Transparency’s importance as an administrative norm seems self-evident. Prevailing ideals of political theory stipulate that the more visible government is, the more democratic, accountable, and legitimate it appears. The disclosure of state information consistently disappoints, however: there is never enough of it, while it often seems not to produce a truer democracy, a more accountable state, better policies, and a more contented populace. This gap between theory and practice suggests that the theoretical assumptions that provide the basis for transparency are (...) wrong. This article argues that transparency is best understood as a theory of communication that excessively simplifies and thus is blind to the complexities of the contemporary state, government information, and the public. Taking them fully into account, the article argues, should lead us to question the state’s ability to control information, which in turn should make us question not only the improbability of the state making itself visible, but also the improbability of the state keeping itself secret. Murray Edelman's work raised significant theoretical and methodological questions regarding the symbolic nature of politics, and specifically the role played by non‐rational beliefs (those that lack real‐world grounding) in the shaping of political preferences. According to Edelman, beneath an apparently functional and accountable democratic state lies a symbolic system that renders an ignorant public quiescent. The state, the media, civil society, interpersonal relations, even popular art are part of a mass spectacle kept afloat by empty symbolic beliefs. However suggestive it (...) is, the weaknesses of Edelman's theoretical and methodological approach, and the relative strengths of more recent research on the politics of cultural symbols, render Edelman's work unable to serve as either model or springboard for the contemporary study of political symbols. This article critically examines the 1992 decision by the Supreme Court of Canada on pornography (Butler v. the Queen). The decision, like the LEAF (Legal Education Action Fund), argues that the dehumanizing and degrading images of women in pornography undermine the achievement of gender equality and reinforce existing inequality. Section 15 of Canada's Charter of Rights and Freedoms takes precedence over Section 2(b) freedom of expression. More immediately, Section 163(8) of the Criminal Code of Canada remains the primary instrument for (...) dealing with pornography. These arguments fail to distinguish between degradation and devaluation; they offer no evidence of a connection between pornography and its effects on gender stratification, nor do they feel obliged to offer such evidence despite the extensive literature on inequality by the social science community. Citing the Sears-Roebuck case on gender discrimination, the author demonstrates that the enemy of gender equality is the stereotype of the idealized traditional woman, not the one-dimensional lust-driven nymphomaniac of pornography. Her opposite is not the "stud" of pornography who is in a constant state of tumescence but "economic man" who sublimates his sexual passion in sports, cars, politics, and money. Censorship, it is suggested, infantilizes women and contributes to their dependency. The article comments on the doctrine of "balancing" rights and on the meaning of "equality" within a feminist context. The larger questions of a trend toward the legalization of cultural issues and the role of the judiciary (weak in European democracies but strong in the American tradition) are raised. (shrink)

ABSTRACT One of Murray Edelman’s most important insights was that understanding public ignorance about politics and policy requires an analysis of how symbolic communication and popular culture shape public knowledge and opinion. Approaches that simply dismiss the public as ignorant or idiotic make a similar error as those that simply embrace the modern public as capable of engaging in the work of a competent demos, insofar as both simplify complex social and cultural processes of meaning‐making and comprehension. The problem for (...) those who wish to take Edelman’s insight seriously—a problem that Edelman failed to resolve—is precisely how to study and theorize the public as something less than deliberative and knowledgeable, but more than simply ignorant. This essay describes the emergence of the 9/11 attacks on the World Trade Center and Pentagon as an object of conspiratorial intrigue and imagination, offering a snapshot of the “9/11 truth movement” and its various theories as they began to reach full bloom. Theories about the attacks have come to constitute the dominant conspiratorial present – a present that looks remarkably like the mid- and late-twentieth-century past, despite significant changes in information technology and the continuing institutionalization and ironization of conspiracy (...) theory as an influential form of popular politics. In addition to the 9/11 conspiracy community, the essay considers the battle over the 9/11 Commission’s review of the government’s failure to anticipate the terrorist attacks. The Commission engaged in knowing and savvy efforts to respond to conspiracy theories and to preempt popular belief in them, offering an authoritative narrative (or, more precisely, set of narratives) to explain what occurred. Meanwhile, the 9/11 truth movement made equally knowing and savvy efforts to critique the official account, responding with its own efforts to reinterpret and re-narrate the attacks, their causes, and what they signify about the contemporary world. While the 9/11 Commission may have criticized the federal government and its intelligence services for their failures of imagination prior to the attacks, the truth movement criticized the Commission either for a failure of imagination – an explanation for the attacks that could see through the “official” account – or for a quite imaginative cover-up of the hidden truths of 9/11. By considering the clash between official authorities and an active conspiracy community, this essay considers how the movement attempted to form a collective political and scholarly community, producing a blizzard of texts offering narratives that compete with the ones told by the Commission that seek the impossible grail of conspiracy theory: the truth. The essay also considers the effects, if any, of the state’s attempt to preempt and respond to conspiracy theories. (shrink)

ABSTRACT A review of two of the strands of cultural studies that Mark Fenster contends are superior to Murray Edelman’s analysis of mass public opinion—Gramsci’s theory of hegemony, and Bourdieu’s sociology—and a more general look at work in the field of cultural studies suggests that all of these alternatives suffer from severe theoretical and methodological limitations. Future studies of culture and politics need to pose questions similar to the ones that preoccupied Edelman, but they must move beyond the political (...) and interpretive biases that have dominated cultural studies (some of which Edelman shared), as well as the questionable view of “ideology” as a matter of elite domination of the masses, rather than as a mediating, constitutive force in the process of individual opinion formation. In their debate about whether Cultural Studies is helpful for understanding public ignorance, Chris Wisniewski and Mark Fenster view ignorance as inevitably plaguing the public in mass democratic society; and they see ?the public? as an abstract entity. However, Pierre Bourdieu's sociology rightly contests these positions. A thorough investigation of the concrete social conditions of political ignorance reveals that ignorance is unevenly dispersed throughout social space and that its relevance depends on social position, such as that of the advantaged (...) and disadvantaged. Such a comprehensive approach to public ignorance is required for advancing political participation among the least advantaged. (shrink)

In the ongoing debate about the impact that studies of public ignorance should have on the study of culture, Mark Fenster and Bret Chandler assume that wider political participation must be our goal, because, to them, political ignorance is a culturally imposed, and therefore removable, obstacle—as if, without the baleful influence of culture, political participants would be well informed. Culture is indeed a primary influence on people's political opinions, so political scientists should indeed study the role it plays in (...) the formation of political beliefs. But such studies should begin with ignorance as people's default position, and should refrain from assuming that the source of ignorance is cultural domination or manipulation. (shrink)

This paper gives an ethical argument for temporarily waiving intellectual property protections for COVID-19 vaccines. It examines two proposals under discussion at the World Trade Organization : the India/South Africa proposal and the WTO Director General proposal. Section I explains the background leading up to the WTO debate. Section II rebuts ethical arguments for retaining current IP protections, which appeal to benefiting society by spurring innovation and protecting rightful ownership. It sets forth positive ethical arguments for a temporary waiver that (...) appeal to standing in solidarity and holding companies accountable. After examining built-in exceptions to existing agreements and finding them inadequate, the paper replies to objections to a temporary waiver and concludes, in section III, that the ethical argument for temporarily waiving IP protection for COVID-19 vaccines is strong. This paper is a technical study of the systematic observations and computations made by Muḥyī al-Dīn al-Maghribī (d. 1283) at the Maragha observatory (north-western Iran, c. 1259–1320) in order to newly determine the parameters of the Ptolemaic lunar model, as explained in his Talkhīṣ al-majisṭī, “Compendium of the Almagest.” He used three lunar eclipses on March 7, 1262, April 7, 1270, and January 24, 1274, in order to measure the lunar epicycle radius and mean motions; an observation on April 20, (...) 1264, to determine the lunar eccentricity; an observation on August 29, 1264, to test the model; and another on March 15, 1262, for measuring the lunar parallax. In the second period of activity at the Maragha observatory, Shams al-Dīn Muḥammad al-Wābkanawī (c. 1254–1320) adopted all of al-Maghribī’s parameter values in his Zīj, but decreased his value for the mean longitude of the moon at epoch by 0;13,11∘\documentclass[12pt]{minimal} \usepackage{amsmath} \usepackage{wasysym} \usepackage{amsfonts} \usepackage{amssymb} \usepackage{amsbsy} \usepackage{mathrsfs} \usepackage{upgreek} \setlength{\oddsidemargin}{-69pt} \begin{document}$$^{\circ }$$\end{document}. In Amartya Sen’s The Idea of Justice, democracy is necessary for the reconciliation of plural justice claims. Sen’s treatment of democracy is however incomplete and inadequate: democracy is under-specified, there are unrecognized difficulties in any context featuring deep moral disagreement or deep division and a conceptualization of public reason in the singular erodes his pluralism. These faults undermine Sen’s account of justice. Developments in the theory of deliberative democracy can be deployed to remedy these deficiencies. This deployment points to a (...) deliberative system encompassing those affected by collective decisions, with places for non-partisan forums and discursive representatives, conditionally open to multiple forms of communication, and geared to the production of workable agreements under normative and discursive meta-consensus. Democracy does not guarantee justice, but in a plural world it is essential to the pursuit of justice. (shrink)

This paper describes how some aspects of Martin Heidegger’s philosophy resonate strongly with an engineering outlook. He argued that practice was more “primordial” than theory, though preserving an important role for theoretical understanding as well, thus speaking to the gap between engineering education (highly theoretical) and engineering practice (mostly empirical). He also underlined the reality of “average” practices into which we are socialized, though affirming the potential for original work and action too, thus providing the grounds for self-actualization whether within (...) the routine or in transcending it. His notion of “thrownness” emphasizes the importance of context, with which engineers are constantly engaged. While all this relates to the idea of our “being”, Heidegger also dealt with the influence of time on our practices. Future death could be seen as spurring innovation, cultural history as a source for critiquing current practice and the present “situation” as the immediate context for corrective action. This is a book about ekphrasis, about the Aeneid, about ancient Greek and Latin literature, about poetry and poetics, and about the ways in which literature can affect the way we live our (...) lives. But most of all, it is a tremendous book on the Aeneid.The six chapters focus on notable points of ekphrasis: Dido's Murals, the Cloak of Cloanthus, Daedalus' Sculptures, Silvia's Stag, the Shield of Aeneas, and the Baldric of Pallas. The dominant figure characterizing ekphrasis in the Aeneid is synecdoche: that is, ekphrasis, Putnam shows us, serves as a mise en abîme in the Aeneid, in which the circularity of ekphrasis both interrupts and comments on the narrative linearity of epic (97, 204, passim). Ekphrasis and epic complement and analogize one another, and therein Virgil is teaching us about major themes of the Aeneid. The most abstract of these themes can perhaps be paraphrased as follows: epic poetry is linear, historical, teleological, and temporal; ekphrasis, something of a lyric mode within epic, is circular, repetitious, and atemporal. The linearity of history becomes a falsifying teleology, a deceptive myth of progress. This is counterbalanced by the ekphrases; their circularity, both in form and content, points to the circular, cyclical nature of history--there is, in the end, no progress (see, e.g., 31, 42, 46, 61, 154-55, 209).Most of what I think is important about ekphrasis is in this book; moreover, much that I had never considered before now seems obvious, after reading it. I cannot, however, summarize the book, and what follows is an exhortation, rather than an outline. The force of Putnam's analysis does not lend itself well to summary, even his own--it would be a mistake to read merely his introduction and conclusion. Reading Putnam I am reminded of William Blake's Assumption of Total Significance, as named and brought to us again by the linguist Háj Ross: this is the assumption that any and every aspect of a text (or other work of art) has the potential to be of the utmost importance. Putnam proves this by his own practice, tracing threads of meaning and resonance from the specific details of the language of the text, with interpretation both bold and securely grounded. In doing so, he shows and recommends a fruitful, almost Emersonian, faith in the individual passage as a microcosm (as synecdoche, as a mise en abîme), a faith borne out in spades by his analysis. At times, some readers will not accept his interpretations, but this is not a problem. Putnam invites [End Page 324] us to go with him on a slow, careful walk through the Aeneid; if we do not see what he sees, that is fine; but he tells us carefully, forcefully, and with great clarity why he himself sees it. Those who are rapid readers may thus not understand the significance of this book and may likely give it short shrift: the best of it cannot be skimmed. But then such rapid readers are very unlikely to understand or care about poetry, especially Virgilian poetry. The details of Virgil's language and the detail of Putnam's discussion are what will, in William Carlos Williams's phrase, "startle us anew."It is most useful, then, to give a sample, but it is not easy to choose. To my mind, the most compelling chapter is that on Daedalus. The association of Virgil and Daedalus is powerfully illustrated; Putnam argues that in Daedalus Virgil is giving us his own "spiritual and psychic" biography as an artist. Neither artist can idealize, neither can bring to completeness, neither can accept the tempting comfort of beauty, the "veneer of charm over terrible truths," and neither can help but see "nature's final pyrrhic triumph over art" (e.g., 84, 91, 94, 95). Taking an analytic and historical approach, this work develops and defends Althusserian critical theory. This theory, it is argued, produces knowledge of how a particular class of people, in a particular time, in a particular place, is dominated, oppressed, or exploited. Moreover, without relying on a general notion of human emancipation, concrete critical theory can suggest political means for the alleviation of these conditions. Because it puts Althusser’s ideas in dialogue with contemporary social science and philosophy, the book as a (...) whole makes contributions to Althusser studies, to Anglo-American political philosophy, and to current debates in the philosophy of the social sciences.
