Most people dread being the subject of interest for doctors, scientists, regulators, and lawyers. While we may joke about the arrogance of the medical profession and the aggressiveness of the legal field, both lie at the core of environmental public health. They are inseparable, sometimes complementary and other times in tension. The role of medicine and science in EPH is clear, but their relationship with law is often opaque. Yet in no other area of public health, from infectious and chronic (...) disease prevention to providing health care in underserved communities, is law so central as an instrument and partner. In this article we explore the relationship of law and science in the broader context of EPH, beginning with an overview of potential goals and challenges. We then offer three organizing principles that inform and guide the integration of law, science and policy in EPH. (shrink)

The paper is a critique of the widespread conception of logic as a neutral arbiter between metaphysical theories, one that makes no `substantive’ claims of its own (David Kaplan and John Etchemendy are two recent examples). A familiar observation is that virtually every putatively fundamental principle of logic has been challenged over the last century on broadly metaphysical grounds (however mistaken), with a consequent proliferation of alternative logics. However, this apparent contentiousness of logic is often treated as though it were (...) neutralized by the possibility of studying all these alternative logics within an agreed metalogical framework, typically that of first-order logic with set theory. In effect, metalogic is given the role of neutral arbiter. The paper will consider a variety of examples in which deep logical disputes re-emerge at the meta-level. One case is quantified modal logic, where some varieties of actualism require a modal meta-language (as opposed to the usual non-modal language of possible worlds model theory) in order not to make their denial of the Barcan formula self-defeating. Similarly, on some views the intended model theory for second-order logic can only be given in a second-order metalanguage—this may be needed to avoid versions of Russell’s paradox when the first-order quantifiers are read as absolutely unrestricted. It can be shown that the phenomenon of higher-order vagueness eventually forces fuzzy logical treatments of vagueness to use a fuzzy metalanguage, with consequent repercussions for what first-order principles are validated. The difficulty of proving the completeness of first-order intuitionistic logic on its intended interpretation by intuitionistically rather than just classically valid means is a more familiar example. These case studies will be discussed in some detail to reveal a variety of ways in which even metalogic is metaphysically contested, substantial and non-neutral. (shrink)

No other scientific theory has had as tremendous an impact on our understanding of the world as Darwin's theory as outlined in his Origin of Species, yet from the very beginning the theory has been subject to controversy. The duality of computer programs is characterized, on the one hand, by their physical implementations on physical devices, and, on the other, by the conceptual implementations in programmers’ minds of the objects making up the computational processes they conceive. We contend that central to programmers’ conceptual implementations are (i) the concept of type, at both the programming and the design level, and (ii) metaphors created to facilitate these implementations.

The ongoing research program of process thought meets some of its most crucial tests in efforts towards a comprehensive philosophy of nature. Contributors to the two special focus issues on natural science for the Process Studies journal provide many examples of such tests and commentary that reflect contemporary scientific thought. A core element of modern scientific methodology is the search for invariant, physical relationships that simplify our understanding of complex systems. In addition to a preference for some form of critical (...) realism and intersubjective testability, scientists search for relationships that are both universal and repeatable. Speakers differ from one another in philosophically problematic ways. Two speakers can vary not simply with respect to what they believe, but also in the ways they speak, the concepts they employ, and the standards they bring to bear. The fact of imperfect convergence gives rise to a wide range of philosophical puzzles, largely via a single generalization: If two speakers disagree with each other, then at least one of them says something false. The generalization is plausible, but mistaken. Counterexamples (...) are common, diverse, and thoroughly entrenched in ordinary talk, scientific discourse, and philosophical inquiry. I focus on a particular family of counterexamples, disagreements about the proper application of linguistic items, or what I call metalinguistic disagreements. Coming to grips with the widespread existence of metalinguistic disagreement requires a nuanced account of the ways in which information can be transmitted via an utterance, and it suggests a substantial rethinking of conventional philosophical wisdom about the nature of meaning. I begin with a philosophical case study in metalinguistic disagreement—disagreements about aesthetics. I go on to explore the more general linguistic properties of metalinguistic disagreements, focusing on their striking failure to license so-called metalinguistic negation. I conclude with a consideration of semantic methodology, arguing that, despite widely held assumptions to the contrary, metalinguistic disagreements can be adjudicated with reference to objective, non-linguistic features of the world. It is possible therefore to roundly reject a pernicious relativism about scientific discourse while simultaneously allowing for widespread, interpersonal variation in meaning. (shrink)

Seguendo Carnap si sostiene come, dato un sistema di riferimento, una questione è interna se valutata e risolta all’interno del sistema in questione, mentre è esterna se mette in discussione il sistema di riferimento dato e lo stato di cose che presuppone. Quindi, attraverso un’analisi incentrata principalmente sul sistema di riferimento ‘la Costituzione della Repubblica Italiana’ e (...) sul tema della giustizia, si discutono la rilevanza e le conseguenze di tale distinzione per la teoria sociale.The article discusses how Rudolf Carnap’s distinction between internal and external questions can be extended and applied to social theory. In accordance with Carnap, I maintain that a question is internal to a framework if the question is solved within the given framework. On the contrary, a question is external to a framework, if the question discusses the given framework. So, through an analysis centralised on the framework ‘The Constitution of Italian Republic’ and on the theme of ‘justice’, I discuss the importance and the consequences of this distinction for social theory. It has been suggested that damage to anterior regions of the left hemisphere results in a dissociation in the perception and lexical activation of past-tense forms. Specifically, in a lexical-decision task in which past-tense primes immediately precede present-tense targets, such patients demonstrate significant priming for irregular verbs (spoke–speak), but, unlike control participants, fail to do so for regular verbs (looked–look). Here, this behavioral dissociation was first confirmed in a group of eleven patients with damage to the pars opercularis (BA 44) (...) and pars triangularis (BA 45) of the left inferior frontal gyrus (i.e., Broca's area). Two conditions containing word-onset orthographic–phonological overlap (bead–bee, barge–bar) demonstrated that the disrupted regular-verb priming was accompanied by, and covaried with, disrupted ortho-phonological priming, regardless of whether prime stimuli contained the regular inflectional rhyme pattern. Further, the dissociation between impaired regular-verb and preserved irregular-verb priming was shown to be continuous rather than categorical; priming for weak-irregular verbs (spent–spend) was intermediate in size between that of regular verbs and strong verbs. Such continuous dissociations grounded in ortho-phonological relationships between present- and past-tense forms are predicted by single-system, connectionist approaches to inflectional morphology and not predicted by current dual-system, rule-based models. Event-related potential data demonstrated that N400 priming effects were intact for both regular and irregular verbs, suggesting that the absence of significant regular-verb priming in the response time data did not result from a disruption of lexical access, and may have stemmed instead from post-lexical events such as covert articulation, segmentation strategies, and/or cognitive control. Religion after Deliberative Democracy responds to gaps exposed by the case of religion in deliberative democratic theory. Religion's persistent visibility in political life has called for new solutions for healing deeply divided societies. In response, the author begins with Jeffrey Stout’s pragmatist vision of democracy before providing a series of supplements in subsequent chapters. Past legacies are refigured in a rapprochement with Jürgen Habermas’s work which is differentiated from the distinctive relevance of Hannah Arendt’s vita activa. New developments in comparative (...) political theology are complemented by recent systems theory approaches to institutional interactions. Peaceful protest movements are reframed in light of the trust-building capacities of minipublics. The result is reason for renewed confidence in democratic practices attuned to fostering political plurality and capable of responding to persistent religious partisanship. This book fills a crucial space in the literature on religion and democracy and will be of interest to students and scholars of philosophy of religion, theology, pragmatism, and political theory. Some commentators speak freely about genetics being poised to change human nature. Contrary to such rhetoric, Norman Daniels believes no such thing is plausible since ‘nature’ describes characteristic traits of human beings as a whole. Genetic interventions that do their work one individual at a time are unlikely to change the traits of human beings as a class. Even so, one can speculate about ways in which human beings as a whole could be genetically altered, and there is nothing about (...) that venture that could not be deliberated in the way other high-impact questions can be evaluated. There might well come a time when it would be defensible to use genetics to change human beings as a class, in order to protect people in the face of changed environmental circumstances or to enhance existing capacities. Moreover, if one understands human nature not in an empirically descriptive way but in a metaphysical way having implications about human behavior, it can make sense to talk about de-naturing individuals through genetic changes. Even under a metaphysical conception of human nature, however, one can still imagine that people in the future might want to alter their traits in pursuit of another normative idea of a good and valuable life, and genetic modifications might function as a pathway to that change. This paper attempts to motivate skepticism about the reality of mathematical objects. The aim of the paper is not to provide a general critique of mathematical realism, but to demonstrate the insufficiency of the arguments advanced by Michael Resnik. I argue that Resnik's use of the concept of immanent truth is inconsistent with the treatment of mathematical objects as ontologically and epistemically continuous with the objects posited by the natural sciences. In addition, Resnik's structuralist program, and his denial of relational (...) properties, is incompatible with a realist metaphysics about mathematical objects. (shrink)

The general conditions of epistemic defeat are naturally represented through the interplay of two distinct kinds of entailment, deductive and defeasible. Many of the current approaches to modeling defeasible reasoning seek to define defeasible entailment via model-theoretic notions like truth and satisfiability, which, I argue, fails to capture this fundamental distinction between truthpreserving and justification-preserving entailments. I present an alternative account of defeasible entailment and show how logic programming offers a paradigm in which the distinction can be captured, allowing for (...) the modeling of a larger range of types of defeat. This is possible through a natural extension of the declarative and procedural semantics of Horn clauses. (shrink)

The HPV (human papillomavirus) vaccine Gardasil (Merck & Co.) was licensed for use by the FDA on June 8, 2006. The Centers for Disease Control and major physician professional organizations have recommended routine universal vaccination in young girls. However, questions remain regarding the safety and efficacy of the vaccine in this age group. Also, vaccine use will not eliminate the need for routine Pap screening, and it may not decrease future cervical cancer rates. This paper surveys the natural history of (...) Possession of a BRCA1 or BRCA2 gene mutation puts a woman at very high risk of developing breast and ovarian carcinoma at an early age. One treatment option is surgical removal of the target organs—breasts, ovaries, and fallopian tubes—before the malignancy develops. This risk-reduction surgery has been shown to significantly reduce the likelihood that a woman will develop one of these cancers. This paper argues that such surgeries do not violate Catholic moral principles, but can be justified using the principles (...) of double effect and totality and integrity.
