After the Gavel Falls: Rethinking the Relationship Between Sentencing and Prison Functions.Netanel Dagan & Shmuel Baron - 2023 - Criminal Law and Philosophy 17 (1):175-195.
The relationship between the purposes of sentencing and imprisonment can be variously conceptualized. The paper theorizes and contrasts two models of sentencing and prison relations—continuity and separation. The continuity model assumes continuity between sentencing and prison regime. Under this model, all sentencing purposes may impact prison regime. The separation model distinguishes between the purposes of sentencing and of imprisonment. Under the separation model, the retributive element of imprisonment is completely fulfilled by depriving the prisoner of liberty. Retributive considerations can affect (...)

Hannah Arendt and Participatory Democracy: A People’s Utopia.Shmuel Lederman - 2019 - Cham: Springer Verlag.
This book centers on a relatively neglected theme in the scholarly literature on Hannah Arendt's political thought: her support for a new form of government in which citizen councils would replace contemporary representative democracy and allow citizens to participate directly in decision-making in the public sphere. The main argument of the book is that the council system, or more broadly the vision of participatory democracy was far more important to Arendt than is commonly understood. Seeking to demonstrate the close links (...)

From Charlottesville to the Nobel: Political Leaders and the Morality of Political Honors.Shmuel Nili - 2020 - Ethics 130 (3):415-445.
Political honors are ubiquitous in public life, whether in the form of public monuments, street names, or national holidays. Yet such honors have received scant attention from normative political theorists. Tackling this gap, I begin by criticizing a desert-based approach to political honors. I then argue that morally appropriate honors are best understood as marking and reinforcing the moral commitments of the collective in whose name they are being awarded. I show how this thesis clarifies and organizes core intuitions regarding (...)

Implications of synaesthesia for functionalism: Theory and experiments.Joe Gray, Susan Chopping, Julia Nunn, David Parslow, Lloyd Gregory, Steve Williams, Michael J. Brammer & Simon Baron-Cohen - 2002 - Journal of Consciousness Studies 9 (12):5-31.
Functionalism offers an account of the relations that hold between behavioural functions, information and neural processing, and conscious experience from which one can draw two inferences: for any discriminable difference between qualia there must be an equivalent discriminable difference in function; and for any discriminable functional difference within a behavioural domain associated with qualia, there must be a discriminable difference between qualia. The phenomenon of coloured hearing synaesthesia appears to contradict the second of these inferences. We report data showing that (...)

There have been several recent attempts to account for the special authority of self-knowledge by grounding it in a constitutive relation between an agent's intentional states and her judgments about those intentional states. This constitutive relation is said to hold in virtue of the rationality of the subject. I argue, however, that there are two ways in which we have self-knowledge without there being such a constitutive relation between first-order intentional states and the second-order judgments about them. Recognition of this (...)

Knowledge is standardly taken to be belief that is both true and justified (and perhaps meets other conditions as well). Timothy Williamson rejects the standard epistemology for its inability to solve the Gettier problem. The moral of this failure, he argues, is that knowledge does not factor into a combination that includes a mental state (belief) and an external condition (truth), but is itself a type of mental state. Knowledge is, according to his preferred account, the most general factive mental (...)

    The Idea of Public Property.Shmuel Nili - 2018 - Ethics 129 (2):344-369.
Political theory lacks a compelling account of public property. Addressing this gap, I present a “deep public ownership” model, according to which the body politic ultimately owns all the resources within its jurisdiction. I argue that this model is compatible with liberal intuitions regarding private property. I then contend that the model expands the scope of government’s duty to uphold the equality of all citizens, by challenging private property constraints on antidiscriminatory government policies. I anticipate the worry that the model (...)

As of July 1, 2008, females aged 11-26 years seeking status as permanent residents in the United States must produce documentation that they have received the human papillomavirus vaccine before the U.S. Citizenship and Immigration Services will approve their status adjustment. Immigration rights activists and public health officials have objected to this new requirement on the grounds that it is unnecessary and imposes unreasonable barriers to lawful immigration due to its expense. The Supreme Court has generally upheld mandatory vaccination requirements (...)

Our Problem of Global Justice.Shmuel Nili - 2011 - Social Theory and Practice 37 (4):629-653.
Global justice seems to be all about "us" treating "them," especially "their" problem of extreme poverty. This article argues that there is such a thing as our problem of global justice, and that it must be both temporally and logically prior to the problem of global justice. In order to establish this thesis, I seek to corroborate three main claims: that our elected governments are actively complicit in dictators' de facto armed robbery of their population's resources; that each democracy as (...)

ABSTRACT Our goal in this paper is to extend counterfactual accounts of scientific explanation to mathematics. Our focus, in particular, is on intra-mathematical explanations: explanations of one mathematical fact in terms of another. We offer a basic counterfactual theory of intra-mathematical explanations, before modelling the explanatory structure of a test case using counterfactual machinery. We finish by considering the application of counterpossibles to mathematical explanation, and explore a second test case along these lines.

Who’s afraid of a world state? A global sovereign and the statist-cosmopolitan debate.Shmuel Nili - 2015 - Critical Review of International Social and Political Philosophy 18 (3):241-263.
Wary of quick statist dismissal of their proposals, cosmopolitans have been careful not to associate themselves with a world state. I argue that this caution is mistaken: cosmopolitans should see the vision of a world state as strategically valuable in exposing weaknesses in statist accounts, particularly of the Rawlsian variety. This strategic value follows if the only cogent arguments against a world state belong to non-ideal theory which assumes non-compliance, rather than to ideal theory with its core assumption of full (...)

Moses Mendelssohn (1729–1786) wrote Jerusalem with his back to the wall. His Jewish identity and liberal outlook were challenged in the public sphere of the German Enlightenment, and this was his last opportunity to write a book that would perpetuate the essence of his faith and his values as the first modern Jewish humanist. The work, which moves between apologetics for his faith and political and religious philosophy was primarily a daring essay that categorically denied the rule of religion and (...)
