The article talks of an evolution of a Biblical notion of Law. The author shows the way, the meaning of the Hebrew term “Torah” was transformed throughout the Pentateuch, in the prophetic tradition and in the wisdom books. He puts into analysis the relationship between the Judaism as a religious formation and the Law as a code. The Law included basic regulations to the moral, religious and political life of Israel.

INTELIGENCIA Y LOGOS es el segundo volumen de la trilogía que sobre el tema general de LA INTELECCION HUMANA publica el filósofo XAVIER ZUBIRI (San Sebastián, 1898). Este volumen es continuación del primero (INTELIGENCIA SENTIENTE) y se completa con el tercero y último, INTELIGENCIA Y RAZÓN. La obra completa analiza, entre otros muchos, los temas y problemas fundamentales de la disciplina filosófica conocida con los nombres de Teoría del conocimiento, Epistemología y Crítica, replanteando en una dimensión hasta ahora inédita cuestiones (...) tales como las de la intelección, el juicio, el conocimiento, la razón, el saber, la comprensión, la verdad, la ciencia, etc. No hay duda de que el enfoque que Zubiri da a estas cuestiones es profundamente original. Desde los tiempos de Parménides la filosofía ha solido resolver el problema de las relaciones entre la inteligencia y la realidad en el punto que constituye el tema central de este volumen, el «logos», cuya expresión más clásica es el «juicio». Zubiri se opone frontalmente a esta tradición, que según él conduce a un logicismo formalista que desvirtúa el papel de la inteligencia e impide el acceso a la realidad. Afirmar que el logos es la estructura fundamental de la intelección supone logificar la inteligencia, es decir, hacer de ella una facultad puramente formal y conceptiva. El resultado de esto es el conceptismo y el idealismo, los males seculares de la filosofía. Frente a esto, Zubiri afirma la preeminencia de la intelección sobre el logos. La inteligencia, como quedó expuesto en el volumen anterior, meramente actualiza las cosas en tanto que «reales». El logos es un modo ulterior de la intelección que permite expresar lo que esas cosas reales son «en realidad». El desarrollo de esta idea central constituye el argumento del presente libro. El ordenamiento jurídico de Santi Romano es, sin duda alguna, una obra fundamental. Y no es la circunstancia concreta de presentar ahora la obra al lector español la que dicta estas palabras, sino que las recojo conociendo plenamente el valor objetivo que ellas tienen; sobradamente tendremos ocasión de ver la consideración que la obra de Romano recibe por parte de la doctrina, como de un auténtico y verdadero hito en el desarrollo del pensamiento jurídico contemporáneo. De ahí precisamente que (...) no trate de llevar a cabo ni un análisis crítico de la misma, ni menos aún de la obra de Romano en general; tal pretensión de enjuiciamiento limitaría casi con lo grotesco, por carecer de toda autoridad en el campo de la dogmática general del Derecho, que es en el que, en concreto, se mueve Santi Romano en la obra que presentamos. Estas páginas, por el contrario, pretenden tener una finalidad mucho más modesta: simplemente presentar la obra al lector español, formulando al mismo tiempo algunas aplicaciones concretas de la tesis ordinamental en el campo específico del Derecho administrativo. Para este trabajo, seleccionamos los programas Bailando por un sueño, Intratables y El show de la mañana, y retomamos algunas expresiones de los sujetos que participaron en grupos de discusión durante los meses de octubre, noviembre y diciembre de 2016 en Ciudad Autónoma de Buenos Aires, Rosario y Córdoba.Estos programas televisivos, en tiempos de una “democracia mediatizada”, son centrales en la modelización de lo político en un sentido muy distinto a lo que definía el concepto de “videopolítica” en los 90. (...) Uno de los cambios a considerar remite al impacto del desarrollo de internet y a los dispositivos asociados para un tipo de “participación mediatizada” en vivo, que transforma sustantivamente el lugar y la posición que tenía el espectador de los viejos medios masivos de comunicación. Con relación al “objeto” de estos programas, es posible identificar y reconstruir una modelización recurrente en el qué se dice y cómo; construcción ideológica que encuentra en la macro forma compartida del panel, por ejemplo, una manera de presentar “diversidad de voces”, en tanto expresión resultante del proceso de trabajo que vincula estética y política en la construcción de una “verdad” sobre el contexto político actual.La estrategia expositiva y argumentativa es la siguiente: 1) Presentamos y caracterizamos estructuralmente a los programas seleccionados y los vinculamos con expresiones rescatadas de los grupos de discusión. 2) Seleccionamos ejes de comparación que posibilitan la precisión de recurrencias entre ellos. 3) Finalmente, con los resultados del recorrido descriptivo y analítico, exponemos rasgos y dinámicas de las novedosas formas de estetización de lo político —en el sentido benjaminiano— como proceso orientado a que las masas —en nuestro caso, los individuos— expresen sus demandas. The historical review of Brazilian foreign policy is in a constant debate, revealing the gap between the development aspirations of a Southern actor and its obstacles to inserting itself into the North. Immersed in this discussion, this article identifies Itamaraty's defining features, seeking to shed light on the ideas that nourish his political thinking today. First, it outlines the three ideational currents that dispute foreign policy decision-making and its effects up to 1990. Next, it analyses the gradual rise of Brazil's (...) international legitimacy based on a foreign policy of prestige. Finally, it examines the decline of Brazilian foreign policy since 2014. This article aims to contribute to the systematic characterization of Itamaraty's schools of thought, tracing some of the narratives that permeate Brazil's international identity. (shrink)

Die gesellschaftspolitischen Konflikte um die Verschärfung von Fluggastkontrollen belegen, dass es bei Entscheidungen darüber, wie und mit welchen Techniken derartige Kontrollprozesse zu organisieren sind, einen Bedarf an ethischer Expertise gibt. Getroffen werden müssen solche Entscheidungen vor einem komplexen Horizont von Wertvorstellungen, der sich nicht auf den Gegensatz ‚entweder Sicherheit oder Freiheit‘ reduzieren lässt. Entsprechend muss eine informierte Entscheidungsfindung berücksichtigen, welche impliziten Wertvorstellungen uns bei der Forderung nach mehr Sicherheit durch Fluggastkontrollen leiten und welche Wertungskonflikte verschiedene Kontrolltechniken jeweils konkret implizieren. Über (...) eine hermeneutische Lesart von John Deweys Moralpragmatismus werden in dieser Arbeit jene Wertvorstellungen rekonstruiert, die uns bei der Forderung nach Sicherheit leiten, wie auch jene, die dabei auf dem Spiel stehen. Auf dieser Basis präsentiert die Arbeit eine Methode zur operationalisierten Technikbewertung, über die verschiedene Kontrollprozesse verglichen sowie Handlungsempfehlungen generiert werden können. Central capabilitarian theories of well-being focus exclusively on actual opportunities to attain states of being and doing that people have reason to value. Consequently, these theories characterise ill-being and disadvantage as deprivations of such opportunities and attainments. However, some well-being aspects are inherently negative. They make up the difference between not being well and being unwell in that they constitute ill-being. While disadvantage can be plausibly captured by deprivations, ill-being cannot be fully captured by them. I support this claim by (...) analysing cases involving inherently negative aspects of homelessness that are not mere deprivations of opportunities to attain beings and doings that people have reason to value. I conclude that ill-being is not only about what one cannot be and do, but also about one’s enduring, and opportunities to avoid, negative beings and doings. Theories and policies should reflect this to get things right, and to do right by people. (shrink)

Political practices often aim to reach valuable outcomes through democratic processes. However, philosophical considerations and democratic deliberations sometimes support different conclusions about what a valuable outcome would be. This paper contributes to a research agenda that aims to reconcile recommendations that follow from these different bases. The setting for this research agenda is capabilitarian. It affirms the idea that what we should distribute are substantive freedoms to be and do things that people have reason to value. Disagreements about these valuable (...) outcomes become particularly problematic in urgent situations such as pandemics, floods, and wildfires. These situations are urgent since they are time-sensitive and involve an impending loss of well-being. A method of compromise would help mitigate losses of well-being while respecting the aim of reaching valuable outcomes through democratic processes. I thus offer an equitable and decisive method of compromise that helps integrate philosophical considerations with democratic deliberations. (shrink)

Hegel's account of ethical life can be shown to contradict Aristotle's in two main ways: first, Hegel follows Kant in emancipating virtue/duty from the particularity associated with the content of motivational drives and with Aristotle's eudaimonia. Hegel thus rejects Aristotelian happiness as the final end of rational action and prioritizes duty. However, against Kant, Hegel unites abstract duty and determined drives within a speculative notion of ethical duty: rational agents find happiness in heeding duty's call. Second, Hegel follows Kant in (...) emancipating agency's subjective dimension from the all-encompassing determinacy of Aristotelian substance metaphysics. At the same time and against Kant, Hegel unifies agency's undetermined, subjective dimension with the determinacy of objective norms and habitual praxis: ethical praxis must be animated by undetermined subjectivity whilst being determined. In both cases, Hegel goes beyond Aristotle by resting his argument on the speculative structure of ‘the concept of the will’. (shrink)

Hegel's absolute idealism has proven to be one of the most controversial philosophical positions to characterize. The most abstract categories of essence are what Hegel calls the determinations of reflection, i.e. identity, difference and ground. Continuing his analysis of the determinations of essence, Hegel then discusses the notions of subsistence, relation and the whole and its parts and arrives at essence's determinations of “inner” and outer: the “inner” functions as ground of appearance and opposes the externality of reflection‐into‐other. In actuality, (...) there is no difference between ground and existence, between existence and essence: actuality is what it is, its existence is its essence, its essence its existence. Hegel sets out to show that the ultimate description of truth ‐ i.e. the concept ‐ creates, undermines, incorporates, and improves on any other relevant definition of truth. The existence of non-standard models of first-order Peano-Arithmetic (PA) threatens to undermine the claim of the moderate mathematical realist that non-mysterious access to the natural number structure is possible on the basis of our best arithmetical theories. The move to logics stronger than FOL is denied to the moderate realist on the grounds that it merely shifts the indeterminacy “one level up” into the meta-theory by, illegitimately, assuming the determinacy of the notions needed to formulate such logics. This paper argues (...) that the challenge can be met. We show how the quantifier “there are infinitely many” can be uniquely determined in a naturalistically acceptable fashion and thus be used in the formulation of a theory of arithmetic. We compare the approach pursued here with Field’s justification of the same device and the popular strategy of invoking a second-order formalism, and argue that it is more robust than either of the alternative proposals. Against recent naturalist critiques of Kant and interpretations of Hegel, it can be shown that Hegel’s accounts of consciousness and mind (Geist) commit him to a distinctly supernatural, post-Kantian idealist concept of subjectivity. While Kant describes this subjectivity as independent, unconditioned and self-positing, he relies on the notion of an interplay of two distinct realms — labelled the ‘natural’-phenomenal and the ‘supernatural’-noumenal — to justify it. While Fichte accepts Kant’s description of the structure of supernatural subjectivity, he rejects the two-realms-doctrine (...) by arguing that Kant’s prioritization of the realms’ difference renders their unity unintelligible. Instead, Fichte maintains that all of reality is posited by a subjectivity that posits itself and then posits the objective world, thereby rendering the natural dependent on the supernatural. While Hegel agrees with Kant and Fichte on the supernatural properties of subjectivity, he rejects Fichte’s prioritization of supernatural subjectivity over natural objectivity and argues that both the supernatural and the natural are aspects of supernatural Geist. Although Hegel ultimately contrasts subjective Geist with objective nature, grounding both in the notion of the metaphysical idea, his idealist commitment to the supernatural subjectivity of consciousness and Geist renders his accounts of mind and cognition incompatible with recent naturalist interpretations. This paper reflects on the limits of logical form set by a novel criterion of logicality proposed in (Bonnay and Speitel, 2021). The interest stems from the fact that the delineation of logical terms according to the criterion exceeds the boundaries of standard first-order logic. Among ‘novel’ logical terms is the quantifier “there are infinitely many”. Since the structure of the natural numbers is categorically characterisable in a language including this quantifier we ask: does this imply that arithmetical forms have (...) been reduced to logical forms? And, in general, what other conditions need to be satisfied for a form to qualify as “fully logical”? We survey answers to these questions. (shrink)

Addiction is a widespread problem affecting people from different regions, generations, and classes. It is often analysed as a problem consisting in compulsion or poor choice-making. Recently, however, integrated analyses of compulsion and choice have been called for. In this paper, I argue that the capability approach highlights the well-being loss at stake in cases of addiction, whether they are described as stemming from compulsion, poor choice-making, or some combination thereof. The relevant capabilities obtain when combinations of individual, socio-political, and (...) environmental factors jointly facilitate abstention. On this complementary evaluative analysis, people’s capabilities to abstain are shown to be undermined by how different kinds of factors interact with each other. The upshot is that without committing to an empirical view of the nature of addiction that must capture each case, the capabilitarian analysis helps highlight a central goal of addiction-related well-being policy-work, namely to promote people’s genuine opportunities to abstain. En este artículo se presentan las reflexiones epistemológicas del filósofo Francisco Fernández Buey (1943-2012), las cuales, han estado continuamente presentes en la obra del autor al menos desde la publicación en 1991 de La ilusión del método, y culminan en su obra póstuma Para la tercera cultura (2013) en una apuesta por la complementariedad entre ciencias positivas y reflexión humanística. Partiendo de un marxismo heterodoxo tanto en el plano ético-político como en el epistemológico, Fernández Buey apuesta por una idea de (...) ciencia alejada del positivismo, a la vez que critica las filosofías contrarias a aquella en la medida en que la consideran como un conocimiento meramente reductor de una realidad que no puede ser aprehendida por la ciencia. Desde el concepto de dialéctica de Manuel Sacristán; el reconocimiento a la figura de Einstein como ejemplo de científico que no renuncia a otros modos de conocimiento; y la reflexión sobre la filosofía de la ciencia en la segunda mitad del siglo XX, el autor nos muestra la necesidad de un diálogo entre cultivadores de la ciencia y las humanidades para afrontar los desafíos del siglo XXI. Wskazuje przy tym, jak współcześni filozofowie związani z postanarchizmem pracują nad statyczną ontologią polityczna anarchizmu poprzez myśl poststrukturalną oraz jak za pomocą współczesnych pojęć filozoficznych dekonstruują oświeceniowe podstawy anarchizmu. Zamiarem tekstu jest wskazanie nie tylko na różnice pomiędzy anarchizmem a postanarchizmem, ale raczej dostrzeżenie pomiędzy nimi silnej zależności. Tekst stanowi przegląd i omówienie koncpecji postanarchizmu w kontekście ontologii politycznej, współczesnej (...) filozofii politycznej oraz historii idei. (shrink)

Despite his commitment to universal explicability, a case can be made that Hegel is better labelled an idealist than a naturalist. As an analysis of his three syllogisms of philosophy reveals, he strictly differentiates between the domains of nature and Geist, suggesting in sequence that Geist replaces nature, Geist comprehends nature and that Geist and nature are comprehended as forms of the metaphysical idea and determine and mediate each other. Since Hegel grounds his accounts of the metaphysical idea and its (...) forms nature and Geist in concept-metaphysics and these include a supernatural notion of undetermined, self-positing universality, Hegel’s entire ontological edifice is ultimately supernatural. This stands in stark contrast to the metaphysics of naturalism, which are based on categories Hegel associates with the logics of being and essence or which fail to sufficiently emancipate universality from its immediate connection to particularity. Hegel’s account of rational willing has recently been misrepresented by both critics and supporters who argue that the content of willing is externally received from history, social context, practices of recognition, etc. This contradicts the conceptual structure of Hegel’s notion of rational action as free individuality, according to which the difference between the willing subject and the content of willing is an internal relation of identity. Since this ‘difference within identity’ can only be grasped by speculative thinking and not through (...) understanding and reflection, the interpreters can be charged with employing the wrong method. Although reliance on the speculative method opens Hegel to the charge of unintelligibility, it helps explain the frequent misrepresentations of his account of freedom and why methodologically uninformed comparisons between Hegel and other thinkers run the risk of being counterproductive. This article explores the use of open-source intelligence (OSINT) techniques as part of data-driven border checks in the EU. While the idea to group travelers into risk categories in order to differentiate the intensity of border checks has been criticized for its likely impact on privacy and other fundamental rights, the exclusive use of “open,” “public” data was proposed as an alternative that mitigates these issues. However, OSINT remains a rather vague term, as it is unclear what constitutes “open” or (...) “public” data, how the use of such techniques would contribute to the production of security, and whether its use actually mitigates most ethical issues. The goal of this article is to contribute toward a situated answer to these questions. It will provide groundwork by clarifying what OSINT practices could entail in the context of the European border checks regime and by developing an ethical perspective on these practices. I will show that the impact depends not so much on the public availability of the analyzed data, but on the specifics of the implementation of OSINT techniques. Thus, certain uses of OSINT continue to raise severe privacy and fundamental rights issues. (shrink)

As competition over peer status becomes intense during adolescence, some adolescents develop insecure feelings regarding their social standing among their peers. These adolescents sometimes use aggression to defend or promote their status. The aim of this study was to examine the relationships among social status insecurity, callous-unemotional traits, and popularity-motivated aggression and prosocial behaviors among adolescents, while controlling for gender. Another purpose was to examine the potential moderating role of CU traits in these relationships. Participants were 1,047 in the 7th (...) or 8th grades from a large Midwestern city. They completed questionnaires on social status insecurity, CU traits, and popularity-motivated relational aggression, physical aggression, cyberaggression, and prosocial behaviors. A structural regression model was conducted, with gender as a covariate. The model had adequate fit. Social status insecurity was associated positively with callousness, unemotional, and popularity-motivated aggression and related negatively to popularity-motivated prosocial behaviors. High social status insecurity was related to greater popularity-motivated aggression when adolescents had high callousness traits. The findings have implications for understanding the individual characteristics associated with social status insecurity. (shrink)

The difficult issues related to the interpretation of quantum mechanics and, in particular, the “measurement problem” are revisited using as motivation the process of generation of structure from quantum fluctuations in inflationary cosmology. The unessential mathematical complexity of the particular problem is bypassed, facilitating the discussion of the conceptual issues, by considering, within the paradigm set up by the cosmological problem, another problem where symmetry serves as a focal point: a simplified version of Mott’s problem.

We will also try to analyze the historical and political context inside which the dada phenomenon occurred. Our main focus will be on two main tenets of Dadaism: the “self-critical” feature of Dada’s self-image as it emerges during the main phases of its history, especially during its early phase, and the political commitment of Dada during its last phases of development. Starting with an empirical study of several Jehovah’s Witnesses1 congregations we aim to highlight the social mechanisms of religious conversion and the phases an individual passes through before becoming a Witness. By applying Lewis Rambo’s systemic stage model of conversion we are able to identify a series of elements that characterize the conversion to this religion in Romania, such as: social filtering, delegitimation of the previous religion, and incipient identification with the Witnesses’ group. The article asserts that the Witnesses’ decision (...) to convert implies the deliberate assumption of the others’ disapproval and even social stigmatization. Nevertheless they opt for this religious status because the immediate benefits brought by the religious community and the future benefits of the earthly Heaven offer them sufficient motives for becoming Witnesses.
