The dissertation provides a critical comparison of the theories of John Rawls and Alasdair MacIntyre with particular attention to the question of identity. The theme of true persuasion as situated by the concepts of eros and logos in Plato's Phaedrus is developed and applied to two contemporary understandings of the person. I suggest explanations for the paradoxical way in which Rawls and MacIntyre tend to read their understandings of identity in terms of the understandings of citizenship. An idiom of Will (...) elaborated in each theorist's view of politics and rationality results in a conflation of person and citizen and the reduction of true persuasion to public philosophy. BackgroundWe assessed potential consent bias in a cohort of > 40,000 adult patients asked by mail after hospitalization to consent to the use of past, present and future clinical and biological data in an ongoing ‘general consent’ program at a large tertiary hospital in Switzerland.MethodsIn this retrospective cohort study, all adult patients hospitalized between April 2019 and March 2020 were invited to participate to the general consent program. Demographic and clinical characteristics were extracted from patients’ electronic health records (EHR). Data (...) of those who provided written consent (signatories) and non-responders were compared and analyzed with R studio.ResultsOf 44,819 patients approached, 10,299 (23%) signed the form. Signatories were older (median age 54 [IQR 38–72] vs. 44 years [IQR 32–60], p <.0001), more comorbid (2614/10,299 [25.4%] vs. 4912/28,676 [17.1%] with Charlson comorbidity index ≤ 4, p <.0001), and more often of Swiss nationality (6592/10,299 [64%] vs. 13,813/28,676 [48.2%], p <.0001).ConclusionsOur results suggest that actively seeking consent creates a bias and compromises the external validity of data obtained via ‘general consent’ programs. Other options, such as opt-out consent procedures, should be further assessed. (shrink)

Conscious perception, like the sight of a coffee cup, seems to involve the brain identifying a stimulus. But conscious input activates more brain regions than are needed to identify coffee cups and faces. It spreads beyond sensory cortex to frontoparietal association areas, which do not serve stimulus identification as such. What is the role of those regions? Parietal cortex support the ‘first person perspective’ on the visual world, unconsciously framing the visual object stream. This three-part paper presents Gordon Pask’s conversation theory (CT) and interaction of actors theory (IA) and outlines ways to apply these cybernetic approaches to designing technologies and scenarios for both formal and informal learning. The first part of the paper covers concepts central to CT and IA, explaining the relationship between conceptual and mechanical operators, and machines mediating informal and formal learning. The second part of the paper applies visual representations of CT and IA to understanding the use of Pask’s (...) course assembly systems (CASTE and THOUGHTSTICKER), created between the late 1960s and the 1980s, and the ThoughtShuffler search interface, created in the 2010s. The third part proposes two pathways for design based on CT and IA: firstly, the potential for designers and observers to reformulate the qualities of tools and learning scenarios to augment human thinking and collective action; and secondly, the possibility to create tools with malleable interfaces that allow users to become intermediaries rather than consumers of knowledge. This study is based on the self-reporting by circus artists’ concerning their injuries. We refer to the theoretical framework of emersiology and argue that circus artists may be able to soothe their distress and pain by learning through their body. We will draw further on the comparison between our therapeutic approach and the techniques of self-care introduced by Michel Foucault in his History of Sexuality.

By considering the slave's critical appropriation of the natural rights doctrine, the ambiguous implications of various notions of consent and liberty are examined. This paper presents a concept for pattern matching based on a parameter optimization system for approximative numerical calculation of some parameter combination under soft and hard constraints. The concept uses a non-linear parameter optimization method with an iterative variation of parameters. The paper focuses on the information modeling process to migrate problem-domain specific criteria into optimization-compatible objects suitable for a standardized parameter optimization procedure. A step-by-step transformation process is presented and implemented in object-oriented programming: classes and interfaces. InWorld Poverty and Human Rights, Thomas Pogge presents a range of attractive policy proposals—limiting the international resource and borrowing privileges, decentralizing sovereignty, and introducing a “global resources dividend”—aimed at remedying the poverty and suffering generated by the global economic order. These proposals could be motivated as a response topositive dutiesto assist the global poor, or they could be justified onconsequentialistgrounds as likely to promote collective welfare. Perhaps they could even be justified onvirtue-theoreticgrounds as proposals that a just or benevolent (...) person would endorse. But Pogge presents them as a response to the violation ofnegative duties; this makes the need for such remedial policies especially morally urgent—on a par with the obligations of killers to take measures to stop killing.In this essay, I focus on the claim that responsibility for world poverty should be conceived in terms of a violation of negative duties. I follow Pogge in distinguishing two questions (p. 134): What kind of duties (positive or purely negative?) would we be subject to in a just global society where everyone fulfilled their duty and there was no significant risk of injustice? And what kind of duties (positive or purely negative?) do we face given that our global society falls short of the just society?I tackle these questions in reverse order below. I argue, in contrast to Pogge, that positive duties are relevant to our answers to both questions. (shrink)

The United States Fish and Wildlife Service in Alaska, USA, conducted a species status assessment for a petition to list the Alexander Archipelago wolf (Canis lupus ligoni) under the Endangered Species Act in 2020-2022. This federal undertaking could not be adequately prepared without including the knowledge of Indigenous People who have a deep cultural connection with the subspecies. Our objective is to communicate the authoritative expertise and voice of the Indigenous People who partnered on the project by demonstrating how their (...) knowledge contributed to the species status assessment. The Indigenous knowledge applied in the assessment is the cultural and intellectual property of those who have shared it. We employed rapid appraisal research to expeditiously develop a preliminary and qualitative understanding of Indigenous People's cultural and ecological knowledge of Alexander Archipelago wolves. We used semi-directed interviewing and inductive coding from grounded theory for text analysis. Indigenous knowledge contributed to the agency's understanding of the Alexander Archipelago wolf in Southeast Alaska and helped the agency with their classification decision. Indigenous research partners explained the rich cultural significance and position of wolves in Tlingit society and described human–wolf relationships and ecological interactions. The agency used a single-species assessment approach based in species ecology and conservation biology, whereas the Indigenous wolf experts applied a multi-species, community ecology approach based in a sociocultural context of balance and respect. The Indigenous wolf experts successfully addressed knowledge gaps identified by the agency. The partners were challenged by a short regulatory timeframe that did not allow for comprehensive study of Indigenous knowledge and constrained review and feedback by Indigenous experts. The United States Fish and Wildlife Service learned that its assessment framework was not designed to account for an Indigenous worldview. To level the playing field, the agency and Indigenous experts should discuss how to co-develop an assessment framework that equitably applies both perspectives. (shrink)

The study of eye movements is a common way to non-invasively understand and analyze human behavior. However, eye-tracking techniques are very hard to scale, and require expensive equipment and extensive expertise. In the context of web browsing, these issues could be overcome by studying the link between the eye and the computer mouse. Here, we propose new analysis methods, and a more advanced characterization of this link. To this end, we recorded the eye, mouse, and scroll movements of 151 participants (...) exploring 18 dynamic web pages while performing free viewing and visual search tasks for 20 s. The data revealed significant differences of eye, mouse, and scroll parameters over time which stabilize at the end of exploration. This suggests the existence of a task-independent relationship between eye, mouse, and scroll parameters, which are characterized by two distinct patterns: one common pattern for movement parameters and a second for dwelling/fixation parameters. Within these patterns, mouse and eye movements remained consistent with each other, while the scrolling behaved the opposite way. (shrink)

Historians of technology have provided important accounts of technological innovation, but they rarely employ concepts which permit a rigorous analysis ofinvention as a mental or cognitive process. This article seeks to address this theoretical lacuna by using concepts adapted from cognitive psychology to compare the mental processes of two telephone inventors, Alexander Graham Bell and Thomas Edison. Specifically, we suggest that invention may be seen as a process in which inventors combine ideas with objects, or what we call mental (...) models and mechanical representations. The strategies by which inventors generate and manipulate these mental models and mechanical representations are what we refer to as heuristics. Using these concepts to narrate the development of the telephone, this article shows how invention can be interpreted as being much more than simply a mysterious act of individual genius. (shrink)
