La justice prédictive est ici sommairement définie comme une justice prédite par des algorithmes et, partant, envisagée comme une justice simplement virtuelle, c’est-à-dire seulement probable, non acquise dans son existence et dont l’actualisation est laissée à la création, à l’imagination et à l’intuition des utilisateurs qui feront que la prédiction restera « une » solution proposée ou deviendra « la » solution finalement adoptée. La justice prédictive apparaît ainsi comme un espace de prospective juridique pour les justiciables, les professions juridiques (...) et la science du droit. Cette introduction à une justice simplement virtuelle étudie, d’une part, le risque qui reste mesuré d’une domination du virtuel, lorsque celui-ci devient prescriptif pour les professionnels ou dissuasif pour les justiciables ; elle envisage, d’autre part, l’avenir espéré d’une responsabilisation face au virtuel, par une nécessaire compréhension technique de l’outil de justice prédictive et une essentielle respiration éthique de ses acteurs. XVIIIth-century writings about the habit of eating meat deal with problems that are only addressed today when defending animal rights, such as the sensibility of animals that are killed for their flesh or what human beings become through the process of eating meat. But in the XVIIIth century this kind of discourse doesn’t belong to animal rights activists, and is even paradoxically exempt from practical consequences: writers who deplore the eating of animal flesh however don’t ask their fellow humans to (...) cease this consumption. How do western XVIIIth-century thinkers solve this paradox: emphasizing empathy with animals, while at the same time killing them to eat their flesh? Through philosophic and medical XVIIIth-century writings dealing with the consequences of eating meat, this paper examines the representation of mankind underlying a discourse that belongs nowadays to meat diet’s subconscious. Segundo Nietzsche, a figura icônica de Port-Royal personifica o conflito entre o cristianismo e a moral derivada dele e, portanto, entre a fé cristã e a probidade científica, ambas ligadas pela ideia de que Deus é a verdade, que a verdade é divina. This Element argues that although Kant's political thought does not tackle issues of global poverty and inequality head on, it nonetheless offers important conceptual and normative resources to think of our global socioeconomic duties. It delves into the Kantian duty to enter a rightful condition beyond the state and shows that a proper understanding of this duty not only leads us to acknowledge a duty of right to assist states that are unable to fulfil the core functions of a state, (...) but also provides valuable hints at what just transnational trade relations and a just regulation of immigration should look like. When scholars inquire into the inspirational sources of Nietzschean perspectivism, they most often credit Leibniz's monadology. However, this overlooks the fact that Pascal — whose writings Leibniz had read — was the first person to introduce the idea of perspective into philosophy. This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. This book offers a 'genealogical' explanation of law's normativity. The term 'genealogical' conveys a commitment to a non-metaphysical type of enquiry. While it explains how law, as a normative phenomenon, comes about, it does not seek to ground law's normativity in anything but the context of social interaction giving rise to it. Legal normativity is brought about on a daily basis. Whether in revolutionary circumstances or in the quotidian need for judges, lawmakers or citizens to balance law's demands with those (...) of morality or prudence, our ability to bind ourselves through law ultimately depends on our capacity to articulate a better way of living together, and to commit ourselves to it. These efforts of assessment and articulation depend, in turn, on our conception of normative agency. Assert the need to trace the truth of ethical judgments to some independent moral 'facts' conditioning their objectivity, and you will get a different understanding of what it is we are doing when we dispute law's authority in the name of moral values. Tracing the truth of moral judgements back to our own social practices not only affects the nature of disagreement; it also dramatically increases our responsibility when, as lawmakers, judges, or citizens we 'take the law into our own hands' and confront it with our moral expectations. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

In his review of Bernard Williams' Ethics and the Limits of Philosophy, Hart eloquently formulated an apprehension that still haunts much of contemporary jurisprudence: if the moral 'I must' has to be 'seen as coming not from outside, but from what is most deeply inside us? the fear is that this will not be enough'. I argue that this fear is the byproduct of the dualist outlook within which Hart—and a significant part of contemporary legal theory—is confined: because of his (...) bald naturalist premise, Hart could not conceive of moral objectivity except in terms presupposing an order of Reason resolutely distinct from the 'natural' world. This paper seeks to debunk this dualist outlook by engaging with the kind of 'non-bald' naturalism advocated in different ways by both McDowell and Blackburn. In considering contemporary efforts to draw a middle way between ethical scepticism and metaphysical rationalism, the paper draws on the pragmatic elements emerging from the confrontation between Habermas and Rawls. Les parlers ruraux abondent en métaphores associées à la parole, notamment à la façon dont elle est fabriquée et produite dans cet ouvroir miniature qu’est la bouche. Deux séries de représentations semblent en réalité s’opposer : un modèle technique qui assimile la parole aux activités textiles d’une part (filer, coudre), aux gestes des petits artisans d’autre part (raboter, étamer, limer) ; un modèle organique qui associe la parole à la sécrétion salivaire (baver) et à l’excrétion (« chier sur, faire des (...) crottes »). Ces deux ensembles de représentations servent à opposer une parole féminine et une parole masculine tout en définissant la norme de chacune d’elles. L’étude met en évidence la portée symbolique de la parole féminine qui, nouant le lien entre la passé et le présent, filant le temps cyclique de la communauté, s’identifie avec la dynamique calendaire ; elle montre aussi la complémentarité que cette parole entretient sur le plan symbolique avec la parole des hommes qui, associée à l’excrétion, à la croissance et à la maturation des végétaux et aux gestes qui tranchent et ouvrent, semble figurer la succession des cycles qui doivent à un moment s’ouvrir les uns sur les autres et l’inévitable transformation de toute chose vivante. The discourse among medical and scientific communities on hymen restoration is largely missing the voice of women affected. This article calls for a more nuanced reflection on women’s real life experiences and the complexities inherent in the negotiation process about the surgery going beyond “ideologies” and the extremes of rape and threats to life. By taking the clinical experience of a woman who requests restoration surgery before her arranged marriage, this article illuminates the grey zone beyond these extremes and explores (...) an individual woman’s options for making her own choices. Recent research suggests that women react to idealized female models in advertising as they would react to real-life sexual rivals. Across four studies, we investigate the negative consequences of this imaginary competition on consumers’ mate-guarding jealousy, indirect aggression, and drive for thinness. A meta-analysis of studies 1–3 shows that women exposed to an idealized model report more mate-guarding jealousy and show increased indirect aggression, but do not report a higher desire for thinness. Study 4 replicates these findings and reveals that (...) the main driver of aggression is the sexually provocative attitude of the model, rather than her thin body size. The ethical implications of these findings for advertising are discussed in light of recent concerns about female bullying, online, and in the workplace. (shrink)

The doctrine of the three orders which distinguishes and hierarchizes flesh, spirit and charity is obviously one of the major themes of Pascal’s thought. But it appears that Pascal meditates as much on the disorder – and dis-order – induced by sin and the corruption of our nature as on the hierarchy and the heterogeneity of these three kinds of reality. In the world he describes, in fact, not only is everything overturned – the lowest order, that of the flesh, (...) now dominating the other two – but also everything is confused – pleasure, for example, obtaining the credence that normally belongs to science, and the flesh invading the order of the spirit through custom and imagination. To maintain then, as several commentators do, that no interference between the orders is possible, so that tyranny can only exist in the state of desire, is in our view to adopt a more Stoic than Pascalian point of view. For to deny disorder is also, according to Pascal, to deny sin by projecting into the second nature the memory of the first. (shrink)

Escamotée par le discours convenu développé dans la tradition romanesque des Guerres de l’Indépendance nationale entre 1850 et 1950, émerge la version très progressiste du projet anticolonial et républicain adossé à l’organisation des pratiques civiques, comme forme précoce d’éducation populaire et révolutionnaire par un peuple insurgé qui lutte pour s’extraire d’un système colonialiste et pour en modifier les rapports sociaux. Ce propos et (...) ce projet seront balayés par le régime établi en 1902, mais il n’est pas infondé de voir se dessiner dans cet imaginaire et cette mémoire la continuité avec les mouvements révolutionnaires cubains du xx e siècle.
