In 2001, France became one of the few countries to require corporate social responsibility reporting through its Nouvelles Régulations Économiques #2001-420. However, initial compliance with the statute was low, a factor implying the law lacked normativity. In this exploratory study, we attempt to determine whether there is movement toward normativity by examining the change in CSR disclosure from 2004 in comparison to 2010 for a sample of 81 publicly traded French firms. We measure both the space and the quality of (...) CSR disclosures, including in the latter a measure based on informational quality attributes as discussed by the International Accounting Standards Board, the Financial Accounting Standards Board, and the Global Reporting Initiative. We find significant increases in the space allocated to CSR disclosure, as well as some evidence of increased quality; although the informational quality of the disclosures remains quite low and fewer firms are including negative performance information in their reports. Finally, we document that differences in disclosure space and quality in 2004 appeared to be associated with legitimacy-based variables and that those relations remain largely unchanged in 2010. As such, it appears that the NRE’s goals of increased transparency remain unmet. (shrink)

In this paper, I describe a collaborative project involving two feminist trained scientists1 in consultation with a bioethicist, a policy analyst, and a research scientist funded by the National Academies Keck Futures Initiative for the design and implementation of a training program for ethics in synthetic biology. In spring 2011, the project culminated in our coteaching an experimental graduate seminar on ethics and synthetic biology.Synthetic biology most commonly refers to an interdisciplinary field that aims to merge engineering and biology (...) methods to create new technologies. Ariel Goldberg is a photographer and poet who crisscrosses New York City working as an adjunct on different college campuses. The more they tell me about JEB in the weeks leading up to this meeting, the more I sense something genealogical afoot. Each representing the white, Jewish, middle -class,antiracist-lesbian-grassroots activism of their respective eras, both JEB and Ariel are self-taught, collaborative, and accountable to their circles of activist/artist friends. Understanding Eating Disorders is an original contribution to the field of healthcare ethics. It develops a new theory concerning the moral basis of eating disorders, and places such disorders for the first time at the centre of philosophical discourse. The book explores the relationship that people have with food and their own body by looking at genetics and neuro-physiology, sociology and family studies, clinical psychology and psychiatry, and frames abnormal eating at the extreme of a spectrum of normal behaviours, directed (...) by moral values. Giordano argues that abnormal eating is not a psycho-pathological phenomenon, but the coherent implementation of ordinary moral values with a long tradition in Western culture. The book also contains a detailed analysis of UK legislation, accompanied by a timely critique of the law on treatment of mental disorders in general and of eating disorders in particular. (shrink)

A large part of the debate around the right to refuse life-prolonging treatment of anorexia nervosa sufferers centers on the issue of competence. Whether or not the anorexic should be allowed to refuse life-saving treatment does not depend solely or primarily on competence. It also depends on whether the anorexic’s suffering is bearable or tractable, and on the degree of involvement of the family in the therapeutic process. Anorexics could be competent to refuse lifesaving treatment (Giordano 2008). However, the (...) anorexic’s refusal of life-saving treatment should not be respected purely because it is a competent decision. Le langage de l'enfant, le langage de l'écolier, de l'enfant du peuple, fait l'objet d'observations à la fois patientes et passionnées à la fin du XIXe siècle et toutes ces observations sont résumées dans l'expression qui devient courante alors de « vie du langage ». Quelque chose là ne se laisse pas dire, sinon par métaphore. Qu'entend-on par « vie du langage »? La référence au puissant paradigme de la vie est fort à la mode car l'évolutionnisme spencérien, puis darwinien, (...) a pris le pouvoir sur toutes les sciences dans la deuxième moitié du siècle. Pour autant, la vie en question n'est qu'une métaphore : il ne s'agit pas, en France du moins, d'appliquer littéralement au langage les caractéristiques des êtres vivants. Ce mode d'expression signale l'émergence d'une vision nouvelle des rapports entre langue et pensée, qui bouleverse les cadres classiques de la question. Il se découvre, dans le babillage de l'enfant, comme dans le langage automatique des fous, ou bien encore dans la misère linguistique du peuple, une insubordination de la langue à la pensée. Les gens ne pensent pas ce qu'ils disent, ils parlent sans penser ou pensent sans parler. En réalité, et en dépit de toutes les illusions qu'ils entretiennent à ce sujet, leur langue est assez rarement ajustée à leurs idées, elle les devance ou les ignore, elle « vit » à sa façon. Comment dès lors arriver à une langue « juste »? Comment éduquer le peuple, l'enfant du peuple, de manière à ce qu'il puisse maîtriser sa pensée? The principles that usually direct ethical decision making are not easily or straightforwardly applicable to the care and treatment of anorexia nervosa, particularly the care and treatment of severe and enduring anorexia nervosa, where the sufferer seems to be recalcitrant to treatment and where the condition has become life-threatening.There are exceptional circumstances that characterize this puzzling and still scarcely understood condition; I suggest that these exceptional circumstances provide moral reasons for partial derogation from the usual principles of ethical decision making.In (...) what follows I argue... The conservation laws do not establish the central premise within the argument from causal overdetermination – the causal completeness of the physical domain. Contrary to David Papineau, this is true even if there is no non-physical energy. The combination of the conservation laws with the claim that there is no non-physical energy would establish the causal completeness principle only if, at the very least, two further causal claims were accepted. First, the claim that the only way that something non-physical could (...) affect a physical system is by affecting the amount of energy or momentum within it, or redistributing the energy and momentum within it. Second, the claim that redistribution of energy and momentum cannot be brought about without supplying energy or momentum. Both of these claims, however, are exceedingly difficult to defend in the context of the argument. (shrink)

This article considers the claim that gender diverse minors and their families should not be able to consent to hormonal treatment for gender dysphoria. The claim refers particularly to hormonal treatment with so-called ‘blockers’, analogues that suspend temporarily pubertal development. We discuss particularly four reasons why consent may be deemed invalid in these cases: the decision is too complex; the decision-makers are too emotionally involved; the decision-makers are on a ‘conveyor belt’; the possibility of detransitioning. We examine each of these (...) reasons and we show that none of these stand up to scrutiny, and that some are based on a misunderstanding of the nature and purposes of this stage of treatment and of the circumstances in which it is usually prescribed. Moreover, accepting these claims at face value could have serious negative implications, not just for gender diverse youth, but for many other minors and families and in a much broader range of healthcare settings. Leo Strauss’ reading of al-Farabi is a meditation on the issue of how philosophers speak beyond their time and place. They must speak in such a way that they can be understood by the enlightened but avoid persecution by the vulgar masses. According to Strauss, al-Farabi recognized that the philosopher can be happy in the imperfect city democratic city because of its freedom of thought, while the masses can be truly happy only in the virtuous city. This leads him to (...) consider the possible role for the philosopher to advise the "enlightened prince" and to participate in the manipulation of the beliefs of the masses toward some enlightened goal – what we are now witnessing in our think-tank politics. But if we consider a truer reading of al-Farabi’s philosophy, it in many ways recognizes the importance of imperfections, ambivalences, and frontiers. Our intellectual and religious ideals are often beyond our reach – Plato’s “city in speech” – but yet these ideals can orient us and give us a sense of place even in our imperfect situations. For al-Farabi, the democratic city is the best of the imperfect cities, because its imperfections and freedoms allow for new possibilities. Today most of us live in this imperfect city, but this is precisely what allows us to maintain our connections with the past, and project many possibilities for the future. Anorexia nervosa is currently classed as a mental disorder. It is considered as a puzzling condition, scarcely understood and recalcitrant to treatment. This paper reviews the main hypotheses relating to the aetiology of anorexia nervosa. In particular, it focuses on family and sociological studies of anorexia. By reflecting on the hypotheses provided within these domains, and on the questions that these studies leave unanswered, this paper suggests that anorexic behaviour is understandable and rational, if seen in light of ordinary moral (...) values. In this paper I wish to examine our imagination of the unity of the earth and the process of globalization by contrasting it with the early origins of mapping and measuring the globe. I will pay particular attention to the work of Abū Rayḥān Al-Bīrūnī. I will demonstrate that the assumptions which allowed for Al-Bīrūnī’s advances in the measurement of the globe were based upon a certain understanding of the relationship of place within the sacred order of the cosmos and (...) the role of reason in this connection. This carries over to his anthropological works which considers the history of other religions and cultures. It shows an approach where objectivity in scientific investigation can stand alongside a diversity of religious faiths or visions. I wish to use these insights to consider the positions of such Western writers on the philosophy of globe-formation, such as Carl Schmitt and especially Peter Sloterdijk. Sloterdijk understands the development of our imagination of the globe as a singular history which was achieved primarily through conquest. Comparing these thinkers is important because our understanding of geopolitics and globalization often involves imposing one definition of humanity, reality or the sacred, which marginalizes or vilifies those with differing views. I hope to demonstrate by these contrasts that a unified imagination of the earth through globalization poses extreme dangers, and that the fragmentation of the globe through many religious and secular and artistic projections is the only possibility for a future. That is: the possibility of a future is dependent upon many opposing images of a future. It is only by a return to the initial impulses which led such scientists as Al-Bīrūnī that a true relationship of the human to the earth can be preserved. (shrink)

Transgender children who are not treated for their condition are at high risk of violence and suicide. As a matter of survival, many are willing to take whatever help is available, even if this is offered by illegal sources, and this often traps them into the juvenile criminal system and exposes them to various threats. Endocrinology offers a revolutionary instrument to help children /adolescents with gender identity disorder: suspension of puberty. Suspension of puberty raises many ethical issues, and experts dissent (...) as to when treatment should be commenced and how children should be followed up. This paper argues that suspension of puberty is not only not unethical: if it is likely to improve the child’s quality of life and even save his or her life, then it is indeed unethical to defer treatment. In light of the recent events of terrorism and publicized cases of mass slayings and serial killings, there have been calls from the public and policy-makers alike for neuroscience and neurotechnology (neuroS/T) to be employed to intervene in ways that define and assess, if not prevent, such wanton acts of aggression and violence. Ongoing advancements in assessment neuroS/T have enabled heretofore unparalleled capabilities to evaluate the structure and function of the brain, yet each and all are constrained by certain technical (...) and practical limitations. In this paper, we present an overview of the capabilities and constraints of current assessment neuroS/T, address neuro-ethical and legal issues fostered by the use and potential misuse of these approaches, and discuss how neuroethics may inform science and the law to guide right and sound applications of neuroS/T to “deliver us from evil” while not being led into temptations of ampliative claims and inapt use. Believing rationally is epistemically valuable, or so we tend to think. It’s something we strive for in our own beliefs, and we criticize others for falling short of it. We theorize about rationality, in part, because we want to be rational. But why? I argue that how we answer this question depends on how permissive our theory of rationality is. Impermissive and extremely permissive views can give good answers; moderately permissive views cannot.

The growing power of communication and information technologies and their reliance on systems, poses great challenges to cultural and religious diversity, and even education. Will these technological systems continue to homogenize cultures and religions? Will this process lead to increasing strife? Or is there a possibility of maintaining both identity and diversity in a peaceful manner? This paper explores an early attempt to consider this problem. It will focus on the Ikhwān al-Ṣafā and their attempt to construct an encyclopedic system (...) to coordinate knowledge during the flowering of Islamic Civilization in the tenth century. It will primarily deal with Epistle or Rasā'il twenty-two – a fable concerning a debate between the humans, the animals and the Jinn. It will discuss their debate and show how the major concern for the Ikhwān al-Ṣafā was not only to embrace the diversity of knowledge but also the need to navigate through this diversity. I would like to suggest through this analysis that a culture gains its richness and identity by recognizing perfections outside of their own identity. This is analogous to the way that the individual human being gains meaning and dignity by reaching beyond its individuality. It also shows the importance of cultural and religious diversity and how the world cannot be unified by a single all-encompassing system. This approach is important because it shows the possibility of maintaining cultural and religious identity while participating in a technological world involving the flow of information on one hand, and global cultural diversities on the other. Giordano Bruno’s Cabala del cavallo pegaseo _ _grew out of the great Italian philosopher’s experiences lecturing and debating at Oxford in early 1584. Having received a cold reception there because of his viewpoints, Bruno went on in the Cabala to attack the narrow-mindedness of the university--and by extension, all universities that resisted his advocacy of intellectual freethinking. _The Cabala of Pegasus _consists_ _of vernacular dialogues that turn on the identification of the noble Pegasus and the humble ass. In the (...) interplay of these ideas, Bruno explores the nature of poetry, divine authority, secular learning, and Pythagorean metempsychosis, which had great influence on James Joyce and many other writers and artists from the Renaissance to the modern period. This book, the first English translation of _The Cabala of Pegasus, _contains both the English and Italian versions as well as helpful annotations. It will have particular appeal to all Renaissance scholars and those interested in the Renaissance cabalistic underpinnings of modern literature. (shrink)

Many views rely on the idea that it can never be rational to have high confidence in something like, “P, but my evidence doesn’t support P.” Call this idea the “Non-Akrasia Constraint”. Just as an akratic agent acts in a way she believes she ought not act, an epistemically akratic agent believes something that she believes is unsupported by her evidence. The Non-Akrasia Constraint says that ideally rational agents will never be epistemically akratic. In a number of recent papers, the (...) Non-Akrasia Constraint has been called into question. Simona Giordano investigates the moral concerns raised by current clinical options available for transgender and gender diverse children and adolescents. From the time young children express gender incongruent preferences and attitudes, up to the time in which older adolescents might apply for medical or surgical treatment, moral questions are likely to be asked: should children be enabled to express themselves freely inside and outside the domestic environment? What are the implications of the choices that parents might make early on? (...) How should clinicians respond to distress around sexual anatomy? Is it ethical to suspend pubertal development? What level of evidence should we seek for medications to be used in paediatric care? What are the risks and benefits of various forms of hormonal treatment? Is it ethical to defer surgical interventions till adulthood? Giordano provides a detailed ethical analysis of these and many other questions that are likely to arise at various stages of a person's life and proposes a moral formula to answer these questions, as well as others, that are likely to arise in a fast-changing landscape. Sophie Grace Chappell develops a picture of what philosophical ethics can be like, once set aside from the idealising and reductive pressures of conventional moral theory. Her question is 'How are we to know what to do?', and the answer she defends is 'By developing our moral imaginations'.

Neuroscience, together with a broadened concept of “mind” has instigated pragmatic and ethical concerns about the experience and treatment of pain. If pain medicine is to be authentic, it requires knowledge of the brain-mind, pain, and the relative and appropriate “goodness” of potential interventions that can and/or should be provided. This speaks to the need for an ethics that reflects and is relevant to the contemporary neuroscience of pain, acknowledgment and appreciation of the sentient being in pain, effects of environment (...) and value(s), and the nature of healing. It may be that neuroethics provides this viable meta-ethic for pain care. This essay describes how an integrative neuroethics of pain care allows, if not obligates, alignment of facts, values, and moral attitudes as a continuing process of re-investigation, analysis, and revision of what we know (and don’t know) about brains, minds, selves, and how we regard and treat the painient. This article describes Cosa Nostra bosses’ psychological characteristics starting from research data collected over almost twenty years. Through the use of fragments of interviews to justice collaborators and their wives, children, and sisters-in-law, we analyze the boss’ role and relational context. This article also reports the results of a recent research on the relationship between boss and white-collar workers, carried out through the analysis of environmental tapping recorded at a famous Sicilian Mafia boss’ house: Giuseppe Guttadauro. This research highlights the (...) psychological diversity the relationship between boss and white-collar worker is based on. The analysis of environmental tapping transcriptions has also allowed discovery of the main relational modalities used by the boss and white-collar worker in their conversations. (shrink)

Both clinical literature and biographical accounts suggest that many transgender individuals experience shame or have experienced shame at some point in their life for reasons related to their gender identity. In clinical psychology, at least until the 1960s, shame has not received much attention; focus was on guilt and shame was regarded mainly as a ‘by-product’ of guilt. From the 1960s shame has been identified as an emotion not necessarily related to guilt and with unique features, and has been studied (...) in connection with a number of situations, such as domestic abuse, trauma, illness, and sexual orientation. However shame has been studied less in connection with gender variance. Shame has however intrigued philosophers, writers and artists for a very long time. Yet, the importance of the contribution of various disciplines to the understanding of the experience of shame in vulnerable individuals has been overlooked. This paper attempts to explore the meaning of shame for transgender individuals, by making reference not only to clinical studies, but also to artworks and literary novels. Franz Kafka, named “the poet of shame” is particularly salient to the analysis of shame, and some of his works will enable us to shed light on the complexities of the experience of shame in transgender individuals which may defy clinical observation. The importance of humanities in the medical curriculum is increasingly recognized. For example, in the United Kingdom, The General Medical Council, which is an independent body established under the Medical Act 1858 and responsible, among other things, for fostering good medical practice and promoting high standards of medical education, in its publication Tomorrow’s Doctors, encouraged inclusion of humanities in the medical curriculum. Literature, arts, poetry, and philosophy are thought to foster the doctors’ ability to “communicate with patients, to penetrate more (...) deeply into the patient’s wider narrative, and to seek more diverse ways of promoting well being and reducing the impact of illness or disability.”.
