This paper argues that ‘that’-clauses are not singular terms (without denying that their semantical values are propositions). In its first part, three arguments are presented to support the thesis, two of which are defended against recent criticism. The two good arguments are based on the observation that substitution of ‘the proposition that p’ for ‘that p’ may result in ungrammaticality. The second part of the paper is devoted to a refutation of the main argument for the claim that ‘that’-clauses are (...) singular terms, namely that this claim is needed in order to account for the possibility of quantification into ‘that’-clause position. It is shown that not all quantification in natural languages is quantification into the position of singular terms, but that there is also so-called ‘non-nominal quantification’. A formal analysis of non-nominal quantification is given, and it is argued that quantification into ‘that’-clause position can be treated as another kind non-nominal quantification. (shrink)

Two recurrent arguments levelled against the view that enduring objects survive change are examined within the framework of the B-theory of time: the argument from Leibniz's Law and the argument from Instantiation of Incompatible Properties. Both arguments are shown to be question-begging and hence unsuccessful.

Das gilt nicht weniger, wenn es Bilder sind, die sich im Medium Sprache - und damit im Medium der Philosophie - zeigen. Heideggers philosophische Meisterschaft hat bekanntlich viel damit zu tun, dass er die originären Möglichkeiten der Sprache und Übersetzung wie wenig andere Denker zu nutzen weiß. Dieser Beitrag untersucht das Wort "Erklüftung" als Beispiel eines scheiternden Versuchs, ein philosophisches Bild zu entwerfen.

Recently psychologists and experimental philosophers have reported findings showing that in some cases ordinary people's moral intuitions are affected by factors of dubious relevance to the truth of the content of the intuition. Some defend the use of intuition as evidence in ethics by arguing that philosophers are the experts in this area, and philosophers' moral intuitions are both different from those of ordinary people and more reliable. We conducted two experiments indicating that philosophers and non-philosophers do indeed sometimes have (...) different moral intuitions, but challenging the notion that philosophers have better or more reliable intuitions. Could laws of nature be violated, in the sense that some proposition is both a law and false? I argue that opponents of regularity theories of laws should accept the metaphysical possibility of such genuine violations. I begin with a clarification of this claim. The main argument is then developed in three steps. I first argue that opponents of regularity theory should endorse the modal-essence view: certain modal principles are essential to the laws of nature. Second, I argue that the (...) modal-essence view entails sophisticated modal primitivism. Third, I argue from sophisticated primitivism to the metaphysical possibility of genuine violations of laws. Jason Stanley and Timothy Williamson have argued that there is no fundamental distinction between what Gilbert Ryle famously called 'knowing how' and 'knowing that', and that the former can be treated as a special kind of the latter. I will endeavour to show that sentences of the form 'a knows how to F' are ambiguous between a reading in which we ascribe knowledge-that to a and another in which we ascribe something to a which is irreducible to any kind of (...) knowledge-that and can most appropriately be characterized as an ability. The authors' attempt to reduce also the latter reading to an ascription of knowledge-that fails because it rests on an unexplained conception of practical modes of presentation. (shrink)

The potential for biases being built into algorithms has been known for some time, yet literature has only recently demonstrated the ways algorithmic profiling can result in social sorting and harm marginalised groups. We contend that with increased algorithmic complexity, biases will become more sophisticated and difficult to identify, control for, or contest. Our argument has four steps: first, we show how harnessing algorithms means that data gathered at a particular place and time relating to specific persons, can be used (...) to build group models applied in different contexts to different persons. Thus, privacy and data protection rights, with their focus on individuals, do not protect from the discriminatory potential of algorithmic profiling. Second, we explore the idea that anti-discrimination regulation may be more promising, but acknowledge limitations. Third, we argue that in order to harness anti-discrimination regulation, it needs to confront emergent forms of discrimination or risk creating new invisibilities, including invisibility from existing safeguards. Finally, we outline suggestions to address emergent forms of discrimination and exclusionary invisibilities via intersectional and post-colonial analysis. (shrink)

The last decade has witnessed the emergence of a paradox perspective on corporate sustainability. By explicitly acknowledging tensions between different desirable, yet interdependent and conflicting sustainability objectives, a paradox perspective enables decision makers to achieve competing sustainability objectives simultaneously and creates leeway for superior business contributions to sustainable development. In stark contrast to the business case logic, a paradox perspective does not establish emphasize business considerations over concerns for environmental protection and social well-being at the societal level. In order to (...) contribute to the consolidation of this emergent field of research, we offer a definition of the paradox perspective on corporate sustainability and a framework to delineate its descriptive, instrumental, and normative aspects. This framework clarifies the paradox perspective’s contents and its implications for research and practice. We use the framework to map the contributions to this thematic symposium on paradoxes in sustainability and to propose questions for future research. (shrink)

Providing a concise definition of hope is challenging. Psychologists alone have proposed 26 theories of hope and 54 definitions thereof. The difficulty of finding a universal definition of hope was summed up by the philosopher Joseph Godfrey who admitted, "I'd rather have hope than be able to define it". Part of the problem is that the concept is the object of scrutiny across many different scholarly disciplines, each of which have their own, sometimes divergent, methodologies and interests in the concept. ZUSAMMENFASSUNGIn seinem 1927 gehaltenen Vortrag Phänomenologie und Theologie vertritt Heidegger die These, dass die Philosophie theologische Grundbegriffe korrigiere, indem sie sie auf ihren rein rational fassbaren Gehalt reduziere und die ontologischen Bedingungen dieses Gehalts formal anzeige. Dieses Prinzip der »Korrektion« kann durch seine Anwendung auf Thomas von Aquins Begriff des göttlichen Worts veranschaulicht werden. Es kann gezeigt werden, dass Heidegger diesen Begriff auf einen rein rational fassbaren Gehalt reduziert, den er mit einer neuen praktischen oder sprachlichen Bedeutung identifiziert, die ein (...) Dasein erfindet, das Zeug oder Sprache in einer radikal neuen Weise gebraucht. Es kann ferner gezeigt werden, dass die ontologischen Bedingungen dieses rein rational fassbaren Gehalts nach Heidegger in der Erschlossenheit des Daseins liegen. This principle of ‘correction’ can be specified by applying it to Aquinas's concept of the divine word. Heidegger can be presented as reducing this concept to a purely rational content that he identifies with a new practical or linguistic meaning invented by a Dasein using tools or language in a radically new way. He can further be shown to hold that the ontological conditions of this purely rational content lie in the Dasein's disclosedness. His correction of Aquinas's concept of the divine word reveals that a common understanding of Heidegger's concept of authenticity, which is of central importance to his philosophy in Being and Time, is misguided: authenticity is not a mode exhibited by someone with a philosophical insight into Dasein's existential structure, but the existentiell mode of the existence of a Dasein who has the existentiell possibilities to invent new meaning by introducing new ways of using tools or language. Realists about laws of nature and their Humean opponents disagree on whether laws ‘govern’. An independent commitment to the ‘governing conception’ of laws pushes many towards the realist camp. Despite its significance, however, no satisfactory account of governance has been offered. The goal of this article is to develop such an account. I base my account on two claims. First, we should distinguish two notions of governance, ‘guidance’ and ‘production’, and secondly, explanatory phenomena other than laws are also candidates for (...) governance. My goal is to develop a unified account which captures both guidance and production as well as the governance of phenomena, such as essence and logical consequence. The account of governance I develop belongs to the family of modal accounts, which was popularized by David Armstrong, but it also employs essentialist resources. If successful, this modal-essentialist account not only reveals the costs that proponents of governance incur, but it also puts that important notion on a solid theoretical foundation. (shrink)

This article re-examines Ned Block‘s ( 1997 , 2007 ) conceptual distinction between phenomenal consciousness and access consciousness. His argument that we can have phenomenally conscious representations without being able to cognitively access them is criticized as not being supported by evidence. Instead, an alternative interpretation of the relevant empirical data is offered which leaves the link between phenomenology and accessibility intact. Moreover, it is shown that Block’s claim that phenomenology and accessibility have different neural substrates is highly problematic in (...) light of empirical evidence. Finally, his claim that there can be phenomenology without cognitive accessibility is at odds with his endorsement of the 'same-order-theory' of consciousness. (shrink)

ZusammenfassungObwohl Film nicht nur eine große Popularität und mediale Vertrautheit genießt, sondern auch als eine der bedeutendsten kulturprägenden Kunstformen der Gegenwart sowie als Mittel kollektiver Selbstverständigung und Ausdruck gesellschaftlicher Reflexion gelten kann, finden filmische Auseinandersetzungen mit aktuellen bioethischen Problemkonstellationen bislang kaum Beachtung im akademischen Diskurs. Dies gilt nicht nur für die vielschichtige Symbolbildung von Spielfilmen, sondern auch für das narrative Potenzial von Dokumentarfilmen. Dabei können dokumentarische Erzählformen wichtige Bedeutungsebenen ethischer Fragestellungen erschließen, indem sie Einblick in die individuellen Lebenslagen der Betroffenen (...) und ihre jeweiligen Perspektiven gewähren. Wie kaum ein anderes Medium ist der Dokumentarfilm geeignet, dabei die persönliche Dimension medizinischer Entscheidungen jenseits theoretischer Argumentationen erfahrbar zu machen. Dieser diskursive Mehrwert, den die Einbeziehung von Dokumentarfilmen in die bioethische Debatte haben kann, wird in diesem Beitrag zunächst als Theorie formuliert und anschließend an zwei Filmbeispielen erläutert, welche die Thematik der Leihmutterschaft aufgreifen und somit eine aktuelle Fragestellung der Reproduktionsmedizin ins Bild setzen. In recent years, there has been a debate, centrally between James Turner Johnson and James F. Childress, on how to understand the just war tradition. The international arena has historically served as the context for demonstrating the normative and political utility of the just war tradition. Contemporary experience shows, however, that violence is not only a distant issue, but it is also a local, domestic problem. Investigation into contemporary police practice, a lacuna in Christian ethics, with regard to the justifiable (...) use of force can help clarify which understanding of the just war tradition is preferable. This special issue focuses on two related topics in Ernst Cassirer’s thought: objectivity and truth. Through this lens, the guest editors attempt to illuminate (a) the historical and systematic value of Cassirer’s philosophical project, (b) the continuing relevance of his account of the plurality and universality of human understanding in view of the crisis of truth that currently permeates Western culture, and (c) the way Cassirer’s style can inspire contemporary scholars who wish to evade the analytic-continental divide. Tobias Endres (...) and Simon Truwant gathered twelve contributions from more analytic oriented authors from the philosophy of science and more continental oriented authors from the philosophy of culture. By bringing these scholars together on a shared topic, they hope to help bridging this divide that is also reflected within Cassirer scholarship by preoccupation with either his philosophy of science or philosophy of culture. The articles in this special issue are preceded by a ceremonial speech that Cassirer gave on the occasion of his assumption of the rectorate of the University of Hamburg on November 7, 1929 and that was translated into English for the first time by the guest editors. Als Schein oder Unwirklichkeit konnotiert, bleiben die neuen Phänomene der Virtualität dabei jedoch weitgehend unreflektiert. Tobias Holischkas phänomenologische Analyse zeigt, dass insbesondere der virtuelle Ort als versammelndes Prinzip eine Realität schafft, die - ganz im Gegensatz zum abstrakten Konzept des Cyberspace - eine ontologische Verbindung zur menschlichen Alltagswelt (...) herstellt und sie auf diese Weise erweitert. The article introduces and defends the Nomological Account of ground, a reductive account of the notion of metaphysical explanation in terms of the laws of metaphysics. The paper presents three desiderata that a theory of ground should meet: it should explain the modal force of ground, the generality of ground, and the interplay between ground and certain mereological notions. The bulk of the paper develops the Nomological Account and argues that it meets the three desiderata. The Nomological Account relies on (...) two central notions: the notion of a ‘law of metaphysics’ and the notion of ‘determination via the laws’. The paper offers the constructional conception of the laws of metaphysics, on which the metaphysical laws are general principles that characterize construction–operations such as composition, constitution, or set-formation. The role of determination in the account is explained and some reductive approaches to the notion are sketched. The case for the Nomological Account presented in this article is also a case for the laws of metaphysics. Since the Nomological Account offers a promising approach to metaphysical explanation we should take the laws of metaphysics seriously. (shrink)

Most plausible moral theories must address problems of partial acceptance or partial compliance. The aim of this paper is to examine some proposed ways of dealing with partial acceptance problems as well as to introduce a new Rule Utilitarian suggestion. Here I survey three forms of Rule Utilitarianism, each of which represents a distinct approach to solving partial acceptance issues. I examine Fixed Rate, Variable Rate, and Optimum Rate Rule Utilitarianism, and argue that a new approach, Maximizing Expectation Rate Rule (...) Utilitarianism, better solves partial acceptance problems. (shrink)

Phineas Gage’s story is typically offered as a paradigm example supporting the view that part of what matters for personal identity is a certain magnitude of similarity between earlier and later individuals. Yet, reconsidering a slight variant of Phineas Gage’s story indicates that it is not just magnitude of similarity, but also the direction of change that affects personal identity judgments; in some cases, changes for the worse are more seen as identity-severing than changes for the better of comparable magnitude. Die vorliegende Ausarbeitung setzt sich mit der Beziehung auseinander, die Subjekt (Erkenntnisvermögen) und Objekt (Erkenntnisgegenstand) im Denken Theodor W. Adornos zueinander einnehmen. Sie fragt, genauer gefasst, wie das Subjekt den darin angestrebten philosophischen Zugang zu seinem Objekt herstellen kann, der sich aus dezidierter Distanz und enger Nähe zugleich speisen soll. Dazu möchte sie dem dialektischen Gefüge von Subjekt und Objekt, wie es in Adornos Schriften zur Geltung kommt, weiter nachgehen: Sie möchte dessen zentrale Aspekte herausstellen, ihren Zusammenhang kenntlich machen und (...) das bei Adorno Ungesagte weiter ausdeuten. Der Autor Tobias Litterst studierte Philosophie und Musikwissenschaft. Er war Doktorand am Lehrstuhl von Prof. Dr. Ulrich Schlösser an der Universität Tübingen. Cicero's Topica is one of the canonical texts on ancient rhetorical theory. This is the first full-scale commentary on this work, and the first critical edition of the work that is informed by a full analysis of its transmission.

The paper explores a deductive-nomological account of metaphysical explanation: some truths metaphysically explain, or ground, another truth just in case the laws of metaphysics determine the latter truth on the basis of the former. I develop and motivate a specific conception of metaphysical laws, on which they are general rules that regulate the existence and features of derivative entities. I propose an analysis of the notion of ‘determination via the laws’, based on a restricted form of logical entailment. I argue (...) that the DN-account of ground can be defended against the well-known objections to the DN-approach to scientific explanation. The goal of the paper is to show that the DN-account of metaphysical explanation is a well-motivated and defensible theory. (shrink)

From ‘connecting the dots’ and finding ‘the needle in the haystack’ to predictive policing and data mining for counterinsurgency, security professionals have increasingly adopted the language and methods of computing for the purposes of prediction. Digital devices and big data appear to offer answers to a wide array of problems of (in)security by promising insights into unknown futures. This article investigates the transformation of prediction today by placing it within governmental apparatuses of discipline, biopower and big data. Unlike disciplinary and (...) biopolitical governmentality, we argue that prediction with big data is underpinned by the production of a different time/space of ‘between-ness’. The digital mode of prediction with big data reconfigures how we are governed today, which we illustrate through an analysis of how predictive policing actualizes between-ness as hotspots and near-real-time decisions. Abstract The subjectivity of conscious experience is a central feature of our mental life that puzzles philosophers of mind. Conscious mental representations are presented to me as mine, others remain unconscious. How can we make sense of the difference between them? Some representationalists (e.g. Tye) attempt to explain it in terms of non-conceptual intentional content, i.e. content for which one need not possess the relevant concept required in order to describe it. Hanna claims that Kant purports to explain the subjectivity (...) of conscious experience in this way. This paper examines this claim in some detail in the context of a more general criticism of this kind of attempt to explain subjectivity and proposes a different reading of Kant that also leads to an alternative account of subjectivity independent from content. The article analyzes the relation of humans and technology concerning so called ‘intelligent’ or ‘autonomous’ algorithms that are applied in everyday contexts but are far removed from any form of substantial artificial intelligence. In particular, the use of algorithms in surveillance and in architecture is discussed. These examples are structured by a particular combination of continuity and difference between humans and technology. The article provides a detailed analysis of boundary practices that establish continuity and oppositions between humans and information technology, (...) referring to their exemplary depiction in movies. Both strands of boundary practices have the potential to challenge as well as sustain the position of the human as liberal, autonomous subject. Finally, it is shown how the particular combination of continuity and difference that structures the use of algorithms maintains the power of liberal, autonomous subject positions, while the shift of decisions to the algorithms seems to decenter the human.
