The present paper deals with the idea of understanding Vedic ethics as a code of righteous living, in the light of Mīmāṁsā philosophy. The paper also intends to reflect upon the possibility of such methods as a means of attaining liberation. In other words, the Vedas provide us with prescriptive codes of right and wrong actions. It commands us about duties and non-duties, through the performance of rituals, in order to lead a good life. We know that human endeavours are (...) primarily based on attaining the desired, and to prevent the unwanted ends. Hence, the entire effort of human actions lies in the fact that we want to attain the cessation of sufferings. This paves the way for studies in Soteriology, and the question arises that, could the Vedas be considered as a literature on Soteriology. The paper consists of a number of sections. The initial ones involve the linguistic analysis of the Vedic statements based on Sanskrit grammar and semantics. These are aimed at depicting the manner in which Vedic sentences act as prescriptive ethical codes. The latter ones deal with the questions raised by the opposing schools, namely Sāṁkhya-Yoga, against the idea of considering Vedas as a supreme sanction of means, leading beings to their salvation from empirical sufferings, and their plausible responses. Current understanding of Mill as a founding father of liberalism is a Cold War creation. Discarding this conception opens the way to a general reassessment of his thought: who was the historical Mill? He did not define himself as liberal and there is no simple template. Most obviously he is a pluralist, defined by a plural heritage received through his father. This framework permitted great creativity in political and social theory, but it was diffuse. The one clear unifying theme is (...) a unique conception of a hierarchy of intellect founded on the inexorable accumulation of positive knowledge. The one important exception to this is political economy. What stands out overall is his individuality, where Mill embodies his own ideal. So apart from political economy, where he could be identified in more conventional terms, his nineteenth-century legacy was personal and incalculably diffusive rather than doctrinaire. The concern of this paper is to critique the political conception of nationalism as a theory of the nation-state. The basic point of the critique is that when the interests of the nation and the principles of the state coincide there emerges a fierce sense of national identity which endangers moral indifference to outsiders, the people within and outside the national boundary, without remorse. Here the attempt to uphold national identity is something more than nationhood. Besides involving territorial identity, common (...) language, custom and culture essential to the idea of a “nation,” it also upholds the consciousness of these as determining separate rights and allegiances, the idea of attachment to a nation and its interests. Such a consciousness can emerge only on the adoption of certain populist ideas such as racism, ethnicity and even such popular elusive myths as the “greatness” of a nation, the urge for the maintenance of “national character,” etc. Such “nationalist xenophobia” leads to the intensification of the distinction between the “own” and the “other,” “national” and the “alien,” the “citizen” and the “migrant” leading to “ethnic disharmony,” “colour bias,” hatred and suspicion of persons with whom one has lived closely as neighbours for decades. The most popular is the economic discourse of the “migrants” putting the “nationals” out of work. All this has its toll on multi-culturalism and humanitarian concerns. Many affluent nations have become cold to human misery, suffering and deaths from wars, terrorism, acute poverty, political persecution, environmental degradation, etc. This has created an “existential” crisis for millions of people on earth. This paper presents an attempt to bridge the gap between logical and cognitive treatments of strategic reasoning in games. There have been extensive formal debates about the merits of the principle of backward induction among game theorists and logicians. Experimental economists and psychologists have shown that human subjects, perhaps due to their bounded resources, do not always follow the backward induction strategy, leading to unexpected outcomes. Recently, based on an eye-tracking study, it has turned out that even human subjects who (...) produce the outwardly correct ‘backward induction answer’ use a different internal reasoning strategy to achieve it. The paper presents a formal language to represent different strategies on a finer-grained level than was possible before. The language and its semantics help to precisely distinguish different cognitive reasoning strategies, that can then be tested on the basis of computational cognitive models and experiments with human subjects. The syntactic framework of the formal system provides a generic way of constructing computational cognitive models of the participants of the Marble Drop game. (shrink)

Automatic summarization of legal case judgements, which are known to be long and complex, has traditionally been tried via extractive summarization models. In recent years, generative models including abstractive summarization models and Large language models (LLMs) have gained huge popularity. In this paper, we explore the applicability of such models for legal case judgement summarization. We applied various domain-specific abstractive summarization models and general-domain LLMs as well as extractive summarization models over two sets of legal case judgements – from the (...) United Kingdom (UK) Supreme Court and the Indian Supreme Court – and evaluated the quality of the generated summaries. We also perform experiments on a third dataset of legal documents of a different type – Government reports from the United States. Results show that abstractive summarization models and LLMs generally perform better than the extractive methods as per traditional metrics for evaluating summary quality. However, detailed investigation shows the presence of inconsistencies and hallucinations in the outputs of the generative models, and we explore ways to reduce the hallucinations and inconsistencies in the summaries. Overall, the investigation suggests that further improvements are needed to enhance the reliability of abstractive models and LLMs for legal case judgement summarization. At present, a human-in-the-loop technique is more suitable for performing manual checks to identify inconsistencies in the generated summaries. (shrink)

An effective and enriching discourse on comparative historiography invests itself in understanding the distinctness and identity that have created various civilizations. Very often, infected by bias, ideology, and cultural one-upmanship, we encounter a presumptuousness that is redolent of impatience with the cultural other and of an ingrained refusal to acknowledge what one’s own history and culture fail to provide. This “failure” need not be the inspiration to subsume the other within one’s own understanding of the world and history and, thereby, (...) neuter the possibilities of knowledge-sharing and cultural interface. It is a realization of the “lack” that provokes and generates encounters among civilizations. It should goad us to move away from what we have universalized and, hence, normalized into an axis of dialogue and mutuality. What Indians would claim as itihasa need not be rudely frowned upon because it does not chime perfectly with what the West or the Chinese know as history. Accepting the truth that our ways of understanding the past, the sense of the past, and historical sense-generation vary with different cultures and civilizations will enable us to consider itihasa from a perspective different from the Hegelian modes of doing history and hence preclude its subsumption under the totalitarian rubric of world history. How have Indians “done” their history differently? What distinctiveness have they been able to weave into their discourses and understanding of the past? Does the fact of their proceeding differently from how the West or the Chinese conceptualize history delegitimize and render inferior the subcontinental consciousness of “encounters with past” and its ways of being “moved by the past”? This article expatiates on the distinctiveness of itihasa and argues in favor of relocating its epistemological and ideological persuasions within a comparative historiographical discourse. (shrink)

Philip Pettit's narrative of the eclipse of republican by liberal liberty in late eighteenth-century Britain adds colour and plausibility to his analytical contrast between republican and liberal liberty. The narrative supports his argument that republicanism and liberalism can be helpfully contrasted in terms of non-domination and non- interference conceptions of liberty. While the narrative has not been scrutinized in the literature, it is in fact flawed. The flaws raise new questions about how stringent a value liberty as non-domination is and (...) what motivated the value. The flaws also raise new questions about the significance of liberty as non-interference within the very strand of liberalism that Pettit focuses upon. Finally, the article casts doubt on some aspects of Quentin Skinner's interpretation of republican liberty. (shrink)

The task of rhetorical role labeling is to assign labels (such as Fact, Argument, Final Judgement, etc.) to sentences of a court case document. Rhetorical role labeling is an important problem in the field of Legal Analytics, since it can aid in various downstream tasks as well as enhances the readability of lengthy case documents. The task is challenging as case documents are highly various in structure and the rhetorical labels are often subjective. Previous works for automatic rhetorical role identification (...) (i) mainly used Conditional Random Fields over manually handcrafted features, and (ii) focused on certain law domains only (e.g., Immigration cases, Rent law), and a particular jurisdiction/country (e.g., US, Canada, India). In this work, we improve upon the prior works on rhetorical role identification by proposing novel Deep Learning models for automatically identifying rhetorical roles, which substantially outperform the prior methods. Additionally, we show the effectiveness of the proposed models over documents from five different law domains, and from two different jurisdictions—the Supreme Court of India and the Supreme Court of the UK. Through extensive experiments over different variations of the Deep Learning models, including Transformer models based on BERT and LegalBERT, we show the robustness of the methods for the task. We also perform an extensive inter-annotator study and analyse the agreement of the predictions of the proposed model with the annotations by domain experts. We find that some rhetorical labels are inherently hard/subjective and both law experts and neural models frequently get confused in predicting them correctly. (shrink)

In the domain of legal information retrieval, an important challenge is to compute similarity between two legal documents. Precedents play an important role in The Common Law system, where lawyers need to frequently refer to relevant prior cases. Measuring document similarity is one of the most crucial aspects of any document retrieval system which decides the speed, scalability and accuracy of the system. Text-based and network-based methods for computing similarity among case reports have already been proposed in prior works but (...) not without a few pitfalls. Since legal citation networks are generally highly disconnected, network based metrics are not suited for them. Till date, only a few text-based and predominant embedding based methods have been employed, for instance, TF-IDF based approaches, Word2Vec and Doc2Vec based approaches. We investigate the performance of 56 different methodologies for computing textual similarity across court case statements when applied on a dataset of Indian Supreme Court Cases. Among the 56 different methods, thirty are adaptations of existing methods and twenty-six are our proposed methods. The methods studied include models such as BERT and Law2Vec. It is observed that the more traditional methods that rely on a bag-of-words representation performs better than the more advanced context-aware methods for computing document-level similarity. Finally we nominate, via empirical validation, five of our best performing methods as appropriate for measuring similarity between case reports. Among these five, two are adaptations of existing methods and the other three are our proposed methods. (shrink)

Building legal domain ontologies is a prominent challenge in the ontology engineering community. The ontology builders confront issues such as the complexity of the legal domain, the difficulty of applying existing ontology engineering approaches, and the intention of developing legal models faithful to realities. In this paper, we discuss constructing a well-founded legal domain ontology, named CargO-S, for the traceability of goods in logistic sea corridors. For building CargO-S, a pattern-oriented approach is applied, supported by ontology-driven conceptual modeling, ontology layering, (...) and ontology reuse processes. CargO-S is grounded in the unified foundational ontology UFO by using the ontology-driven conceptual modeling language OntoUML. Besides, ontology layering is proposed to simplify the development process by dividing CargO-S into three layers located at different granularity levels: upper, core, and domain. For building the upper and core layers, conceptual ontology patterns are reused from the foundational ontology UFO and the legal core ontology UFO-L. These patterns are applied, either by extension or analogy with legal rules, for building the domain layer. CargO-S is then validated by implementing the ontology as OWL and SWRL rules. Finally, the performance and the semantic accuracy of CargO-S are evaluated using a dual evaluation approach. (shrink)

The latter half of nineteenth-century England was rife with the evolution question. As English imperialism also reached its pinnacle during this time, racial gradations and superiority of the white race in the newly formed human chain loomed large culturally. In 1849, Thomas Carlyle anonymously published his anti-emancipationist perspective in “The Occasional Discourse on the Negro Question,” followed by John Stuart Mill’s divergent response to him in 1850 titled, “The Negro Question.” In 1878, The Westminster Review also published a woman’s perspective, (...) “The Importance of Race and Its Bearing on the Negro Question” by Alice Bodington, which resembled the Carlyle essay in various ways. Although Mill’s essay was a direct attack on Carlyle’s explosive article and is overtly against Carlyle and Bodington’s ideas, this paper argues that an imperialist agenda underlies Mill’s views and in fact poses the same theories of Carlyle and Bodington. The paper first proceeds to interrogate Mill’s hegemonic subtext through a comparison of these three essays by situating them within the scientific discourse of the era, arguing that science, especially phrenology and evolution theories, didn’t exist in a vacuum, but was used to perpetrate the normative racial ideologies of the period. The paper also uses Edward Said’s theory of ‘Othering the Orient’ in Culture and Imperialism to show that while Mill seemingly diverges from Carlyle’s stance, this ‘othering’ is in fact present in all three writers’ works. There is a problematique about Buddhist Art. It cannot be deduced directly from the basic tenets of ethical Buddhism. Early Buddhist views forbid art as sensuous luxury. Even when Buddhists employed art for edifying ends it was essentially representative and realistic. With the changes in Buddhist system of beliefs and the rise of Buddhist philosophical schools Buddhist art came to symbolize the ideals of tranquility and Karunā - the Mahāyāna ideals par excellence. The masterpiece of the Gupta art depicting the (...) Master in dharmacakrapravartana mudra at Sarnath or the Bodhisattva Padmapani of the Ajanta murals shows that the beauty of the Buddha image resides not in following models of worldly beauty but rather in the creation of an ideal. The medieval Buddhist art is a continuation of the achievements at Sarnath and Ajanta. (shrink)

This paper studies the relationship between personal stock donation by top executives and board of directors (insiders) of publicly traded corporations and their personal tax, shareholders' returns, and social responsibility. The study finds evidence that the timing of stock donations is driven by personal tax gain. The study further shows, comparing stock gift corporations relative to their non-stock gift cohorts, that personal stock gifts are associated with lower short-term and long-term stock returns to shareholders. This implies that stock donation driven (...) by insiders' personal gain adversely affects shareholder wealth. However, the likelihood and intensity of insiders to make personal stock donation is reduced when firms have strong corporate social responsibility (CSR). Agency theory explains insiders' opportunistic behavior, stakeholder theory is also supported by evidence that stock donation is negatively related to CSR, and stewardship theory offers a different view to explain the rationale behind insiders' stock donation and shareholders' reactions to stock gifts. This paper is about the uses of language which the Oxford philosopher of language, J.L. Austin excluded from theoretical consideration in his William James Lectures delivered in 1955 and posthumously published as How to Do Things with Words. Uses of language, such as dramatic, poetic or comedic, are said by Austin to be non-serious, deviant and parasitic upon the everyday normal ordinary language. This leaves literature out of consideration as an etiolation. Derrida, who is not merely a trained philosopher but (...) also one of the finest literary critics of our day, fails to agree with Austin. In his “Signature, Event, Context”, and Limited Inc, he criticizes Austin of “totalization” and “idealization” of the norm or the standard; his inability to see that the parasitic is necessarily inbuilt in the standard. This paper is an attempt at seeing how far Derrida is justified in his critique as there is much that is common between his and Austin’s approaches towards language. (shrink)
