Les perspectives ouvertes par le big data et la justice prédictive ont été largement commentés par les économistes du droit. L’article revient sur la manière dont on peut appréhender ces évolutions économiques et technologiques en montrant comment la possibilité de disposer d’informations plus précises sur le droit à venir renouvelle les problématiques classiques de l’économie du droit. Après une brève description économique de ces innovations techniques, on revient sur la possible automatisation et individualisation de l’application des règles de droit pour (...) en saisir les implications en termes d’efficacité économique du droit. Enfin, on traite de l’automatisation des jugements et du travail du juge en croisant cette question avec celle, bien connue en économie du droit, des biais de jugements et des biais cognitifs. The processes underwriting the acquisition of culture remain unclear. How are shared habits, norms, and expectations learned and maintained with precision and reliability across large-scale sociocultural ensembles? Is there a unifying account of the mechanisms involved in the acquisition of culture? Notions such as “shared expectations,” the “selective patterning of attention and behaviour,” “cultural evolution,” “cultural inheritance,” and “implicit learning” are the main candidates to underpin a unifying account of cognition and the acquisition of culture; however, their interactions require greater (...) specification and clarification. In this article, we integrate these candidates using the variational (free-energy) approach to human cognition and culture in theoretical neuroscience. We describe the construction by humans of social niches that afford epistemic resources called cultural affordances. We argue that human agents learn the shared habits, norms, and expectations of their culture through immersive participation in patterned cultural practices that selectively pattern attention and behaviour. We call this process “thinking through other minds” (TTOM) – in effect, the process of inferring other agents’ expectations about the world and how to behave in social context. We argue that for humans, information from and about other people's expectations constitutes the primary domain of statistical regularities that humans leverage to predict and organize behaviour. The integrative model we offer has implications that can advance theories of cognition, enculturation, adaptation, and psychopathology. Crucially, this formal (variational) treatment seeks to resolve key debates in current cognitive science, such as the distinction between internalist and externalist accounts of theory of mind abilities and the more fundamental distinction between dynamical and representational accounts of enactivism. Spinoza studies have seen a renaissance of interest in his views on modality, from which considerable disagreement has emerged about Spinoza's modal commitments. Much of this disagreement stems from larger interpretive disagreements about Spinoza's metaphysics. After a brief introduction, this SEP article begins with Spinoza's views on the distribution of modal properties, which quickly leads the heart of Spinoza's metaphysics, intersecting his views on causation, inherence, God, ontological plenitude and the principle of sufficient reason. Although the question of whether Spinoza (...) was a necessitarian is the predominant topic of discussion in the recent secondary literature on Spinoza's modal views, Spinoza also sketches interesting accounts of the nature of modality and the ground of modality that shed fresh light on his modal commitments. Though understudied by recent interpreters, these latter topics were of interest to Spinoza's peers and remain vibrant research questions in contemporary metaphysics of modality. (shrink)

Machery and Weiskopf argue that the kind concept is a natural kind if and only if it plays an explanatory role in cognitive scientific explanations. In this paper, we argue against this explanationist approach to determining the natural kind-hood of concept. We first demonstrate that hybrid, pluralist, and eliminativist theories of concepts afford the kind concept different explanatory roles. Then, we argue that we cannot decide between hybrid, pluralist, and eliminativist theories of concepts, because each endorses a different, but equally (...) viable, specification of the explananda of cognitive science. It follows that an explanationist approach to determining the natural kind-hood of concept fails, because there is no consensus about whether or not concept should be afforded an explanatory role in our best cognitive scientific explanations. We conclude by considering what our critique of explanationism could imply for further discussions about the explanatory role of concepts in cognitive science. (shrink)

Some philosophers argue that all concepts cannot have the same representational structure, because no single kind of representation has been successful in accounting for the phenomena related to the formation and application of concepts. Here, I argue against this “appeal to cognitive science” by demonstrating that different theories of the kind concept cohere with different interpretations of the argument. To circumvent the threat of relativism, I argue that theories of concept should be understood as working hypotheses, which are provisionally accepted (...) to facilitate the investigation and explanation of the mind/brain. From this perspective, theories of concept are to be evaluated as part of a comparative analysis of the different kinds of cognitive science they inspire. (shrink)

Understanding inductive reasoning is a problem that has engaged mankind for thousands of years. This problem is relevant to a wide range of fields and is integral to the philosophy of science. It has been tackled by many great minds ranging from philosophers to scientists to mathematicians, and more recently computer scientists. In this article we argue the case for Solomonoff Induction, a formal inductive framework which combines algorithmic information theory with the Bayesian framework. Although it achieves excellent theoretical results (...) and is based on solid philosophical foundations, the requisite technical knowledge necessary for understanding this framework has caused it to remain largely unknown and unappreciated in the wider scientific community. The main contribution of this article is to convey Solomonoff induction and its related concepts in a generally accessible form with the aim of bridging this current technical gap. In the process we examine the major historical contributions that have led to the formulation of Solomonoff Induction as well as criticisms of Solomonoff and induction in general. In particular we examine how Solomonoff induction addresses many issues that have plagued other inductive systems, such as the black ravens paradox and the confirmation problem, and compare this approach with other recent approaches. This text, which is part of a project, ‘Toward a Politics and Poetics of Singularity’, explores the implications of a phrase used more or less simultaneously, although independently, by Walter Benjamin and Sigmund Freud, ‘the single trait’. In his 1962 lectures on the problem of identification, Jacques Lacan focused on this phrase in Freud in order to exemplify the difference between the subject and the signifier. The use of the phrase by Benjamin in his essay on ‘Destiny and Character’ inflects (...) the discussion toward questions of ‘comedy’ and ‘tragedy’, and thereby links the singularity of the signifying process to literary and theatrical forms. Like process theism, Christian theology affirms the immanence of God in the world and of the world in God. Unlike process theism, it also affirms the ontological priority of God over the world. As a result, Christian theologians will object to describing God’s relation to the world by analogy with the mind’s relation to the body or in terms of whole-part relations. In Christian history, the God-world relation has been more often described in terms of “participation.” The world is said (...) to participate in God, keeping in mind that this language is highly metaphorical. The idea of participation is a development of themes enunciated by Plato and Aristotle, but adapted by Christian theologians to trinitarian ends. The created world participates in God by reflecting the trinitarian life of identity and difference. This establishes an organic and internal relation between God and the world. (shrink)

This paper shows that Hannah Arendt was a theorist both of secularization as a process and the secular as a goal of modern politics. It reconstructs these arguments in her corpus, especially her book "On Revolution," and argues that this dimension of her work may have been a response to Carl Schmitt (and is in any event now usefully read in such a way). The paper ends by examining how Arendt might reply to currently influential challengers of a secular politics.
