The Chinese translation of Coca Cola is thought to be a well-known good translation, and many people discussed the translation or brand translation with it as an example. A large number of books or articles generally and abstractly conclude that the Chinese translation leaves people a kind of feeling of coolness and cleanness, pleases and attracts consumers’ attention and their favor, however there is not still a book or an article studying systematically and scientifically how good the translation is, neither (...) wholly from perspectives of linguistics, culture and aesthetic translation. Based on the literature review and comparative analysis with cultural translation study and translation aesthetics, the thesis is to discover how good the translation is, based on the analysis of Chinese translation of Coca Cola from the aspects of linguistics, culture and translation aesthetics, and to build a criticism model of translation of brand names, in addition, to analyze the enlightenment of this translation in other translation activities. According to the argument scheme approach, to evaluate a given scheme-saturating instance completely does entail asking all critical questions relevant to it. Although this is a central task for argumentation theorists, the field currently lacks a method for providing a complete argument evaluation. Approaching this task at the meta-level, we combine a logical with a substantive approach to the argument schemes by starting from Toulmin’s schema: ‘data, warrant, so claim’. For the yet more general schema: ‘premise; if premise, then conclusion; (...) so conclusion’, we forward a meta-level CQ-list that is arguably both complete and applicable. This list should inform ongoing theoretical efforts at generating appropriate object-level CQs for specific argument schemes. (shrink)

Whether abduction is treated as an argument or as an inference, the mainstream view presupposes a tight connection between abduction and inference to the best explanation. This paper critically evaluates this link and supports a narrower view on abduction. Our main thesis is that merely the hypothesis-generative aspect, but not the evaluative aspect, is properly abductive in the sense introduced by C. S. Peirce. We show why equating abduction with IBE unnecessarily complicates argument evaluation by levelling the status of abduction (...) as a third reasoning mode. We also propose a scheme for abductive argument along with critical questions, and suggest retaining abduction alongside IBE as related but distinct categories. (shrink)

With a few yet increasing number of exceptions, the cognitive sciences enthusiastically endorsed the idea that there are basic facial expressions of emotions that are created by specific configurations of facial muscles. We review evidence that suggests an inherent role for context in emotion perception. Context does not merely change emotion perception at the edges; it leads to radical categorical changes. The reviewed findings suggest that configurations of facial muscles are inherently ambiguous, and they call for a different approach towards (...) the understanding of facial expressions of emotions. When Carl Wellman introduced the reasoning-type conduction, he endorsed a dialectical view on natural language argumentation. Contemporary scholarship, by contrast, treats conductive argument predominantly on a product view. Not only did Wellman’s reasons for a dialectical view thus fall into disregard; a product-treatment of conduction also flouts the standard semantics of ‘argument’. Attempting to resolve these difficulties, our paper traces Wellman’s preference for a dialectical view to the role of defeasible warrants. These act as stand-ins for value hierarchies that arguers (...) of normal suasory inclination find acceptable. We also improve on extant ways of diagramming conduction and distinguish two of its structural variants. (shrink)

I argue that, contrary to some critics, the notion of conscious experience is a good candidate for denoting a distinct and scientifically interesting phenomenon in the brain. I base this claim mainly on an analysis of neuropsychological data concerning deficits resulting from various types of brain damage as well as some additional supporting empirical evidence. These data strongly point to the hypothesis that conscious experience expresses information that is available for global, integrated, and flexible behavior.

This article examines whether the charitable giving amount and likelihood of firm response to catastrophic events relate to firms’ ownership type using a unique dataset of listed firms in China, where state ownership is still prevalent. Based on the data of Chinese firms’ response to the 2008 Sichuan earthquake, we find that the extent of corporate contributions for state-owned firms following this disaster is less than that for private firms. State-owned firms are also less likely to respond in␣this disaster compared (...) to private firms. The results also␣reveal that firm size, profitability, geography, cash resource available, and leverage affect firms’ philanthropic disaster response behavior in China. (shrink)

In this article, I consider a curious blind spot in constitutional scholarship concerning the resurging rural/urban divide—a readily evident phenomenon closely associated with political resentment and anti-establishment sentiments—and how we may begin to address that challenge through creative constitutional designs. Specifically, I draw upon insights from comparative constitutionalism to discuss four main areas of constitutional law and theory that appear to hold some intellectual promise in this context: formal constitutional commitment at the national level to recognizing the urban/rural divide and (...) commitment to addressing it; creative electoral system designs that take into account the spatial dimension of politics; spatial pluralization based on concepts such as “mixed constitutions,” “community standards,” and “margin of appreciation”; and rethinking elements of equalization and fiscal federalism more generally. Taken together, the four directions I discuss here offer a repertoire of constitutional design possibilities that hold promise in mitigating the resurging rural/urban gulf. More generally, they serve as an invitation to constitutional thinkers to shake up the rather stagnant constitutional thought of spatial governance, and to think creatively about the ever-expanding urban/rural divide and its consequences for the theory and practice of 21st century constitutional democracy. The Toulmin model has been proved useful in law and argumentation theory. This model describes the basic process in justifying a claim, which comprises six elements, i.e., claim (C), data (D), warrant (W), backing (B), qualifier (Q), and rebuttal (R). Specifically, in justifying a claim, one must put forward ‘data’ and a ‘warrant’, whereas the latter is authorized by ‘backing’. The force of the ‘claim’ being justified is represented by the ‘qualifier’, and the condition under which the claim cannot be (...) justified is represented as the ‘rebuttal’. To further improve the model, (Goodnight, Informal Logic 15:41–52, 1993) points out that the selection of a backing needs justification, which he calls legitimation justification. However, how such justification is constituted has not yet been clarified. To identify legitimation justification, we separate it into two parts. One justifies a backing’s eligibility (legitimation justification 1 ; LJ 1 ); the other justifies its superiority over other eligible backings (legitimation justification 2 ; LJ 2 ). In this paper, we focus on LJ 1 and apply it to the legal justification (of judgements) in hard cases for illustration purposes. We submit that LJ 1 refers to the justification of the legal interpretation of a norm by its backing, which can be further separated into several orderable subjustifications. Taking the subjustification of a norm’s existence as an example, we show how it would be influenced by different positions in the philosophy of law. Taking the position of the theory of natural law, such subjustification is presented and evaluated. This paper aims not only to inform ongoing theoretical efforts to apply the Toulmin model in the legal field, but it also seeks to clarify the process in the justification of legal judgments in hard cases. It also offers background information for the possible construction of related AI systems. In our future work, LJ 2 and other subjustifications of LJ 1 will be discussed. (shrink)

Authority arguments generate support for claims by appealing to an agent’s authority status, rather than to reasons independent of it. With few exceptions, the current literature on argument schemes acknowledges two basic authority types. The _epistemic_ type grounds in knowledge, the_ deontic_ type grounds in power. We review how historically earlier scholarship acknowledged an_ attractiveness-based_ and a _majority-based_ authority type as equally basic type. Crossing these with basic speech act types thus yields authority argument sub-schemes. Focusing on the_ epistemic-assertive_ sub-scheme (...) (‘an epistemic authority _A_ _E_ asserts a proposition _P_’), we apply a meta-level approach to specifying critical questions. Results improve the evaluation of this sub-scheme and show how similar improvements are obtainable for other schemes. (shrink)

My own serious study of Max Scheler began in 1958 when I pre sented a Master's thesis to St. Louis University under the direction of Professor Vernon]. Bourke on Scheler's value-theory. Three years later when I returned to complete my doctorate work at St. Louis University I returned also to the study of Max Scheler. In the meantime, several more volumes of the Gesammelte Werke had appeared, several new translations of Scheler were published and the whole area ofphenome nology began (...) to be more favorably accepted by the American intel lectual community. My doctoral dissertation was on Scheler's theory of community under the expert and careful direction of Professor James Collins. The bulk of the present work is a direct result of my work at St. Louis University. I have never regretted the time and effort spent on the study of Scheler. He can be classified as nothing short of a genius, not only in the breadth of his interests but also in the vitality, unity and depth of his thought. Most students of Scheler criticize his lack of unity; I claim to find strong lines of inner consistency throughout his writings. In the second place, my study of Scheler has put me into contact with many of the most dominant intellectual influences of the day. (shrink)

As a value-led entity, the nonprofit depends on its staff for the delivery of the brand value outsides and thus promoting the brand inside is crucial to the development of the nonprofits. Using a sample of 290 full-time staff working in 270 nonprofits in China, two related studies were conducted. Study 1 aimed to develop and validate a new scale for internal branding in the nonprofit context, while Study 2 aimed to investigate the linking mechanism between internal branding and brand (...) performance with the mediating roles of the person–organization fit and intent to stay with the brand. As predicted, the results revealed that: the nonprofit internal branding scale is a three-dimensional construct that is composed of brand-centered training, internal brand communication, and brand-oriented leadership, internal branding positively predicts POF, IntSB, and brand performance, and POF and IntSB sequentially mediate the internal branding–brand performance relationship. The implications of our findings for internal branding in the nonprofit context are discussed. (shrink)

To analyze the argument structure, the linked vs convergent distinction is crucial. In applying this distinction, argumentation scholars test for variations of argument strength under premise revision. A relevance-based test assesses whether an argument’s premises are individually relevant to its conclusion, while a support-based test assesses whether premises support the conclusion independently. Both criteria presuppose that evaluating an argument’s strength is methodologically prior to identifying its structure. Yet, if ‘argument structure’ is a concept of analysis, then a structural analysis would (...) precede evaluating an argument’s strength. We problematize that state-of-the-art methods to identify structures fail, because they rely on evaluative judgments, and so “put the cart before the horse.”. (shrink)

Instances of the ad baculum argument (also known as the threat appeal argument or the argument from threat) are common in both private and public sphere discourse. Although contemporary argumentation scholarship recognizes these instances as contingently fallacious, the literature lacks not only a well-motivated ad baculum argument scheme but also a complete list of critical questions (CQs). In combining argument scheme and speech act theoretic elements, we formulate the felicity conditions of the speech act of threatening from the viewpoint of (...) a rational third party and use the recognition conditions of this speech act to construct the ad baculum argument scheme and its correctness conditions to construct the CQs. Results include revised felicity conditions of the speech act of threatening, a new ad baculum argument scheme, and a set of arguably complete, functionally distinct CQs. (shrink)

The modern ethical framework demands informed consent for research participation that includes disclosure of material information, as well as alternatives. The severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2) pandemic (COVID-19) results in illness that often involves rapid deterioration. Despite the urgent need to find therapy, obtaining informed consent for COVID-19 research is needed. The current pandemic presents three types of challenges for investigators faced with obtaining informed consent for research participation: (1) uncertainty over key information to informed consent, (2) time (...) and pressure constraints, and (3) obligations regarding disclosure of new alternative therapies and re-consent. To mitigate consenting challenges, primary investigators need to work together to jointly promote urgent care and research into COVID-19. Actions they can take include (1) prior plan addressing ways to incorporate clinical research into clinical practice in emergency, (2) consider patients vulnerable with early deliberation on the consent process, (3) seek Legally Authorized Representatives (LARs), (4) create a collaborative research teams, (5) aim to consent once, despite evolving information during the pandemic, and (6) aim to match patients to a trial that will most benefit them. The COVID-19 pandemic both exacerbates existing challenges and raises unique obstacles for consent that require forethought and mindfulness to overcome. While research teams and clinician-investigators will need to be sensitive to their own contexts and adapt solutions accordingly, they can meet the challenge of obtaining genuinely informed consent during the current pandemic. This paper presents an extended version of the Quantified Argument Calculus (Quarc). Quarc is a logic comparable to the first-order predicate calculus. It employs several nonstandard syntactic and semantic devices, which bring it closer to natural language in several respects. Most notably, quantifiers in this logic are attached to one-place predicates; the resulting quantified constructions are then allowed to occupy the argument places of predicates. The version presented here is capable of straightforwardly translating natural-language sentences involving defining clauses. A three-valued, (...) model-theoretic semantics for Quarc is presented. Interpretations in this semantics are not equipped with domains of quantification: they are just interpretation functions. This reflects the analysis of natural-language quantification on which Quarc is based. A proof system is presented, and a completeness result is obtained. The logic presented here is capable of straightforward translation of the classical first-order predicate calculus, the translation preserving truth values as well as entailment. The first-order predicate calculus and its devices of quantification can be seen as resulting from Quarc on certain semantic and syntactic restrictions, akin to simplifying assumptions. An analogous, straightforward translation of Quarc into the first-order predicate calculus is impossible. (shrink)

Prior research suggests that corporate credibility is associated with firm financial performance in developed countries. This article examines whether corporate credibility is related to firm performance using Economic Observer's rating of corporate credibility in China, the largest emerging market in the world. Based on a four-stage valuation model, we find that more reputable and credible firms outperform those with low ratings by almost 20% in 3-year stock returns and have better 3-year net profit margins, return on equity, and sales growth. This study is the first to directly examine the relationship between corporate credibility and firm performance in emerging markets such as China, and our results confirm that firms with high credibility exhibit better financial and market performance at least in the following 3 years. Though they have much in common, the fields of organizational effectiveness (OE) and corporate social performance (CSP) have developed independently. Although both areas deal with organization-environment interactions, each focus is different-OE focuses on how an organization "manages" its environment for its own ends whereas CSP focuses on an organization's responsibilities to, and performance vis-a-vis, its environment. Scholars within the two fields, therefore, have tended to take parallel, nonintersecting paths and, thus, have overlooked potential synergies. In calling attention to potental conceptual (...) and empirical development at the intersection of OE and CSP, the authors examine similarities and differences between the two domains, propose a framework for analyzing congruity between an organization's functional and social performance, present illustrative cases to demonstrate the benefits of considering the OE-CSP interface, and suggest guidelines for conducting research at the OE-CSP interface. Narcissism is considered a generally undesirable trait in the workplace, but is this the whole story? In grandiose narcissism, two dimensions (narcissistic rivalry and narcissistic admiration) are recognized corresponding to self-protecting and self-enhancing regulatory processes separately. Applying the self-regulation theory and the conservation of resources theory, we investigated the distinct outcomes and influencing mechanisms of the two dimensions in an organizational context using multilevel structural equation modeling. Whereas previous literature has found narcissism to be mainly related to negative outcomes in (...) the workplace, our dimensional framework indicates that grandiose narcissism may have a Janus face—i.e., a dark side of unethical behaviors and a light side of prosocial behaviors. From a sample of 646 frontline employees in a Chinese call center, we found that while employee narcissistic rivalry was positively related to customer-directed sabotage through the mediation of emotional exhaustion, narcissistic admiration was positively related to organizational citizenship behavior toward customers (OCB-C) through the mediation of self-perceived status. In addition to the internal self-regulation of these two narcissism dimensions, political skill provides an external self-regulation that moderates the mediating effect of self-perceived status at the first stage—that is, the positive relationship between narcissistic admiration and self-perceived status is stronger when political skill is high rather than low. Our post hoc analyses further reveal that narcissistic rivalry is negatively related to OCB-C through the mediation of self-perceived status. Theoretical contributions and practical implications are discussed. (shrink)

Past literature in the area of employee–customer interactions suggests that being mistreated by customers is deemed one of the most important work-related stressors for service employees. However, little is known about the effects of customer mistreatment on the family domain. In a representative sample of 221 front-line employees in the East China hairdressing industry using three separate surveys administered 1 month apart respectively, the current study explores the mediation effects of work-to-family conflict (WFC) and the moderation effects of psychological detachment (...) (PD) and leader–member exchange (LMX) on the relationship between customer mistreatment and family satisfaction (FS). The research revealed that the employees confronted with intensive customer mistreatment tended to experience high levels of WFC, and WFC mediated the effects of customer mistreatment on FS. In addition, both PD and LMX attenuated customer mistreatment’s direct effects on WFC and indirect effects on FS (via WFC). This study contributes to the managerial psychology literature related to the customer mistreatment construct and a better understanding of how PD and LMX act as a work-family spillover effect moderator of customer mistreatment on individuals. In his writings, Francis Bacon emphasized the interrelatedness between the migration of people and knowledge, arguing that Europeans of his time had surpassed the greatest civilizations because of their ability to traverse the world freely. Concentrating on Spanish observers who investigated New Spain’s flora, this article bridges theory and practice by examining the Iberian roots of Bacon’s views. The article examines scientific approaches for acquiring bioknowledge by Iberians who specialized in European medicine, including Francisco Hernández, Juan de Cárdenas and (...) Francisco Ximénez. While the article recognizes the contribution of travellers and expatriates to Spain’s bioprospecting project, it also points to the ways in which the limitations of the transfer of botanical information was acknowledged and discusses its meaning. By presenting the complexities in the communication of knowledge, I argue, naturalists in the colonies could highlight their unique vantage point in relation to “armchair” specialists in the metropole. This article examines whether the likelihood and amount of firm charitable giving in response to catastrophic events are related to firm advertising intensity, and whether industry competition level moderates this relationship. Using data on Chinese firms’ philanthropic response to the 2008 Sichuan earthquake, we find that firm advertising intensity is positively associated with both the probability and the amount of corporate giving. The results also indicate that this positive advertising intensity-philanthropic giving relationship is stronger in competitive industries, and firms in (...) competitive industries are more likely to donate. This study thus provides evidence suggesting that even in the wake of catastrophic events, corporate philanthropic giving is strategic. (shrink)

Working Memory plays a crucial role in many high-level cognitive processes . The prevalent view holds that active components of WM are predominantly intentional and conscious. This conception is oftentimes expressed explicitly, but it is best reflected in the nature of major WM tasks: All of them are blatantly explicit. We developed two new WM paradigms that allow for an examination of the role of conscious awareness in WM. Results from five studies show that WM can operate unintentionally and outside (...) of conscious awareness, thus suggesting that the current view should be expanded to include implicit WM. (shrink)

We develop and study the complexity of propositional proof systems of varying strength extending resolution by allowing it to operate with disjunctions of linear equations instead of clauses. We demonstrate polynomial-size refutations for hard tautologies like the pigeonhole principle, Tseitin graph tautologies and the clique-coloring tautologies in these proof systems. Using interpolation we establish an exponential-size lower bound on refutations in a certain, considerably strong, fragment of resolution over linear equations, as well as a general polynomial upper bound on interpolants (...) in this fragment.We then apply these results to extend and improve previous results on multilinear proofs , as studied in [Ran Raz, Iddo Tzameret, The strength of multilinear proofs. Comput. Complexity ]. Specifically, we show the following:• Proofs operating with depth-3 multilinear formulas polynomially simulate a certain, considerably strong, fragment of resolution over linear equations.• Proofs operating with depth-3 multilinear formulas admit polynomial-size refutations of the pigeonhole principle and Tseitin graph tautologies. The former improve over a previous result that established small multilinear proofs only for the functional pigeonhole principle. The latter are different from previous proofs, and apply to multilinear proofs of Tseitin mod p graph tautologies over any field of characteristic 0. We conclude by connecting resolution over linear equations with extensions of the cutting planes proof system. (shrink)

Linguistic equity through an interpreter is not merely a fundamental human right but also an integral part of procedural justice. As codified in the professional code of conduct, interpreters should faithfully interpret everything that has been said in the exact same manner as the original speakers. Much has been researched about the content. Little has been known about the interpretations of the manner. Drawing on one hundred questionnaire responses, this article examines the interpreters’ awareness of the manner of speech in (...) Australian virtual courts and remote interpreting settings. The results suggest a general lack of understanding of the manner of speech, as reflected by interpreters’ inadequate knowledge of definitions and specific types of manner-related features. Furthermore, the insufficient understanding of the manner of speech impacts the interpreters’ perceptions of the manner of speech in the original utterances, and their views of the faithful reproduction of the se feature in courtroom discursive practices. The qualitative and quantitative analyses of written responses provided by professional interpreters provide insights into the practical aspects of reproducing the manner of speech in court. (shrink)
