Résumé Cet article rend compte d’une recherche sur le vécu des couples confrontés au cancer. La qualité de vie du patient et de son entourage devient de plus en plus cruciale au fur et à mesure que s’accroît l’espérance de vie des personnes atteintes. Le couple constitue une entité psychique spécifique qui résulte de la dynamique intersubjective entre conjoints. Cette entité peut être atteinte en cas de maladie grave. L’étude servant d’appui à cet article porte sur l’annonce de la maladie, (...) la période des traitements et la rémission. Il est ainsi mis en évidence que le « syndrome de Lazare » ne concerne pas que la personne malade, mais également le conjoint et que l’homéostasie du couple est perturbée bien au-delà de l’annonce de la rémission. The 2008 crisis has revived debates on the relevance of laissez-faire, and thus on the role of the State in a modern economy. This volume offers a new exploration of the writings of Keynes and Friedman on this topic, highlighting not only the clear points of opposition between them, but also the places in which their concerns where shared. This volume argues that the parallel currently made with the 1929 financial crisis and the way the latter turned into the Great (...) Depression sheds new light on the proper economic policy to be conducted in both the short- and the long-run in a monetary economy. In light of the recent revival in appreciation for Keynes’ ideas, Rivot investigates what both Keynes and Friedman had to say on key issues, including their respective interpretations of both the 1929 crisis and the Great Depression, their advocacy of the proper employment policy, and the theoretical underpinnings of the latter. Commençons par le beau: selon Pouivet, on peut et on doit reconnaître un objet comme étant une œuvre d’art avant de l’évaluer. Pour les œuvres dont la saisie demande du temps, cela paraît très naturel. Je n’ai même pas besoin d’avoir lu les feuilles couvertes de signes que je tiens dans les mains pour savoir qu’il s’agit d’un roman ou je peux n’en avoir lu que quelques pages, donc je n’ai évidemment pas besoin de l’avoir évalué. Toutefois, il n’est pas (...) certain que la façon dont j’évalue le roman, au terme de ma lecture, ne change rien à ma catégorisation. C’est un peu comme classer x dans la catégorie des oiseaux en voyant une photo de ses pattes puis réaliser en découvrant une photo de x dans son entier qu’il s’agit d’une autruche: x demeurera un oiseau, mais perdra un certain nombre de propriétés associées aux oiseaux prototypiques. Classer x ce n’est pas simplement le mettre ou non dans la catégorie des oiseaux, mais c’est le mettre à une plus ou moins grande distance du prototype de la catégorie en question. Les œuvres d’art prototypiques sont celles que l’on a tous immédiatement à l’esprit: La naissance de Vénus de Botticelli, La Joconde de Léonard de Vinci, le David de Michel-Ange, etc. Et dans les propriétés les plus saillantes de ces objets, on pense bien sûr à leur beauté. Une œuvre qui raterait le coche de la beauté serait sûrement encore une œuvre d’art, mais elle serait probablement exilée aux confins de son genre. Et que certaines œuvres tentent de mettre à mal le diktat de la beauté ne change rien à l’affaire: si elles essaient de renverser notre conception de l’art en nous choquant c’est que le diktat existe bien. The main purpose of this article is to bring into relief the difficulties faced by generous interpretations of the Kantian problem of poverty and to propose an alternative interpretation which (a) agrees with some generous interpretations that Kant's juridical treatment of poverty is to be understood by analogy with his juridical treatment of slavery, but which (b) departs from generous interpretations in general by arguing that this analogy is not to be understood in terms of “dependence” as such, but in (...) terms of “depersonification.” More specifically, it argues that what makes slavery and poverty unjust for Kant is not that they entail a human being finding herself (completely) dependent on the choice of another human being, but that they entail a human being being deprived of her juridical personality. The Kantian problem of poverty is ultimately a problem of juridical depersonification, and this problem of juridical depersonification does not arise in all (complete) dependence relations. (shrink)

This paper concentrates on the way Kant's distinction between duties of right and duties of virtue operates at the interstate level. I argue that his Right of Nations (V ölkerrecht) can be interpreted as a duty to establish a kind of interstate distributive justice (that is, as a duty to secure states in their independence and territorial possessions), which is called for to secure domestic distributive justice and to protect individuals' freedom and private property. Or at least this is 'ideal (...) theory' for, as I specify, this cosmopolitan linkage is compromised by Kant's endeavour to accomodate the existence of non-republican states. (shrink)

Just like other experts, members of the professions develop their craft thanks to a deep internalisation of both complex cognitive structures and a mix of habits and intuitive understandings. These non-cognitive aspects of expertise can be what distinguishes the merely competent from the truly brilliant. Yet habits can also be what makes us blind to important features of the world we inhabit. In the life of a professional, these features include the vulnerability of those seeking her services, which in turn (...) grounds the professional's particular ethical responsibility. This book develops an in-depth account of habit to understand its impact upon the way moral decisions are made in a professional context. Its central thesis is the following: what most often stands in the way of a professional meeting her ethical responsibility is not so much stupidity (or character defects) but rather the deleterious aspects of habituation. This book calls for renewed attention to be paid to habits and their relationship to ethical agency. Mostly neglected in moral and legal theory, such an inquiry not only conditions an adequate understanding of the risks inherent in a legal system's institutional structure. Zusammenfassung Der vorliegende Aufsatz nähert sich dem Thema „Geflüchtete in Deutschland“ sowohl aus gesellschaftspolitischer als auch aus theologischer Perspektive. Der Aufsatz vertritt die Auffassung, dass der Mensch zur Entfaltung seines Selbst dazu aufgerufen ist, dem Anderen zu begegnen und für ihn einen Platz in seinem Leben einzuräumen, damit der Mensch nicht in den Grenzen seines eigenen Selbst gefangen bleibt. In diesem Aufsatz sind es die Geflüchteten in Deutschland, die als die Anderen betrachtet werden. Der Aufsatz ist daher ein Plädoyer an (...) die Einheimischen, Geflüchtete aufzunehmen und bereit zu sein, mit ihnen in eine gegenseitige Beziehung zu treten. Die Offenheit der Theologie kann sich dabei auf zwei Ebenen zeigen: Einerseits durch die ständige Rückkehr zum Kern der christlichen Botschaft, nämlich Gottes- und Nächstenliebe. Zum anderen in der Offenheit des christlichen Denkens und der Theologie und ihrer Lehren, die den christlichen Glauben in der Gegenwart vertreten. Der Aufsatz geht davon aus, dass das Element der Offenheit gegenüber den Anderen ein wichtiger Bestandteil einer zeitgemäßen, aber auch zukunftsfähigen Christlichen Theologie ist. Damit stellt der Beitrag einen grundsätzlichen Schlüsselgedanken für eine zukünftige christliche Theologie bereit, der fordert, den Anderen immer im Blick zu behalten, damit die Grenzen der Selbsterhaltung und Selbstdurchsetzung der Theologie überwunden werden können. This paper describes the construction method of a legal application ontology. This method is based on the merging of micro-ontologies built from European community directives. The terminae construction method from texts enhanced by an alignment process with a core legal ontology is used for building micro-ontologies. A merging process allows constructing the legal ontology.

In this article we address the question of individual identity and its place – or rather omission – in contemporary discussions about the cosmopolitan extension of liberalism as the dominant political theory. The article is divided into two parts. In the first part we show that if we consistently emphasise the complementarity of the “inner” and “outer” identity of a person, which is essential to liberalism from its very beginnings, then a fundamental flaw in the liberal cosmopolitan project becomes apparent. (...) This is the underestimation of the indispensability of an unambiguously determined public framework which will fix and enforce liberal principles and values in a comprehensible way. Such a framework for liberalism was always the political community and then, above all, the modern state, in which the liberal identity could then be realised. The discussion in this part of the article prepares the ground for an examination, in the second part, of a dilemma which cosmopolitan liberalism must face. In the second part we argue that the attempt to tackle the given problem presents liberals with the following dilemma: either it is necessary to plead for the institution of a global political authority (a “world state”), or to give up the belief that fundamental liberal principles and values can be realised to a global extent. We show, at the same time, that because of the character and ambitions of the cosmopolitan project, the promise of plural identities and multi­centred law cannot be relied upon. Cet article est une étude sur l’apparition et la fortune critique du terme installation dans le vocabulaire de l’art contemporain. À travers la brève histoire de la diffusion de ce mot en art seront analysés les circonstances contextuelles, les modalités de fonctionnement et l’imaginaire de la forme « installation ». Devenue populaire grâce à trois artistes commissaires d’un lieu d’exposition à Londres, le « Museum of Installation » dans les années 1990, la forme « installation » renvoie à des dispositifs (...) antérieurs, amorcés dès les avant-gardes. L’analyse historique permet d’en appréhender les différents paliers : les prémisses, puis les « environnements » issus de l’assemblage et popularisés par Allan Kaprow, et l’« in situ », ces deux dernières formes et leur terminologie dominant jusqu’à la fin des années 1970. Après la transition constituée par les années 1980, le texte se conclut par l’analyse d’un moment inaugural ouvrant l’histoire des installations en France, les « Ateliers du Paradise » de 1991. À travers cette œuvre sont questionnées les différentes valeurs critiques comme les ambiguïtés de ce mode aujourd’hui si répandu internationalement qu’il semble à beaucoup synonyme d’art contemporain. This article studies the emergence and critical reception of the term installation in today’s artistic vocabulary. Through the brief history of the diffusion of the word will be analyzed its contextual circumstances, the functioning procedures and the imaginary conveyed through the different forms of installation. Mediated by three artists who, in the 1990s, curated a place in London they called the “Museum of Installation”, installation as an art form much predates the 1990, and can be found in avant-garde art. The historical analysis allows one to discern different stages: the premises of installation, “environments” issued from assemblage and popularized by Allan Kaprow, “site-specific” installations,—these last two forms and words being prevalent up to the end of the 1970s. After presenting the transitional period of the 1980s, the text concludes with the analysis of an inaugural event opening the history of installations in France, the “Paradise’s Studios”, in 1991. Through this analysis are questioned the critical values as well as the ambiguities of installation, as this very form is so internationally spread today that it seems to mean contemporary art itself. Dans un premier temps, est proposé un tour d’horizon des questions ouvertes et fermées depuis le vieil anglais avant de nous intéresser à l’apparition et à l’évolution des pronoms relatifs en wh-. C’est sur les différentes manières dont nous pouvons conceptualiser notre identité et nos communautés d’appartenance que sera mis l’accent dans cet article. Après avoir souligné les dangers d’une interprétation « communautarienne » de la communauté qui naturalise l’identité en la pensant comme une essence, ainsi que les apories d’une conception universaliste qui l’ouvre à l’ensemble de l’humanité sans tenir compte (...) des identités concrètes et situées, nous plaiderons ici en faveur d’une appréhension « cosmopolite » de la communauté permettant de concevoir l’identité comme plurielle et ouverte à la différence. This study seeks to gain knowledge about key conditions in the process of digitalization using a socio-technical systems design as a theoretical framework and a case-study approach. Semi-structured interviews with 15 relevant stakeholders are conducted to learn about barriers to and enablers of the development and implementation process in a manufacturing company. After conducting a thematic analysis, eight higher-ranked themes relevant to the digitalization process are identified. These are grouped to describe the overarching phenomena, resulting in four enablers and four (...) barriers. The study takes a holistic view of digitalization in its investigation of the development and subsequent implementation processes. The findings contribute to the literature via three key takeaways for stakeholders of a digitalization process in manufacturing. First, it is vital to understand and strengthen the role of the key enablers identified in this paper. Second, managers should observe and identify barriers in their own organizations, related both to technical and social aspects. Third, some of the enablers described in this paper can serve managers as helpful tools to approach the expected barriers to digitalization. This paper also challenges the research literature by arguing that research conducted on digitalization that sets new standards and premises for the working life in industry needs to use up-to-date socio-technical design concepts and theories. L’auteur propose une approche originale de l’ordre public culturel, construit autour de trois piliers : la liberté de création, incluant le droit à la rémunération et à la diffusion de l’œuvre, la protection du vivre-ensemble, et notamment des plus faibles, le droit pour les générations présentes et futures d’accéder aux biens culturels composant le patrimoine artistique d’une nation.

Escamotée par le discours convenu développé dans la tradition romanesque des Guerres de l’Indépendance nationale entre 1850 et 1950, émerge la version très progressiste du projet anticolonial et républicain adossé à l’organisation des pratiques civiques, comme forme précoce d’éducation populaire et révolutionnaire par un peuple insurgé qui lutte pour s’extraire d’un système colonialiste et pour en modifier les rapports sociaux. Ce propos et (...) ce projet seront balayés par le régime établi en 1902, mais il n’est pas infondé de voir se dessiner dans cet imaginaire et cette mémoire la continuité avec les mouvements révolutionnaires cubains du xx e siècle. La epidemia del coronavirus ha afectado profundamente las prácticas religiosas en casi todo el mundo pues las políticas de aislamiento obstaculizan el ejercicio comunitario de la vivencia espiritual propia de muchos cultos. Sin embargo para algunos sectores la pandemia ha posibilitado la generación de nuevas prácticas y formas de crear comunidad a la distancia utilizando para ello la web. Este documento es una reflexión general sobre las religiones mundializadas y el COVID-19, que busca aportar un elemento de análisis para entender (...) el islam latino y cómo se organiza frente a la crisis, pues veremos que a pesar de la pandemia el trabajo de proselitismo no sólo no se ha detenido, sino que se ha ampliado, a la par que se propone la creación de una ummah global. Y finalmente se da una idea general de la recomposición de una parte del islam latino y de ciertos grupos del islam mundializado. (shrink)
