In the article “Nudging and Informed Consent”, Cohen argues that the use of “nudging” by physicians in the clinical encounter may be ethically warranted because it results in an informed consent where obligations for beneficence and respect for autonomy are both met. However, the author's overenthusiastic support for nudging and his quick dismissal of shared decision-making leads him to assume that “soft” manipulation is un-problematic and that “wisdom” on the side of medical professionals will suffice to guard against abuse. Opposing (...) this view, we propose that: 1) patient preferences and values should not be boiled down to rational or irrational decisions based on cognitive reasoning alone, 2) potential threats to the physician-patient must be mitigated and could be minimized by employing alternative strategies that acknowledge the impact of cognitive heuristics in shaping decision-making but maintain transparency and trust, and 3) patient preferences and values can be legitimately influenced only under specific circumstances. The latter include: (1) exhaustion of other means; (2) evidence that nudging is effective in a specific context; (3) evidence of clear and active public misinformation (e.g., industry promoting smoking); (4) explicit pubic dialogue between various stakeholders including medical professional societies about nudging; (5) upholding shared decision-making as a preferred approach; and (6) a rich understanding of clinical reality beyond the simple dichotomy of beneficence-autonomy. In an effort to reclaim women's moral psychology, feminist philosophers have reevaluated several seemingly negative emotions such as anger, resentment, and bitterness. However, one negative emotion has yet to receive adequate attention from feminist philosophers: contempt. 1 argue that feminists should reconsider what role feelings of contempt for male oppressors and male'dominated institutions and practices should play in our lives. 1 begin by surveying four feminist defenses of the negative emotions. I then offer a brief sketch of the nature and (...) moral significance of contempt, and argue that contempt can be morally and politically valuable for the same reasons that feminists have defended other negative emotions. I close by considering why feminists have been hesitant to defend contempt as a morally and politically important emotion. (shrink)

InBeing and Nothingness, Jean-Paul Sartre affirms a circle of relations between oneself and another. This circle moves between the relations of love and desire and results from the fact that both love and desire are attempts to capture the other who always remains out of reach. Sartre denies that there can be a dialectic of such relations with others: never can there be a motivated movement beyond the frustrations and failures of each of these attempts to relate to the other. (...) The only way out of this circle is, therefore, according to Sartre, a radical conversion.Like the master in Hegel'sPhenomenology of Mind, each individual caught in this circle wants what cannot be attained: the assimilation or the negation of the freedom of the other. He is thus, like Hegel's master, impervious to any reasons that could count against what he is seeking; his failures cannot in any way motivate him to want what can be. From the point of view of such desires, any negative evaluation of these desires must seem arbitrary. Therefore, to the extent that Sartre's earlier writings indicate no other possibilities of human existence except those premised on such impossible demands, Sartre's negative evaluations concerning the bad faith of these individuals must seem arbitrary.My conclusion is not, however, simply negative since I argue that inSaint Genet Sartre presents Genet's life as a dialectical movement beyond failure to triumph. This is not a dialectic of bad faith. Rather it is a dialectic based on a very different desire from the desire for what cannot be. If Sartre thus develops another level, another fundamental desire, from which the level of bad faith can be judged to be wrong, then at least from this level the judgment is not a merely arbitrary one. The world in which we live is largely the product of the rise, competition, and fall of empires. This chapter examines European, and principally British, ideologies of imperialism during the last two hundred years. The chapter starts by distinguishing between imperial imaginaries, ideologies, and theories, before dissecting elements of the western imperial imaginary, focusing in particular on notions of civilizational hierarchy. The rest of the article examines three ideal-typical aspects of imperial ideology: justification; governance; and resistance. Ideologies of justification provide (...) reasons for supporting or upholding imperial activity, seeking to legitimate the creation, reproduction, or expansion of empire. Ideologies of governance articulate the modalities of imperial rule in specific contexts. Finally, ideologies of resistance reject imperial control. (shrink)

In this article I pursue two main lines of argument. First, I seek to delineate two distinctive modes of justifying imperialism found in nineteenth-century political thought (and beyond). The 'liberal civilizational'li model, articulated most prominently by John Stuart Mill, justified empire primarily in terms of the benefits that it brought to subject populations. Its proponents sought to 'civilize'lthe 'barbarian'. An alternative `republican' model focused instead on the benefits - glory, honour and power above all - that accrued to the imperial (...) state. Less concerned with spreading civilization, its proponents concentrated on fortifying the imperial polity. Second, I offer a 'republican' interpretation of the writings of the historian and public moralist J.A. Froude (1818-94), arguing that he both diagnosed the problems of modern Britain and prescribed imperial solutions to those problems, based on his reading of the fate of the Roman republic. (shrink)

This article describes the ethical conflicts that a sample of US nurse utilization reviewers faced in their work, and also each nurse’s self-reported ethical orientation that was used to resolve the dilemmas. Data were collected from a sample of 97 registered nurses who were working at least 20 hours per week as utilization reviewers. Respondents were recruited from three managed care organizations that conduct utilization reviews in a large midwestern city. A cross-sectional survey design was used to collect demographic data (...) and to ask closed-response, short-answer and open-ended questions. Ethical conflicts reported by nurses were similar across utilization review settings and many were justice orientated. Self-reported ethical orientations were similar across organizations, with beneficence dominating. Implications of these findings are discussed. (shrink)

This article explores the ways in which naturism articulates a set of relationships between the body and nature. We begin by sketching the histories of some Western naturist movements, tracing their lineage back to 19th-century life reform movements and through into inter-war reorientations of citizenship and morality. We consider the problematic of the naked body's relationship to the erotic (and specifically to the erotics of nature), drawing on some materials on outdoor sex; set alongside this is a discussion of the (...) regenerative use of wilderness in the mythopoetic men's movement. These strands are finally drawn together in order to consider the complex negotiation of discourses of nature, human nature, the natural body and the natural landscape - a negotiation embodied in naturism. In this paper a number of oppositions which have haunted mathematics and philosophy are described and analyzed. These include the Continuous and the Discrete, the One and the Many, the Finite and the Infinite, the Whole and the Part, and the Constant and the Variable.

In this paper we construct the ortholattices arising in quantum logic starting from the phenomenologically plausible idea of a collection of ensembles subject to passing or failing various “tests.” A collection of ensembles forms a certain kind of preordered set with extra structure called anorthospace; we show that complete ortholattices arise as canonical completions of orthospaces in much the same way as arbitrary complete lattices arise as canonical completions of partially ordered sets. We also show that the canonical completion of (...) an orthospace of ensembles is naturally identifiable as the complete lattice of properties of the ensembles, thereby revealing exactlywhy ortholattices arise in the analysis of “tests” or experimental propositions. Finally, we axiomatize the hitherto implicit concept of “test” and show how they may be correlated with properties of ensembles. (shrink)

Confucianism has made a comeback in mainland China over the last two decades or so. Politically minded Confucian revivalists see Confucianism as the core of national identity that differs from “foreign” traditions such as liberalism and they argue for replacing Marxism with Confucianism as the core ideology of the one-party state. But is the ancient tradition of Confucianism compatible with the modern tradition of nationalism? And is it possible to defend a morally appealing form of “Confucian nationalism”? Why should one believe that conscious awareness is solely the result of organizational complexity? What is the connection between consciousness and combinatorics: transformation of quantity into quality? The claim that the former is reducible to the other seems unconvincing—as unlike as chalk and cheese! In his book1 Penrose is at least attempting to compare like with like: the enigma of consciousness with the progress of physics.

Considered together, Butler and Whitehead draw from a wide palette of disciplines to develop distinctive theories of becoming, of syntactical violence, and creative opportunities of limitation. The contributors of this volume offer a unique contribution to and for the humanities in the struggles of politics, economy, ecology, and the arts.

One of the most familiar uses of the Russell paradox, or, at least, of the idea underlying it, is in proving Cantor's theorem that the cardinality of any set is strictly less than that of its power set. The other method of proving Cantor's theorem — employed by Cantor himself in showing that the set of real numbers is uncountable — is that of diagonalization. Typically, diagonalization arguments are used to show that function spaces are "large" in a suitable sense. (...) Classically, these two methods are equivalent. But constructively they are not: while the argument for Russell's paradox is perfectly constructive, (i.e., employs intuitionistically acceptable principles of logic) the method of diagonalization fails to be so. Abstract The Marxian vulgate, which long dominated the historiography of the French Revolution, and which was broadly accepted in the social sciences, is no longer sustainable. But newer attempts to frame the issue of class in entirely linguistic terms, producing the claim that France had no bourgeoisie because few people explicitly described themselves as ?bourgeois,? are not entirely convincing. The Revolution brought into being, and helped to sustain, a new social group: the ?state bourgeoisie,? which defined itself by its education (...) and by state service, and which was socially cohesive and exclusive. Thus, the Revolution can be seen as ?bourgeois? not in the sense of having been caused by a rising bourgeoisie, but in the sense that it caused one to rise. (shrink)
