L'histoire sociale du XIXe siècle ne semble pouvoir s'écrire sans bibliothèque littéraire, sans recours aux descriptions laissées par la littérature de l'époque. Tentant de convertir cette fatalité en objet de réflexion, cet article veut suggérer combien les méthodes et les sources de l'histoire du livre et de la lecture peuvent contribuer à la constitution d'une histoire sociale du XIXe siècle plus réflexive. Il souligne la prolifération de descriptions sociales dans les années 1830 et 1840, où se forge à proprement parler (...) un imaginaire social, un répertoire de représentations textuelles et iconographiques de la société. L'étude des appropriations dont ces textes furent l'objet- appropriations de lecteurs ordinaires ou débats critiques - montre à la fois combien la littérature réaliste a pu alors contribuer à la formulation des identités et des expériences sociales singulières d'individus ou de groupes et combien la question de la pertinence sociologique de ces fictions était âprement discutée. Le roman réaliste du premier XIXe siècle forme ainsi un élément majeur de la production du« social »et de ses images dans un univers culturel où la littérature était largement créditée d'une capacité à dire la vérité du monde. We theorize that social media will reduce the incidence of corporate greenwash. Drawing on the management literature on decoupling and the economic literature on information disclosure, we characterize specifically where this effect is likely to be most pronounced. We identify important differences between social media and traditional media, and present a theoretical framework for understanding greenwash in which corporate environmental communications may backfire if citizens and activists feel a company is engaging in excessive self-promotion. The framework allows us to draw (...) out a series of propositions regarding the impact of social media on corporate decisions whether to greenwash, and what channels to use for environmental communication. We posit and find evidence consistent with a new mechanism of intra-firm enforcement spillovers: the leakage of scarce compliance resources across facilities within a firm. Using a facility-level panel data set of Clean Air Act (CAA) enforcement actions from 2005 to 2017, we find a facility is more likely to violate the CAA following penalties on its same-industry-same-state siblings. In contrast, there is no significant spillover across firms. We show that the intra-firm spillover is not due to changes in regulatory (...) attention or production shifting. Instead, our results suggest it may result from the redeployment of scarce compliance resources across siblings. Consistent with this mechanism, we find compliance leakage only occurs at privately held firms and facilities that lack the resources to invest in pollution prevention. The findings contribute to understanding the efficacy of environmental enforcement and have important implications for intra-firm management of environmental performance and regulatory enforcement approaches. Corporate-level environmental information disclosure is increasingly common. This article studies the impact of a prominent media-generated sustainability ratings program, Newsweek’s 2009 ranking of the 500 largest U.S. firms. Using an event study methodology, the authors find the rankings had a significant impact on shareholder value. Firms in the top 100 experienced abnormal returns after the information release that were 0.6%–1.0% higher than returns of firms in the bottom 400. The form of the information released had significant effects as well. Nuanced (...) environmental score variables had no independent impact on market outcomes; only the final ranking mattered. This article also explores possible channels through which the rankings may have had their impact. Industrial emissions of greenhouse gases are significant contributors to climate change, which poses a grave threat to social and economic systems. Our understanding of what might drive firms to reduce their emissions of these gases, however, is incomplete, and it is not clear that the knowledge gained from other environmental issues will readily apply to these emissions. We argue and find that indicators of environmental injustice previously shown to relate to toxic pollutants, for example, are poor predictors of greenhouse gas (...) emissions. Instead, we show that the degree of belief in and concern about climate change in a local community is a significant predictor of the facility’s rate of emission improvements. Furthermore, we find that beliefs at both the facility and headquarter communities influence emission reduction, and that those effects are substitutes for each other. (shrink)

In struggling to free science from theological implications, Huxley let his own philosophical beliefs influence his interpretation of the data. However, he was certainly not unique in this respect. Like the creationists he despised, he made many important contributions to the issue of progression in the fossil record and its relationship to evolutionary theory. Certainly other factors were involved as well. Undoubtedly, just the sheer inertia of ideas played a role. He was committed to a theory of type and was (...) heavily influenced by von Baer, who argued that one could not rate the different types as being higher or lower than the others. By the mid-1850s his animosity toward Owen had become extreme and he tried to discredit the man whenever possible; yet, as I have pointed out, he also was more than willing to cite Owen's early work when it suited his needs.But I believe the crucial factor in Huxley's eventually accepting progression was that he finally disassociated it from the idea of divine plan. This happened gradually through the 1860s and 1870s, as more and more fossil finds provided support for Darwin's theory. In evaluating this new evidence that supported gradualism, Huxley also realized that progression was an intrinsic part of Darwin's theory:The hypothesis of evolution supposes that at any given period in the past we should meet with a state of things more or less similar to the present, but less similar in proportion as we go back in time... if we traced back the animal world and the vegetable world we should find preceding what now exist animals and plants not identical with them, but like them, only increasing their differences as we go back in time, and at the same time becoming simpler and simpler until finally we should arrive at that gelatinous mass which, so far as our present knowledge goes, is the common foundation of all life.In concluding his first lecture to the Americans, he told them: “The hypothesis of evolution supposes that in all this vast progression there would be no breach of continuity, no point at which we could say ‘This is a natural process,’ and ‘This is not a natural process.’”85 Finally for Huxley, progression was no longer linked to Divine Plan. Abstract: In Vacco v. Quill, 521 U.S. 793 (1997), the Supreme Court for the first time in American case law explicitly applied the principle of double effect to reject an equal protection claim to physician-assisted suicide. Double effect, traced historically to Thomas Aquinas, proposes that under certain circumstances it is permissible unintentionally to cause foreseen evil effects that would not be permissible to cause intentionally. The court rejected the constitutional claim on the basis of a distinction marked out by (...) the principle, i.e., between directly intending the death of a terminally ill patient as opposed to merely foreseeing that death as a consequence of medical treatment. The Court held that the distinction comports with fundamental legal principles of causation and intent. Id. at 802. -/- Critics allege that the principle itself is intrinsically flawed and that, in any event, its employment in Vacco is without legal precedent. I argue in response to contemporary objections that double effect is a valid principle of ethical reflection (Part II); claims to the contrary notwithstanding, double effect analysis is a pervasive, albeit generally unacknowledged principle employed regularly in American case law (Part III); and drawing on the preceding two sections, Vacco's application of the principle of double effect is appropriate (Part IV). -/- My conclusion is that [o]peration of some form of the principle, by whatever name, is inevitable. In an imperfect world where duties and interests collide, the possibility of choices of action foreseen to have both good and evil consequences cannot be avoided. In rare circumstances, ethics and the law require that a person refrain from acting altogether. The influential realist thesis that politics and morals are distinct and mutually exclusive spheres of interest is one that has been challenged within the tradition of analytic moral and political theory. Over the last 50 years, several notable liberal analytic philosophers, including Isaiah Berlin, Stuart Hampshire, and Thomas Nagel, have argued that not only is politics not separate from and inimical to ethics but that there exists such a thing as political morality. This article contends that while the notion (...) of political morality may make more sense of what is regarded as a central and troubling problem of politics, it also forces us to confront the more fundamental challenge of the radical contingency of our moral and political predicament. From, at least, the mid-fourth century until the mid-fifth-century AD a controversy concerning a seemingly trivial fact engaged Christian scholars: when did Methuselah die? Although most of the major Latin fathers were drawn into the fray — and echoes of the debate continued in Latin exegesis for another five centuries — this controversy has escaped historians and is today unknown. So this paper has a double task. First, uncover from its remnants what we can know of this problem that elicited (...) much exertion on the part of Jerome and Augustine at its height, and was discussed urgently before them by Hilary of Poitiers , and after them by Eucherius of Lyons . Second, to examine some of the effects of this controversy on the Latin theology, and, in particular, the Latin church’s understanding of scripture. While any conscious awareness of the controversy itself has disappeared, many of the ideas which underwent development in the controversy, such as the notion of inerrancy and of the fundamental role of the Hebrew text, became part of the life-blood of Latin theology. Pp. 475 (paper). In March of 1993 the Revue thomiste marked its centenary by sponsoring a three-day colloquium at the lnstitut Catholique of Toulouse on "St. Thomas in the 20th century." The commemoration resumed the following month with a conference at the University of Fribourg (Switzerland), site (...) of the journal's foundation. This volume assembles the papers presented at the Toulouse colloquium and a selection of those read in Fribourg. All of the contributions are in French. The volume opens with a letter (dated 11 March 1993) that His Holiness John-Paul II addressed to the Prior Provincial of the Toulouse Dominicans, under whose aegis the Revue thomiste is now published. The Pope pays tribute to the "lucid discernment" that has guided this journal in a "critical and constructive reflection on the major problems of our epoch, assuring it a place of choice in Catholic intellectual life" (p. 7). Next follows an editorial introduction by Serge-Thomas Bonino, O.P., who examines the pertinence of the Revue's motto vetera novis augere. Acknowledging that the Thomistic revival of this century has largely proven to be unsuccessful, to judge by the extent of its cultural impact, he concludes nevertheless that this failure may pave the way for an eventual renewal, on condition that the past achievements and deficiencies of Thomism come to be adequately understood. The present volume thus aims to assess the efforts of Francophone philosophers and theologians to advance the thought of Thomas Aquinas; it thereby provides us with a valuable status quaestionis, enabling Aquinas's contemporary disciples to measure better the challenge that lies before them. The first of the volume's three sections is devoted to historical studies on the Revue thomiste's role in the formation of contemporary Neo-Thomism and its contribution to some of the important theological controversies in the first half of this century. Francesco Baretta narrates the vicissitudes of the journal's inception and first years (1893-1905). Not until the establishment in 1907 of the Revue des sciences philosophiques et theologiques by members of the Dominican order's Paris province (the reasons that motivated the foundation of a rival journal are taken up by Andre Duval in a paper wholly devoted to this topic [pp. 96108 ]) did the Revue thomi~te come to be closely affiliated with the Toulouse province. Prior to this time it enjoyed the active collaboration of the order's three French provinces: Lyon, Paris, and Toulouse. Inspired by the recently promulgated Aeterni Patris (1879), the founders of the Revue thomiste sought to implement the encyclical's recommendation that the doctrine of Thomas Aquinas be brought into fruitful dialogue with modern science. Yet in so doing the Revue thomiste encountered serious obstacles, both theoretical and practical. Theoretically, the journal's chief collaborators were unable to recognize the originality of the hypothetico-deductive method and thus persisted 480 BOOK REVIEWS in thematizing modem science according to the epistemological categories of Aristotle's Posterior Analytics. Practically, they were unable (some exceptions aside) to enlist the support of contributors competent in both experimental science and scholastic thought. Thomism's engagement with modernity is taken up anew by Henry Donneaud, who charts the Revue thomiste's role in the nascent modernist crisis. During this period (1900-1908) the journal's rapprochement with the physical sciences attenuated, giving way to a preoccupation with modernism and its attendant controversies: the evolution of Catholic dogmas, the nature and role of apologetics, etc. Far from presenting a united front in the face of these theological developments, the principal collaborators of the Revue thomiste diverged in the fundamental orientation of their responses. Gradually, two very different Thomisms emerged: one, markedly conservative, refused any compromise with the new trends, condemning them in toto by appeal to a literalist, a-historical reading of the master; the other, progressive, sought to confront the modernists on their own terrain by drawing on the resources of a Thomistic doctrine open to amendment. Dans cet article, je me propose de réfléchir, à partir de certains travaux de Thomas Nagel, sur la nature de la réflexion métaphysique. Nous qualifions certains problèmes de métaphysiques et leur attribuons par là une certaine unité. Il est cependant difficile de caractériser cette unité, et l’ensemble de ces problèmes peut apparaître comme une simple rhapsodie : quel rapport existe-t-il entre des questions comme « sommes-nous libres? », « quelle est la place de l’esprit dans la nature? » ou (...) « pouvons-nous connaître la réalité extérieure? ». J’avance une hypothèse à propos de l’origine, de la nature et de l’unité de ces problèmes, ainsi que de la fonction de leur examen à l’intérieur de la métaphysique, du moins à propos de certains d’entre eux, ceux qui portent sur ce qui est et non sur ce en quoi consiste le fait d’être. J’essaie également de dégager de cette hypothèse une compréhension plus précise de la nature d’une part centrale de l’enquête métaphysique. (shrink)

Qu'attendre des chercheurs en sciences sociales? Qu'ils fassent tout bonnement leur métier ou qu'à partir de leurs analyses ils s'impliquent dans les problèmes qui relèvent de leur compétence ou même qu'à partir de leur position de chercheur ils prennent publiquement position sur les grandes questions du jour? Ces alternatives sont loin d'épuiser le champ des possibles, mais les énoncer invite à s'interroger sur les rapports qu'entretiennent les travaux de recherche en sciences sociales avec les pratiques sociales qu'elles étudient. Ces questions (...) n'étaient pas étrangères à Philippe Lucas - et c'est peu dire. Elles sont aussi à l'origine de ce livre. Président de l'université Lumière-Lyon II avant d'être nommé recteur de l'Académie de Bordeaux puis de l'Académie de Caen, Philippe Lucas fut aussi et d'abord un chercheur qui concevait son travail de recherche comme un engagement. Sa " sociologie impliquée " supposait la confrontation des points de vue et le débat non seulement après coup, une fois le travail terminé, mais avant tout dès les premières investigations et tout au long de la recherche. Quel meilleur hommage rendre à Philippe Lucas que de reprendre aujourd'hui ces questions qui furent les siennes? Il les avait posées à sa manière mais leur actualité nous frappe, leur importance aussi. Ceux qui ont contribué à cet ouvrage collectif ont tenté d'y répondre et d'abord de les reformuler en proposant tantôt leur témoignage tantôt leurs réflexions de chercheurs sur l'implication et l'engagement : leur propre implication et celle de leurs disciplines, leur propre engagement et celui de leurs disciplines. Theories of personal identity in the tradition of John Locke and Derek Parfit emphasize the importance of psychological continuity and the abilities to think, to remember and to make rational choices as a basic criterion for personhood. As a consequence, persons with severe dementia are threatened to lose the status of persons. Such concepts, however, are situated within a dualistic framework, in which the body is regarded as a mere vehicle of the person, or a carrier of the brain as (...) the organ of mental faculties. Based on the phenomenology of embodiment, this paper elaborates a different approach to personal identity in dementia. In this perspective, selfhood is primarily constituted by pre-reflective self-awareness and the body memory of an individual, which consists in the embodiment and enactment of familiar habits, practices and preferences. After describing the different types of body memory, the paper develops a phenomenology of dementia as a loss of reflexivity and meta-perspective. This is contrasted with the preservation of individual forms of body memory even in the later stages of the illness. The ethical consequences of an embodied approach to dementia are outlined. A final look is given to narrativistic and constructionist concepts of the self in dementia. (shrink)

Thomas Murray's graceful and humane book illuminates one of the most morally complex areas of everyday life: the relationship between parents and children. What do children mean to their parents, and how far do parental obligations go? What, from the beginning of life to its end, is the worth of a child? Ethicist Murray leaves the rarefied air of abstract moral philosophy in order to reflect on the moral perplexities of ordinary life and ordinary people. Observing that abstract moral (...) terms such as altruism and selfishness can be buried in the everyday doings of families, he maintains that ethical theory needs a richer description than it now has of the moral life of parents and children. How far should adults go in their quest for children? What options are available to women who do not want to bear a child now? Should couples be allowed to reject a child because of genetic disability or "wrong" gender? How can we weigh the competing claims of the genetic and the rearing parents to a particular child? _The Worth of a Child_ couples impressive learning with a conversational style. Only by getting down to cases, Murray insists, can we reach moral conclusions that are unsentimental, farsighted, and just. In an era of intense public and private acrimony about the place and meaning of "family values," his practical wisdom about extraordinary difficult moral issues offers compelling reading for both experienced and prospective parents, as well as for ethicists, social and behavioral scientists, and legal theorists. Natural kinds are often contrasted with other kinds of scientific kinds, especially functional kinds, because of a presumed categorical difference in explanatory value: supposedly, natural kinds can ground explanations, while other kinds of kinds cannot. I argue against this view of natural kinds by examining a particular type of explanation—mechanistic explanation—and showing that functional kinds do the same work there as traditionally recognized natural kinds are supposed to do in “standard” scientific explanations. Breaking down this categorical distinction between traditional natural (...) kinds and other kinds of kinds, I argue, delivers two goods: It provides us with a view of natural kindhood that does justice to the epistemic roles of kinds in scientific explanations. And it allows us to solve a problem that HPC theory, currently one of the more popular accounts of natural kindhood, confronts. (shrink)

Others regard it as contrary [to Divi- • ] 4 S!On, ••• Triverius, like many modern commentators, adds to, rather than sorts out, the confusion, continuing, " And since each one is entitled to his opinion, I am now maintaining that Resolution is contrary to Demonstration...." 5 Many centuries before Triverius we find a similar ambiguity in Greek commentators on Aristotle, who outline several types of analysis. Galen's opening remarks of the Ars medica, giving three methods of teaching (analysis, synthesis, and definition) is a common locus for the discussion of resolution/ analysis in the Middle Ages and Renaissance. Galen's contribution, at least for Aquinas, seems to have been completely mediated by Medieval Arabic commentators. Galen's own discussions are either incomplete, as in the opening passage to the Ars medica (in Claudii Galeni Opera Omnia, ed. C. G. Kiihn, [Repr. Hildesheim: Georg Olms, 1965], vol. I, pp. 305-306), which merely mentions the word, or are unclear accounts of analysis (Cf. Galen's discussion of analysis in De Peccatorum, in Opera Omnia, vol. 5, ch. 5, pp. 80-81). In this response to Neil Manson’s latest intervention in our debate about the best consent model for biobank research we show, contra Manson that the ‘expiry problem’ that affects broad consent models because of changes over time in methods, purposes, types of data used and governance structures is a real and significant problem. We further show that our preferred implementation of meta consent as a national consent platform solves this problem and is not subject to the cost and burden objections (...) that Manson raises. Duncan Purves and Nicolas Delon have argued that one’s life will be meaningful to the extent that one contributes to valuable states of affairs and this contribution is a result of one’s intentional actions. They then argue, contrary to some theorists’ intuitions, that non-human animals are capable of fulfilling these requirements, and that this finding might entail important things for the animal ethics movement. In this paper, I also argue that things besides human beings can have meaningful existences, but I (...) disagree with Purves and Delon’s theory of meaning, and some of the practical implications they suggest arise from their conclusion. Specifically, I argue that Purves and Delon are wrong to suggest that intentional agency is necessary for one’s life to be meaningful; contributing to valuable states of affairs can be sufficient by itself.
