In recent years, several cases about the legal personhood of nonhuman animals garnered global attention, e.g. the recognition of ‘basic rights’ for the Argentinian great apes Sandra and Cecilia. Legal scholars have embraced the animal turn, blurring the once sovereign boundaries between persons and objects, recognising nonhuman beings as legal subjects. The zoonotic origins of the Covid-19 pandemic stress the urgency of establishing ‘global animal law’ and deconstructing anthropocentrism. To this end, it is vital to also consider the extensive premodern (...) legal history that humans share with other animals. Over 200 so-called animal trials have been documented in premodern Europe. In these proceedings, certain nonhuman animals—particularly domestic pigs—were prosecuted, often resulting in their capital punishment or anathema. This paper takes a history of ideas approach to these historical instances where Western philosophy of law and philosophical anthropology intersect, problematising the notion that such trials constitute wholesome precedents of the kind of legal personhood presently debated in jurisprudence. My counter-hegemonic analysis of the legal prosecution and execution of several pigs in fifteenth-century France demonstrates that late mediaeval notions of criminality transcended the alleged human-nonhuman divide whilst reaffirming and reifying human distinctiveness. I propose that pig trials were local laboratories where Christian communities reflected upon the natural hierarchy of God’s creation. Ensuing the apparent breach of the prescribed boundaries of nature, these communities renegotiated and re-naturalised everyday interspecies sociability by utilising the offending animals to exemplify particular norms about what it means to be human, generally to the animals’ detriment. The paper introduces ten open problems in belief revision theory, related to the representation of the belief state, to different notions of degrees of belief, and to the nature of change operations. It is argued that these problems are all issues in philosopical logic, in the strong sense of requiring inputs from both logic and philosophy for their solution.

The outcome set of a belief change operator is the set of outcomes that can be obtained with it. Axiomatic characterizations are reported for the outcome sets of the standard AGM contraction operators and eight types of base-generated contraction. These results throw new light on the properties of some of these operators.

Several attempts have been made to transfer the concept of informed consent from medical and research ethics to dealing with affected groups in other areas such as engineering, land use planning, and business management. It is argued that these attempts are unsuccessful since the concept of informed consent is inadequate for situations in which groups of affected persons are dealt with collectively (rather than individually, as in clinical medicine). There are several reasons for this. The affected groups from which informed (...) consent is sought cannot be identified with sufficient precision. Informed consent is associated with individual veto power, but it does not appear realistic to give veto power to all individuals who are affected for instance by an engineering project. Most importantly, the concept of informed consent puts focus on the public’s acceptance of ready-made proposals rather than on its participation in the decision-making process as a whole, which includes the development of alternatives for the decision. Therefore, the concept of informed consent is not applicable to a company’s relations with groups and collectives. It may, however, be applicable to a company’s relations with individual persons such as customers and employees. (shrink)

In this article, we focus on the cross-cultural aspects of the implementation of an American company's code of ethics into its Swedish subsidiary. We identify the cross-cultural stories that the receivers in the subsidiary use when trying to explain the parent's code and conceptualize these stories as part of an emerging narrative of national belonging and differences. The receivers resisted the code by amplifying the importance of national identity. Rather than stimulating a discussion on ethics that might have strengthened the (...) ties between the parent and the subsidiary, the outcome of the code implementation had the opposite effect. The article concludes by stressing the process of implementing codes across cultures rather than code content. (shrink)

By replacement is meant an operation that replaces one sentence by another in a belief set. Replacement can be used as a kind of Sheffer stroke for belief change, since contraction, revision, and expansion can all be defined in terms of it. Replacement can also be defined either in terms of contraction or in terms of revision. Close connections are shown to hold between axioms for replacement and axioms for contraction and revision. Partial meet replacement is axiomatically characterized. The ideal world semantics of standard deontic logic identifies our obligations with how we would act in an ideal world. However, to act as if one lived in an ideal world is bad moral advice, associated with wishful thinking rather than well-considered moral deliberation. Ideal world semantics gives rise to implausible logical principles, and the metaphysical arguments that have been put forward in its favour turn out to be based on a too limited view of truth-functional representation. Contractions on belief sets that have no finite representation cannot be finite in the sense that only a finite number of sentences is removed. However, such contractions can be delimited so that the actual change takes place in a logically isolated, finite-based part of the belief set. A construction that answers to this principle is introduced, and is axiomatically characterized. It turns out to coincide with specified meet contraction.

We can express values in three major ways: in terms of classification, comparison, and quantity. The interrelations among these three types of value expressions are surveyed, with a particular emphasis on relations of interdefinability. Furthermore, interrelations between value terms and terms expressing norms or choices are explored. Several of these connections have been surprisingly little studied, and further investigations may possibly lead to the discovery of additional connections among the different formal representations of value and value-related concepts.

Se concluye que la filosofía formalizada es una especialidad en peligro que necesita ser revitalizada, y que debe incrementar sus interacciones con la filosofía no formalizada. El estilo enigmático, que es común en la lógica filosófica, debe llevar a discusiones explícitas sobre la relación problemática entre modelos formales, conceptos filosóficos y temas que motiven su desarrollo.

A formal language is introduced that contains expressions for the dependency of a legal relation on the claims that the concerned individuals make and on the permissions that they grant. It is used for a classification of legal relations into six major categories: categorical obligation, categorical permission, claimable obligation, grantable permission, claim-dependent obligation and grant-dependent permission. Although choice and preference are distinct categories, it may in some contexts be a useful idealization to treat choices as fully determined by preferences. In order to construct a general model of such preference-based choice, a method to derive choices from preferences is needed that yields reasonable outcomes for all preference relations, even those that are incomplete and contain cycles. A generalized choice function is introduced for this purpose. It is axiomatically characterized and is shown to compare favourably with alternative (...) constructions. (shrink)

Climate science denial has a perhaps surprisingly strong standing in anthroposophy. Anthroposophical deniers of climate science usually do not contest the existence of global warming, but they ascribe it to “cosmic” processes that are largely described in astrological terms. Thoroughly refuted claims that ongoing global warming depends on variations in solar activity have been adopted by anthroposophists. This article proposes three major explanations for the persistence of climate science denial in the anthroposophical movement: Anthroposophists constantly look for guidance on scientific (...) issues in the writings of their founder Rudolf Steiner, who made claims far off from the mainstream science of his time. They consider the material world to be constantly influenced by “spiritual” factors, including astrological constellations and a host of supernatural beings. Finally, they cherish ideas on a predetermined, largely cyclic, cosmic plan, of which humanity is a part. (shrink)

Deontic logic is the logic of normative concepts such as obligation, permission, and prohibition. This non-technical overview of the area has a strong emphasis on the connections between deontic logic and problems discussed in moral philosophy. Major issues treated are the distinction between ought-to-be and ought-to-do, the various meanings of permissive expressions, the logical relations among norms, the paradoxes of deontic logic, and the nature of moral conflicts and moral dilemmas. It is concluded that deontic logic has resources for precise (...) treatment of important issues in moral philosophy, but in order to make full use of these resources, more co-operation between logicians and moral philosophers is needed. Rationality postulates for preferences are developed from two basic decision theoretic principles, namely: (1) the logic of preference is determined by paradigmatic cases in which preferences are choice-guiding, and (2) excessive comparison costs should be avoided. It is shown how the logical requirements on preferences depend on the structure of comparison costs. The preference postulates necessary for choice guidance in a single decision problem are much weaker than completeness and transitivity. Stronger postulates, such as completeness and transitivity, can be derived (...) under the further assumption that the original preference relation should also be capable of guiding choice after any restriction of the original set of alternatives. A money-pump is a thought experiment involving a person whose preferences form a circle. Repeatedly, she pays some money to go from one alternative to another that she likes better. When she has paid her way around the full circle she is back at the starting-point, but with less money. Money-pumps have been used to show that certain preference patterns are irrational since they make a person exploitable. Formal tools can be used to analyze money-pumps in a precise manner, distinguish (...) between different types of money-pumps, and investigate decision strategies to avoid their pernicious effects. Although money-pumps are rather contrived constructions, these investigations have practical relevance since there seem to be decision situations in the real world with the same structure. (shrink)

Preferences and choices have central roles in moral philosophy, economics, and the decision sciences in general. In a formal language we can express and explore the properties of preferences, choices, and their interrelations in a precise way, and uncover connections that are inaccessible without formal tools. In this chapter, the plausibility of different such properties is discussed, and it is shown how close attention to the logical details can help dissolve some apparent paradoxes in informal and semi-formal treatments.
