This article argues that an engagement with the powerful critical insights of Žižek’s theory of ideology and practice of cultural critique is a necessary step for any art historical methodology which aims to fully account for a work of art’s function within the society of its creation and reception, and to explain how it came to play such a role. However, any attempt to situate cultural artefacts within historically contingent networks of social relations requires an account of historical change incompatible (...) with any formalist or transcendentalist methodology. Moreover, if it is to be of any use as an academic discourse, art history must be able to account for the specifities of ‘art’ as a distinct—but not autonomous—sphere of human activity. It is precisely these two issues that a wholesale importation of Žižek’s writing into the domain of art history encounters. A solution must be found whereby the critical lessons of Žižek are not ‘lost in translation’. In this vein, the present article begins by outlining Žižek’s conception of ideology and elucidating the problematic consequences of any straightforward application of its parameters as an art historical methodology. It then reads the interventions of Jacques Rancière and Judith Butler as providing the necessary theoretical tools by which one can construct the possibility of a powerful Žižekian art historical methodology. My primary target in this paper is a puzzle that emerges from the conjunction of several seemingly innocent assumptions in action theory and the metaphysics of moral responsibility. The puzzle I have in mind is this. On one widely held account of moral responsibility, an agent is morally responsible only for those actions or outcomes over which that agent exercises control. Recently, however, some have cited cases where agents appear to be morally responsible without exercising any control. This leads some (...) to abandon the control-based account of responsibility and replace it with an alternative account. It leads others to deny the intuition that agents are responsible in these troublesome cases. After outlining the account of moral responsibility I have in mind, I look at some of the arguments made against the viability of this theory. I show that there are conceptual resources for salvaging the control account, focusing in particular on the nature of vigilance. I also argue that there is empirical data that supports the control account so conceived. (shrink)

This paper addresses the extent to which both Julian Barbour‘s Machian formulation of general relativity and his interpretation of canonical quantum gravity can be called timeless. We differentiate two types of timelessness in Barbour‘s (1994a, 1994b and 1999c). We argue that Barbour‘s metaphysical contention that ours is a timeless world is crucially lacking an account of the essential features of time—an account of what features our world would need to have if it were to count as being one in which (...) there is time. We attempt to provide such an account through considerations of both the representation of time in physical theory and in orthodox metaphysical analyses. We subsequently argue that Barbour‘s claim of timelessness is dubious with respect to his Machian formulation of general relativity but warranted with respect to his interpretation of canonical quantum gravity. We conclude by discussing the extent to which we should be concerned by the implications of Barbour‘s view. (shrink)

This survey outlines a history of museums written through biographies of objects in their collections. First, the mechanics of the movement of things and the accompanying shifts in status are considered, from manufacture or growth through collecting and exchange to the museum. Objects gathered meanings through associations with people they encountered on their way to the collection, thus linking the history of museums to broader scientific and civic cultures. Next, the essay addresses the use of items once they joined a (...) collection, whether classificatory, analytical, or in display. By thus embedding the study of scientific practice in material culture, this approach contributes to constructivist histories of science. The final section addresses the role of objects in the experience of the visitors, emphasizing how fruitful the history of museum objects can be in the study of the public engagement with science. Samuel Pufendorf is one of the most important moral and political philosophers of the seventeenth century. His theory, which builds on Grotius and Hobbes, was immediately recognized as a classic and taken up by writers as diverse as Locke, Hume, Rousseau, and Smith. Over the past twenty years there has been a renaissance of Pufendorf scholarship. On the Duty of Man and Citizen is Pufendorf's own epitome of his monumental On the Law of Nature and of Nations, and it (...) served as a basic text in European universities throughout the Enlightenment. This edition has a lucid and historically sensitive translation by Michael Silverthorne, the first since the early twentieth century. James Tully's introduction sets the text in its context, summarizes the main arguments, surveys recent literature on Pufendorf, and shows how Pufendorf transformed natural law theory into an independent discipline of juristic political philosophy that dominated reflection on politics until Kant. A theory’s fertility is one of the standard theoretical virtues. But how is it to be construed? In current philosophical discourse, particularly in the realism debate, theoretical fertility is usually understood in terms of novel success: a theory is fertile if it manages to make successful novel predictions. Another, more permissible, notion of fertility can be found in the work of Ernan McMullin. This kind of fertility, McMullin claims, gives us just as strong grounds for realism. My paper critically assesses (...) McMullin’s notion of fertility and its realist rationale. It concludes that McMullin’s preferred example, namely the fertile development of the Bohr-Sommerfeld model of the atom, does not support McMullin’s argument for realism. Although the implications for the realism debate are as of yet unclear, the case study offers some important methodological lessons. (shrink)

There is a mystery at the heart of Plato's Parmenides. In the first part, Parmenides criticizes what is widely regarded as Plato's mature theory of Forms, and in the second, he promises to explain how the Forms can be saved from these criticisms. Ever since the dialogue was written, scholars have struggled to determine how the two parts of the work fit together. Did Plato mean us to abandon, keep or modify the theory of Forms, on the strength of Parmenides' (...) criticisms? Samuel Rickless offers something that has never been done before: a careful reconstruction of every argument in the dialogue. He concludes that Plato's main aim was to argue that the theory of Forms should be modified by allowing that forms can have contrary properties. To grasp this is to solve the mystery of the Parmenides and understand its crucial role in Plato's philosophical development. (shrink)

In Metaphysics Λ, Aristotle appeals to the prime mover: an unmoved mover that is the first moving cause of the world. Elsewhere, he calls the science concerned with the prime mover ‘theology’ (Meta. E.1, 1026a19). But what is the point of this science? On a common view, its purpose is to give an account of the prime mover itself, and especially to prove its existence. By contrast, I argue that Aristotle’s theology in Metaphysics Λ is ‘nature-bound’: it ultimately aims at (...) explaining facts about the perceptible world, in particular the motion of heavenly bodies and the cycle of generation of perishable substances. Ricoeur’s philosophical project can be broadly termed as a philosophical anthropology. Within this context, a main role is given to the issue of imagination through the resources of phenomenology, hermeneutics, and reflexive philosophy. The issue of picture, however, remains quite unknown and has not been much questioned; it might even be undermined by being reduced to the context of reproductive imagination as opposed to that of productive imagination within Ricoeur’s anthropology, and due to the emphasis on the linguistic relationship to (...) sense or meaning. Yet, instead of opposing the plane of picture to the plane of sense or meaning, an articulated connection between those two planes should be sought. The issue of symbolism opened by Ricoeur in his Philosophie de la volonté provides the starting point for our investigation. From that early hermeneutics on to La mémoire, l’histoire, l’oubli, via De l’interprétation. Essai sur Freud, La Métaphore vive, and Temps et récit, one could also consider that picture makes us think. But the issue of symbolism cannot be distinguished from that of imagination. One also has to link two paths of Ricoeur’s philosophy through the issue of symbolism, one that is orientated in the path of hermeneutics – the progression to the standpoint set by Du texte à l’action –, another that links the project of a philosophical anthropology to the fields of art and aesthetics. The research is thus structured around four parts. A first part is focused on the articulated connection between Ricoeur’s philosophy of imagination and philosophical aesthetics by addressing the hermeneutical prospect as the condition for the effectiveness of this connection. Extending this hermeneutical stance, a second part seeks to establish a bond between Ricoeur’s notion of a critical hermeneutics and the issue of picture. A third part, concurrent with the context of a critical hermeneutics, aims to consider imagination as mediating the plane of art and the plane of experience by referring to Ricoeur’s reading of analytic philosophy and, more specifically, analytic philosophy of art. Relying on the previous parts, a fourth part finally addresses the field of film, articulating ontological, narrative, and social layers to a philosophical hermeneutics. (shrink)

From where does management acquire its authority to act in the name of the corporation? The orthodoxy that shareholders alone authorise management is frequently criticised for treating the corporation as the property of shareholders, rather than as a distinct legal person in its own right (Ciepley, 2013; Deakin, 2012; Robé, 2011; Stout, 2012). However, Hobbes’s theory of incorporation in Leviathan shows this influential critique of shareholder primacy to rest on a non sequitur. It does not follow from the (correct) observation (...) that the corporation is a legal person to the conclusion that its interests are distinct from those of shareholders. Just as individuals become citizens of a state when they authorise a sovereign, shareholders are incorporated when they authorise a representative assembly to act in their interests. Shareholders thereby form a single corporate person and are ultimately responsible for whatever is done in their corporate name. (shrink)

Recently there has been a growing literature on the concept of moral certainty. This concept, which is inspired by Wittgenstein’s reflections in On Certainty, is most prominently argued for by Nigel Pleasants. Pleasants contends that there is a meaningful parallel to be drawn between the epistemic certainties discussed by Wittgenstein and moral certainties. These moral certainties are unreflective, non-propositional, and show in the ways that we act. In addition, these certainties cannot be doubted by a reasonable moral agent. In a (...) recently published article, Fairhurst is critical of Pleasants’ account. Fairhurst argues that there are problems with Pleasants’ example of a moral certainty, 'it is wrong to kill innocent non-threatening people'. Fairhurst appeals to euthanasia as an example of when a reasonable person could meaningfully doubt that it is wrong to kill innocent, non-threatening people. If this is a certainty, then a doubt such as this should not be possible. In addition, he argues that Pleasants’ claim that moral certainties are natural is not well substantiated. In this article, I attempt to defend an account of moral certainty against Fairhurst’s criticisms. I divide his criticisms into two parts. His first set of criticisms deal with Pleasants’ example of a moral certainty. I argue that some of his criticisms are inconsistent while others can be addressed by making a small amendment to Pleasants’ account. His second criticism deals with Pleasants’ claim that moral certainties are natural. In order to address this criticism, I appeal to Machery’s Nomological Account of human nature and use it as a basis that allows us to consistently make the claim that there are natural moral certainties. This paper focusses on the Rabbinic suggestion that the attitude of awe, rather than any particular belief, lies at the heart of religiosity. On the basis of these Rabbinic sources, and others, the paper puts forward three theses: (1) that belief is not a sufficiently absorbing epistemic attitude to bear towards the truths of religion; (2) that much of our religious knowledge isn’t mediated via belief; and (3) that make-believe is sometimes more important, in the cultivation of religiosity than is (...) mere belief. Timothy O’Connor has recently defended a version of libertarianism that has significant advantages over similar accounts. One of these is an argument that secures indeterminism on the basis of an argument that shows how causal determinism threatens agency in virtue of the nature of the causal relation involved in free acts. In this paper, I argue that while it does turn out that free acts are not causally determined on O’Connor’s view, this fact is merely stipulative and the argument that (...) he presents for this conclusion begs the question. In this paper we contribute to “sociology in bioethics” and help clarify the range of ways sociological work can contribute to ethics scholarship. We do this using a case study of an innovative neurotechnology, functional magnetic resonance imaging, and its use to attempt to diagnose and communicate with severely brain-injured patients. We compare empirical data from interviews with relatives of patients who have a severe brain injury with perspectives from mainstream bioethics scholars. We use the notion of an “ethical landscape” (...) as an analogy for the different ethical positions subjects can take—whereby a person’s position relative to the landscape makes a difference to the way they experience and interact with it. We show that, in comparison to studying abstract ethics “from above” the ethical landscape, which involves universal generalizations and global judgements, studying ethics empirically “from the ground,” within the ethical landscape foregrounds a more plural and differentiated picture. We argue it is important not to treat empirical ethics as secondary to abstract ethics, to treat on-the-ground perspectives as useful only insofar as they can inform ethics from above. Rather, empirical perspectives can illuminate the plural vantage points in ethical judgments, highlight the “lived” nature of ethical reasoning, and point to all ethical vantage points as being significant. This is of epistemic importance to normative ethics, since researchers who pay attention to the various positions in and trajectories through the ethical landscape are unlikely to think about ethics in terms of abstract agency—as can happen with top-down ethics—or to elide agency with the agency of policymakers. Moreover, empirical perspectives may have transformative implications for people on the ground, especially where focus on the potential harms and benefits they face brings their experiences and interests to the forefront of ethical and policy discussion. Or perhaps ranges too far. For the questions suggested by this concatenation of terms cannot be limited to the fate or future of "theory" in (...) whatever will remain of the "university" in a globalized world. And yet it is no doubt significant that "theory" leads the parade—significant but also perhaps part of the problem. For not just etymology links "theory" to notions such as detached contemplation, spectatorship, and appropriation through vision. The history and practice that have been associated with this term continue, even today, to be indebted to the dualist paradigm of an underlying subject—today reformulated as "agent" or "position"—confronting and comprehending an ob-ject. And yet, if we are still discussing "theory," here and today, it is by virtue of a series of texts that have persistently and powerfully questioned the subject-object paradigm that has dominated theoretical discourse at least since Descartes, and sought to elaborate alternatives to it. Those alternatives have almost always involved a reflection upon language as the medium of a practice that is no longer "theoretical" in the traditional sense, because it no longer works within the parameters of the subject-object model of cognition and truth. From Kierkegaard to Nietzsche, Benjamin, Heidegger, de Man, and Derrida, the subject-object model of cognition has been reinterpreted as an effect of the medium of language, a medium that articulates itself through the reading, writing, and repetition of texts, understood as concatenations of significance that both respond to and address an irreducible alterity.The "university" has always occupied an equivocal position with respect to this "linguistic" problematization of the subject-object model of cognition and truth: not only because "the university" as such has never existed—not at least as the singular universal implied by the definite article—but even more, because of the traditional claim of universities to serve as places where universally valid cognition is both transmitted and produced. In this sense, notions such as "the globalization of the university" simply continue the universalizing claims built into universities and promoted by them in order to justify their social existence and dependency.The very notion, or rather figure, implied in the notion of "globalization" tends to strengthen such universalism. Coming after the struggle between Communist and Capitalist camps in the Cold War, "Globalization" stresses that there is no place left on the "globe" where the capitalist system, its values, its power, and way of life can be contested. Relative essentialism, the view that multiple objects about which there are distinct de re modal truths can occupy the same space at the same time, is a metaphysical view that dissolves a number of metaphysical issues. The present essay constructs and defends relative essentialism and argues that it is implicit in some of the ideas of W. V. Quine and Donald Davidson. Davidson’s published views about individuation and sameness can accommodate the common-sense insights about change and persistence of Aristotle and (...) Kripke. Aristotle and Kripke have to give up unmediated direct reference resting on a unique correct articulation of reality into entities. Davidson has to acknowledge a distinction between descriptions giving accidental and those giving essential features of an object. Quine and Davidson were in a position to be a relative essentialist, but were over-impressed by supervenience. The relative essentialist view of beings developed from Quine and Davidson strongly suggests the Heideggerian distinction between beings and Being, and is the perspective from which analytic philosophy can engage that topic. Relative essentialism also connects analytic philosophy to Derrida’s thinking about differance. (shrink)
