In this paper we analyse logic of false belief in the intuitionistic setting. This logic, studied in its classical version by Steinsvold, Fan, Gilbert and Venturi, describes the following situation: a formula $\varphi$ is not satisfied in a given world, but we still believe in it. Another interpretations are also possible: e.g. that we do not accept $\varphi$ but it is imposed on us by a kind of council or advisory board. From the mathematical point of view, the idea is (...) expressed by an adequate form of modal operator $\mathsf{W}$ which is interpreted in relational frames with neighborhoods. We discuss monotonicity of forcing, soundness, completeness and several other issues. Finally, we mention the fact that it is possible to investigate intuitionistic logics of unknown truths. We present three examples of topological semantics for intuitionistic modal logic with one modal operator □. We show that it is possible to treat neighborhood models, introduced earlier, as topological or multi-topological. From the neighborhood point of view, our method is based on differences between properties of minimal and maximal neighborhoods. Also we propose transformation of multitopological spaces into the neighborhood structures.

The paper discusses the origin of two Germanic terms for ‘Atlantic herring, _Clupea harengus _L.’. The Proto-Germanic noun _*siled- _m. ‘herring’, attested in most North Germanic languages (e.g. ON. _sild_, Far. _síld_, OSv. _sild_, Sv. _sill_, Norw. _sil_), cannot be treated as inherited. It seems to represent a Saami (or Laponian) borrowing, cf. Saa. (Northern) _sâlled_, (Lule) _sallēt _‘herring’.

A Note on the Linguistic Determinacy in the Legal Context This paper discusses linguistic vagueness in the context of a semantically restricted domain of legal language. It comments on selected aspects of vagueness found in contemporary English normative legal texts and on terminological problems related to vagueness and indeterminacy both in the legal domain and language in general. The discussion is illustrated with selected corpus examples of vagueness in English legal language and attempts to show problems of the relation between (...) vagueness and ambiguity in the context of legal institutionalised systems.The discussion also evokes theoretical issues which pertain to the relation between legal texts and their contexts, the problem of how linguistic forms acquire their contextual meaning and how linguistic expressions are disambiguated. These issues are further related to the post-Gricean theory of relevance, its inferential model of communication, and the interplay between the linguistic code and inferential processes in communication. Speech acts and the autonomy of linguistic pragmatics This paper comments on selected problems of the definition of linguistic pragmatics with a focus on notions associated with speech act theory in the tradition of John Langshaw Austin. In more detail it concentrates on the relevance of the use of the Austinian categorisation into locution, illocution, and perlocution in locating a divide in between pragmatics and semantics, and especially the distinction between the locutionary act and the illocutionary act and its implications (...) for the definition of pragmatics and its separation from the semantic theory.The relation between form and meaning is further briefly reviewed against dichotomies including the Gricean and neo-Gricean ‘what is said’ versus ‘what is implicated’ or meant, between what can be ‘locuted’, but not said, and what can be said, but not asserted. These dichotomies are related to the theoretical commitments as to the accepted operative forces in speech acts, primarily convention and intention. It is suggested that, roughly, the development of the speech act theory can be viewed as a process by which the theory moves away from its originally sociolinguistic orientation towards a more psychologistic account, which in turn leads towards diminishing the role of semantics and the subsequent juxtaposition of pragmatics and syntax rather than pragmatics and semantics. In their insightful article, Brent Kious and Margaret Battin (2019) correctly identify an inconsistency between an involuntary psychiatric commitment for suicide prevention and physician aid in dying (PAD). They declare that it may be possible to resolve the problem by articulating “objective standards for evaluating the severity of others’ suffering,” but ultimately they admit that this task is beyond the scope of their article since the solution depends on “a deep and difficult” question about comparing the worseness of two possible (...) scenarios: letting someone die (who could have been helped) with not letting someone die (whose suffering could only be alleviated by death). In our commentary, we argue that creating such standards is more difficult than the authors assume because of the many types of deep uncertainties we have to deal with: (1) diagnostic, (2) motivational, and (3) existential. While agreeing with the main conclusion of Dominic Wilkinson and colleagues (Wilkinson, Butcherine, and Savulescu 2019), namely, that there is no moral difference between treatment withholding and withdrawal as such, we wish to criticize their approach on the basis that it treats the widespread acceptance of withdrawal aversion (WA) as a cognitive bias. Wilkinson and colleagues understand WA as “a nonrational preference for withholding (WH) treatment over withdrawal (WD) of treatment” (22). They treat WA as a manifestation of loss aversion (...) and refer to Kahneman and colleagues (1991), which defined this effect as follows: “the disutility of giving up an object is greater that the utility associated with acquiring it” (194). In a previous work, Wilkinson and Savulescu understood nonequivalence between treatment withholding and withdrawal as a reflection of slightly different, although related, phenomena: status quo bias or omission bias (Wilkinson and Savulescu 2012, 130–131). In neither of these two papers do they describe precisely the relation between these well-known psychological effects and WA, nor do they explain why they treat these effects as examples of nonrational preferences, despite the fact that these issues have been the subject of wide-ranging discussions on the intersection of psychology, economy, and philosophy. The answer to this question draws our attention to many factors, including bodily actions, which also work to embody cognition. With this in mind, enactivism is included in discussions of embodiment.

Książka zawiera wybrane teksty najważniejszych myślicieli zaliczanych do dwóch najbardziej znaczących kierunków neokantowskich, a mianowicie do szkoły badeńskiej i szkoły marburskiej. Szkoły te wyłoniły się w konsekwencji podziałów, jakie dokonywały się w ramach neokantyzmu, niezwykle złożonego kierunku filozoficznego drugiej połowy XIX wieku i początków wieku XX. Mówienie o neokantyzmie jest złożone, gdyż nie można podać ani daty jego powstania, ani też daty zakończenia, co przysparza wielu kłopotów z jego historycznym określeniem. Pomijając wszelkie trudności klasyfikacyjne, antologia ogranicza się do zaprezentowania poglądów (...) dwóch najważniejszych szkół. Poglądy szkoły badeńskiej ukazują teksty Wilhelma Windelbanda i Heinricha Rickerta, Emila Laska i Brunona Baucha. Natomiast poglądy szkoły marburskiej prezentują teksty Hermanna Cohena i Paula Natorpa oraz ich najwybitniejszych uczniów, tzn. Ernsta Cassirera i Nicolaia Hartmanna. Autorzy żywią przekonanie, że zamieszczone teksty są najbardziej reprezentatywne dla neokantyzmu prezentowanych szkół. (shrink)

In this paper, we discuss the problem of the relationship between legal concepts and legal norms. We argue that one of the widespread theories of legal concepts, which we call ‘the embedding theory’, is false. The theory is based on the assumption that legal norms are central for any legal system and that each legal norm establishes an inferential link between a certain class of facts and a certain class of legal consequences. Alf Ross’s embedding theory was presented in his (...) famous paper “Tu–Tu”. According to Ross, the sole function of legal concepts is to simplify normative information. Hence, the use of legal concepts may be a matter of convenience, rather than necessity. We criticize this approach mainly by pointing to the existence of so-called second order substantive concepts, which are not reducible to any determined set of conditional sentences (inferential links). In short, second order substantive concepts play the role of general standards, and general standards are used to provide flexibility for a particular legal system. In addition, general standards are ‘value loaded’, since they serve as a frame of reference for judges applying law to particular cases. To understand such general standards as a predefined set of conditionals means to overlook their ‘open’ content, and thus their function. In our opinion, the acceptance of the embedding theory means to misinterpret the function of general standards. We also argue that Giovani Sartor’s idea of defective legal concepts doesn’t help to clarify or defend the embedding theory. (shrink)

In this interview, Tomasz Zarębski speaks with Allan Janik, co-author of _Wittgenstein’s Vienna_ (1973, with Stephen Toulmin), on the occasion of the 50 th anniversary of the publication of this pathbreaking book. The conversation concerns the circumstances, motivations and reasons for his undertaking the work on the book, as well as its reception and place in Wittgenstein scholarship. A large part of the discussion refers to his perspective of Wittgenstein, Toulmin’s philosophical writings, and Janik’s own vision of philosophy. Reclamation of a slur involves the creation of a new, positively-valenced meaning that gradually replaces the old pejorative meaning. This means that at a critical stage, the slur is ambiguous. It has been claimed that this ambiguity is polysemy. However, it is far from clear whether the view can explain why the introduction of the new meaning forces the old one out of existence. I argue that this datapoint can be explained by invoking the mechanism of homonymic conflict, and, therefore, (...) that the ambiguity involved in reclamation is homonymy. One generalization that follows from my account is that conventionalized verbal irony, unlike conventionalized metonymy and metaphor, begets homonymy. Along the way, I criticize the standard ways of drawing the distinction between polysemy and homonymy in terms of semantic and etymological relatedness. If the notions of polysemy and homonymy are to be invoked in explanations, they should be understood in terms of how meanings are stored in the mental lexicon. My account also provides an elegant way of conceptualizing the difference between two types of conceptual engineering, namely reclamation and amelioration. (shrink)

To analyze potential negative consequences of adopting generative AI solutions in the digital afterlife industry (DAI), in this paper we present three speculative design scenarios for AI-enabled simulation of the deceased. We highlight the perspectives of the data donor, data recipient, and service interactant – terms we employ to denote those whose data is used to create ‘deadbots,’ those in possession of the donor’s data after their death, and those who are meant to interact with the end product. We draw (...) on the scenarios to map out several key ethical concerns posed by ‘re-creation services’ and to put forward recommendations on the ethical development of AI systems in this specific area of application. The recommendations, targeted at providers of AI-enabled re-creation services, include suggestions for developing sensitive procedures for retiring deadbots, ensuring meaningful transparency, restricting access to such services to adult users only, and adhering to the principle of mutual consent of both data donors and service interactants. While we suggest practical solutions to the socio-ethical challenges posed by the emergence of re-creation services, we also emphasize the importance of ongoing interdisciplinary research at the intersection of the ethics of AI and the ethics of the DAI. In this commentary paper, we are taking one step further in questioning the central assumptions in the bioethical debates about reproductive technologies. We argue that the very distinction between “person affecting” and “identity affecting” interventions is based on a questionable form of material-origin essentialism. Questioning of this form of essentialist approach to human identity allows treating genome editing and genetic selection as more similar than they are taken to be in the standard approaches. It would also challenge the idea that (...) normative reasons we have in these two types of cases markedly differ in strength. (shrink)

We argue that there are neither scientific nor social reasons to require gathering ethno-racial data, as defined in the US legal regulations if researchers have no prior hypotheses as to how to connect this type of categorisation of human participants of clinical trials with any mechanisms that could explain alleged interracial health differences and guide treatment choice. Although we agree with the normative perspective embedded in the calls for the fair selection of participants for biomedical research, we demonstrate that current (...) attempts to provide and elucidate the criteria for the fair selection of participants, in particular, taking into account ethno-racial categories, overlook important epistemic and normative challenges to implement the results of such race-sorting requirements. We discuss existing arguments for and against gathering ethno-racial statistics for biomedical research and present a new one that refers to the assumption that prediction is epistemically superior to accommodation. We also underline the importance of closer interaction between research ethics and the methodology of biomedicine in the case of population stratifications for medical research, which requires weighing non-epistemic values with methodological constraints. Standard deontic logic (SDL) is defined on the basis of possible world semantics and is a logic of alethic-deontic modalities rather than deontic modalities alone. The interpretation of the concepts of obligation and permission comes down exclusively to the logical value that a sentence adopts for the accessible deontic alternatives. Here, we set forth a different approach, this being a logic which additionally takes into consideration whether sentences stand in relation to the normative system or to the system of values (...) under which we predicate the deontic qualifications. By taking this aspect into account, we arrive at a logical system which preserves laws proper to a deontic logic but where the standard paradoxes of deontic logic do not arise. My paper builds on the conceptual tools from three interrelated philosophical debates that—as I believe—may help structure important if chaotic discussions about surrogates for living human brains and resolve some practical issues related to regulatory matters. In particular, I refer to the discussions about the “moral precautionary principle” in research ethics (Koplin and Wilkinson 2019); about normative uncertainty in ethics (MacAskill, Bykvist, and Ord 2020), and about the inductive risk problem for animal welfare scientists (Birch 2018). I elucidate upon the (...) possible meanings of the phrase “a too good human brain surrogate” used by Henry T. Greely (2021), and I demonstrate that the evaluation of the practical and regulatory implications of the “goodness” of such surrogates created for research purposes should be sensitive to the possible consequences of two types of errors: the under-attribution and over-attribution of moral status to such beings. Many authors writing about this topic (including Greely 2021, but see also, e.g., Koplin and Savulescu 2019) concentrate only on the first type of error, neglecting the negative consequences of the second type, i.e., over-attribution. Consider how we evaluate how normal an object is. On the dual-nature hypothesis, a normality evaluation depends on the object’s goodness and frequency. On the single-nature hypothesis, the evaluation depends solely on either frequency or goodness. To assess these hypotheses, I ran four experiments. Study 1 shows that normality evaluations vary with both the goodness and the frequency assessment of the object. Study 2 shows that manipulating the goodness and the frequency dimension changes the normality evaluation. Yet, neither experiment rules (...) out that some people evaluate normality solely based on frequency, and the rest evaluate normality solely based on goodness. Whence two more experiments. Study 3 reveals that when scenarios are contrasted—presented one after another—only frequency matters. But, as study 4 shows, when scenarios are evaluated alone, both frequency and goodness influence normality evaluations in a single person, although the more a person is sensitive to one dimension, the less she’s sensitive to the other. The dual-nature hypothesis seems thus true of uncontrasted applications of the concept of normality, whereas the single-nature hypothesis seems true of contrasted applications. (shrink)

Incorporating normality ascriptions into counterfactual theories of causation was supposed to handle isomorphs. It doesn’t—conjoining isomorphs can produce cases that such ascriptions cannot resolve.

In this article, I present a new interpretation of the pro-life view on the status of early human embryos. In my understanding, this position is based not on presumptions about the ontological status of embryos and their developmental capabilities but on the specific criteria of rational decisions under uncertainty and on a cautious response to the ambiguous status of embryos. This view, which uses the decision theory model of moral reasoning, promises to reconcile the uncertainty about the ontological status of (...) embryos with the certainty about normative obligations. I will demonstrate that my interpretation of the pro-life view, although seeming to be stronger than the standard one, has limited scope and cannot be used to limit destructive research on human embryos.
