O. Matthiessen. Career-wise, however, Howe’s path to academia (...) has be en indirect: born in 1937, she gained her first professorship in 1989 in the Poetics Program at SUNY Buffalo. A visual artist by [End Page 192] training, Howe veered into a genre of writing in the 1970s that seeks to “install certain narrativ es somewhere between history, mystic speech, and poetry” (p. 44). Her poetry includes Secret History of the Dividing Line (1978), Pythagorean Silence (1982), and Defenestration of Prague (1983). In 1985 she published an original criti cal study, My Emily Dickinson, which criticized editors for having homogenized the format and typography of Dickinson’s manuscripts, taming the unruly rigor of poems which were originally “multifaceted visual and verbal productions.” Howe also argu ed that the Amherst poet should not be viewed as a victim of repression, as many feminists see her, but as a refuser of congregations, a powerful will-to-reclusion in art—“One unchosen American women alone at home and choosing.” Emily’s home was a nomadi c space between orthodoxies.An understanding of Howe’s kinship with Dickinson’s poetic daring is helpful for reading The Birth-Mark, whose prose is poetic, and whose protagonist, Mary Rowlandson, shared Dickinson’s “stubborn strength in isolation.” The captivity narratives ar e portals into the antinomian controversy of New England, which was “the primordial struggle of North American literary expression” (p. 4). It is not Gilbert and Gubar to whom Howe has recourse in her analyses of hostage consciousness. She cites the philo sophy of Emmanuel Lévinas. As with feminism, which she extends rather than follows, Howe takes up the philosophy of alterity without its orthodoxy. (In the face of frontier brutality she cannot discern the “Father of orphans and defender of widows” of Psalm 68.) Encounters in the wilderness of tribes, woods, and waters aroused an immodest otherness within the American literary unconscious, unsettling the styles of expression and selfhood which the puritan colonies were trying to instantiate. The literary awakening of Dickinson, Rowlandson, Melville, Hawthorne, and other writers was not due to the Great Awakening urged by churches, but to the traumatic transfer of sovereignty from God to frontier, a permanent revolution to which these writers’ imaginations would remain exposed.Howe’s new foray into criticism tracks the textual marginalia which yield the visionary utterances of Rowlandson and Hutchinson. A self-confessed “library cormorant,” Howe gathers a quiet spectacle of testimonies, those of separated loved ones dragged int o “Removes” by tribes of Native Americans. These resonant texts from New England village libraries and major collections at Harvard, are melded together by Howe’s intuitive, almost telepathic sensibility into a kind of spiritual drama informed by critical acumen. Howe takes her bearings from Patricia Caldwell’s essay “The Antinomian Language Controversy,” which appeared in the Harvard Theological Review in 1976. The dislocating frontier experience for Hutchinson, Rowlandson, and others forced the c reation of a different language. It is with this antinomian language that Howe develops a sensitive rapport, echoing its myriad haunting voices in her commentaries. Indeed, Howe’s work is a creative example of the fusion of horizons which Gadamer says epitomizes the hermeneutic event. Philosophy has had its share: one thinks of Wittgenstein and C. S. Peirce, but many lesser Wittgensteins and Peirces somehow (...) adapted and became tenured. In regard to such figures “eccentric” meant outside the circle or off center; “radical” meant surprising, original, sincere. Today radical has a murky political sense. Most radicality takes place in a discourse, or as a discourse—in the title of a university press book—which when invoked aligns the writer with the orthodoxy of a speech community. No surprise; only a dull echo as membership is [End Page 516] confirmed and the circle remains unbroken. Contrary to almost everyone’s intentions, never has so much “identity politics” been melded with the writing act in a metaphysical proof. We write about pragmatism, therefore we are new pragmatists. We write eco-feminism, therefore we are radical eco-feminists.Yet the nonconformist self-image of many philosophers is belied less by the uniformity of their discourse than of their lives, constrained as they are by professional protocol. The vistas and catastrophes we access through this book cannot be easily disengaged from the personality that guides us to Tenochtitlan, Matagalpa, Kuta, Bali, the Sambodromo in Rio de Janeiro, Khlong Toei, and Chichicastenango. From these places and others Lingis reports the sometimes macabre longings and vulnerabilities of those who have nothing in common except violent changes in heritage and landscape. He speaks to their wounds and of his own ailments he acquires by exposing himself to forsaken circumstances: it is all material for his philosophy. In this work speech is primary, as it was for phenomenologists before Derrida.Merleau-Ponty’s writing remains unsurpassed as an eloquent transcript of perceptual life as expression and bodily engagement. Lingis, who translated The Visible and the Invisible, has from the start of his career been the most interesting and outlandish promulgator of this style of phenomenology. But his focus was decisively turned by Emmanuel Lévinas (whom Lingis has also translated) towards alterity relations, intimate events in which persons defer to and ennoble strangers by taking responsibility for them. Speech and physical contact are precious components of these relations, allowing persons to disburden themselves, to exchange pain and betrayal for tenderness and trust.Lingis shows how alterity relations suffer abuses at the face-to-face level and in the global network of electronic media. We enter his work breathlessly, as into a deep valley where there is gunfire and tropical birds. Spy satellites pass overhead. The human beings are strangely quiet. Women and children are being herded into canvas-covered trucks by youthful militia with oversized weapons. The volatile prose lifts up the voices of the damned just before they vanish around the bend in the jungle. Lingis speaks for them. This article reaches out to the audience for controversial religious writing after the English Reformation, by examining the shared language of attainable truth, of clarity and certainty, to be found in Protestant and Catholic examples of the same. It argues that we must consider those aspects of religious controversy that lie simultaneously above and beneath its doctrinal content: the logical forms in which it was framed, and the assumptions writers made about their audiences’ needs and responses. Building on the work (...) of Susan Schreiner and others on the notion of certainty through the early Reformation, the article asks how English polemicists exalted and opened up that notion for their readers’ benefit, through proclamations of visibility, accessibility and honest dealing. Two case studies are chosen, in order to make a comparison across confessional lines: first, Protestant reactions against the Jesuit doctrine of equivocation in the late sixteenth and early seventeenth centuries, which emphasized honesty and encouraged fear of hidden meaning; and second, Catholic opposition to the notion of an invisible-or relatively invisible-church. It is argued that the language deployed in opposition to these ideas displays a shared emphasis on the clear, certain, and reliable, and that which might be attained by human means. Projecting the emphases and assertions of these writers onto their audience, and locating it within a contemporary climate, the article thus questions the emphasis historians of religion place on the intangible-on faith-in considering the production and the reception of Reformation controversy. In this study of Giorgio Agamben's pre-Homo Sacer work, I assess his idea of the ethical subject. Over the course of these early writings, he adopts a Walter Benjamin-inspired redemptive aim as he endeavours to uncover the circumstances of alienated subjectivity and possibility of authentic experience. However, while Agamben borrows from Benjamin to elaborate on the ethical potential of the nihilist pose, a more Kantian conception of idealist autonomy becomes increasingly pronounced. This Kantianism is at odds with the Benjaminian nihilism (...) that guides his redemptive prescription, leaving Agamben's ethical subject mired in a realm of meaningless authenticity. (shrink)

We propose the Prototime Interpretation of quantum mechanics, which claims that quantum entanglement occurs in a "prototemporal" realm which underlies spacetime. Our paper is tentative and exploratory. The argument form is inference to the best explanation. We claim that the Prototime Interpretation (PI) is worthy of further consideration as a superior explanation for perplexing quantum phenomena such as delayed choice, superposition, the wave-particle duality and nonlocality. In Section One, we introduce the Prototime Interpretation. Section Two identifies its advantages. This article considers the recent Court of Appeal decision of Bank of Credit and Commerce International (Overseas) Ltd v Akindele. In this case, the Court of Appeal was required to consider a claim that the defendant should be held liable as a constructive trustee for dishonestly assisting in breaches of fiduciary duty, or knowingly receiving property traceable to a breach of fiduciary duty. The decision is important as the Court of Appeal proposed a new liability test for the claim of (...) knowing receipt. It was held that the test should no longer be based on knowledge. Instead, the court should now determine the claim on the basis of whether the defendant received the property unconscientiously. This article reviews the law, and suggests that the test of unconscientious receipt is preferable to the test of knowledge, as it has a flexibility which was not available under the knowledge‐based test. But, the notion of unconscientiousness, or unconscionability, is too subjective and requires some structure. In the article, economic analysis is used to give the concept of unconscionability the necessary structure. (shrink)

Bioethics and the law have weaved back and forth over time influencing each field. Sometimes ethics leads the debate on problematical issues; for example, the Recombinant DNA Advisory Committee at the National Institutes of Health established regulations prior to initiating human (...) gene therapy. At other times, law takes over; Roe v. Wade, for example, has polarized and closed public discussion on abortion. Most frequently, however, scientific developments initiate discussion in both fields, as when the announcement of the birth of Dolly—the first cloned mammal—sparked President Clinton to ask the National Bioethics Advisory Commission for a report on cloning.A back-and-forth pattern also exists within the law itself, this time between legislator and judge. Legislators enact statutes, which apply universally to regulate conduct in society. Judges, on the other hand, interpret statutes and apply them to particular cases to resolve disputes between parties. Case law, as judge-made law is called, that grows in the absence of legislation becomes the common law. Legislatures can change the course of common law development by enacting more law, usually as amendments, but sometimes as repeals. A judge who sees the facts of a case or the law differently may also change the common law. And so the counterpoint between legislator and judge goes.A legal case becomes a landmark in bioethics because of its historical or precedential value to the field. Historical cases reflect judicial reasoning or rationalization that lays the conceptual foundation for a bioethical principle. Perhaps the best known example of this is the focus on the right to self-determination in Schloendorff that led to the development of informed consent. The principle of autonomy in bioethics derives its legal impetus from this line of cases.A case that acquires landmark status because of its precedential value does so for one of two reasons based on legal precedents. First, the case may be one of “first impression.” In the legal sense, that means that the particular case with its [End Page 191] facts or issues is the first one that a particular court has confronted within that court’s jurisdiction or area of decision-making authority. To be a landmark in bioethics, however, the ordinary sense of “first impression” applies. The first time that a particular bioethical topic has appeared in court for legal resolution makes a case one of “first impression” for bioethics. The case of Baby M on surrogacy contracts illustrates this.The second way in which a case can achieve landmark status based on precedents involves legal precedent and the jurisdictional basis of the court system. Under the common law system, a preceding case that involves the same or similar facts or issues as a current case must be followed by lower—i.e., less authoritative—courts in the same jurisdiction. That judicial rule of decision making is called stare decisis. It creates an institution of continuity, yet allows for change due to differences in judicial interpretation of facts and issues, which is called distinguishing the case.All courts under United States jurisdiction must follow the U.S. Supreme Court. Despite their ethical challenges, recommender systems (RS) are widely endorsed as a necessary solution to the problem of information overload. After clarifying how the harmful effects of information overload can be characterized in distinct ways, I explore the often overlooked potential benefits of abundant online spaces. I argue that these spaces afford valuable opportunities to experience spontaneous freedom. I then put forth a more comprehensive evaluation of the role RS should assume in algorithmically structuring the online space. Both bioethics and law have governed human genomics by distinguishing research from clinical practice. Yet the rise of translational genomics now makes this traditional dichotomy inadequate. This paper pioneers a new approach to the ethics of translational genomics. It maps the full range of ethical approaches needed, proposes a “layered” approach to determining the ethics framework for projects combining research and clinical care, and clarifies the key role that return of results can play in advancing translation.

What the moral theologian has to teach concerning the Sermon on the Mount depends fundamentally on how these words of the Lord are heard. With hearing comes understanding, and because this Sermon is considered in the tradition to be a kind of interpretative key to any understanding of the Christian life as such, the way one hears what is being said is critical to the formation and practices of faith in the believer. In an age determined by nihilism, this hearing (...) has been overtaken by the need to reassert the moral god, in consequence of which faith is reduced to its service in propping up an otherwise endangered morality, however variously that may be described. This is illustrated with reference to John Paul II's encyclical letter, Veritatis Splendor. What is lost through such an account is the hearing of this Sermon as a word of grace, from out of whose movement the hearer is prepared for the reception of faith and is turned out toward the future with God. St Thomas Aquinas's teaching shows how each use of grace is an event of appropriation wherein the believer is conformed to Christ, so that in one's understanding and making one's own of what is being heard, God is claiming His own. Kant objects on principle to any duty of moral self-perfection that would aim at the moral self-perfection of another person. Yet, despite the apparent barrier posed by the introspective technique of self-perfecting effort, I argue that such a duty is both possible and desirable as a part of moral friendship. Through mutual sincere efforts at self-disclosure, we escape the prison of mutual distrust which otherwise characterizes social life and consolidate the very sincerity necessary for moral improvement.

The social discount rate – the rate at which future benefit flows from government investment are discounted to present value – has been a frequent subject of technical debate among professional economists. From a broader perspective, however, the selection of an appropriate rate enjoins consideration of questions that define the very contours of our public philosophy. It carries implicit assumptions about the nature of citizenship, the relation between public and private spheres, and, most singularly, the status of a political society (...) as it is located in time. A key determinant of intertemporal economic allocation, the social discount rate provides a unique registry of a polity's historical consciousness and perceptions of its intergenerational obligations. Yet the highly technical nature of the debate over the discount rate has proven inhospitable to scholars otherwise inclined to investigate its ethical dimensions. Some, notably A. K. This states how theCommission intends to apply the principle andestablishes guidelines for its application. Thedocument is intended to inform discussions oninternational agreements. In particular, itprovides a defense of European Union (EU)precautionary policies in case of tradedisputes, for example, in case the EU isaccused of imposing unfair trade barriers onexports of genetically-modified (GM) productsfrom the United States under the rules of theWorld Trade Organisation. In the communication,the Commission emphasizes the scientificaspects (...) of the precautionary principle, perhapspartly to counter claims from US officials thatthe EU's reluctance to accept GM imports is notbased on science but is politically-motivated.However, a principle is by definition a moralguide to behavior. In other words, it is anethic. The precautionary principle should beviewed as a complement to science, to beinvoked when a lack of scientific evidencemeans that outcomes are uncertain. Anyinterpretation of this principle needs to placeat least as much emphasis on its ethical andvalue-based aspects as on its scientificjustification. The Commission's interpretationrisks undermining the painstaking progress madeamong European Union member states inresponding to public concern about GM crops andfood by adopting increased precaution. This paper argues that Gadamer's hermeneutics offers a methodological perspective for social and political theory that overcomes the impasse created by the dichotomy between the positivist and humanist approaches to social action. Both the positivists’attempt to replace the actors’subjective concepts with the objective concepts of the social scientist and the humanists’attempt to describe meaningful action strictly in the social actors’terms have been called into question in contemporary discussions. Gadamer's approach, which is based on the hermeneutical method of textual interpretation, offers (...) an alternative to both the positivist and humanist perspectives. Gadamer argues that understanding a text involves the fusing of the conceptual schemes of author and interpreter. Relying on Ricoeur's analysis of the parallels between actions and texts, it is argued that this understanding of the process of textual interpretation can be profitably applied to the analysis of social action. This application, furthermore, provides a means of analyzing social action that transcends the dichotomy between the positivist and humanist approaches. Gadamer's approach legitimizes the imposition of the observer's conceptual scheme without denying the constitutive role of the social actors’concepts. (shrink)

Passionate readers both, Olivia Langdon and Mark Twain courted through books, spelling out their expectations through literary references as they corresponded during their frequent separations. Surprisingly, in the process Olivia Langdon reveals herself not as a hypochondriacal hysteric, as many twentieth-century critics have portrayed her, but as a thoughtful intellectual, widely read in literature, history and modern science. Not so surprisingly, Samuel Clemens reveals himself as a critic and a sceptic, lampooning Langdon's physics lessons and her literary heroines. He also (...) shows himself as an astute strategist, carefully manipulating Langdon and her parents. At the same time, Clemens's letters exhibit his own conservatism about women's nature and women's roles, while Langdon's show her carefully choosing from her culture's array of possible role models. The paper builds an argument about empathy, kinesthesia, choreography, and power as they were constituted in early eighteenth century France. It examines the conditions under which one body could claim to know what another body was feeling, using two sets of documents – philosophical examinations of perception and kinesthesia by Condillac and notations of dances published by Feuillet. Reading these documents intertextually, I postulate a kind of corporeal episteme that grounds how the body is constructed.
