In contrast to Christopher Kelty’s case for the “careful cultural analysis of the domesticated forms that open source is taking” – which we agree to be a very useful endeavor – we would like to stick with the original call for papers for this special issue, that explicitly addresses the critical power of free software and a necessary shift to epistemologies. In our contribution we are responding to the aims of this special issue and to some of the contributions from (...) the perspective of feminist epistemology. There are several reasons for this decision. First of all, feminist scholars have been amongst the rst and most explicit to stress the linkages between knowledge and power. Apart from this generic focus, speci c feminist approaches, namely the approaches proposed by Helen Longino, Karen Barad and Lucy Suchman, o er invaluable insights for understanding the critical power of free software as a practice, which enables the materialization of principles into objects, as Kelty rightly emphasizes. Furthermore, feminist approaches suggest looking at epistemological politics and the situatedness of knowledge practices including e ects of perspectivism and marginalization. We adopt a performative understanding of epistemic practices, an understanding that take the interrelations between epistemology, ontology and ethics seriously. Thus, we start our inquiry from Kelty’s observation that free software “promises a sequence of [...] values: experimentalism and creativity, provisionality and modi ability, recti cation and refraction, dissent and critique, participation and obligation“ and that it „allows values and principles to be turned into material objects“. These and other values have already been inscribed in the launch of the GNU project in the beginning 1980s, the creation of the GPL, and they are continuously realized in the Free Software movement. Hence the interesting question is how they are realized and how are they shaped vice-versa by practices. (shrink)

ObjectiveHopelessness and depression are strongly associated with suicidality. Given that physical and psychological outcomes can be altered with hope, hope is a therapeutic goal of increasing importance in the treatment of brain tumor patients. Moreover, it is not yet understood which factors affect the perception of hope in brain tumor patients. In addition, it remains uncertain whether lower-grade brain tumor patients suffer less from psycho-oncological distress than higher-grade brain tumor patients.MethodsNeuro-oncological patients were examined perioperatively with the Distress Thermometer and the (...) Herth Hope Index. In addition, psychological comorbidities and an assessment of general psycho-oncological distress were recorded.ResultsSixty-six brain tumor patients were included. No differences between higher- and lower-grade brain tumor patients were observed for general psycho-oncological distress and hope. However, higher-grade brain tumor patients showed a significantly higher level of depression and more negative expectations regarding therapeutic success. The extent of depression correlated negatively with hope.ConclusionUnexpectedly, higher-grade brain tumor patients remained as hopeful as lower-grade brain tumor patients despite the devastating diagnosis, higher levels of depression, and a worse expectation of therapeutic success. Conversely, lower-grade brain tumor patients experience as much psycho-oncological distress as patients with a higher-grade brain tumor, underpinning the imperative need for comprehensive psycho-oncological screening. For all brain tumor patients, considering hope is important to avoid suicides resulting from hopelessness and depression. (shrink)

The prevailing historiographies of Jewish life in England suggest that religious representations of the Jews in the early modern period were confined to the margins and fringes of society by the desacralization of English life. Such representations are mostly neglected in the scholarly literature for the latter half of the long eighteenth century, and English Methodist texts in particular have received little attention. This article addresses these lacunae by examining the discourse of Adam Clarke, an erudite Bible scholar, theologian, preacher (...) and author and a prominent, respected, Methodist scholar. Significantly, the more overt demonological representations were either absent from Clarke‘s discourse, or only appeared on a few occasions, and were vague as to who or what was signified. However, Clarke portrayed biblical Jews as perfidious, cruel, murderous, an accursed seed, of an accursed breed and radically and totally evil. He also commented on contemporary Jews, maintaining that they were foolish, proud, uncharitable, intolerant and blasphemous. He argued that in their eternal, wretched, dispersed condition, the Jews demonstrated the veracity of biblical prophecy, and served an essential purpose as living monuments to the truth of Christianity. Driven by the increasing availability and deployment of ubiquitous computing technologies across our private and professional lives, implementations of automatically processable regulation (APR) have evolved over the past decade from academic projects to real-world implementations by states and companies. There are now pressing issues that such encoded regulation brings about for citizens and society, and strategies to mitigate these issues are required. However, _comprehensive yet practically operationalizable_ frameworks to navigate the complex interactions and evaluate the risks of projects that implement (...) APR are not available today. In this paper, and based on related work as well as our own experiences, we propose a framework to support the conceptualization, implementation, and application of _responsible_ APR. Our contribution is twofold: we provide a holistic characterization of what responsible APR means; and we provide support to operationalize this in concrete projects, in the form of leading questions, examples, and mitigation strategies. We thereby provide a scientifically backed yet practically applicable way to guide researchers, sponsors, implementers, and regulators toward better outcomes of APR for users and society. (shrink)

The field of computational law has increasingly moved into the focus of the scientific community, with recent research analysing its issues and risks. In this article, we seek to draw a structured and comprehensive list of societal issues that the deployment of automatically processable regulation could entail. We do this by systematically exploring attributes of the law that are being challenged through its encoding and by taking stock of what issues current projects in this field raise. This article adds to (...) the current literature not only by providing a needed framework to structure arising issues of computational law but also by bridging the gap between theoretical literature and practical implementation. Key findings of this article are: (1) The primary benefit (efficiency vs. accessibility) sought after when encoding law matters with respect to the issues such an endeavor triggers; (2) Specific characteristics of a project—project type, degree of mediation by computers, and potential for divergence of interests—each impact the overall number of societal issues arising from the implementation of automatically processable regulation. An important challenge when creating automatically processable laws concerns open-textured terms. The ability to measure open-texture can assist in determining the feasibility of encoding regulation and where additional legal information is required to properly assess a legal issue or dispute. In this article, we propose a novel conceptualisation of open-texture with the aim of determining the extent of open-textured terms in legal documents. We conceptualise open-texture as a lever whose state is impacted by three types of forces: internal forces (the (...) words within the text themselves), external forces (the resources brought to challenge the definition of words), and lateral forces (the merit of such challenges). We tested part of this conceptualisation with 26 participants by investigating agreement in paired annotators. Five key findings emerged. First, agreement on which words are open-texture within a legal text is possible and statistically significant. Second, agreement is even high at an average inter-rater reliability of 0.7 (Cohen’s kappa). Third, when there is agreement on the words, agreement on the Open-Texture Value is high. Fourth, there is a dependence between the Open-Texture Value and reasons invoked behind open-texture. Fifth, involving only four annotators can yield similar results compared to involving twenty more when it comes to only flagging clauses containing open-texture. We conclude the article by discussing limitations of our experiment and which remaining questions in real life cases are still outstanding. (shrink)

These initial glimpses of what we now call the Galilean moons of Jupiter are among the first great revelations to have accrued from pointing the newly invented telescope toward the heavens. Yet, were these men the first to observe Jupiter’s satellites? There have been persistent reports, particularly in the nineteenth century, that these moons (...) can be seen with the naked eye. Dance is regarded as visual art form by common arts and science perspectives. Definitions of dance as means of communication agree that its message is conveyed by the dancer/choreographer via the human body for the observer, leaving no doubt that dance is performed to be watched. Brain activation elicited by the visual perception of dance has also become a topic of interest in cognitive neuroscience, with regards to action observation in the context of learning, expertise and aesthetics. The view that (...) the aesthetic experience of dance is primarily a visual one is still shared by many artists and cultural institutions, yet there is growing interest in making dance performances accessible for individuals with visual impairment / blindness. Means of supporting the non-visual experience of dance include verbal (audio description), auditive (choreographed body sounds, movement sonification), and haptic (touch tour) techniques, applied for different purposes by artists and researchers, with three main objectives: to strengthen the cultural participation of a non-sighted audience in the cultural and aesthetic experience of dance; to expand the scope of dance as an artistic research laboratory toward novel ways of perceiving what dance can convey; and to inspire new lines of (neuro-cognitive) research beyond watching dance. Reviewing literature from different disciplines and drawing on the personal experience of an inclusive performance of Simon Mayer's “Sons of Sissy,” we argue that a non-exclusively visual approach can be enriching and promising for all three perspectives and conclude by proposing hypotheses for multidisciplinary lines of research. Somehow, the secular age seems to have been replaced by a new era, where political action flows directly from metaphysical conflict. The Faith of the Faithless asks how we might respond. Following Critchley's Infinitely Demanding, this new book builds on its philosophical and political framework, also venturing into the questions of (...) faith, love, religion and violence. Should we defend a version of secularism and quietly accept the slide into a form of theism--or is there another way? From Rousseau's politics and religion to the return to St. Paul in Taubes, Agamben and Badiou, via explorations of politics and original sin in the work of Schmitt and John Gray, Critchley examines whether there can be a faith of the faithless, a belief for unbelievers. Expanding on his debate with Slavoj Zizek, Critchley concludes with a meditation on the question of violence, and the limits of non-violence. (shrink)

Broad in its geographic scope and yet grounded in original archival research, this book situates the inception of modern aesthetic theory – the philosophical analysis of art and beauty - in theological contexts that are crucial to explaining why it arose. Simon Grote presents seminal aesthetic theories of the German and Scottish Enlightenments as outgrowths of a quintessentially Enlightenment project: the search for a natural 'foundation of morality' and a means of helping naturally self-interested human beings transcend their own (...) self-interest. This conclusion represents an important alternative to the standard history of aesthetics as a series of preludes to the achievements of Immanuel Kant, as well as a reinterpretation of several canonical figures in the German and Scottish Enlightenments. It also offers a foundation for a transnational history of the Enlightenment without the French philosophes at its centre, while solidly endorsing historians' growing reluctance to call the Enlightenment a secularising movement. The task of axiomatizing physical theories has attracted, in recent years, some interest among both empirical scientists and logicians. However, the axiomatizations produced by either one of these two groups seldom appear satisfactory to the members of the other. It is the purpose of this paper to develop an approach that will satisfy the criteria of both, hence permit us to construct axiomatizations that will meet simultaneously the standards and needs of logicians and of empirical scientists.

The concept of indistinguishable particles in quantum theory is fundamental to questions of ontology. All ordinary matter is made of electrons, protons, neutrons, and photons and they are all indistinguishable particles. Yet the concept itself has proved elusive, in part because of the interpretational difficulties that afflict quantum theory quite generally, and in part because the concept was so central to the discovery of the quantum itself, by Planck in 1900; it came encumbered with revolution. I offer a deflationary reading (...) of the concept ‘indistinguishable’ that is identical to Gibbs’ concept ‘generic phase’, save that it is defined for state spaces with only finitely-many states of bounded volume and energy. That, and that alone, makes for the difference between the quantum and Gibbs concepts of indistinguishability. This claim is heretical on several counts, but here we consider only the content of the claim itself, and its bearing on the early history of quantum theory rather than in relation to contemporary debates about particle indistinguishability and permutation symmetry. This paper examines what agents should do when others fail to comply with their responsibilities to prevent dangerous climate change. It distinguishes between six different possible responses to noncompliance. These include what I term (1) 'target modification' (watering down the extent to which we seek to prevent climate change), (2) ‘responsibility reallocation’ (reassigning responsibilities to other duty bearers), (3) ‘burden shifting I’ (allowing duty bearers to implement policies which impose unjust burdens on others, (4) 'burden shifting II’ (allowing some to (...) protect peoples rights in ways which impose otherwise unjustified burdens on the duty bearers, (5) 'compromising moral ideals' (permitting agents to compromise non-justice ideals that they are otherwise bound by); and (6) ‘promoting compliance (implementing policies and creating institutions which reduce noncompliance). It concludes by outlining a methodological framework for evaluating these options, and by setting out my tentative and provisional evaluation of which responses are the least bad. (shrink)

This paper argues that research on normative issues in the life sciences will benefit from a tighter integration of philosophy of science. We examine research on ethical, legal and social issues in the life sciences (“ELSI”) and discuss three illustrative examples of normative issues that arise in different areas of the life sciences. These examples show that important normative questions are highly dependent on epistemic issues which so far have not been addressed sufficiently in ELSI, RRI and related areas of (...) research. Accordingly, we argue for the integration of research on the epistemic aspects of the relevant areas of science into ELSI research to provide a better basis for addressing normative questions. One of the main contributions of Richard Bradley’s book is an elegant extension of Jeffrey’s Logic of Decision that countenances the evaluation of conditional prospects. This extension offers a promising new setting in which to model dynamic choice. In Bradley’s framework, plans can be understood as conditionals of an appropriate sort, while dynamic consistency can be viewed as providing a constraint on the evaluation of conditionals across time. In this paper, we study connections between planning conditionals and dynamic consistency.

Deconstruction and pragmatism constitute two of the major intellectual influences on the contemporary theoretical scene; influences personified in the work of Jacques Derrida and Richard Rorty. Both Rortian pragmatism, which draws the consequences of post-war developments in Anglo-American philosophy, and Derridian deconstruction, which extends and troubles the phonomenological and Heideggerian influence on the Continental tradition, have hitherto generally been viewed as mutually exclusive philosophical language games. The purpose of this volume is to bring deconstruction and pragmatism into critical confrontation with (...) one another through staging a debate between Derrida and Rorty, itself based on discussions that took place at the College International de Philosophie in Paris in 1993. The ground for this debate is layed out in introductory papers by Simon Critchley and Ernesto Laclau, and the remainder of the volume records Derrida's and Rorty's responses to each other's work. In Ethics–Politics–Subjectivity, Simon Critchley takes up three questions at the centre of contemporary theoretical debate: What is ethical experience? What can be said of the subject who has this experience? What, if any, is the relation of ethical experience to politics? Through spirited confrontations with major thinkers, such as Lacan, Nancy, Rorty, and, in particular, Levinas and Derrida, Critchley finds answers in a nuanced “ethics of finitude” and defends the political possibilities of deconstruction. Causal queries about singular cases, which inquire whether specific events were causally connected, are prevalent in daily life and important in professional disciplines such as the law, medicine, or engineering. Because causal links cannot be directly observed, singular causation judgments require an assessment of whether a co‐occurrence of two events c and e was causal or simply coincidental. How can this decision be made? Building on previous work by Cheng and Novick (2005) and Stephan and Waldmann (2018), we propose a (...) computational model that combines information about the causal strengths of the potential causes with information about their temporal relations to derive answers to singular causation queries. The relative causal strengths of the potential cause factors are relevant because weak causes are more likely to fail to generate effects than strong causes. But even a strong cause factor does not necessarily need to be causal in a singular case because it could have been preempted by an alternative cause. We here show how information about causal strength and about two different temporal parameters, the potential causes' onset times and their causal latencies, can be formalized and integrated into a computational account of singular causation. Four experiments are presented in which we tested the validity of the model. The results showed that people integrate the different types of information as predicted by the new model. (shrink)

Compromise is an inescapable part of human coexistence, from the mundane choices of domestic life to the grand stage of world politics. Notwithstanding its ubiquity, compromise raises a number of philosophical puzzles. One kind of problem is conceptual: what is compromise, and how might it differ from similar social phenomena, such as consensus and bargaining? A second kind of problem concerns the murky ethics of compromise, particularly on matters of moral significance. Compromise may have a salutary role in facilitating cooperation, (...) but it can also involve the sacrifice or betrayal of important values. Can there be moral reasons for genuine moral compromise and, if so, what form might they take? Similarly, are there any limits to moral compromise, or are all moral commitments ultimately subject to negotiation? (shrink)

The Moral Conscience principle claims that a conflict between the demands of a law and the demands of an individual’s sincere moral conscience provides her with a defeasible moral entitlement to an exemption. This chapter argues that this principle is vulnerable to an unfairness objection. There is nothing special about moral conscience that would justify granting an exemption, it claims, that is not shared by a variety of non-moral projects. Thus, there is no principled moral reason for a defeasible entitlement (...) to moral conscience-based exemptions that is not an equally good reason for a defeasible entitlement to non-moral project-based exemptions. Since the chapter assumes that people are not defeasibly entitled to such project-based exemptions, it advocates scepticism about the Moral Conscience principle. (shrink)

Simon Critchley's aim in this book is to provide a less familiar, more troubling, and truer account of Levinas's work. He proposes a new dramatic method for reading Levinas, where the fundamental problem of his work is seen as the attempt to escape from the tragedy of Heidegger's philosophy and (...) the way in which that philosophy shaped political events in the last century. Boghossian's discrimination argument for the incompatibility of externalism and a priori self-knowledge presupposes the relevant-alternatives account of knowledge, more precisely, the claim that the ability to rule out relevant alternatives is a necessary condition for knowledge. In the first two sections of this essay, I object to Boghossian's argument by showing that the standard way of supporting the claim just mentioned, namely with recourse to Goldman's famous barn example, will not convince a rational externalist who knows the relevant facts. In (...) section three, a second challenge to the discrimination argument is developed. First, a descriptive variant of Goldman's barn example is distinguished from a demonstrative variant of this scenario. Then, it is argued that the fact that Goldman's protagonist does not have knowledge in the demonstrative variant cannot be explained by the claim that the ability to rule out relevant alternatives is necessary for knowledge. From this it is concluded that it is not possible to substantiate the claim just mentioned with recourse to Goldman's barn example. The upshot of the discussion in sections one through three is that one cannot argue for the incompatibility of externalism and a priori self-knowledge by drawing on the claim that the ability to rule out relevant alternatives is required for knowledge. In the final section of the article, it is shown that one can furthermore not argue for the incompatibility thesis by invoking the contention that so-called global reliability is necessary for knowledge. Rather than defend each instance of problem suggested by Williams, what I propose to do is to respond by making two clarificatory points: first, I rule out two ways of understanding mathematical problems that might be clouding the water; and then, second, I further characterise how Deleuze thinks some mathematical problems, two in particular, are not just examples of mathematical problems, but provide mathematical models for what a mathematical problem in general can be understood to be. This is important because (...) it is how mathematical problems can be modelled in mathematics that provides Deleuze with a model for how problems can be modelled in other discourses. This will then get to the bottom of what is at stake in my approach to Deleuze and to Deleuze studies in general. (shrink)

The indexing systems used to systematise our knowledge about a domain tend to have an evaluative character: they represent some things as more important, general, complex, or central than others. They are also imperfect and can misrepresent something as more or less important, etc., than it really is. Such distortions mostly result from mistakes made due to lack of time or resources. In some cases they follow systematic patterns which can reveal the implicit judgements and values shared within a community (...) who maintains and uses an index. I focus on the example of PhilPapers, the largest database of philosophy texts available, to show how the arrangement of categories and the way items are assigned to them, can effectively marginalise certain topics, authors, and entire traditions. I draw attention to such issues as: ordering, size and depth of categories, the use of miscellaneous categories, localising indexes in category names, and assigning items to some but not other categories. I suggest that such structuring of the index can have an impact on users, normalising marginalisation and contributing to the perpetuation of inequalities. I conclude by offering some suggestions for improvement which might help our databases flourish and become even more useful. (shrink)

This article argues that integrated infrastructural planning is necessary for building cities that encourage tolerance as a civic behaviour. It argues in favour of open planning and insists that tolerance must be tolerance of risk and uncertainty in urban experience.
