The article introduces and defends the Nomological Account of ground, a reductive account of the notion of metaphysical explanation in terms of the laws of metaphysics. The paper presents three desiderata that a theory of ground should meet: it should explain the modal force of ground, the generality of ground, and the interplay between ground and certain mereological notions. The bulk of the paper develops the Nomological Account and argues that it meets the three desiderata. The Nomological Account relies on (...) two central notions: the notion of a ‘law of metaphysics’ and the notion of ‘determination via the laws’. The paper offers the constructional conception of the laws of metaphysics, on which the metaphysical laws are general principles that characterize construction–operations such as composition, constitution, or set-formation. The role of determination in the account is explained and some reductive approaches to the notion are sketched. The case for the Nomological Account presented in this article is also a case for the laws of metaphysics. Since the Nomological Account offers a promising approach to metaphysical explanation we should take the laws of metaphysics seriously. (shrink)

The paper explores a deductive-nomological account of metaphysical explanation: some truths metaphysically explain, or ground, another truth just in case the laws of metaphysics determine the latter truth on the basis of the former. I develop and motivate a specific conception of metaphysical laws, on which they are general rules that regulate the existence and features of derivative entities. I propose an analysis of the notion of ‘determination via the laws’, based on a restricted form of logical entailment. I argue (...) that the DN-account of ground can be defended against the well-known objections to the DN-approach to scientific explanation. Realists about laws of nature and their Humean opponents disagree on whether laws ‘govern’. An independent commitment to the ‘governing conception’ of laws pushes many towards the realist camp. Despite its significance, however, no satisfactory account of governance has been offered. The goal of this article is to develop such an account. I base my account on two claims. First, we should distinguish two notions of governance, ‘guidance’ and ‘production’, and secondly, explanatory phenomena other than laws are also candidates for (...) governance. My goal is to develop a unified account which captures both guidance and production as well as the governance of phenomena, such as essence and logical consequence. The account of governance I develop belongs to the family of modal accounts, which was popularized by David Armstrong, but it also employs essentialist resources. If successful, this modal-essentialist account not only reveals the costs that proponents of governance incur, but it also puts that important notion on a solid theoretical foundation. (shrink)

Tobias and Morrison's encounter with Putin underlines the fragility and limits and urgency of human agency. The question remains: will the examples of Jain austere living and Bhutan's good government be enough to provide a roadmap into an uncertain future? (shrink)

This special issue focuses on two related topics in Ernst Cassirer’s thought: objectivity and truth. Through this lens, the guest editors attempt to illuminate (a) the historical and systematic value of Cassirer’s philosophical project, (b) the continuing relevance of his account of the plurality and universality of human understanding in view of the crisis of truth that currently permeates Western culture, and (c) the way Cassirer’s style can inspire contemporary scholars who wish to evade the analytic-continental divide. Tobias Endres (...) and Simon Truwant gathered twelve contributions from more analytic oriented authors from the philosophy of science and more continental oriented authors from the philosophy of culture. By bringing these scholars together on a shared topic, they hope to help bridging this divide that is also reflected within Cassirer scholarship by preoccupation with either his philosophy of science or philosophy of culture. The articles in this special issue are preceded by a ceremonial speech that Cassirer gave on the occasion of his assumption of the rectorate of the University of Hamburg on November 7, 1929 and that was translated into English for the first time by the guest editors. The potential for biases being built into algorithms has been known for some time, yet literature has only recently demonstrated the ways algorithmic profiling can result in social sorting and harm marginalised groups. We contend that with increased algorithmic complexity, biases will become more sophisticated and difficult to identify, control for, or contest. Our argument has four steps: first, we show how harnessing algorithms means that data gathered at a particular place and time relating to specific persons, can be used (...) to build group models applied in different contexts to different persons. Thus, privacy and data protection rights, with their focus on individuals, do not protect from the discriminatory potential of algorithmic profiling. Second, we explore the idea that anti-discrimination regulation may be more promising, but acknowledge limitations. Third, we argue that in order to harness anti-discrimination regulation, it needs to confront emergent forms of discrimination or risk creating new invisibilities, including invisibility from existing safeguards. Finally, we outline suggestions to address emergent forms of discrimination and exclusionary invisibilities via intersectional and post-colonial analysis. (shrink)

Summary: The paper provides an argument for modal primitivism, the view that necessity is not defined and is therefore part of the structure of reality. It then raises the explanation-challenge for primitivists: how can modal truths be explained by hyper-intensional truths, if necessity is not defined in terms of hyper-intensional phenomena? To address the challenge, the paper introduces 'sophisticated modal primitivism' which gives a substantive analysis of the notion of a 'source of necessity'. What does it mean to be human? We invite the reader to discuss this most fundamental issue in philosophy and to do so in an intercultural framework. The question of the human was the starting point for a legendary discussion between two German philosophers who met in Davos in 1929. We return to this historical event and re-imagine the debate between Martin Heidegger and Ernst Cassirer from a global perspective. Generating twenty papers from elaborate discussions, our authors contribute to the (...) thought experiment by inviting the Japanese philosopher Nishida Kitarō from Kyoto and other Japanese thinkers into the debate to overcome the challenge of Eurocentrism inherent to these historic days in Davos. The application of enhancement technologies to children and non-medical infant male circumcision are both topics that enjoy the continuous attention of bioethical research but are usually discussed in isolation from each other. Yet one can show that three major arguments used by opponents of the enhancement of children are also applicable to circumcision. These arguments are based on the insecurity of these procedures, the child's right to an open future, and human nature as a foundation of human dignity. People who (...) reject the enhancement of children because of these arguments but accept circumcision hold mutually inconsistent moral convictions or apply double moral standards to these cases. This is particularly important when legislative systems treat the enhancement of children and circumcision in a considerably different manner, which is true for many contemporary legislative systems. At least three strategies can be adopted in order to avoid such inconsistencies, two of which, however, fail for various reasons. According to a third, more promising strategy, circumcision should be subsumed under human enhancement and treated like other enhancement technologies. This strategy justifies restrictions on, but not the prohibition of circumcision. Furthermore, proponents of circumcision should be prepared for future technologies that provide similar benefits as circumcision but are not as contentious as this intervention, so that, in the future, circumcision could become more and more unacceptable. Heideggers philosophische Meisterschaft hat bekanntlich viel damit zu tun, dass er die originären Möglichkeiten der Sprache und Übersetzung wie wenig andere Denker zu nutzen weiß. Throughout the last decade, calls for a return to materiality have reverberated within the humanities and social sciences. Few, however, have noticed that this return has also entailed a return to fiction, as the new theoretical writings on matter regularly include elements of storytelling, fabulation or other genres of invention. This article asks why this alliance between new materialism and fiction has come about: Why do scholars united by a common interest in ‘getting real’ consistently utilize a type of discourse (...) defined precisely by not committing itself to reality? Examining works by Jane Bennett, Dominic Pettman, Stacy Alaimo, Astrida Neimanis, Donna Haraway, and Rebekah Sheldon, the article explores this question by tracing three modes of fictionality in new materialism distinguished by inventing non/human entanglements, scientific knowledge, and future societies respectively. Ultimately, the article argues that fictionality is a particularly attractive tool for attempts to transcend anthropocentric regimes of truth. (shrink)

Deepfakes raise various concerns: risks of political destabilization, depictions of persons without consent and causing them harms, erosion of trust in video and audio as reliable sources of evidence, and more. These concerns have been the focus of recent work in the philosophical literature on deepfakes. However, there has been almost no sustained philosophical analysis of deepfakes from the perspective of concerns about honesty and dishonesty. That deepfakes are potentially deceptive is unsurprising and has been noted. But under what conditions (...) does the use of deepfakes fail to be honest? And which human agents, involved in one way or another in a deepfake, fail to be honest, and in what ways? If we are to understand better the morality of deepfakes, these questions need answering. Our first goal in this paper, therefore, is to offer an analysis of paradigmatic cases of deepfakes in light of the philosophy of honesty. While it is clear that many deepfakes are morally problematic, there has been a rising counter-chorus claiming that deepfakes are not essentially morally bad, since there might be uses of deepfakes that are not morally wrong, or even that are morally salutary, for instance, in education, entertainment, activism, and other areas. However, while there are reasons to think that deepfakes can supply or support moral goods, it is nevertheless possible that even these uses of deepfakes are dishonest. Our second goal in this paper, therefore, is to apply our analysis of deepfakes and honesty to the sorts of deepfakes hoped to be morally good or at least neutral. We conclude that, perhaps surprisingly, in many of these cases the use of deepfakes will be dishonest in some respects. Of course, there will be cases of deepfakes for which verdicts about honesty and moral permissibility do not line up. While we will sometimes suggest reasons why moral permissibility verdicts might diverge from honesty verdicts, we will not aim to settle matters of moral permissibility. (shrink)

Dividing the Beds: A Risk Community under ‘Code Black’? During the COVID-19 crisis a risk of ‘code black’ emerged in the Netherlands. Doctors mentioned that in case of code black, very senior citizens might not receive intensive care treatment for COVID-19 due to shortages. Sociologist Ulrich Beck argued that palpable risks lead to the creation of new networks of solidarity. In this article this assumption is investigated by analyzing the different storylines prevalent in the public discussion about ‘code black’. Initially, (...) storylines showing sympathy with the plight of the elderly came to the fore. However, storylines brought forward by medical organizations eventually dominated, giving them the opportunity to determine health care policy to a large extent. Their sway over policymaking led to a distribution scheme of vaccines that was favourable for medical personnel, but unfavourable for the elderly. The discursive process on code black taken as a whole displayed a struggle over favourable risk positions, instead of the formation of risk solidarity. (shrink)

ZUSAMMENFASSUNGIn seinem 1927 gehaltenen Vortrag Phänomenologie und Theologie vertritt Heidegger die These, dass die Philosophie theologische Grundbegriffe korrigiere, indem sie sie auf ihren rein rational fassbaren Gehalt reduziere und die ontologischen Bedingungen dieses Gehalts formal anzeige. Dieses Prinzip der »Korrektion« kann durch seine Anwendung auf Thomas von Aquins Begriff des göttlichen Worts veranschaulicht werden. Es kann gezeigt werden, dass Heidegger diesen Begriff auf einen rein rational fassbaren Gehalt reduziert, den er mit einer neuen praktischen oder sprachlichen Bedeutung identifiziert, die ein (...) Dasein erfindet, das Zeug oder Sprache in einer radikal neuen Weise gebraucht. Es kann ferner gezeigt werden, dass die ontologischen Bedingungen dieses rein rational fassbaren Gehalts nach Heidegger in der Erschlossenheit des Daseins liegen. This principle of ‘correction’ can be specified by applying it to Aquinas's concept of the divine word. Heidegger can be presented as reducing this concept to a purely rational content that he identifies with a new practical or linguistic meaning invented by a Dasein using tools or language in a radically new way. He can further be shown to hold that the ontological conditions of this purely rational content lie in the Dasein's disclosedness. His correction of Aquinas's concept of the divine word reveals that a common understanding of Heidegger's concept of authenticity, which is of central importance to his philosophy in Being and Time, is misguided: authenticity is not a mode exhibited by someone with a philosophical insight into Dasein's existential structure, but the existentiell mode of the existence of a Dasein who has the existentiell possibilities to invent new meaning by introducing new ways of using tools or language. A comprehensive treatment of the concept of causation in evolutionary biology that makes clear its central role in both historical and contemporary debates. Most scientific explanations are causal. This is certainly the case in evolutionary biology, which seeks to explain the diversity of life and the adaptive fit between organisms and their surroundings. The nature of causation in evolutionary biology, however, is contentious. How causation is understood shapes the structure of evolutionary theory, and historical and contemporary debates in evolutionary biology (...) have revolved around the nature of causation. Despite its centrality, and differing views on the subject, the major conceptual issues regarding the nature of causation in evolutionary biology are rarely addressed. This volume fills the gap, bringing together biologists and philosophers to offer a comprehensive, interdisciplinary treatment of evolutionary causation. Contributors first address biological motivations for rethinking evolutionary causation, considering the ways in which development, extra-genetic inheritance, and niche construction challenge notions of cause and process in evolution, and describing how alternative representations of evolutionary causation can shed light on a range of evolutionary problems. In this review essay, I examine the central tenets of sociologist Dave Elder-Vass’s recent contribution to social ontology, as put forth in his book The Causal Power of Social Structures: Emergence, Structure and Agency. Elder-Vass takes issue with ontological individualists and maintains that social structures exist and have causal powers in their own right. I argue that he fails to establish his main theses: he shows neither that social structures have causal powers “in their own right” (in any sense of (...) this expression) nor that they exist. Are acts of violence performed in virtual environments ever morally wrong, even when no other persons are affected? While some such acts surely reflect deficient moral character, I focus on the moral rightness or wrongness of acts. Typically it’s thought that, on Kant’s moral theory, an act of virtual violence is morally wrong (i.e., violate the Categorical Imperative) only if the act mistreats another person. But I argue that, on Kant’s moral theory, some acts of virtual violence can be morally (...) wrong, even when no other persons or their avatars are affected. First, I explain why many have thought that, in general on Kant’s moral theory, virtual acts affecting no other persons or their avatars can’t violate the Categorical Imperative. For there are real world acts that clearly do, but it seems that when we consider the same sorts of acts done alone in a virtual environment, they don’t violate the Categorical Imperative, because no others persons were involved. But then, how could any virtual acts like these, that affect no other persons or their avatars, violate the Categorical Imperative? I then argue that there indeed can be such cases of morally wrong virtual acts—some due to an actor’s having erroneous beliefs about morally relevant facts, and others due not to error, but to the actor’s intention leaving out morally relevant facts while immersed in a virtual environment. I conclude by considering some implications of my arguments for both our present technological context as well as the future. (shrink)

Most plausible moral theories must address problems of partial acceptance or partial compliance. The aim of this paper is to examine some proposed ways of dealing with partial acceptance problems as well as to introduce a new Rule Utilitarian suggestion. Here I survey three forms of Rule Utilitarianism, each of which represents a distinct approach to solving partial acceptance issues. I examine Fixed Rate, Variable Rate, and Optimum Rate Rule Utilitarianism, and argue that a new approach, Maximizing Expectation Rate Rule (...) Utilitarianism, better solves partial acceptance problems. (shrink)

ZusammenfassungObwohl Film nicht nur eine große Popularität und mediale Vertrautheit genießt, sondern auch als eine der bedeutendsten kulturprägenden Kunstformen der Gegenwart sowie als Mittel kollektiver Selbstverständigung und Ausdruck gesellschaftlicher Reflexion gelten kann, finden filmische Auseinandersetzungen mit aktuellen bioethischen Problemkonstellationen bislang kaum Beachtung im akademischen Diskurs. Dies gilt nicht nur für die vielschichtige Symbolbildung von Spielfilmen, sondern auch für das narrative Potenzial von Dokumentarfilmen. Dabei können dokumentarische Erzählformen wichtige Bedeutungsebenen ethischer Fragestellungen erschließen, indem sie Einblick in die individuellen Lebenslagen der Betroffenen (...) und ihre jeweiligen Perspektiven gewähren. Wie kaum ein anderes Medium ist der Dokumentarfilm geeignet, dabei die persönliche Dimension medizinischer Entscheidungen jenseits theoretischer Argumentationen erfahrbar zu machen. Dieser diskursive Mehrwert, den die Einbeziehung von Dokumentarfilmen in die bioethische Debatte haben kann, wird in diesem Beitrag zunächst als Theorie formuliert und anschließend an zwei Filmbeispielen erläutert, welche die Thematik der Leihmutterschaft aufgreifen und somit eine aktuelle Fragestellung der Reproduktionsmedizin ins Bild setzen.
