The Fourth Industrial Revolution based on digitalization, the development of AI, robotics, big data, and increasing automation is dredging up older debates on the end of human work. This article contributes to this debate arguing that these changing circumstances represent an opportunity to advance a renewed consideration of human work. By emphasizing its most distinctively human dimensions, including gratuitousness, relationality, and meaningfulness, we propose the articulation of a social model that recognizes relational goods as a specific contribution of human work (...) in an attempt to overcome the state and the market's monopoly of public life built around the dichotomy between the private and the public. Such a social model is based on the concept of circular subsidiarity, which represents a departure from traditional notions of subsidiarity by promoting a dynamic and reciprocal interplay between three essential societal spheres: the state, the market, and organized civil society, all of which have their role to fulfill by providing security, efficiency, and relational goods. Ultimately, this article suggests that circular subsidiarity can lead to a more inclusive and equitable social model by acknowledging how relational goods not only humanize civil society but also sustain the functioning of both the market and the state. This article describes and proposes the “environmental subsidiarity principle” as a guiding ethical value in forestry governance. Different trends in environmental management such as local participation, decentralization or global governance have emerged in the last two decades at the global, national and local level. This article suggests that the conscious or unconscious application of subsidiarity has been the ruling principle that has allocated the level at which tasks have been assigned to different agents. Based on this hypothesis this (...) paper describes the principle of subsidiarity and its application to environmental policies within forest governance and proposes the “environmental subsidiarity” principle as a critical conceptual tool for sustainable resource management. The paper explains as an example how “environmental subsidiarity” is the key principle that can link payment for ecosystem services (PES) with environmental public policies and applies this principle with all its political consequences to reducing emissions from deforestation and forest degradation, and enhancing forest carbon stocks in developing countries (REDD+) architecture. It concludes by showing how the adoption of “environmental subsidiarity” as a ethical principle could help to maximize benefits to all stakeholders involved in PES schemes such as REDD+. (shrink)

Is there a ‘constitutional moment’in contemporary Europe? What if anything is the constitution of the European Union; what kind of polity is the Union? The suggestion offered is that there is a legally constituted order, and that a suitable term to apply to it is a ‘commonwealth’, comprising a commonwealth of ‘post-sovereign’ states. Is it a democratic commonwealth, and can it be? Is there sufficiently a demos or ‘people’ for democracy to be possible? If not democratic, what is it? Monarchy, (...) oligarchy, or democracy, or a ‘mixed constitution’? Argued: there is a mixed constitution containing a reasonable element of democratic rule. The value of democracy is then explored in terms of individualistic versus holistic evaluation and instrumental versus intrinsic value. Subsidiarity can be considered in a similar light, suggestively in terms of forms of democracy appropriate to different levels of self-government. The conclusion is that there is no absolute democratic deficit in the European commonwealth. (shrink)

The paper starts with a case study of a medium-sized company in which a strong and successful change in the organisational form and job design took place. A bureaucratic organisation with highly-specialised jobs was converted into a new organisation in which employees became much more autonomous in managing their own work. This not only entailed new techniques and managerial systems but also a new anthropological vision. Bureaucratic rules were reduced, but not eliminated completely, and management became less authoritarian. Employees could (...) therefore apply greater entrepreneurial spirit, developing their talents in pursuit of the company’s common goals. It is argued that this new organisational form is ethically superior to the old, and reflects the basic requirements of the principle of subsidiarity. The ethical principle of subsidiarity holds that a larger and higher-ranking body should not exercise functions which could be efficiently carried out by a smaller and lesser body; rather the former should support the latter by aiding it in the coordination of its activities with those of the greater community. While the principle has usually been applied in a political context, this paper explores the principle as a moral base for organisational forms within business organisations. Finally, the principle of subsidiarity is analysed in the context of business organisations and proposed as an ethical guideline for organisational forms. This would help to mitigate the effects of those bureaucracies in which individuals, with their dignity, freedom, diversity and capacity for undertaking business activities with entrepreneurial spirit, are often not fully appreciated. Every country must allocate final decision-making authority over different issues/subjects within its boundaries. Historically, many scholars working on this topic implicitly assumed that identifying the features providing entities with justified claims for authority and the entities possessing those features would also identify which groups should have which powers (or vice versa). However, many candidate allocative principles select multiple entities as candidates for some sub-state authority and yet fail to explain which powers each should possess. Further work must explain which groups (...) should possess which powers when and what to do when two groups can make equally-valid authority claims using the same principle. Subsidiarity, the principle under which authority should presumptively belong to the entity representing those ‘most affected’ by its exercise and capable of addressing underlying problems, is one of the few principles focused on identifying which groups should have which powers. Unfortunately, subsidiarity alone does not provide guidance on many issues/subjects. Useful subsidiarity-related guidance relies on balancing underlying justificatory interests, which do the real allocative work. Another allocative principle remains necessary. A deflationary account of subsidiarity’s allocative potential nonetheless provides insights into how to articulate a new principle and accounts of subsidiarity that can fulfill other moral roles. Subsidiarity, i.e., “the principle of subsidiarity,” i.e., “the principle of subsidiary function/responsibility,” i.e., the principle that it is unjust for a higher authority to usurp the self-governing authority that lower authorities, acting in the service of their own members, rightly have over those members, is a presumptive and defeasible, not an absolute, principle. But it excludes any general policy or aim of assuming the control or managerial direction of lower groups. Its deepest rationale is the intrinsic desirability of (...) self-direction, a good that is to be favored and respected even at the expense of some efficiency in the pursuit of other goods. Though arising out of Aristotelean moral and political theory, it denies or strongly disambiguates a cardinal principle of Aristotelean political theory. An important question for liberal political theory is whether its account of political morality is compatible with religious political thought. This paper examines one aspect of that broad question, namely the compatibility of the Christian pluralist tradition with liberalism's account of state sovereignty. According to Cécile Laborde, a central commitment of liberalism—and perhaps its most radical—is the claim that the state possesses a form of sovereignty that she dubs ‘competence-competence’. This refers to the state's meta-jurisdictional authority to decide the areas (...) of competence of associations within it. The Christian pluralist tradition, in contrast, emphasises the independent authority of various kinds of social groups and the external limits this places on the state. The paper argues that, despite appearances to the contrary and the claims of many pluralist thinkers, these two views are compatible. It does so through a detailed examination of the two main strands of Christian pluralism, namely subsidiarity and sphere sovereignty, and by comparing pluralists’ and liberals’ approaches to the regulation of religious groups. This article closely examines the way in which Thomas Aquinas understood the relationship between the various forms of human community. The article focuses on Aquinas's theory of law and politics and, in particular, on his use of political categories, such as city, province and empire, together with the associated concepts of kingdom and nation, as well as various social groupings, such as household, clan and village, alongside of the distinctly ecclesiastical categories of parish, diocese and universal church. The analysis of (...) these categories is used in the article to help explain Aquinas's role in the development of theories about subsidiarity, federalism and mixed constitutionalism. In the first place, it is argued that a close inquiry into Aquinas's discussion of the many and various forms of human community sheds light on the origins and development of the idea of subsidiarity within Catholic social teaching. Second, while Aquinas certainly did not advance a theory of federalism as that idea is presently understood, it is argued that recovering what Aquinas had to say about the categories of human community helps us to understand the origin and later development of federal ideas. Finally, it is argued that far from endorsing a system of absolute monarchy as is sometimes alleged, when understood in this way, Aquinas supported a particular kind of mixed constitution in which monarchy is tempered by a variety of constitutional constraints founded upon a conception of the body politic as itself constructed out of a plurality of smaller, intermediate corporations and communities of a political, ecclesiastical and social character. Subsidiarity is a key term in the development of the European Union. The word itself was unknown in the English language until recently when it was first used and immediately became a key concept in the European political discussion. Since then, everyone is using it according to their own interpretation and purpose. From the extreme left to the extreme right, from the Euro-sceptics to the Euro-enthusiasts, the term is used to justify contradictory points of view.Is it because its meaning (...) is so vague that anyone can use it at will? Is it because this concept, which seems at first hand to be so clear, does not mean anything and is useless in rethinking the renewal of social organization? The European purpose in introducing the subsidiarity principle was to give a place to intermediary communities, but the whole ambiguity of the concept is related to the comprehension of what is called a community. This in its turn is related to the view one has of what a human being is, and of the importance of his relationship with others for the constitution of his identity.If a community is part of the human identity, this has a deep influence on the understanding of what a community is, and the consequences of the principle of subsidiarity point towards much more than a mere principle of political federalism. Subsidiarity is often implicitly conceived as an organizational model or a Weberian ideal type. The purpose of this paper is to show that, in contrast, subsidiarity is a principle in the sense of the tradition originating from Thomas Aquinas. Considered as an ideal type, subsidiarity may be perceived as impossible to apply because of its ideal status, abstracted from the circumstances. Here, we will demonstrate the consequences of the fact that subsidiarity is one of the common (...) principles of practical moral reasoning of particular prudence. Because it is a principle, subsidiarity does not have a visualizable substance or prescribe an organizational model, unlike the ideal type. It thus avoids the indiscriminate application of organizational models to contexts that are not appropriate, and in the context of tension between external consultants and managers, it rehabilitates the prudence of leaders who know the circumstances of their organization. It has always been the fate of centrally important concepts in public debate to be used promiscuously. ‘Democracy’, for instance, has long been assigned multiple contested meanings; its meaning is univocal only in the minds of passionate advocates of a single political project seeking to monopolize usage of the term, whether Liberals or Leninists. Theorists tend to worry about this conceptual promiscuity more than practitioners, who, firing off loaded concepts in the heat of political battle, are impatient of reminders that, (...) perhaps, this or that concept is not being consistently used as originally intended. “No matter,” says the busy practitioner, “it is doing the job I currently intend.” This reply is often justified: scholarly intrusions into public debate are sometimes appropriately dubbed ‘academic’ . However, when rhetorical skirmishes cease and a concept gets to be embedded in public policy or legislation, clarity is indispensable.This, of course, summarizes the recent career of the concept of ‘subsidiarity’, which has been nominated as possibly ‘the most contentious abstract noun to have entered European politics since 1789’ . Advocates of both centralization and decentralization currently invoke it with the same firmness of conviction. Its inclusion in the Maastricht Treaty, far from having generated clear guidelines on how to determine the proper balance between European and national competences, has only served to highlight the competing interpretations which it can, apparently, bear. ‘Subsidiarity’ is suffering from a ‘clarity deficit’ which needs remedying. My aim in what follows is to contribute to that process of clarification and to suggest ways in which the concept might be critically developed.First, I attempt to retrieve the original meaning of subsidiarity and exhibit its intrinsic relationships to related concepts of community and the common good. I seek to show that subsidiarity is only one aspect of a broader theory, rooted in Catholic social thought, of the proper relationship between persons and communities. Subsidiarity takes its meaning from an elaborate social theory which is personalist, pluralist and communitarian. Charges of vacuity against subsidiarity are only to be expected when the concept is treated in isolation from this background theory. Second, I identify and attempt to remedy certain deficiencies of the concept by critically elaborating what I take to be its central intent. In a brief conclusion, I indicate the need to bring the concept into dialogue with alternative models of the person-community relationship. (shrink)

The philosophical origins of the principle of subsidiarity must be understood historically. This chapter argues that the critical point for the emergence of the principle lay in Thomas Aquinas’s theological interpretation of Aristotle’s political philosophy and his application of it to the institutional pluralism of medieval Europe. From Aristotle, Aquinas developed the idea that human societies naturally progress from families, through villages to entire city-states, but he recognised that what Aristotle said of city-states could be applied not only to (...) cities but even more emphatically to political communities on the scale of provinces, kingdoms and empires. Moreover, for Aquinas, the civil order was not the only ‘perfect community’ in Aristotle’s sense: there was also the church in all of its many grades and jurisdictions, alongside the many different religious orders and fraternities of medieval Europe, some of them also organised into their own graded hierarchies. Reflecting on the complexity of the society surrounding him, Aquinas acknowledged the many and various purposes for which various associations and forms of human community exist and are formed, giving rise to a whole host of familial, geographical, professional, mercantile, scholarly and other specialised societies. All of these groups and groupings, from the smallest to the largest, have their place and their proper function, according to Aquinas, and each should to be allowed to make its unique and special contribution as a means to integral human fulfillment, without undue interference from any others, including the state. All stakeholders agree publicly that innovation and governance of emerging technologies should be done responsibly. However, the international debate on who should do what to contribute to this lofty goal is nowhere near a solution. The starting point of this paper is the issue of how and for which reason to engage stakeholders in addition to governments in the international governance of nanotechnology. This article examines the mainly North-American communitarian criticism of political liberalism and the related concept of subsidiarity (...) in order to shed new light on this discussion. The central research question is: Can a communitarian-subsidiarity perspective on the roles of governments, companies and civil society actors that hold a stake in emerging technologies clarify the grounds on which each actor should be expected to contribute to responsible research and innovation at the international level? After selecting some relevant aspects of a communitarian-subsidiarity model for a dialogue society, an analytical framework is proposed. This framework is then applied to the recent international dialogue on responsible governance of nanotechnology. The outcomes of the analysis are compared to the OECD planning guide on public engagement and outreach in nanotechnology, and indicators for monitoring progress in responsible global innovation are suggested. The main contribution of the selected communitarian-subsidiarity perspective is that it offers philosophical grounds for a return of citizens to the driving seat in cooperative international responsible innovation. The right to ‘domestic remedies’, which ideally connects ‘subsidiarity’ and ‘embeddedness’ of the ECHR in the legal systems of member States, is deemed to play a crucial role for the Strasbourg machinery survival as well as for an effective protection of human rights, especially in the field of the ‘reasonable-time’ requirement. In this respect the Italian case seems an excellent test. Once a compensatory remedy was introduced in the Italian legal system by Law No. 80 of 2001 (the ‘Pinto (...) Act’), it soon appeared that such a remedy could be considered ‘effective’ in so far as it was implemented in accordance with the ECtHR’s jurisprudence. Therefore a legal tool for the interaction between ECtHR and Italian courts had to be found. Nevertheless, the results of this interaction might suggest that the domestic remedy has neither increased the protection of the reasonable-time requirement in Italy nor is it the final solution to the ECtHR’s overload. The principle of subsidiarity can be an effective tool for adjusting economic systems and establishing the social rule-of-law concept in public organisation. In considering the usability of the principle of subsidiarity, the following aspects thereof are discussed: the role in the development of the European social model; employment in determining limits for the powers of the public and private sectors; the application in the market and planned economy systems; and the social justice function in the development of a (...) social welfare state. The principle of subsidiarity as an instrument for individuals’ interests, balancing and adjusting in the regulation of economic systems, helps to establish the relative sizes of public policy and the market, as subsidiarity can help ensure a more equitable distribution of public goods while guaranteeing the maintenance of the creative potency of operators and minimal satisfaction of vital needs of individuals unable to contribute to the production of goods. It amounts to a constitutional measure determining the balance of productive and protective state, thus ensuring the stability of the state organisation. In the concept of a social rule-of-law state, subsidiarity draws clear limits to the state’s powers, institutionally bringing together efforts of all members of the community to achieve welfare in the state. Prysukhin “The Principle of Subsidiarity: Lessons from the Social Teaching of the Catholic Church” analyzes the achievements of the Social Teaching of the Catholic Church, represented by the works of Leo XIII, Pius XI, Pius XII, John Paul II, revealing the meaningful characteristics of the concept of “the principle of subsidiarity”, its role and meaning in the system of Christian values. The principle of subsidiarity makes possible such relationships in social life, when the (...) community of higher order does not interfere in the internal life of the community of the lower order, taking over the proper functions of that function; for the common good it gives it when necessary support and assistance, thereby coordinating its interaction with other social structures. The principle of subsidiarity guides social practice to the promotion of the common good in the human community. The spread and application of the principle of subsidiarity opposes the danger of "nationalization" of society and the most terrible manifestations of collectivism, restricts the absoluteization of power, bureaucratization of state and socio-cultural structures, becoming one of the guarantors of respect for the rights and freedoms of citizens of their country. Jane Jacobs’s classic 1961 book, The Death and Life of Great American Cities, famously indicted a vision of urban development based on large scale projects, low population densities, and automobile-centered transportation infrastructure by showing that small plans, mixed uses, architectural preservation, and district autonomy contributed better to urban vitality and thus the appeal of cities. Implicit in her thinking is something that could be called “the urban good,” and recognizable within her vision of the good is the principle of (...) class='Hi'>subsidiarity—the idea that governance is best when it is closest to the people it serves and the needs it addresses—a principle found in Catholic papal encyclicals and related documents. Jacobs’s work illustrates and illuminates the principle of subsidiarity, not merely through her writings on cities, but also through her activism in New York City, which was influential in altering the direction of that city’s subsequent planning and development. A common criticism of the Green New Deal proposal to address climate change is that it would centralize too much power at the level of the federal government. However, the Green New Deal can avoid this by centering local action and decision-making in keeping with the principle of subsidiarity from Catholic social ethics. This principle holds that higher levels of society should not override the initiative of lower levels of society but should instead coordinate and support their work whenever (...) possible. How should a political society be structured so as to legitimately distribute political power? One principle advanced to answer this question is the principle of subsidiarity. According to this principle, the default locus of political power is with the lowest competent political unit. This article argues that subsidiarity is a structural principle of a conception of political legitimacy informed by epistemic considerations. Broadly, the argument is that political societies organised according to the principle of subsidiarity can more (...) effectively achieve political decisions that can justifiably appear to be correct from the point of view of those subject to them. The article presents two considerations in order to establish a pro tanto case for acting separately before presenting five additional epistemic considerations that establish a prima facie case for acting separately. The article then shows that political legitimacy and the epistemic aim of decision-making can sometimes be served more effectively and efficiently by allowing higher-level political units to assist lower-level political units. In this work, we present some traits of the socio-political and economic thought of Giuseppe Toniolo, who lived in Italy at the turn of the XIX and XX century, with special reference to the contribution that the Italian economist and sociologist gave to the definition and implementation of the principle of subsidiarity and to the ethical foundation of economic science. After outlining the definition of the subsidiarity principle in the first paragraph, we sketch the historical background in which (...) Toniolo lived and operated. We then focus on the ethical factor and on the concept of subsidiary State emerging from Toniolo’s writings. As with any proposal for institutional reform, and especially one that has gained so much ground in such a short amount of time, this paper asks whether diversity, equity, and inclusion (DEI) movement is good for corporations. Are businesses stronger with DEI practices and ideas or weaker? We believe that the DEI movement is asking the right questions: How do we create more just and equitable institutions? The challenge, however, is whether this movement is giving the right answers to such (...) questions. The main premise of our paper is that without deeper principles than DEI itself, these qualities of corporate life will be misunderstood, misused, and disordered in our increasingly fragmented and politicized culture. We propose in this essay that “subsidiarity” serves as one of those deeper principles that can order and enrich our understanding of DEI. It serves as a gift principle that begins to reveal the deepest nature of our work, namely, that our work allows us to exercise our gifts in serving others. (shrink)

He goes unmentioned in the major social encyclicals of Leo and Pius, despite the fact that Leo himself was Taparelli's student. Because of his rhetorically and philosophically potent critique of Enlightenment thought and its effect on mid-nineteenth-century Europe, available to a popular audience through his frequent contributions to the Jesuit periodical La Civiltà Cattolica, Taparelli's name carried baggage for a Church that sought to move beyond the posture of reaction to liberal political orders.However, as Behr shows in the introduction, Taparelli hardly rejected the methods and insights of modern political thought tout court. Behr describes Taparelli's system as a "realist social science." This terminology speaks to the promise which Taparelli found in the sociological analysis of Montesquieu in particular. Though Taparelli judged that Montesquieu held a questionable preference for a republican political form, he greatly admired Montesquieu's ability to, as Behr puts it, "bring political theory into relationship with social theory and historical contingency" (8). Though Taparelli was not familiar with the work of Alexis De Tocqueville, Behr also notes the resonances between Taparelli's work and Tocqueville's political sociology and defense of "intermediary institutions." Yet Taparelli makes up for what the sociological approaches of Montesquieu and Tocqueville lack in the way of natural, teleological principles of politics. Behr alerts the reader from the very beginning of his work that, in approaching Taparelli, he will not find a simple recapitulation of Thomas, but rather a creative approach to political thought which aims to set what is worthy in the modern empirical methodologies on firmer foundations through the recovery of Thomistic-Aristotelian principles.In chapter 1, "Taparelli and the Age of Ideology," Behr situates Taparelli within the political conflicts of the early nineteenth century. Behr sets the scene for Taparelli's renovated Scholasticism by explaining the opposition between Catholic traditionalism (represented especially by Joseph De Maistre and Donoso Cortés) and Catholic liberalism (represented especially by Henri Dominique Lacordaire and his more radical associate Felicité de Lammenais). Drawing on the principle of subsidiarity, this article develops a framework for allocating medical decision-making authority in the absence of capacity to consent and argues that decisional authority in paediatric transgender healthcare should generally lie in the patient. Regardless of patients’ capacity, there is usually nobody better positioned to make medical decisions that go to the heart of a patient’s identity than the patients themselves. Under the principle of subsidiarity, decisional authority should only be held by a higher (...) level decision-maker, such as parents or judges, if lower level decision-makers are incapable of satisfactorily addressing the issue even with support and the higher level decision-maker is better positioned to satisfactorily address the issue than all lower level decision-makers. Because gender uniquely pertains to personal identity and self-realisation, parents and judges are rarely better positioned to make complex medical decisions. Instead of taking away trans youth’s authority over their healthcare decisions, we should focus on supporting their ability to take the best possible decision for themselves. (shrink)
