The present debate in legal theory is dominated by an unfruitful schism. On the one hand, analytical theories are concerned with the positivity of law, running the risk of missing the law's relation to society. On the other hand, sociological approaches analyze all sorts of social interactions of law, but have developed no conceptual tools to do justice to the autonomy of law. The theory of autopoiesis offers law a chance of getting round the falsely posed alternative between an autonomous (...) rule system or a socially conditioned decision-making process. It is a theory of law that sees the law's autonomy in the self-reproduction of a communication network and understands its relation to society as interference with other autonomous communication networks. Building on the ideas of Humberto Maturana, Heinz von Foerster and Niklas Luhmann, Gunther Teubner uses the concepts of self-organization and autopoiesis to develop a concept of law as a hypercyclically closed social system. This book will stand as a landmark in legal theory and become a standard point of departure in the sociology of law. (shrink)

Niklas Luhmann and Jacques Derrida start with a common assumption in their analyses of the law and the economy - the foundational paradox of social institutions. But then autopoiesis and deconstruction move into opposite directions. Luhmann pursues the question of how de-paradoxification constructs the immanence of social institutions and builds a world of autopoietic social systems. By contrast, Derrida's thought aims at the transcendence of social institutions through their re-paradoxification. However, there is a hidden supplementarity of autopoiesis and deconstruction which (...) makes it worthwhile to relate the theories to each other. Derrida's distinction of writing/speech is necessarily blind toward Luhmann's distinction of consciousness/communication, but is, at the same time, continuously provoked by it. On another level, the opposite happens. Luhmann's autopoiesis is permanently irritated by Derrida's différance but is at the same time unable to conceptualize it. This complementary blindness of their distinctions directrices is a permanent source of mutual irritation which requires a reformulation of the social and of the possibility of justice. (shrink)

What are the consequences of modernity for the institution of contracting? As the unity of the traditional contract is dissolved into a multiplicity of separate contracting worlds, the binding force of contracting needs to be reformulated from an interpersonal to an interdiscursive relation. The central thesis of this Article is that the unity of contracting is hidden in the blind spot of the distinction between contracting worlds. Contracting needs two diametrically contradictory but complementary theories which cannot be integrated into a (...) synthesis. As demonstrated with the example of the expertise contract, the subtle interplay of different contracting worlds depends basically on a fragile symmetry of chances of translation. The normative correlate of contract understood as translation between different worlds of meaning would be an extension of constitutional rights into the context of private governance regimes. The disastrous AIDS epidemic, the numbers killed by which worldwide have overtaken those of the dead in all civil wars of the 90s, took a special turn in South Africa with the legal case “Hazel Tau vs. Glaxo and Boehringer”. The case translates the multidimensional social issues into the narrower quaestiones juris : has the pricing policy of transnational pharmaceutical enterprises violated fundamental human rights? Can AIDS patients assert their right to life directly against transnational corporations? Does “Access to Medication (...) as a Human Right” exist in the private sector? More generally, do fundamental rights obligate not only States, but also private transnational actors directly? (shrink)

Globalization processes imply the self-deconstruction of the hierarchy of legal norms. Thus, legal pluralism is no longer only an issue for legal sociology, but becomes a challenge for legal practice itself. Traditionally, rule making by `private regimes' has been subjugated under the hierarchical frame of the national constitution. When this frame breaks, then the new frame of legal institutions can only be heterarchical. The origin of global non-state law as a sequence of recursive legal operations is an `as if', not (...) only a founding myth as a self-observation of law, rather the legal fiction of concrete past operations. This fiction, however, depends on social conditions outside legal institutions, on a historical configuration in which it is sufficiently plausible to assume that in earlier times, too, legal rules were applied. The present debate on constitutional rights aims to protect the individual against the intrusive power of the state. Analysing the precarious relationship between art and money, the authors argue that constitutional rights need to be extended into the regimes of private governance. This requires four fundamental changes. (1) Constitutional rights can no longer be limited to the protection of individual actors. Instead, they need to be extended to guarantees of freedom of discourses. (2) The new experience of the twentieth century (...) is that totalizing tendencies have their origin not only in politics, but also in other fields of action, especially in technology, science, and the economy. Thus, a discursive concept of constitutional rights should be directed against any social system with totalizing tendencies. (3) Instead of concentrating on centres of economic and social power, constitutional rights in the private sphere should focus on the specific communicative medium of the expansionist social system involved. (4) This excludes the direct analogy of a ‘right’ as a quasispatial exclusion zone. More significant guarantees of discursive autonomy could be found in a ‘proceduralization’ of constitutional rights. (shrink)

The contemporary global crisis can be explored in different perspectives. This text focuses on constitutionalism. It asks whether constitutionalism still matters. Responding to this question requires revisiting the basic analytical and normative concepts that shape individual autonomy, polity, law and democracy in the context of globalization. Part I of the article introduces the question of the crisis of constitutionalism. It briefly explores the dispute between proponents of state and post-state constitutionalism, and proceeds with an analysis of societal constitutionalism. The critical (...) reading of this theory prepares the ground for a positive normative argument. Part II of the article argues for the return to the moral core of constitutionalism. It defends the claim that justice at the global stage requires establishing a minimum common denominator that would be composed of universalizable substantive principles. The institutional question follows. Its focus should be on the authoritative identification, protection and advancement of the core values of constitutionalism in the social and legal-political realms of the world society. (shrink)

Este artigo tem como objetivo central analisar a necessidade de repensar o Direito e, em particular, o Constitucionalismo, devido às constantes transformações sociais e à crescente complexidade das relações interconectadas na sociedade global. Inicialmente, aborda-se o Direito Constitucional como uma teoria do conhecimento, explorando as três matrizes epistemológicas que permitem analisar o Constitucionalismo em diferentes contextos históricos. O problema central envolve a busca por uma teoria adequada para analisar e propor soluções para questões jurídicas globais, destacando a abordagem pragmática-sistêmica baseada (...) na Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann. Com ênfase nessa matriz epistemológica, o artigo explora a Teoria dos Sistemas Sociais de Luhmann, bem como diferentes abordagens para a Autopoiese e a terceira fase do constitucionalismo, o Constitucionalismo Social, com foco nos Fragmentos Constitucionais, teoria desenvolvida por Gunther Teubner. A justificativa para essa análise baseia-se na adequação da Teoria dos Sistemas Sociais em um contexto pós-moderno, onde problemas e respostas jurídicas transcendem fronteiras nacionais. O artigo adota uma metodologia sistêmico-construtivista com base nos pressupostos da sociologia de Luhmann e utiliza abordagens monográficas e técnicas bibliográficas para explorar abordagens contemporâneas em Direito Constitucional. Conclui-se que, diante dos desafios jurídicos globais, o Constitucionalismo tradicional limitado aos Estados Nacionais é insuficiente, e a Teoria dos Sistemas Sociais Autopoiéticos de Niklas Luhmann oferece uma abordagem adequada para lidar com a crescente complexidade. Any satisfactory model of the emotions must at once recognize their place within intentional psychology and acknowledge their uniqueness as mental causes. In the first half of the century, the James-Lange model had considerable influence on reinforcing the idea that emotions are non-intentional (see Lange 1885 and James 1890). The uniqueness of emotions was therefore acknowledged at the price of denying them a place within intentional psychology proper. More recently, cognitive reductionists (including identity theorists) like Robert Solomon and Joel Marks (...) recognize that emotions are intentional but, by reducing them to judgments, beliefs, desires, etc., fail to capture their distinctiveness as mental causes (see Solomon 1976 and Marks 1982). In other words, their place within intentional psychology is acknowledged at the price of denying them their uniqueness. (shrink)

‘Language and End Time’ is a translation of Sections I, IV and V of ‘Sprache und Endzeit’, a substantial essay by Günther Anders that was published in eight instalments in the Austrian journal FORVM from 1989 to 1991 (the full essay consists of 38 sections). The original essay was planned for inclusion in the third (unrealised) volume of The Obsolescence of Human Beings. ‘Language and End Time’ builds on the diagnosis of ‘our blindness toward the apocalypse’ that was advanced in (...) the first volume of The Obsolescence in 1956. The essay asks if there is a language that is capable of making us fully comprehend the looming ‘man-made apocalypse’. In response to this, it offers a critique of philosophical jargon and of the putatively ‘objective’ language of (nuclear) science, which are both dismissed as unsuitable. Sections I, IV and V introduce this core problematic. The selection of this text for inclusion in this special journal issue responds to present-day realities that inscribe Anders’s reflections on nuclear science and the nuclear situation into new contexts. The critique that ‘Language and End Time’ advances resonates with the way in which the (undemocratic) decisions of a few companies and individuals are shaping the future of life on earth. At the same time, the wider stakes of Anders’s turn against the language employed by (weapons) scientists are newly laid bare by the realities and politics of climate change and fake news. In this new context, the language of science is all too readily dismissed as if it were a mere idiom that can be ignored without consequence. It is against the backdrop of a future that is, if anything, more uncertain than at the time of Anders’s writing, that the essay’s reflections on popularisation, the limits of language and the nature of truth gain added significance. Composer, conductor, educator, jazz critic, and horn virtuoso, Gunther Schuller here brings together his writings on music. There are numerous articles about jazz, dealing with his favourite figures like Duke Ellington and Ornette Coleman, and also Schuller's concept of the 'Third Stream', the area where jazz and concert music intersect. Other sections deal with the composition and performance of contemporary music, musical education, and musical aesthetics.

The paper is concerned with Quine's substitutional account of logical truth. The critique of Quine's definition tends to focus on miscellaneous odds and ends, such as problems with identity. However, in an appendix to his influential article On Second Order Logic, George Boolos offered an ingenious argument that seems to diminish Quine's account of logical truth on a deeper level. In the article he shows that Quine's substitutional account of logical truth cannot be generalized properly to the general concept of (...) logical consequence. The purpose of this paper is threefold: first, to introduce the reader to the metamathematics of Quine's substitutional definition of logical truth; second, to make Boolos' result accessible to a broader audience by giving a detailed and self-contained presentation of his proof; and, finally, to discuss some of the possible implications and how a defender of the Quinean concepts might react to the challenge posed by Boolos' result. Following decades of neglect, the work of the German Jewish philosopher, literary author, cultural critic, and poet Günther Anders (1902–1992) is gaining increasing recognition in the English-speaking world. This translation of “Résistance heute” (Resistance Today) makes one of Anders’s most programmatic and polemical short texts available. Published at the height of his anti-nuclear activism, “Resistance Today” is the written version of a speech Anders delivered in November 1962 upon acceptance of the northwest Italian city of Omegna’s Resistance Prize (other notable (...) recipients included Jean-Paul Sartre and Frantz Fanon). It first appeared in print in the West German left-wing journal Das Argument in November 1963. Clearly written for the occasion, the text condenses (and often further radicalizes) key premises about the end of history, the amoral character of work, and the continuity between Nazi totalitarianism, the nuclear age and the world of consumerism that are developed in great nuance across a range of books that Anders had recently published. Key co-ordinates include: Die Antiquiertheit des Menschen 1 (The Obsolescence of Human Beings 1, 1956), his groundbreaking critique of technology; Der Mann auf der Brücke (The Man on the Bridge, 1959), a philosophical travel diary occasioned by Anders’s 1958 visit to Japan and his participation at the World Conference Against Atomic and Hydrogen Bombs in Tokyo; Burning Conscience (1961), a correspondence with the American reconnaissance pilot Claude Eatherly, who scouted the target area before the Enola Gay went on to drop the atom bomb on Hiroshima. It seems likely that Burning Conscience, which turned into an international bestseller, occasioned the award of the prize. (shrink)

In the dissertation I provide a framework for assessing arguments intended to establish nonconceptual thought and for presenting my own case based on the emotions. Drawing on the work of Frege, I motivate three principles for individuating conceptual thought which I derive from his notion of sense. For a thought to be conceptual, I claim, it must be distinct from its force, be individuated by its cognitive significance, and determine its reference or correctness conditions. The nonconceptualist's objective, I contend, is (...) to cite a thought which violates at least one of these principles and which plays an unquestionable role in explaining the actions of mature human beings. ;With the framework in place, I turn to recent arguments for nonconceptual thought presented by Peacocke, Evans, Stalnaker, Dretske and others. The point of the review is not only to map the positions of this uncharted debate but to expose contentious assumptions. For example, there is a tendency among theorists to regard nonconceptual thought as more primitive than conceptual thought, as thought through which concepts should be grounded or to which they should be reduced. However, it is apparent that such uses of 'nonconceptuality' often presuppose controversial views about the epistemology of perception and the ontology of concepts. To steer clear of these contentious assumptions, I turn to the emotions, developing a case for nonconceptual thought which does not presuppose that its explanatory value depends on controversial ontological or epistemological agendas. ;The argument I present centers on the content/force distinction. Drawing on speech act theory, I claim that emotions conflate content and force which is most clearly illustrated by the resistance of emotional contents to inferential structure and their logical basicness. The conflation not only helps to explain the arational and ineffable character of nonconceptual thought but also suggests its dependence on conceptual thought, illustrated by the way emotional experiences generally presuppose higher cognitive states like beliefs or judgements. While this reversal of dependency may seem counterintuitive to those who cling to certain epistemological and ontological assumptions, the model has far-reaching implications for theories of content and computation. Philosophers of mind have recently sought to establish a theoret- ical use for nonconceptual content. Although there is disagreement about what nonconceptual content is supposed to be, this much is clear. A state with nonconceptual content is mental. Hence, while one may deny that refrigerators and messy rooms have conceptual capacities, their states, as physical and not mental, do not have nonconceptual content. A state with nonconceptual content is also intentional, which is to say that it represents a feature of (...) the world for a subject. It may be tempting to think of qualitative states as having nonconceptual content since they can be experienced by indi- viduals independently of their possession of the requisite concepts, e.g. someone could experience pains, itches or tingles without possessing the concept pain, itch or tingle. But on such a view, one would have to assume that qualitative states are representational since mental states cannot be candidates for nonconceptuality unless they have intentional properties.2. When two or more people coordinate their actions in space and time to produce a joint outcome, they perform a joint action. The perceptual, cognitive, and motor processes that enable individuals to coordinate their actions with others have been receiving increasing attention during the last decade, complementing earlier work on shared intentionality and discourse. This chapter reviews current theoretical concepts and empirical findings in order to provide a structured overview of the state of the art in joint action research. We (...) distinguish between planned and emergent coordination. In planned coordination, agents' behavior is driven by representations that specify the desired outcomes of joint action and the agent's own part in achieving these outcomes. In emergent coordination, coordinated behavior occurs due to perception action couplings that make multiple individuals act in similar ways, independently of joint plans. We review evidence for the two types of coordination and discuss potential synergies between them. (shrink)

Should decision-making algorithms be held to higher standards of transparency than human beings? The way we answer this question directly impacts what we demand from explainable algorithms, how we govern them via regulatory proposals, and how explainable algorithms may help resolve the social problems associated with decision making supported by artificial intelligence. Some argue that algorithms and humans should be held to the same standards of transparency and that a double standard of transparency is hardly justified. We give two arguments (...) to the contrary and specify two kinds of situations for which higher standards of transparency are required from algorithmic decisions as compared to humans. Our arguments have direct implications on the demands from explainable algorithms in decision-making contexts such as automated transportation. (shrink)

The article investigates one of the key contributions to modern structural mathematics, namely Hilbert’sFoundations of Geometry(1899) and its mathematical roots in nineteenth-century projective geometry. A central innovation of Hilbert’s book was to provide semantically minded independence proofs for various fragments of Euclidean geometry, thereby contributing to the development of the model-theoretic point of view in logical theory. Though it is generally acknowledged that the development of model theory is intimately bound up with innovations in 19th century geometry (in particular, the (...) development of non-Euclidean geometries), so far, little has been said about how exactly model-theoretic concepts grew out of methodological investigations within projective geometry. This article is supposed to fill this lacuna and investigates this geometrical prehistory of modern model theory, eventually leading up to Hilbert’sFoundations. (shrink)
