A major objection to the view that the relation of persons to human animals is coincidence rather than identity is that on this view the human animal will share the coincident person's physical properties, and so should (contrary to the view) share its mental properties. But while the same physical predicates are true of the person and the human animal, the difference in the persistence conditions of these entities implies that there will be a difference in the properties ascribed by (...) these predicates, with the result that the physical properties that determine the person's mental states will belong to the person and not to the human animal. In Physical Realization, Sydney Shoemaker considers the question of how physicalism can be true: how can all facts about the world, including mental ones, be constituted by facts about the distribution in the world of physical properties? Physicalism requires that the mental properties of a person are 'realized in' the physical properties of that person, and that all instantiations of properties in macroscopic objects are realized in microphysical states of affairs. Shoemaker offers an account of both these sorts of (...) realization, one which allows the realized properties to be causally efficacious. And nowhere are the antithetical natures of their existentialist and poststructuralist philosophies more apparent than in their disparate approaches to historical understanding. In Volume One of this authoritative two-volume study, Thomas R. Flynn conducted a pivotal and comprehensive reconstruction of Sartrean historical theory. This long-awaited second volume offers a comprehensive and critical reading of the Foucauldian counterpoint. A history, theorized (...) Foucault, should be a kind of map, a comprehensive charting of structural transformations and displacements over time. Contrary to other Foucault scholars, Flynn proposes an "axial" rather than a developmental reading of Foucault's work. This allows aspects of Foucault's famous triad of knowledge, power, and the subject to emerge in each of his major works. Flynn maps existentialist categories across Foucault's "quadrilateral," the model that Foucault proposes as defining modernist conceptions of knowledge. Deliberative democracy entails a commitment to deciding political questions on their merits. To that end, people engage in an exchange of reasons in a shared endeavour to arrive at the right answer or the best judgement they can make in the circumstances. Of course, in practice a shared judgement may be impossible to reach. Yet while compromise may seem a natural way of dealing with the disagreement that deliberation leaves unresolved – for example, some deliberative theorists argue that a willingness (...) to compromise manifests respect for the considered views of others, even as we continue to disagree with them – the relationship between deliberation and compromise is not as straightforward as one might think. To explain why, this paper contrasts conflicts of judgement with conflicts of preference, interest and value to show why greater attention needs to be paid to the character of the decision to be made. This article seeks to contribute to a vision for leadership in business based on a recovery of virtue. The vision for leadership articulated here draws principally on the writings of the classical philosopher Aristotle and of the contemporary philosopher Josef Pieper. Without discounting the ever-increasing complexity of modern business, this essay will attempt to reconstruct Aristotle’s emphasis on virtue and moral character, and argues for the philosopher’s relevance to modern management and corporate leadership. The paper concludes that the message of (...) virtue is a message of hope and attempts to find plain language to articulate its value to those engaged in business or concerned with the formulation of government policy. We present and defend a Thomistic cosmological argument that runs independently of the principle of sufficient reason, sidestepping perhaps two of the most recurrent objections to cosmological reasoning: (a) the possibility of brute facts (i.e., that not everything needs an adequate explanation of its existence) and (b) the accusation of the composition fallacy. Drawing upon the work of Barry Miller, we show that any contingent entity like Thumper the rabbit, upon metaphysical analysis, is either a contradictory structure and therefore an (...) impossible existent or else points towards an extrinsic cause for the unity of its really distinct metaphysical parts (namely, its essence and its existence). This conclusion enables the inference that only an uncaused cause with no really distinct metaphysical parts can ultimately produce anything with really distinct metaphysical parts. Among philosophers, the question about strategic fouls has been whether they are ethically justified in light of our best conception of sport. This paper proposes a different defense. I argue that many strategic fouls should be excused even if we regard them as unjustified. I first lay out a partial defense of the assumptions that playing to win cannot be subordinate to playing skillfully and that winning has value that cannot be accounted for in terms of the skill that produces (...) it. I then argue that the logic of competitive play structures practical reason such that it is unreasonable to require even an ethical competitor always to subordinate the aim of winning to ethical standards within the game. Some ethical failures should be excused. The argument implies limits on the excusing conditions. I discuss these limits in some detail, showing that they fit patterns in the common acceptance of strategic fouls. I then address possible objections. In conclusion I argue that the logic of excuse rather than justification explains a common reaction to strategic fouls, resolving what might otherwise appear to be a contradiction in that reaction. A survey of university students tested whether committing animal abuse during childhood was related to approval of interpersonal violence against children and women in families. Respondents who had abused an animal as children or adolescents were significantly more likely to support corporal punishment, even after controlling for frequency of childhood spanking, race, biblical literalism, and gender. Those who had perpetrated animal abuse were also more likely to approve of a husband slapping his wife. Engaging in childhood violence against less powerful (...) beings— animals—may generalize to the acceptance of violence against less powerful members of families and society—women and children. Not all intellectual property rights grant the right to exclude that is indicative of “property rules,” as that term was used by Guido Calabresi and A. Douglas Melamed in their seminal article. Some intellectual property rights are “liability rules,” in which the right holder has an entitlement to compensation for use of the protected invention, not a right to preclude the use. Although patent laws normally grant a right to exclude others from use of the protected invention as a default, (...) most countries’ laws allow the government to convert the patent property rule into a liability rule through a compulsory license. It has been noted, for example, that by the end of the 1950s, the U.S. had issued compulsory licenses covering 40 to 50 thousand patents, including substantial portions of the patent portfolios of AT&T, General Electric, IBM, and Xerox. The U.S. Supreme Court recently expressed a willingness to accept liability rules over injunctions in some patent infringement cases. (shrink)

Michel Foucault surveyed the history of Western philosophy in terms of the Delphic ‘Know thyself’ and the Socratic ‘care of the self’. The former generates academic philosophy as we know it today whereas the latter conceives of philosophy as a ‘way of life’. At issue are competing notions of ‘truth’ and the philosophical relevance of the discursive/nondiscursive domains. Comparing this account with a similar but distinct reading of the same Greek texts by Greco-Roman historian Pierre Hadot, I underscore the ‘existentialist’ (...) tenor of this distinction and assess the challenges and liabilities of pursuing philosophy as a ‘way of life’. Husserl’s philosophy of culture relies upon a person’s body being expressive of the person’s spirit, but Husserl’s analysis of expression in Logical Investigations is inadequate to explain this bodily expressiveness. This paper explains how Husserl’s use of “expression” shifts from LI to Ideas II and argues that this shift is explained by Husserl’s increased understanding of the pervasiveness of sense in subjective life and his increased appreciation for the unity of the person. I show how these two developments allow Husserl (...) to better describe the bodily expressiveness that is the source of culture. Husserl’s account of culture is thoroughly intentionalistic, but it does not emphasize thought at the expense of embodiment. Culture originates not in an abstract subjectivity, but by persons’ expressing themselves physically in the world. By seeing how Husserl develops his mature position on bodily expressiveness, we can better appreciate the meaningfulness and the bodily concreteness of cultural objects. (shrink)

Since the appearance of a widely influential book, Self-Knowledge and Self-ldentity, Sydney Shoemaker has continued to work on a series of interrelated issues in the philosophy of mind and metaphysics. This volume contains a collection of the most important essays he has published since then. The topics that he deals with here include, among others, the nature of personal and other forms of identity, the relation of time to change, the nature of properties and causality and the relation between (...) the two, dualism and immortality, and the nature of mental states. All the essays show the same care and precision in argument as the earlier book, but they also reveal a substantial shift in Professor Shoemaker's position to a form of materialism. In fact, a number of papers together constitute what is probably the most subtle and rigourous defence yet of a sophisticated functionalism in the account of the mind. (shrink)

Only recently have sociologists considered the role of nonhuman animals in human society. The few studies undertaken of battered women and their animal companions have revealed high rates of animal abuse co-existing with domestic violence. This study examines several aspects of the relationship between humans and animals in violent homes. The study explored the role of companion animals in the abusive relationship through in-depth, semi-structured interviews with clients at a battered women's shelter. In particular, the study focused on the use (...) of companion animals by women's violent partners to control, hurt, and intimidate the women; the responses of the animals to the women's victimization; and the role of pets as human surrogates and the resulting symbolic interaction between human and nonhuman family members. The significance of the findings for family violence research and application are discussed, as well as the broader implications for sociological investigation of human-animal interaction. (shrink)

Sociologists have largely ignored the role of animals in society. This article argues that human-animal interaction is a topic worthy of sociological consideration and applies a sociological analysis to one problematic aspect of human-animal relationships - animal cruelty. The article reformulates animal cruelty, traditionally viewed using a psychopathological model, from a sociological perspective.The article identifies social and cultural factors related to the occurrence of animal cruelty. Ultimately, animal cruelty is a serious social problem that deserves attention in its own right, (...) not just because of its association with human violence. (shrink)

This article critically examines Jürgen Habermas’s theory of democracy as developed in Between Facts and Norms. In particular, it focuses on the concept of communicative power and argues that there is a crucial ambiguity in Habermas’s use of this concept. Since communicative power is the key normative resource that is supposed to counter the norm-free steering media of money and administrative power, its role within the theory must be made clear. The article begins by explaining the normative and social-theoretic foundations (...) of the theory. Then it highlights the normative importance of the public sphere in Habermas’s two-track model of deliberative politics, before turning to the problems with the concept of communicative power. Two alternative readings of its role are provided in order to demonstrate how it needs to be further clarified. (shrink)

Any property has two sorts of causal features: “forward-looking” ones, having to do with what its instantiation can contribute to causing, and ldquo;backward-looking” ones, having to do with how its instantiation can be caused. Such features of a property are essential to it, and properties sharing all of their causal features are identical. Causal necessity is thus a special case of metaphysical necessity. This work considers the consequences for political philosophy of what contemporary philosophers have called the end, or closure, especially in the works of Nietzsche and Heidegger.

What types of unity and disunity belong to a group of people sharing a culture? Husserl illuminates these communities by helping us trace their origin to two types of interpersonal act—cooperation and influence—though cultural communities are distinguished from both cooperative groups and mere communities of related influences. This analysis has consequences for contemporary concerns about multi- or mono-culturalism and the relationship between culture and politics. It also leads us to critique Husserl’s desire for a new humanity, one that is rational, (...) cooperatively united, and animated by a universal philosophical culture. Reflecting on culture, a spiritually shaped and shared domain of the world, draws us to reflect also on ourselves as social and rational animals, and to ask, what should we reasonably hope for—and aim for—in a human culture that expresses and supports our shared lives of reason? The coronavirus pandemic has impacted health care, economies and societies in ways that are still being measured across the world. To control the spread of the virus, governments continue to appeal to citizens to alter their behaviours and act in the interests of the collective public good so as to protect the vulnerable. Demonstrations of collective solidarity are being consistently sought to control the spread of the virus. Catchphrases, soundbites and hashtags such as ‘we’re all in this together’, ‘stronger together’ (...) and other messages of unity are employed, invoking the sense of a collective struggle. However, this approach is fundamentally challenged as collectivist attitudes run contrary to the individualism of neoliberal ideology, to which citizens have been subjected. This paper argues that attempting to employ the concept of solidarity is inherently challenged by the deep impact of neoliberalism in health policies and draws on the work of Durkheim to examine the concept in a context in which health care has become established as an individual responsibility. The paper will argue that a dominant private-responsibility model and an underfunded public system have eroded solidarity weakening its effectiveness in generating concerns for the collective. Although the idea of the public interest features prominently in many accounts of deliberative democracy, the relationship between deliberative democracy and the public interest is rarely spelt out with any degree of precision. In this article, I identify and defend one particular way of framing this relationship. I begin by arguing that people can deliberate about the public interest only if the public interest is, in principle, identifiable independently of their deliberations. Of course, some pluralists claim that the public interest (...) is an implausible idea, which casts doubt on the idea that there might be something for people to deliberate about. Yet while, following Brian Barry, we can get around this problem by defining the public interest as an interest in which everyone shares qua member of the public, what still needs to be explained is why people should be prepared to privilege this particular capacity. I argue that the account of political equality with which deliberative democracy is bound up offers a compelling explanation of this sort, even if it also gives rise to some difficult questions of feasibility. I conclude by considering the charge that any political scheme that framed the relationship between deliberative democracy and the public interest in this way would be undesirable. (shrink)
