This article surveys recent feminist contributions to moral philosophy with an emphasis on those works which engage with debates within mainstream ethics. The article begins by examining a tension said to arise from the two criteria a theory must meet if it is to count as feminist moral theory: the women's experience requirement and the feminist conclusion requirement. Subsequent sections deal with feminist relational theories of rights, feminist work on responsibility and feminist contractarian approaches to ethics. This book explores the relationship between the law and pervasive and persistent reasonable disagreement about justice. It reveals the central moral function and creative force of reasonable disagreement in and about the law and shows why and how lawyers and legal philosophers should take reasonable conflict more seriously. Even though the law should be regarded as the primary mode of settlement of our moral conflicts,it can, and should, also be the object and the forum of further moral conflicts. There is (...) more to the rule of law than convergence and determinacy and it is important therefore to question the importance of agreement in law and politics. By addressing in detail issues pertaining to the nature and sources of disagreement, its extent and significance, as well as the procedural, institutional and substantive responses to disagreement in the law and their legitimacy, this book suggests the value of a comprehensive approach to thinking about conflict, which until recently has been analysed in a compartmentalized way. It aims to provide a fully-fledged political morality of conflict by drawing on the analysis of topical jurisprudential questions in the new light of disagreement. Developing such a global theory of disagreement in the law should be read in the context of the broader effort of reconstructing a complete account of democratic law-making in pluralistic societies. The book will be of value not only to legal philosophers and constitutional theorists, but also to political and democratic theorists, as well as to all those interested in public decision-making in conditions of conflict. In _Biocultural Creatures_, Samantha Frost brings feminist and political theory together with findings in the life sciences to recuperate the category of the human for politics. Challenging the idea of human exceptionalism as well as other theories of subjectivity that rest on a distinction between biology and culture, Frost proposes that humans are biocultural creatures who quite literally are cultured within the material, social, and symbolic worlds they inhabit. Through discussions about carbon, the functions of cell membranes, the activity (...) of genes and proteins, the work of oxygen, and the passage of time, Frost recasts questions about the nature of matter, identity, and embodiment. In doing so, she elucidates the imbrication of the biological and cultural within the corporeal self. In remapping the relation of humans to their habitats and arriving at the idea that humans are biocultural creatures, Frost provides new theoretical resources for responding to political and environmental crises and for thinking about how to transform the ways we live. Habermas does not rule out the possibility of violence in language. In fact his account explicitly licenses a broad conception of violence as ‘systematically distorted communication’. Yet he does rule out the possibility that language simultaneously imposes as it discloses. That is, his argument precludes the possibility of recognizing that there is an antinomy at the heart of language and philosophical reason. This occlusion of the simultaneously world-disclosing and world-imposing character of language feeds and sustains Habermas’s legal and political arguments, (...) where he states that in order to achieve consensus rational deliberation must eliminate force. In this paper, I claim that this argument operates through a manoeuvre that leaves Habermas’s position curiously blind to its own predicament. To explain why, I turn to Kant’s treatment of the problem of evil in Religion Within the Boundaries of Mere Reason. Here, as in the Western philosophical tradition more generally, evil has no separate existence: it is folded back into Kant’s philosophical scheme. Arendt notes that as soon as Kant identifies the problem of evil he rationalizes it into comprehensible motives. I will show how, through a move that is structurally similar to Kant’s rationalization of evil, Habermas rationalizes and attempts to eliminate violence from his consideration of law and language. In Habermas’s work, law and language appear as ciphers for reason. The case to be made here is that Habermas’s inability to recognize the paradoxical character of language and reason makes his work blind to the violence in which it is unavoidably implicated. In ambiguous situations, infants have the tendency to gather information from a social interaction partner to regulate their behavior [social referencing ]. There are two main competing theories concerning SR’s function. According to social-cognitive information-seeking accounts, infants look at social interaction partners to gain information about the ambiguous situation. According to co-regulation accounts, infants look at social interaction partners to receive emotional support. This review provides an overview of the central developments in SR literature in the past years. We focus (...) on the role of situational aspects such as familiarity of SR partners and situational threat, not only for SR, but also for subsequent behavioral regulation. As the competing accounts make different predictions concerning both contextual factors, this approach may reveal novel insights into the function of SR. Findings showed that a higher familiarity of SR partners consistently resulted in decreased looking and that higher threat remains largely understudied, but seemed to increase looking in the first few studies. Concerning behavioral regulation findings are mixed. We point out that moving toward a more complex situatedness may help to disentangle the heterogeneous results by considering the interaction between familiarity and threat rather than investigating the factors in isolation. From a general perspective, this review underlines the importance of situational factors and their interaction in eliciting a phenomenon, such as SR, but also in determining the nature of the phenomenon itself. The Great Exhibition of 1851 in London was a large, highly significant affair that brought the innovations and industries of the world together under one roof. While it was indeed a global event, it has been argued, especially by people at the time, whether or not the exhibition was held for the great benefit of the British. This paper will argue that the primary motivation for the British was indeed their own benefit by looking at British prestige, what they had (...) to offer the exhibition, and what they stood to gain by hosting such an event. This paper considers the resources MacIntyre provides for undertaking empirical work using his goodsvirtues-practices-institutions framework alongside the attendant challenges of doing such work. It focuses on methods that might be employed in judging the extent to which observed social arrangements may conform to the standards required by a practice-embodying institution. It concludes by presenting the outline of an empirical project exploring at a music facility in the North East of England, The Sage Gateshead.

Interest in republicanism as a political theory has burgeoned in recent years, but its implications for the understanding of law have remained largely unexplored. Legal Republicanism is the first book to offer a comprehensive, critical survey of the potential for creating republican accounts of fundamental issues in law and legal theory.

This paper poses a series of objections to Sofia Jeppsson’s hard-line reply to Pereboom’s four-case manipulation argument. According to Jeppsson, the compatibilist can resist Pereboom’s argument by disregarding facts about what caused an agent to act (the ‘causal perspective’) and focusing primarily on the agent’s own perspective of their action (the ‘agential perspective’). Jeppsson argues that we have an obligation to disregard the causal perspective. This is for two reasons: (I) we must disregard the causal facts of the agent’s action, (...) including whether they have been manipulated, since the agent has reason to disregard them; and (II) the causal perspective is not obviously relevant to judgments of moral responsibility. In this paper, I show that both (I) and (II) can be undermined because the causal perspective provides information that is necessary for moral deliberations. This is because it would seem that at least one necessary condition for an agent to be considered morally responsible is that the agent’s actions are not fully controlled by someone else. Since this is information that we can only obtain via the causal perspective, we do not have an obligation to disregard this perspective and so need not accept the compatibilist’s hard-line account. This paper considers the state of contingent laborers, Ph.D. holders, lovers of robust scholarship, and hopeful academics who toil away in the neoliberal university in the search for the academic good life. The author argues that the academic good life is a fantasy and agrees that the fantasy is cruel, i.e. not attainable or livable, but does suggest the practices of teaching and conducting research, the practices that make up a scholarly life, are sustainable activities of a good life that (...) can and should inform how we use the university. After drawing on Alasdair MacIntyre and Chris Higgins to picture the academic good life, Deane turns to theories of refusal articulated by Sandy Grande and Bonnie Honig to suggest refusal practices for reimagining lives that are academic and good. Claims that the self and experience in general are narrative in structure are increasingly common, but it is not always clear what such claims come down to. In this paper, I argue that if the view is to be distinctive, the element of narrativity must be taken as literally as possible. If we do so, and explore the consequences of thinking about our selves and our lives in this manner, we shall see that the narrative view fundamentally confusues art and (...) life. We learn from art itself that our selves and lives transcend narratives and that thinking in a narrative manner ignores the rich complexity of individual persons. This is an essay in appreciation of The Abundant Herds, a study of the ama-Zulu's naming practices for their Nguni cattle. The book reveals an aesthetic vision in which contemplative and practical attention are intertwined and a complex classificatory system does not undermine an appreciation of the individuality of the cattle. The book and the practices it celebrates permit a richer account of the beauty of farm animals to the standard functionalist approach.

We have followed with interest the commentaries arising from Moore and Donnellys1 argument that authorities in charge of research ethics committees should focus primarily on establishing code-consistent reviews.1 We broadly agree with Savulescu’s2 argument that ethics committees should become more expert, but in a different way and for a different reason. We have recently been working with the UK Health Research Authority analysing the outcomes of their ‘Shared Ethical Debate’ exercises.3 Each ShED exercise involves the circulation of a single research (...) project to a number of RECs. The resulting minutes from each REC are compared along with the final decisions made by each REC on the project under consideration. This process was originally an administrative exercise designed to promote greater consistency among the 60 or so ethics committees that were brought under the HRA ) umbrella within the UK National Health Service. Over 20 ShEDs have been run, and although the process has significant weaknesses and has not always been run consistently, the results of the exercises are fascinating. Broadly speaking, NHS RECs have been getting more consistent over time in terms of their decision-making, but the reasons for the final decisions as described in the committee minutes continue to vary widely. Qualitative research now needs to be done to understand why different committees can have such different discussions in relation to exactly the same research project and yet come to essentially the same conclusion. This paper explores recent vigilance attending pedophilia in the UK context. It examines governmental and popular responses to the perceived threat posed by child sex offenders, exhibited respectively in provisions for sex offender orders within the Crime and Disorder Act 1998, and in press and public campaigns for the “naming and shaming” of paedophiles. These two responses cohabit in current contexts of concern about childhood as innocence and vulnerability, and are worked out against the figure of the paedophile as a (...) “dangerous individual”; nevertheless, they invoke different visions of political community. Developing Foucault's observation that contemporary political rationalities combine two distinct models of political community, that of the juridically constituted polity and that of the society rendered calculable and organized through normalizing models of risk, the paper argues that both of these models are evident in governmental and popular responses to paedophilia. However, where the former, a technical and administrative response to a problem of social order, aims to achieve public safety through the professional prediction and management of risk, the latter is premised on the elimination of danger,demanding the public outing of paedophiles and their exorcism from the community. While these responses contest whether danger can be turned into risk through professional management, they are mutually enhancing in fostering governmental and popular concern with public and community safety. I'm going to focus my comments on a relatively small part of Joe Heath's book, the section on the household division of labour. Although it's a small piece of a much larger picture, I've chosen this area for two reasons: First, it connects with my own interests in issues of family justice. Second, I think for me it highlights a potentially larger problem concerning the relationship between justice and efficiency. When Heath puts the contrast between those who place rights before (...) efficiency in terms of a contrast between the US and Canadian health care systems, I find that I'm in agreement with the argument for efficiency. But when I think about the contrast in terms of the question of the gendered division of domestic labour, I'm less certain that I want to accord efficiency the kind of status it has according to Heath. Abstract:This article examines how two American theorists, Gayle Rubin and Judith Butler, deploy geologic language during the 1990s moment when their feminist careers morphed into queer careers. I argue that the precise composition of this institutional shift – methodological, material, and epistemological – is both reflected and refracted in the figure of the rock. A symbol that connotes fixity in short time spans, but dynamism in long ones, the rock oscillates between facticity and dissolution, mirroring shifting notions of sex and (...) gender in the 1990s. In her retrospective account of the emergence of queer theory, Rubin’s use of a fossil metaphor ushers the field toward a non-reproductive and non-procreative genealogy, illuminating a different temporal texture to such seemingly fixed structures as sex, gender, and sexuality. Butler’s inherited geologic language conceives of gender as the process of sedimentation that resists the biological determinism of identity-based feminist politics. Examining the rock provides crucial readings of Butler’s materiality, one that oscillates between fixed being and dynamic becoming, stability and change, surface signification and depth excavation. His view that human beings are not rational but symbolic animals and his famous dispute with Martin Heidegger at Davos in 1929 are compelling alternatives to the deadlock between 'analytic' and 'continental' approaches to philosophy. SAMANTHA GREY | : Prevailing connotations of reconciliation orbit concord or harmonious coexistence, meaning that concern for justice is necessarily subordinated to a more casually pragmatic peace. Bringing justice considerations to the fore means focusing on reparations as a key element of reconciliation’s suite of activities—but reparations are necessarily a matter of process, which precludes considering elements of the “package” in isolation from one another, as is the case with traditional evaluative criteria of motivation or proportion. Accordingly, this article (...) proposes that reparations are better framed as a considered reaction to the unjust allocation of burdens, so that subsequent reallocations serve justice by answering the needs and demands of survivors. Taking cues from a variety of sources both within and beyond the transitional justice literature, the work at hand attempts just such a retrospective reframing by looking at a recently completed Canadian reparations process: the Indian Residential Schools Settlement Agreement. | : Les connotations dominantes de la réconciliation gravitent autour de la concorde ou de la coexistence harmonieuse, signifiant que le souci de la justice est nécessairement subordonné à une paix plus pragmatique. In the Critique of Pure Reason, Kant describes schematism as a (A141/B180–1). While most commentators treat this as Kant's metaphorical way of saying schematism is something too obscure to explain, I argue that we should follow up Kant's clue and treat schematism literally as Kunst. By letting our interpretation of schematism be guided by Kant's theoretically exact ways of using the term Kunst in the Critique of Judgment we gain valuable insight into the nature of schematism, as well as its (...) connection to Kant's concerns in the third Critique. Abstract25.6 Million people in the United States have Limited English Proficiency (LEP), defined as insufficient ability to read, write, or understand English. We will (1) Delineate the merits of approaching language as a social determinant of health, (2) highlight pertinent public health values and guidelines which are most relevant to the plight of populations with LEP and (3) Use the COVID-19 pandemic as an example of how a breakdown in public health ethics values created harm for populations and patients with (...) LEP. We define a framework to tease out public health responsibilities given some populations’ limited proficiency in a society’s predominant language. The American Public Health Association (APHA) public health ethics core values serve as a framework to interrogate current practices. We use the COVID-19 case to illustrate gaps between health policy and healthcare disparities experienced by populations with LEP. (shrink)

ABSTRACTThis article addresses the identity of the legitimate actors of international law-making from the perspective of democratic theory. It argues that both states or state-based international organisations, and civil society actors should be considered complementary legitimate actors of international law-making. Unlike previous accounts, our proposed model of representation, the Multiple Representation Model, is based on an expanded, democratic understanding of the principle of state participation: it is specifically designed to palliate the democratic deficits of more common versions of the Principle (...) of State Consent. Second, it endorses a qualified version of the Principle of Civil Society Participation, one that is much more restrictive and more critical of the democratic defects of civil society actors than most of its current supporters. Taking hunting as an example, an account of animal beauty as animation can be developed. Our delight in many kinds of animals is crucially a matter of an aesthetic property which can be called “the animate” or “animation.” A proper response to animate animal beauty is a virtuous character trait that hunters lack. The beauty of animals calls for particular responses from observers: it brings along certain duties and requires the cultivation of certain traits of character—ones that are incompatible with (...) hunting animals. Thomas Hobbes is an iconic figure who serves as an easy reference for pundits commenting on the brutality of war as well as for critics of a distinctly modern individualism in which calculating and rapacious self-interest is the cause of the violence, destruction, and exploitation endemic to the contemporary world. Frost's reading of Hobbes's philosophy shows us that underlying such visions of self and politics is another iconic figure: that of the Cartesian subject. What gives the iconic Hobbes his hardcore (...) individualism and its corollary accounts of instrumentalism, conflict, and absolutism is a Cartesian rendering of the self as split into mind and body. Carefully elaborating Hobbes's materialist ontology, _Lessons from a Materialist Thinker_ challenges both our implicit Cartesian assumptions about the self and the commonplace Hobbes that so readily figures violence in our political imagination. Through his materialism, Hobbes presents an alternative modern account of self-consciousness, reason, agency, power, freedom, and responsibility. In doing so, he shows that our fundamental intersubjectivity and interdependence require that we pursue peace above all else. (shrink)

One of the more striking aspects of Maurice Merleau-Ponty's Phenomenology of Perception (1945) is his use of psychological case studies in pathology. For Merleau-Ponty, a philosophical interpretation of phenomena like aphasia and psychic blindness promises to shed light not just on the nature of pathology, but on the nature of human existence more generally. In this paper, I show that although Merleau-Ponty is surely a pioneer in this use of pathology, his work is deeply indebted to an earlier philosophical study (...) of pathology offered by the German Neo-Kantian Ernst Cassirer in the third volume of the Philosophy of Symbolic Forms (1929). More specifically, I argue that Merleau-Ponty, in fact, follows Cassirer in placing Kant's notion of the productive imagination at the centre of his account of pathology and the features of existence it illuminates. Recognizing the debt Merleau-Ponty's account of pathology has to the Kantian tradition not only acts as a corrective to more recent interpretation of Merleau-Ponty's views of pathology (Dreyfus, Romdenh-Romluc), but also recommends we resist the prevailing tendency to treat Merleau-Ponty's philosophy as anti-Kantian. Instead, my interpretation seeks to restore Merleau-Ponty's place within the Kantian tradition. (shrink)
