetic value and a theory of freedom that makes the aesthetic not just supererogatory but fundamental for any fully autonomous life. Although we have lost touch with this way of thinking about aesthetic value and freedom, we submit that it is illuminating for contemporary thinking about both. (shrink)

Lloyd analyzes every proposed evolutionary explanation of female orgasm and argues that all but one suffers from serious evidential errors. Lloyd attributes these errors to two main biases: androcentrism and adaptationism. This paper begins by arguing that the explanation Lloyd favors—the by-product account—is guilty of the androcentrism which supposedly implicates the other explanations of female orgasm with numerous evidential discrepancies. This suggests that there is another error afflicting orgasm research in addition to the biases Lloyd identities. I attempt to diagnose (...) and characterize this additional error. In short, I think the error is using an imprecise definition of the trait in question. Further, Lloyd takes her analysis to support Longino’s contextual empiricist model of scientific objectivity. I consider what implications this analysis has for contextual empiricism. Finally, I argue that theorizing about female orgasm should be done from a conceptual engineering approach. (shrink)

In this paper, I argue that in spite of suggestions to the contrary, Merleau-Ponty defends a positive account of the kind of abstract thought involved in mathematics and natural science. More specifically, drawing on both the Phenomenology of Perception and his later writings, I show that, for Merleau-Ponty, abstract thought and perception stand in the two-way relation of “foundation,” according to which abstract thought makes what we perceive explicit and determinate, and what we perceive is made to appear by abstract (...) thought. I claim that, on Merleau-Ponty's view, although this process can sometimes lead to falsification, it can also be carried out in such a manner that allows mathematics and natural science to articulate what we perceive in a way that is non-distortive and in keeping with the demands of perception itself. Socioeconomic status -related health disparities persist for numerous chronic diseases, with lower-SES individuals exhibiting greater risk of morbidity and mortality compared to their higher-SES counterparts. One likely contributor is disparities in health messaging efforts, which are currently less effective for motivating health behavior change among those lower in SES. Drawing on communication neuroscience and social neuroscience research, we describe a conceptual framework to improve health messaging effectiveness in lower SES communities. The framework is based on evidence that health-message-induced activity in (...) the ventral striatum and subdivisions of the medial pre-frontal cortex predicts behavior change. Additionally, we draw from social neuroscience work showing that activity in these regions during valuation and the processing of self-related vs. social information, differs as a function of SES. Bringing together these previously disparate lines of work, we argue that health messages emphasizing the benefits to close others of engaging in behavior change will be more effective among lower SES individuals. We also outline a research agenda based on our framework. Ultimately, we hope that this framework utilizing a “brain-as-predictor” approach generates novel insights about the neural underpinnings of message-induced behavior change among lower SES individuals, and helps to close the gap in SES-based health disparities by harnessing the power of neuroimaging. In ambiguous situations, infants have the tendency to gather information from a social interaction partner to regulate their behavior [social referencing ]. There are two main competing theories concerning SR’s function. According to social-cognitive information-seeking accounts, infants look at social interaction partners to gain information about the ambiguous situation. According to co-regulation accounts, infants look at social interaction partners to receive emotional support. This review provides an overview of the central developments in SR literature in the past years. We focus (...) on the role of situational aspects such as familiarity of SR partners and situational threat, not only for SR, but also for subsequent behavioral regulation. As the competing accounts make different predictions concerning both contextual factors, this approach may reveal novel insights into the function of SR. Findings showed that a higher familiarity of SR partners consistently resulted in decreased looking and that higher threat remains largely understudied, but seemed to increase looking in the first few studies. Concerning behavioral regulation findings are mixed. We point out that moving toward a more complex situatedness may help to disentangle the heterogeneous results by considering the interaction between familiarity and threat rather than investigating the factors in isolation. From a general perspective, this review underlines the importance of situational factors and their interaction in eliciting a phenomenon, such as SR, but also in determining the nature of the phenomenon itself. Previous long-term memory research found that angry faces were more poorly recognised when encoded with averted vs. direct gaze, while memory for happy faces was unaffected by gaze. Contrasti...

T2 in an attentional blink paradigm served as a high- or low-frequency prime word for a subsequent repeated target. Consistent with research in visual word identification, only reported primes facilitated the identification of a target repeated approximately 8 s after RSVP. Priming was greater for low- than high-frequency words. Analogous with masked priming, a blinked T2 facilitated report of a repeated target occurring 318 ms after T2 in RSVP. The blinked repetition priming effect was additive with target frequency. These results (...) indicate that: the outcomes of processing prime words are a key factor in repetition priming effects, with blinked and reported T2s behaving like masked and unmasked primes, respectively, there may be different sources of repetition effects, there is a consistent cross-paradigm pattern of repetition effects that occurs as a function of prime–target interval and the ability to identify the word on its first and second presentation. In the 1880s and 1890s, the British Isles-Ireland especially-experienced a Celtic Literary Revival. Drawing on both history and religion, this revival focused on aspects of old Celtic spirituality and how their beliefs were intertwined with the natural world around them. While not everyone was sympathetic to this sense of spirituality and nostalgia, the revival did gain traction amongst many authors of the time. Using the works of influential writers like William Butler Yeats and the Rhymers Club, this paper seeks to (...) explore how Celtic spirituality was being rediscovered and interpreted during the late Victorian period. The Great Exhibition of 1851 in London was a large, highly significant affair that brought the innovations and industries of the world together under one roof. While it was indeed a global event, it has been argued, especially by people at the time, whether or not the exhibition was held for the great benefit of the British. This paper will argue that the primary motivation for the British was indeed their own benefit by looking at British prestige, what they had (...) to offer the exhibition, and what they stood to gain by hosting such an event. Nature has been widely represented in literature and culture as healing, redemptive, unspoilt, and restorative. In the aftermath of the First World War, writers grappled with long cultural associations between nature and healing. Having survived a conflict in which relations between people, and the living environment had been catastrophically ruptured, writers asked: could rural and wild places offer meaningful sites of solace and recovery for traumatised soldiers? In Virginia Woolf’s Mrs Dalloway (1925), Rebecca West’s The Return of the Soldier (1918), (...) Nan Shepherd’s The Weatherhouse (1930) and Lewis Grassic Gibbon’s Sunset Song (1932), trauma severs emotional, social, and cultural relationships with the natural world. These interwar literatures offer counter-narratives to simplistic depictions of nature as a healing space and highlight the difficulties of returning to rural environments and ‘reconnecting’ with known and natural places. How should feminist philosophers regard the inequalities that structure the lives of women? Some of these inequalities are trivial and others are not; together they form a framework of unequal treatment that shapes women’s lives. This paper asks what priority we should give inequalities that affect women; it critically analyzes Claudia Card’s view that feminists ought to give evils priority. Sometimes ending gender-based inequalities is the best route to eliminating gender-based evil.
