The article discusses the relation between the concepts of unfair trade, exploitation, and below-subsistence wages with regard to individual economic transactions. Starting from the common notion that exploitation involves some kind of unfair advantage taking, it asks how “unfair” is to be understood, and what it is that is taken advantage of in exploitative exchanges. On this basis it then explores a line of argument for grounding the claim that below-subsistence wages are exploitative, focusing on the condition of morally transformative (...) voluntary consent to transactions. By analyzing the structure of coercion with regard to threats, offers, and circumstances it comes to the conclusion that consent to an offer is morally non-transformative with regard to legitimizing the outcome of a transaction if the person giving the “consent” has only unacceptable options in absolute terms to choose from, since this reduces “consent” to a mere act of rationality devoid of any normative content. Accordingly, it argues that insofar as below-subsistence wages are unacceptable options in absolute terms, they are to be considered exploitative and an instance of unfair trade. (shrink)

This volume aimed to highlight narrative identities of European cities or city neighbourhoods that have been overlooked, such as mid-sized cities. These cities are neither small towns nor metropolises, cities that are now unveiling their appeal or specificity. The present special issue thus covers a range of representations of cities. The articles investigate more systematically how different texts deal with various cities from different experiential and fictional perspectives. The issue covers the geographical scope across Europe, from east to west or (...) vice versa, as well as a range of different works of national literature(s), but with a clear emphasis on mid-sized European cities that have until now been deemed as lesser-known, secondary, peripheral, ‘other’ cities that are in the focus of the research of the COST project Writing Urban Places. Following up on earlier investigations, the present research aims at validating the construct impostor phenomenon by taking other personality correlates into account and to examine whether the impostor phenomenon is a construct in its own right. In addition, gender effects as well as associations with dispositional working styles and strain are examined. In an online study we surveyed a sample of N = 242 individuals occupying leadership positions in different sectors. Confirmatory factor analyses provide empirical evidence for the discriminant validity (...) of the impostor phenomenon. In accord with earlier studies we show that the impostor phenomenon is accompanied by higher levels of anxiety, dysphoric moods, emotional instability, a generally negative self-evaluation, and perfectionism. The study does not reveal any gender differences concerning the impostor phenomenon. With respect to working styles, persons with an impostor self-concept tend to show perfectionist as well as procrastinating behaviors. Moreover, they report being more stressed and strained by their work. In sum, the findings show that the impostor phenomenon constitutes a dysfunctional personality style. Informed consent represents a specific protocol for obtaining consent from a fully informed human subject to take part in clinical research. Still, informed consent is not only required for clinical trials but it also represents a critical precondition before enrolment in standard everyday medical procedures. Relevant fundamental criteria for obtaining informed consent must be followed, and that is that patient must have the decisional capacity to reach autonomous decision. The patient must be adequately informed and not coerced. Evaluating decisional capacity (...) is crucial to providing the required level of care. The decision of which decisional capacity tool to use can be challenging because of various dissimilarities among the instruments. In this paper, four widely documented instruments have been evaluated, namely, the MacArthur Competence Assessment Tool for Treatment (MacCAT-T), the Hopkins Competency Assessment Test (HCAT), the Structured Interview for Competency/Incompetency Assessment Testing, Ranking Inventory (SICIATRI), and the Capacity Assessment Tool (CAT). Some of them include a fully structured interview; semi-structured forms characterise others. Most of them are adaptable for different scenarios, and yet, some are tailored for specific treatment decisions. Some evaluate all four components of decisional capacity, while others do not. Although a broad range of capacity assessment tools is available, it has been shown that they notably improve the accuracy of capacity evaluations. Given that many pathological conditions could result in impaired decisional capacity, physicians must be able to correctly and consistently assess the capacity for which education and previous experience are pivotal. Die Werke, die um das Jahr 1900 von Patienten in psychiatrischen Einrichtungen geschaffen wurden, werden erstmals aus einer phänomenologischen Perspektive heraus betrachtet. Ausgangspunkt ist die Phänomenologie des Philosophen Maurice Merleau-Ponty und seines Konzepts von Leiblichkeit. Im Mittelpunkt stehen die Werke von Elisabeth Faulhaber, Carl Lange und Edmund Träger. Die Autorin befragt die Werke der drei Art-Brut-Künstler (...) nach den darin zum Ausdruck kommenden Zeit- und Raumordnungen, nach dem Verhältnis der Künstler zu sich selbst und zur Welt. Diese Bildbetrachtungen ermöglichen es Lesern, sich den Künstlern anzunähern und ihr „Zur-Welt-Sein“ nachzuvollziehen. Das vermeintlich Kranke wird durch die Analyse der Bildsprache als existenzielle und momentane Balancefindung verstehbar. Was auf den ersten Blick fremd erscheint, wird auf Ordnungsstrukturen und Metaphernbildungen im schöpferischen Prozess zurückgeführt. So entwickelt die Autorin ein neues Verständnis von Kunst, geschaffen von Menschen in Phasen existenzieller seelischer Krisen. Sie geht damit weit über kunsthistorische Analysen auf der einen und psychiatrische Diagnosen auf der anderen Seite hinaus und stellt gängige Definitionen von Kunst und Krankheit in Frage. Die Autorin erweitert die wissenschaftliche Debatte zu Phänomenologie und Bildsprache und bringt dafür erstmals alle verfügbaren Quellen und Erkenntnisse zu den drei Vertretern der Outsider Art zusammen. Whats human rights got to do with it? That is, whats human rights got to do with the June 2004 report of the Social Sciences and Humanities Research Ethics Special Working Committee to the Inter-Agency Advisory Panel on Research Ethics. The disturbing answer is not enough. Certain key recommendations of the working committee, it is suggested, would unacceptably weaken the researchers legal and moral accountability to research participants. Those particular recommendations rely on misguided references to academic freedom and the nature (...) of the non-medical research context. In fact, universal human rights, and the legal instruments in which they are embodied ought to inform the research endeavor at every stage; from problem selection to analysis and conclusions. This will lead us closer to shared truths rather than simply to the academic elites vision of truth. Without sufficient regard for the human rights of research participants academic freedom itself is not possible. (shrink)

This article investigates the anthropology of Spinoza as a strategy for happiness, political, as well as individual. Inspired by the readings, comments, and perspectives of Matheron, Deleuze, and Balibar, I will analyze Spinoza’s theory of the affects as the basis for this strategic anthropology. These authors all share an ontological and political vision organized around the concepts of multitude and the transindividual which result directly from Spinoza’s analysis of the human affects in books III and IV of the Ethics, and (...) his theory of political dynamics developed in the Political treatise. They consider Spinoza a contemporary and share with him the idea of a relational ontology and an inextricable and mutual interdependence of the individual and the community which is captured in the concept of the transindividual. With Matheron/Spinoza I will focus on the question of anthropology and the structure of thought, with Deleuze/Spinoza on the kinds of knowledge in relation to the human mind and body, and with Balibar/Spinoza on the transindividual, productive, active, and thus strategic nature of our thinking. These three analyses of human thought and affects all proceed from the hypothesis of conatus/desire as human essence and aim not just at theoretical knowledge but rather at the effective improvement of our well-being and lives, that is, at happiness. In recent years, discourses around “personalized,” “stratified,” and “precision” medicine have proliferated. These concepts broadly refer to the translational potential carried by new data-intensive biomedical research modes. Each describes expectations about the future of medicine and healthcare that data-intensive innovation promises to bring forth. The definitions and uses of the concepts are, however, plural, contested and characterized by diverse ideas about the kinds of futures that are desired and desirable. In this paper, we unpack key disputes around the “personalized,” “stratified,” (...) and “precision” terms, and map the epistemic, political and economic contexts that structure them as well as the different roles attributed to patients and citizens in competing future imaginaries. We show the ethical and value baggage embedded within the promises that are manufactured through terminological choices and argue that the context and future-oriented nature of these choices helps to understanding how data-intensive biomedical innovations are made socially meaningful. This is a collection of sixteen essays by a diverse group of international scholars that offers a wide-ranging and contemporary perspective on the major aspects of Christian Wolff’s ethics. The volume focuses on Wolff’s German Ethics, arguably his most important and influential text on moral philosophy, but many of the chapters also consider the development of the basic tenets of Wolff’s moral theory in his later Latin writings. The contributions cover a range of topics, including the systematic structure of the (...) text itself and the relation between Wolff’s ethics and the preceding natural law tradition. Many chapters pay special attention to the core concepts of Wolff’s moral philosophy, such as obligation, perfection, the highest good, and happiness. Other notable topics include Wolff’s conception of moral judgment and moral education, as well as the role of psychology and anthropology in his ethical thought. The volume also contains discussion of the influence of Wolff’s ethics on subsequent figures such as C.A. Crusius, G.F. Meier, and Kant. We propose a new topological semantics for evidence, evidence-based justifications, belief, and knowledge. Resting on the assumption that an agent’s rational belief is based on the available evidence, we try to unveil the concrete relationship between an agent’s evidence, belief, and knowledge via a rich formal framework afforded by topologically interpreted modal logics. We prove soundness, completeness, decidability, and the finite model property for the associated logics, and apply this setting to analyze key epistemological issues such as “no false lemma” (...) Gettier examples, misleading defeaters, undefeated justification versus undefeated belief, as well as the defeasibility theories of knowledge. (shrink)

Alternative food networks (AFN) are argued to provide platforms to re-socialize and re-spacealize food, establish and contribute to democratic participation in local food chains, and foster producer–consumer relations and trust. As one of the most recent examples of AFN, Participatory Guarantee Systems (PGS) have gained notable traction in attempting to redefine consumer-producer relations in the organic value chain. The participation of stakeholders, such as consumers, has been a key element theoretically differentiating PGS from other organic verification systems. While research on (...) farmer participation in PGS is attracting interest, consumer participation is still widely overlooked. Using a mixed methods approach, this paper describes five PGS markets in Mexico, Chile and Bolivia. A survey was conducted with consumers in the PGS markets to explore their awareness of the PGS, how consumers participate in the PGS, and their level of trust in the respective PGS and its certified products. Results showed a low level of awareness of PGS among market consumers, few participation possibilities, and minimal consumer participation overall. Nevertheless, trust in organic quality was generally high. Consumers primarily relied on the direct relationship with producers and the PGS market itself as sources of trust. These results provide novel insight into PGS consumer-market interactions, and contribute to discussions concerning social embeddedness, awareness and participation within AFN. (shrink)

Population-level biomedical research offers new opportunities to improve population health, but also raises new challenges to traditional systems of research governance and ethical oversight. Partly in response to these challenges, various models of public involvement in research are being introduced. Yet, the ways in which public involvement should meet governance challenges are not well understood. We conducted a qualitative study with 36 experts and stakeholders using the World Café method to identify key governance challenges and explore how public involvement can (...) meet these challenges. This brief report discusses four cross-cutting themes from the study: the need to move beyond individual consent; issues in benefit and data sharing; the challenge of delineating and understanding publics; and the goal of clarifying justifications for public involvement. The report aims to provide a starting point for making sense of the relationship between public involvement and the governance of population-level biomedical research, showing connections, potential solutions and issues arising at their intersection. We suggest that, in population-level biomedical research, there is a pressing need for a shift away from conventional governance frameworks focused on the individual and towards a focus on collectives, as well as to foreground ethical issues around social justice and develop ways to address cultural diversity, value pluralism and competing stakeholder interests. There are many unresolved questions around how this shift could be realised, but these unresolved questions should form the basis for developing justificatory accounts and frameworks for suitable collective models of public involvement in population-level biomedical research governance. Over evolutionary time, humans have developed a selective sensitivity to features in the human face that convey information on sex, age, emotions, and intentions. This ability might not only be applied to our conspecifics nowadays, but also to other living objects (i.e., animals) and even to artificial structures, such as cars. To investigate this possibility, we asked people to report the characteristics, emotions, personality traits, and attitudes they attribute to car fronts, and we used geometric morphometrics (GM) and multivariate statistical (...) methods to determine and visualize the corresponding shape information. Automotive features and proportions are found to covary with trait perception in a manner similar to that found with human faces. Emerging analogies are discussed. This study should have implications for both our understanding of our prehistoric psyche and its interrelation with the modern world. (shrink)

This article attempts to conceptualise the notion of the foreigner in relation to immigrant early childhood teachers. Sparked by Kristeva’s challenge, to live with and as others without ostracism or levelling, it highlights tensions that arise in a juxtaposition of the Aotearoa/new Zealand early childhood curriculum document, Te Whāriki and other guidelines for cross-cultural practices, with perspectives on the foreigner and foreignness. Situated in the neoliberal sociopolitical and cultural landscape of Aotearoa/new Zealand, the analysis foregrounds and re-frames orientations towards immigrant (...) teachers as they may play out in the early childhood realm. Kristeva’s insights into foreigners’ raw and intimate experiences provide a freeing lens to emphasise influences on and consequences of a foreigner’s otherness. While Kristeva’s challenge may be a never-ending story of a utopian future in education, its use in this analysis is intended to provoke an awareness of complex conceptualisations of foreignness and of tensions that could subvert the aim of working towards this, possibly elusive, ideal. The thesis addresses the question of human consciousness in its oscillation between conditioning and transcendence: the impact of cultural worldviews on the individual's lifeworld and their gradual transcendence as a form of spiritual practice. At the centre of attention is a group of individuals and their unfolding life-stories as they move through a journey of transformation, seeking to explore and understand the complexity of their own consciousness. The emphasis is on the embodiment of belief systems and the individuals' inherent existential (...) power to transcend cultural precepts. The so-called Women’s Wall received widespread news coverage; in the United (...) States, NPR, the BBC, the Washington Post, and the New York Times all had stories on it. Debra Messing, Kerry Washington, and Rose McGowan tweeted about it. As a scholar of caste, gender, and religion in Kerala, India, I watched the news and international attention with a good deal of interest and a bit of unease about how the intersections of casteism and patriarchy (brahmanical patriarchy) were glossed over in the reporting. The issues surrounding the Women’s Wall reveal the ways in which certain groups invest in the protection of brahmanical patriarchal power; a power that is reflected in political tensions between the Kerala state and the Indian central government that may come to a head in the upcoming Lok Sabha elections. Casteism and religious divides in Kerala are rarely discussed in depth because Kerala is largely seen as a progressive state, with a 94 percent literacy rate. Other development indicators also point to the assumption that Kerala is exceptional: low infant mortality rates, low maternal mortality rates, low fertility rates, and a population where there are more women than men. Kerala is seen as secular because there is a large number of both Christian and Muslim religious minorities. In 1957, 254 News and Views Kerala made history by democratically electing a communist government and initiating a set of far-reaching (although not all-encompassing) land distribution policies. The state is seen as transgender friendly with a transgender beauty pageant and support for trans surgery. The “feminist ” Women’s Wall protest fits in quite neatly within the dominant narrative that Kerala is exceptional, progressive, and thus a model for other Indian states and for countries in the Global South to follow. However, even as “progressive” Kerala is celebrated today, it is not clear that women in the state are necessarily as empowered as commonly believed. The state has some of the highest rates of violent crime in the nation and violence against women is widespread.1 Kerala’s suicide rates are two times the national average, and Kerala leads all other states in India in the number of family murder/suicides.2 Women are vastly underrepresented in politics.3 Although women are educated, the female workforce participation rate is one of the lowest in India.4 There is evidence to suggest that educated, nonworking women are using their education toward securing a better marriage match rather than for employment or empowerment.5 Kerala has a history of extremely repressive caste practices. This area of India once not only practiced untouchability, but what is known as “distance pollution.” A Dalit (the most oppressed caste in the caste hierarchy) was not allowed within sixty feet of a Brahmin (the most privileged caste), and the mere shadow of a Dalit falling upon a dominant-caste person could result in a Dalit’s death.6 Dalit Bahujans were prohibited 1. What is astro-culture? In The Babylonian Planet it is unfolded as an aesthetic, an idea, a field of study, a position, and a practice. It helps to engineer the shift from a world view that is segregated to one that is integrated - from global to planetary; from distance to intimacy and where closeness and cosmic distance live side-by-side. In this tour de force, Sonja Neef takes her cue from Edouard Glissant's vision of multilingualism and reignites the myth of (...) the Tower of Babel to anticipate new forms of cultural encounter. For her, Babel is an organic construction site at which she fuses theoretical analysis and case studies of artists, writers and thinkers like William Kentridge, Orhan Pamuk and Immanuel Kant. Her skilful interrogations then allow her to paint a portrait of art and culture that abolishes the horizon as a barrier to vision and reclaims it as a place of contact and relation. By combining the Babylonian concept of the encounter and the planetary concept of the whole-earth, Neef creates a space - an astro-culture - in which she can examine topics as varied as language, translation, media, modernity, migration and the moon. In doing so, she instigates a renewed cultural understanding receptive to the kinder forms of cultural encounter and globalisation she hopes will come. (shrink)

In this article, the focus will first be on the distinction Spinoza makes in his Tractatus theologico-politicus on the different strivings of human beings and the two different conceptions of law—natural and ad arte—in relation to freedom. Proceeding from these distinctions and Spinoza’s objective with his philosophical enquiries, I will then consider whether a change occurs between the earlier TTP and the later unfinished Tractatus politicus. Both texts are marked by a naturalist turn, the indifference of religion, moral neutrality, the (...) identification of right and power and the denial of natural hierarchy, but nonetheless one can also observe a change in the TP, where the naturalistic premise is more explicit, the human condition more on the forefront and the use of the concepts more precise; the ‘people’, for example, are replaced by the ‘multitude’. In search of sources and aspects for the naturalist turn and the specific conceptual evolution between the TTP and TP, we will consider the example of Machiavelli (and thereafter of Lucretius), De la Court’s notion of a free republic building on Machiavelli and the revolutionary ideas of Van den Enden aimed at improving on his predecessor. The different aspects linked to the use of the concept of multitude in the TP will then be analyzed in relation to the sources and aspects mentioned so as to return to the initial questions concerning law and freedom. This paper investigates the affiliation of Book I of the Latin translation of Euclid's Elements attributed to Hermann of Carinthia with the Arabic transmission of the Greek mathematical work. It argues that it is a translation of a text of the Arabic secondary transmission, that is, of an Arabic edition mixed with comments. Two methodological claims are made in the paper. The first insists that the determination of a text whose transmission was as multifaceted and complex as the Euclidean Elements (...) needs to be based on a systematic investigation of entire books rather than on selected theorems or diagrams of global, mostly structural relevance. The second claim starts from the experience that almost all results regarding the place of a particular document in a chain of transmission are conjectural. It acknowledges that individual results are more or less persuasive, depending upon the qualitative status of the argument. It suggests that the quantitative accumulation of similarities, differences, errors, regularities, or peculiarities allows one to recognize patterns and thus improves the reliability of judgment. The AO has been leveled against contemporary libertarian conceptions of free will and says that freedom of the will, conceived as freedom of indifference, implies that choices can be made for no reason. If successful, the AO would undermine the rationality of libertarian views, which is why a rebuttal of it is of systematic interest. I discuss the attempt of Christian August Crusius (1715–75) in order to explain that Crusius (...) rejects the AO by showing that there is no choice without a reason. (shrink)

This article investigates the contribution of Spinoza and authors of his circle (Antistius Constans, Van den Enden and Koerbagh) on the modern conception of tolerance. In his Tractatus theologico-politicus (1670), Spinoza launches the libertas philosophandi-question integrating two kinds of freedom between which there is a tension: freedom of thought and speech and freedom of religious conscience. As freedom means living and acting in society in light of one’s own interests, tolerance becomes a political issue that depends from political perspectives and (...) priorities. This insight leads Spinoza to bringing together the control of political authority on religious affairs and a political regime of religious plurality and toleration. These ideas seem to be reminiscent of texts published in his immediate circle: the anonymus De jure ecclesiasticorum (1665); the political pamphlets Kort verhael (1662) and Vrye Politijke Stellingen (1665) of his teacher Van den Enden; the subversive dictionary Een Bloemhof (1668) and the systematic philosophical Een Ligt (1668) of Koerbagh. In these texts the question of religion and religious authority shifts to the question of the nature and origin of political authority. The authors all criticize the abuse of power in light of the idea that there is no freedom without equality and no equality without freedom. Together with Spinoza’s Tractatus politicus (1677), they thereby form an anomaly within the anomaly of the Calvinist Low Countries that regards specifically this radical democratic view. They are not so much talking about tolerance but about everyone’s active participation in political life which is necessary for the rescue of the republic. (shrink)
