This ambitious book examines the notion of legal transparency from a unique cultural and historical perspective. Drawing from their combined academic and practical experience with both Chinese and Western legal traditions, authors John Head and Xing Lijuan explore how an intense debate — pitting legal transparency against legal opaqueness — unfolded in dynastic Chinese law, which began in the dark mists of history and ended formally just over a hundred years ago. Legal Transparency in Dynastic China presents a clear narrative that assumes no prior expertise in Chinese law or history, and it caters to readers interested in issues of good governance, comparative studies, China, history, and law. The book begins by defining “legal transparency” and explaining where it fits into the larger context of the transparency-in-government movement that has gained such momentum in recent years, especially at the urging of Western powers. Then the book explains the fundamentally different values espoused by early Confucianists, for whom society is best governed not through written law but through the exemplary behavior of a highly educated, virtuous, and enlightened elite. After tracing the political and ideological challenges that the Confucianists faced from the Legalists, Head and Xing examine the compromise that resulted in the so-called “Confucianization of the Law” around 200 BCE. They then show how that alloy of competing ideologies characterized Chinese dynastic law for many centuries, resulting in what some would consider the most enduring and effective legal system in human history. This paper posits that differences in corporate governance structure partly result from differences in institutional arrangements linked to business systems. We developed a new international triad of business systems: the Anglo-American, the Communitarian and the Emerging system, building on the frameworks of Choi et al. (British Academy of Management (Kynoch Birmingham) 1996, Management International Review 39, 257–279, 1999). A common factor determining the success of a corporate governance structure is the extent to which it is transparent to market forces. Such (...) transparency is more than pure financial transparency; as it can also be based on factors such as governmental, banking and other types of institutional transparency mechanism. There may also be a choice for firms to adopt voluntary corporate disclosure in situations where mandatory disclosure is not established. The Asian financial crisis of 1997–1999 and the more recent corporate governance scandals such as Enron, Andersen and Worldcom in the United States and Ahold and Parmalat in Europe show that corporate governance and business ethics issues exist throughout the world. As an illustration we focus on Asia’s emerging1 markets, as, both in view of the pressure of globalization and taking into account the institutional arrangements peculiar to the emerging business system, these issues are important there. Particularly for those who have to find an accommodation between the corporate governance structures and disclosure standards of the Emerging system and those of the Anglo-American and Communitarian systems. Objective: Collaborative governance is an innovative approach to address complex societal challenges, involving partnerships between state and non-state actors. Consequently, social media is powerful tools for promoting transparency and accountability. Methodology: The study examines the role of non-state actors in leveraging social media to enhance transparency in collaborative governance initiatives. The research analyses two case studies - the #FeesMustFall campaign in South Africa and the #Tajamuka/Sesijikile campaign in Zimbabwe. Results: Through a qualitative analysis of the case studies, the (...) study explores how non-state actors, such as civil society organizations and activist groups, have utilized social media to amplify their voices, mobilize public support, and exert pressure on government entities. Findings reveal that effective use of social media can empower non-state actors to overcome information asymmetries, facilitate public scrutiny, and foster collaborative problem-solving. Transparency’s importance as an administrative norm seems self-evident. Prevailing ideals of political theory stipulate that the more visible government is, the more democratic, accountable, and legitimate it appears. The disclosure of state information consistently disappoints, however: there is never enough of it, while it often seems not to produce a truer democracy, a more accountable state, better policies, and a more contented populace. This gap between theory and practice suggests that the theoretical assumptions that provide the basis for (...) transparency are wrong. This article argues that transparency is best understood as a theory of communication that excessively simplifies and thus is blind to the complexities of the contemporary state, government information, and the public. Taking them fully into account, the article argues, should lead us to question the state’s ability to control information, which in turn should make us question not only the improbability of the state making itself visible, but also the improbability of the state keeping itself secret. Openness and transparency are becoming hallmarks of responsible data practice in science and governance. Concerns about data falsification, erroneous analysis, and misleading presentation of research results have recently strengthened the call for new procedures that ensure public accountability for data-driven decisions. Though we generally count ourselves in favor of increased transparency in data practice, this Commentary highlights a caveat. We suggest that legislative efforts that invoke the language of data transparency can sometimes function as “Trojan Horses” through (...) which other political goals are pursued. Framing these maneuvers in the language of transparency can be strategic, because approaches that emphasize open access to data carry tremendous appeal, particularly in current political and technological contexts. We illustrate our argument through two examples of pro-transparency policy efforts, one historical and one current: industry-backed “sound science” initiatives in the 1990s, and contemporary legislative efforts to open environmental data to public inspection. Rules that exist mainly to impede science-based policy processes weaponize the concept of data transparency. The discussion illustrates that, much as Big Data itself requires critical assessment, the processes and principles that attend it—like transparency—also carry political valence, and, as such, warrant careful analysis. The purpose of this book is to formulate and discuss positive (as distinguished from normative) rational choice models of the advantages and costs of transparency in various areas of public sector activity and to assess what is in effect the social level of obfuscation in politics that results from rational behaviour.

Transparency lies at the heart of most modern slavery reporting legislation, but while publication of statements is mandatory, conformance with content guidance is voluntary, such that overall, corporate responses have been poor. Existing studies, concentrated in business to consumer rather than inter-organisational contexts, have not undertaken the fine-grained assessments of statements needed to identify which aspects of reporting performance are particularly poor and the underlying reasons that need to be addressed by policy makers. In a novel design, this study (...) utilises the ethical trade initiative assessment framework to evaluate the content of 95 UK government suppliers’ modern slavery statements. The findings suggest that in a modern slavery context, discovery challenges are more important than firms’ attitudes to disclosure. We contribute to the transparency literature through a model contrasting discovery costs and disclosure risks and by identifying the disclosure of unknowns as an additional relevant dimension of disclosure. We then discuss the model in relation to normativity theory to consider options through which the currently low legitimacy of the reporting governance regime can be enhanced and the intended norms established. This article evaluates the potential of the current Corporate Social Responsibility (CSR) agenda for addressing issues related to societal governance. The investigation focuses on the experience of the oil and gas sector, which has been among the leading industry sectors in championing CSR. In particular, the article analyses the issue of revenue transparency, which has been the principal governance challenge addressed by multinational oil and gas companies. We are sceptical of concerns over the opacity of algorithmic decision tools. While transparency and explainability are certainly important desiderata in algorithmic governance, we worry that automated decision-making is being held to an unrealistically high standard, possibly owing to an unrealistically high estimate of the degree of transparency attainable from human decision-makers. In this paper, we review evidence demonstrating that much human decision-making is fraught with transparency problems, show in what respects AI fares little worse or better (...) and argue that at least some regulatory proposals for explainable AI could end up setting the bar higher than is necessary or indeed helpful. The demands of practical reason require the justification of action to be pitched at the level of practical reason. Decision tools that support or supplant practical reasoning should not be expected to aim higher than this. We cast this desideratum in terms of Daniel Dennett’s theory of the “intentional stance” and argue that since the justification of action for human purposes takes the form of intentional stance explanation, the justification of algorithmic decisions should take the same form. In practice, this means that the sorts of explanations for algorithmic decisions that are analogous to intentional stance explanations should be preferred over ones that aim at the architectural innards of a decision tool. In the first part of the 21st century, the complicated relationship between transparency and security reached a boiling point with revelations of extra-judicial CIA activities, near universal NSA monitoring and unprecedented whistleblowing – and prosecution of whistleblowers under the Espionage Act. This article examines the dual necessities of security and transparency for any democracy, and the manner in which whistleblowers radically saddle this Janus-faced relationship. Then I will move to contemporary examples of whistleblowing, showing how and why some (...) prove more damaging or beneficial than others. I will conclude with some suggestions as to practical reforms which might mitigate the seemingly inevitable pendulum-swinging between Snowden-style vigilantism and a panoptic security state. This paper investigates the importance of standardising and maintaining the transparency of advanced driver-assistance systems (ADAS) functions nomenclature, designs, and operations in all categories up until fully autonomous vehicles. The aim of this paper is to reveal the discrepancies in ADAS functions across automakers and discuss the underlying issues and potential solutions. In this pilot study, user manuals of various brands are reviewed systematically and critical analyses of common ADAS functions are conducted. The result shows that terminologies used to (...) describe ADAS functions vary widely across manufacturers and sometimes do not reflect their fundamental functions intuitively. Operational conditions and control procedures also vary across the selected models under this study. Due to this lack of consensus across the industry, drivers are not aware or well informed about ADAS functions in their vehicles, leading to a very low utilization rate and may lead to misuse of those functions. This paper provides insightful suggestions for the transport industry, Artificial Intelligence (AI) experts, and regulators to design frameworks and guidelines in governing the naming convention, operating conditions, control procedures, and information disclosure of ADAS. Democratic governments might be required by law to disseminate information to the people. This is called governmental transparency. What is the burden of transparency? We propose a “pragmatic information theory of communication” that places information accessibility as a foundation of transparency. Using a game model—the Transparency Game—we show that the pragmatic theory is the only one that makes it difficult for governments to appear transparent while not actually being transparent. There are two important consequences of understanding (...) transparency through the theory: Accessible information must be actionable, and cognitive science plays a vital role in assessing the accessibility of information. Government is a rational necessity for mankind because a society without government leads to chaos. Government regulates the affairs of the individual and the community, implements the limits, and ensures the dignity and independence of the human society. Thinking in the main goals of the divine prophets, it is clear that achieving great goals such as liberating people from the domination and captivity of foreigners, comprehensive human education, reviving human values, establishing justice, bringing people to excellence and (...) growth, etc., requires formation. In this context, transparency is a key attribute, which can bring much power to the expected level as an effective mechanism for protecting citizens’ political, economic, social and cultural rights. This concept is thus a valuable solution in the fight against sinister phenomena, such as political and economic corruptions, which are ranked as the biggest challenges facing any society. Even though transparency is nowadays deemed an emerging concept, its roots can be traced back to Islamic teachings, mainly during the short reign of Imam Ali, (peace be upon him [PBUH]). As a central figure, Imam Ali considered transparency as essential, and shared his views on governance and practical methods with the people and all audiences based on complete honesty and openness. As per Alavi thoughts, some criteria and indicators, both structural and behavioural, are involved in order to ensure the public good and meet the interests of all by providing the prerequisites for the realisation of transparency, at odds with the predominant ideas that transparency in governance, like many concepts in the political and governance-related spheres, has a western origin. Contribution: The concept of transparency, with a proven history in global experiences, accordingly holds a special place in the literature of Islamic governments. Given the importance of this topic, the present study with an emphasis on transparency aims to examine Islamic teachings on governance in Islamic societies, and reflect on governance transparency components in such societies, relying on expert opinions. Transparency has been proposed as a way of handling value-ladenness in machine learning (ML). This article highlights limits to this strategy. I distinguish three kinds of transparency: epistemic transparency, retrospective value transparency, and prospective value transparency. This corresponds to different approaches to transparency in ML, including so-called explainable artificial intelligence and governance based on disclosing information about the design process. The process of democratic consolidation in Mexico has not resolved the issues of trust in public institutions due to the lack of mechanisms to implement public policies related to transparency and accountability. Municipal governments have struggled to meet transparency and accountability obligations due to the heterogeneity in their demographic, economic, cultural, and institutional composition. In the case of Sonora, most municipalities have faced difficulties in fulfilling these basic information obligations on their portals and assuming responsibility for the management (...) of resources. The aim of this study is to explain the main factors that have hindered the fulfillment of these transparency and accountability obligations in the municipalities of the state of Sonora and to analyze the institutional instruments involved. This research reveals findings on the relationship between transparency and accountability policies and the municipal institutional design, and how the latter has represented an obstacle for the efficient implementation of these policies in Sonora’s municipalities. This study examines specifically, the mission statement and ideology as discursive practices of the Mavrodi Mondial Moneybox (MMM) Ponzi scheme. As the demand for transparency in governance, public and private practices increase, there is also a rising proliferation of counter forms of transparency in financial sectors. While studies have focused on the practices of transparency in the reports of public and private institutions, very little attention has been paid to the perils of transparency in mission statements (...) of online scam practices such as Ponzi schemes that parade as transparent financial schemes. Using a critical discourse analytic approach, this study investigates Ponzi schemes in Nigeria and their ideology of a ‘transparent economic system’. These schemes claim to operate a mutual benefit fund for the poor and discourage individuals from investing in banks. The critical discourse analysis draws attention to masked discourses of MMM and examines how the transparent discourse of the MMM generally constitutes deceptive discourse. The findings of the study reveal that factual and political arguments and propagandas are strategies of negative other representation that attempt to discredit the government and other legitimate financial institutions and at the same time attempt to control the mind of the participants by presenting the schemes as reliable thereby defrauding their victims. Corporate disclosure and reporting of information has become synonymous with transparency which in discourses idealising its value is part of the rhetoric of good governance. This notion is overtly conveyed in principles and codes of corporate governance practice which have proliferated globally over the last three decades. The possibility for transparency to conceal more than is revealed is considered with regard to corporate communication of information, with the consequence that power and real knowledge of the corporate behavioural agenda (...) remains in corporate hands. Philosophically, the paradoxical and unintended outcome is that corporations are constrained by the norm of transparency in developing authentic moral behaviour, while also exercising power and control since in the information society transparency does not, and indeed cannot, lead to revealing all. Transparency places greater emphasis on judging, or evaluating existing organisational processes than on assessment of (self-)learning processes based on what actually takes place when corporations make decisions. Reducing non-core food advertising to children is an important priority in strategies to address childhood obesity. Public health researchers argue for government intervention on the basis that food industry self-regulation is ineffective; however, the industry contends that the existing voluntary scheme adequately addresses community concerns. This paper examines the operation of two self-regulatory initiatives governing food advertising to children in Australia, in order to determine whether these regulatory processes foster transparent and accountable self-regulation. The paper concludes that while both (...) codes appear to establish transparency and accountability mechanisms, they do not provide for meaningful stakeholder participation in the self-regulatory scheme. Accordingly, food industry self-regulation is unlikely to reflect public health concerns or to be perceived as a legitimate form of governance by external stakeholders. If industry regulation is to remain a feasible alternative to statutory regulation, there is a strong argument for strengthening government oversight and implementing a co-regulatory scheme. This paper highlights the complex and fractured nature of EU governance, before examining various ways of introducing more light into the various dark recesses of current governance structures. The debate on transparency at the EU level is viewed through the prism of deliberative democracy and enabling more effective citizen participation in the governing processes. This model of democracy considers political participation by citizens in a broad sense which is not limited to participation in strictly political institutions (voting). From this (...) perspective the ability of citizens to effectively participate in social dialogue, in the broad sense of the term, is a definite attribute of democracy. The ability to participate in social dialogue depends to a large extent on accessibility of information and accessibility of the dialogue itself. The role of advanced information technology is obvious. It not only facilitates access to relevant information crucial for will formation processes but also facilitates social dialogue among citizens. Some form of organized and networked ‘active’ citizenry is moreover required‐ aware, committed and potent. This paper will thus further argue that ‘civil society’ (defined as in any event embracing the not for profit, public interest sector) at the EU level has a special role to play in this regard and will explore in outline some possible means of institutionalising this role in the highly specific EU context. As per the teachings of Islam, social trust involves placing others as the pillars of the Islamic countries, which needs to be maintained. Therefore, any promise or action that undermines the social trust of the people as a social capital is one of the most important anti-social factors that must be dealt with. In view of that, Islam is struggling against hypocrisy as an antisocial trend, because it damages social trust when a hypocrite preaches one thing and does another; in (...) other words, the deeds do not confirm the words. That is why citizens cannot believe and trust in their promises, because such individuals do not fulfil them at any time. In this context, officials are suggested to respect the principle of transparency in the governance of Islamic societies in order to improve citizens’ social trust. Therefore, the present study aimed to investigate the role of transparent governance based on the teachings of Nahj al-Balagha in creating social trust among 428 Iranian Muslim citizens in 2022. In sum, the results indicated that transparent governance has a significant positive effect on citizens’ social trust in the officials of Islamic societies, as calculated by structural equation modelling in Linear Structural Relations (LISREL) (path coefficient = 0.58; t -value = 5.54). Contribution: This study provided a new insight into the role of transparent governance in creating and strengthening social trust among the officials and citizens of Islamic societies, which deserves further attention by governments and researchers. In Switzerland, the importance of transparency in animal experimentation is emphasized by the Swiss Federal Council, recognizing the public’s great interest in this matter. Federal reporting on animal experimentation indicates a total of 585,991 animals used in experiments in Switzerland in 2022. By Swiss law, the report enables the public to learn about many aspects such as the species and degree of suffering experienced by the animals, but some information of interest to the public is missing, such as the (...) fate of the animals at the end of the experiment (e.g., euthanized, rehomed in a private home, reused in another experiment). When it comes to animals bred in facilities but not used in experiments, further information of interest is not required to be made public according to Swiss law, for example, the number and fate of “surplus” animals (i.e., animals bred but not used in experiments for a variety of reasons such as not carrying the phenotypical properties needed). Considering that the Swiss government has a duty to provide a full accounting of animal experimentation conducted on the public’s behalf, further relevant information should be disclosed. While efforts toward transparency, such as the STAAR Agreement, have been made in the scientific community, these mostly reflect the legal requirements already in force. If Switzerland is to move toward more transparency in public information on animal experimentation, an update of the legal requirements is needed. In this article, we give recommendations for Swiss law to move toward more transparency in public information on seven aspects: (1) the fate of the animals at the end of the experiment; (2) the sources of funding for animal experimentation; (3) the harm-benefit analysis performed by researchers and ethics committees to justify an experiment using animals; (4) the number of breeding/surplus animals; (5) the fate of breeding/surplus animals; (6) the harms experienced by animals in facilities; and (7) the funding of animal facilities. To clarify positions of various stakeholder groups in their joint search for acceptable solutions, the concept of animal welfare was split up into three notions: no suffering, respect for intrinsic value, and non-appalling appearance of animals. This strategy was based on the hypothesis that multi-stakeholder solutions should be based on shared values rather than on compromises. The usefulness of such an artificial value distinction strategy was tested in (...) a small series of experiments. The results demonstrate that the chosen concept to distinguish between values is effective in a stakeholder context. Farmers’ views on doing good to animals appeared to be largely based on their value to prevent suffering and predominantly focused on the provision of regular care. Their priority for this value is clearly shared with other stakeholders, providing a basis for joint solutions. The concept of intrinsic value does not play a discernable role in farmers’ considerations. Based on the varying views on welfare, it can be inferred that there is a gradual rather than a principal difference between government legislation and farmers’ values, whereas public perception and acceptance of farm practices remains complicated. Distinction between value groups and focusing on a selected notion (such as no suffering) proved to be effective in bringing representatives of stakeholder groups together, but is unlikely to bridge the emotional gap between commercial farm practices and public ideals. Corruption within the private sector has often not been dealt with in Brazil. Organizations may find corrupt acts in its operations or practices, but specific concepts and programs to avoid them are neither concrete nor clear. Some Brazilian stockholders have become aware of the risks involved in unethical procedures and are adopting the Best Practices of Corporate Governance initiative. International agencies have intensively supported organizations and governments in an effort to define policies that inhibit illegal or corrupt cultural habits throughout (...) the world, but Brazilian practitioners show insufficient response. Skepticism may indicate a lack of understanding about how an ethical leadership can guide employees, setting high standards for the organizational culture and climate, clearly defining limits of correct behavior, and creating appropriate codes of ethics. Transparency still has to be discovered as a significant tool to encourage professionalism in performance and reporting of data in Brazilian companies. In this article, we analyze the ethical behavior of the purchasing department of a multinational company in its host country, Brazil. It focuses specifically on the supplier–buyer relationship. The results indicate that despite the negative reputation Brazilians have in business ethics, a company can still develop a positive and ethical relationship with its stakeholders. Communication, transparency, compliance with the company’s code of conduct as well as the supplier’s awareness of the buyer’s code of conduct are the factors which influence the supplier–buyer relationship. Transparency can be used as a tool to reduce corruption, thereby increasing ethical behavior and company image. Good ethical behavior can help to build up a company’s image. (shrink)

Openness implies bottom-up empowerment and top-down transparency. The Paradox of Openness analyses the tensions encountered when openness is applied to the quest for democracy and markets, freedom and truth, compliance and transparency, and consensus and dissent in progressive Nordic societies.

The post-war Western world has seen a gradual shift from government to governance, a process that also concerned the issues related to agro-food sustainability, such as food quality, environmental impact, social justice, and farm animal welfare. Scholars believe that social media are a new site that reconfigures relations between various actors involved in the governance of these problems. However, empirical research on this matter remains scarce. This paper fills this gap by examining the case of Februdairy, a Twitter hashtag (...) campaign to promote the British dairy industry, hijacked by animal protection activists. For this case, I employ the relational perspective on technology affordances—as operationalised by Faraj and Azad, Materiality and organizing. Social interaction in a technological world, Oxford University Press, Oxford, 2012)—to highlight two distinct strategic modes of embracement of social media functionalities by the opposing groups: hashtag hijacking and crowdsourcing transparency. The analysis reveals also that a pre-existing social structure of the agro-food system conditions reconfiguration of social relations by technology in a way that actually strengthens the tendency to govern the issue of farm animal protection with market mechanisms. Building on conceptual insights from the history and sociology of numbers, media and surveillance studies, and theories of governance and risk, this article analyzes the forms of transparency produced by the use of numbers in social life. It examines what it is about numbers that often makes their ‘truth claims’ so powerful, investigates the role that numerical operations play in the production of retrospective, real-time and anticipatory forms of transparency in contemporary politics and economic transactions, and discusses some (...) of the implications resulting from the increasingly abstract and machine-driven use of numbers. It argues that the forms of transparency generated by machine-driven numerical operations open up for individual and collective practices in ways that are intimately linked to precautionary and pre-emptive aspirations and interventions characteristic of contemporary governance. As such, these numerical operations raise important political and ethical questions that deserve further conceptual and empirical scrutiny. (shrink)

According to the Dutch Ministry of Economic Affairs (2001), transparency by means of Sustainability Reporting should lead to better Corporate Social Responsibility (CSR) performance of companies. Sustainability Reporting should also give consumers the information they need to purchase the most sustainable products available (Dutch Ministry of Economic Affairs, 2004). This article analyses the driving factors influencing CSR and Sustainability Reporting at seven breweries in the Netherlands. It also gives a better understanding of organizational behaviour with reference to CSR and (...) the reasons breweries have for Sustainability Reporting. The Dutch government has no intention of forcing organizations to publish a sustainability report, since it is trying to diminish the volume of legislation. Rather, the government prefers to rely on the willingness and initiatives of organizations to make CSR a success. In 2006, the Dutch Ministry of Economic Affairs will evaluate the effect of its CSR policy. But is it a success already? During our research, breweries appeared to find CSR more important than Sustainability Reporting. Sustainability reporting is, for most breweries, not the way to reach stakeholders. Most stakeholders have their own means for receiving information e.g. annual reports, meetings, public statements and press releases. Although small breweries think CSR is very important, they feel no pressure from outside to publish a sustainability report. For them it is very complex and expensive to publish a sustainability report. Large breweries feel pressure from many stakeholders to be transparent, but not on a regular basis. We conclude from this research that CSR does not stimulate Sustainability Reporting, but neither does Sustainability Reporting stimulate CSR. (shrink)

The research aims to investigate the characteristics and risks associated with the handling of sensitive data in the implementation of public policies within the digital government model. To achieve this, a hypothetical-deductive method and bibliographic and documentary procedures are employed, proposing an interdisciplinary discussion on technological advancement, data protection, transparency, and public policies. The justification revolves around the importance of a comprehensive, cohesive system that genuinely protects sensitive personal data, considering the need to keep pace with technological developments (...) and maintain a minimum level of security in the digital age at both national and international levels. There is no doubt that the judicious and strategic use of data has the potential to drive substantial improvements in policy evaluation, decision-making, and the relationship between government and citizens. Recent scandals such as those involving Enron and WorldCom (USA), Nortel and Crocus (Canada), and Parmalat and Royal Ahold (EU) exposed failures in corporate governance that shook the capital markets in developed countries and put the spotlight on weak corporate governance in developing, emerging and transitional economies. Companies from developing economies with weak financial transparency and governance will find it difficult to raise capital and attract foreign investors. We investigate the challenges and evaluate the progress of corporate governance in (...) Egypt. Using historical, empirical and interview data, we review the development of stock markets and accounting and financial reporting standards. We analyse the structure of capital markets, major players in the economy, the privatisation policy, board structure and the cultural and legal environment of corporate governance. We review initiatives and impediments for improving corporate governance, including the establishment of the Egyptian Institute of Directors. Among politicians and policy-makers it is almost universally assumed that more transparency in government is better. Until now, philosophers have almost completely ignored the topic of transparency, and when it is discussed there seems to be an assumption that increased transparency is a good thing, which results in no serious attempt to justify it. In this book Brian Kogelmann shows that the standard narrative is false and that many arguments in defence of transparency are weak. (...) He offers a comprehensive philosophical analysis of transparency in government, examining both abstract normative defences of transparency, and transparency's role in the theory of institutional design. This article identifies how democracy and transparency in Thailand have been subverted since 2001. Specifically, it appraises the sentiments and trends that have been in place since 1993 to prevent a return to authoritarian government. Additionally, it also examines structures and policies that have thwarted democratic consolidation since 2000. The central hypothesis of the article is that there has been a structural weakening of democracy in Thailand under the Thai Rak Thai government since 2001. In other words, (...) Transparency is a crucial condition to implement a CSR policy based on the reputation mechanism. The central question of this contribution is how a transparency policy ought to be organised in order to enhance the CSR behaviour of companies. Governments endorsing CSR as a new means of governance have different strategies to foster CSR transparency. In this paper we discuss the advantages and disadvantages of two conventional policy strategies: the facilitation policy and the command and control strategy. (...) Using three criteria (efficiency, freedom and virtue) we conclude that both strategies are defective. Most attention is paid to the facilitation strategy since governments nowadays mainly use this. In evaluating this strategy we analyse the Dutch case. As an alternative we introduce a third government policy: the development of a self-regulating sub-system. By construing an analogy with the historical development of corporate financial disclosure, we point out that the vital step in the creation of a self-regulating subsystem is the creation of strong informational intermediate organisations. BackgroundBiobanks have recently been established in several low- and middle-income countries in the Arab region of the Middle East. We aimed to explore the views of biobank managers regarding the challenges, ethical issues, and governance arrangements of their biobanks.MethodsIn-depth semi-structured qualitative interviews were conducted with a purposive sample of eight biobank managers from Egypt, Jordan, and Sudan. Interviews were performed either face-to-face, by phone, or via Zoom and lasted approximately 45–75 min. After verbal consent, interviews were recorded and then transcribed. (...) The authors performed a thematic analysis of the transcripts independently and then integrated the themes via a consensus process.ResultsBiobank managers discussed the main challenges in establishing their biobanks. These included the staff’s lack of experience and training, limited funds, deficit awareness of biobanks, obtaining funding from different sources. Only four reported they were active in distributing biospecimens and health data to researchers. Six biobanks used a broad consent model, one used tiered consent, and another allowed participants to opt-out of being recontacted. Five managers avoided partnerships with pharmaceutical companies due to concerns with unfavorable reactions from the community. Five managers did not have clear policies for returning research results to the donors. Five expressed challenges with sample and data sharing with international collaborators; all five used material transfer agreements. The biobank managers revealed variable governance arrangements and activities with community involving awareness and educational efforts rather than active engagement. Several expressed the importance of transparency with the operations of their biobanks and gaining the trust of their stakeholders.ConclusionManagers of biobanks in LMICs in the Arab Middle East encounter financial, operational, and social challenges toward their sustainability efforts. Discussions with key stakeholders are warranted to manage ethical issues involving informed consent, privacy, data sharing, and the return of results. We recommend that biobank managers in the Arab Middle East form collaborative networks within the region and internationally, develop trusting governance relationships with their stakeholders, and pursue engagement activities with their communities to enhance trust. Freedom of information laws promote transparency by permitting individuals and organizations to obtain government documents. However, exemptions from disclosure are necessary to protect privacy and to permit government officials to deliberate freely. Deliberative language is often the most challenging and burdensome exemption to detect, leading to high processing costs and delays in responding to open-records requests. This paper describes a novel deliberative-language detection model trained on a new annotated training set. The deliberative-language detection model is a component (...) of a decision-support system for open-records requests under the US Freedom of Information Act, the FOIA Assistant, that ingests documents responsive to an open-records requests, suggests passages likely to be subject to deliberative language, privacy, or other exemptions, and assists analysts in rapidly redacting suggested passages. The tool’s interface is based on extensive human-factors and usability studies with analysts and is currently in operational testing by multiple US federal agencies. (shrink)

In recent years, many Small Island Developing State governments have worked to increase openness and transparency of their transactions as a means to enhance efficiency and reduce corruption in their economies. In order to achieve a cost-effective and efficient strategy to implement a transparent government, Information Communication Technologies offer an opportunity of virtualization by deploying e-government services to promote transparency, accountability and consistency in the public sector and to minimize corruption. This paper explores the potential impact (...) of government virtualization by SIDS and against corruption by comparing the corruption perception index rates of 15 SIDS countries. The CPI relates to the degree by which corruption is perceived to exist among public officials and politicians by business people and country analysts. In order to reveal the long-term impact of virtual deployment and its consequences on corruption, an in-depth case analysis based on the CPI index rates was conducted on the deployment of the e-government system in Cyprus. Open Government gilt vielfach als die universale Staatsdoktrin für das 21. Jahrhundert, ohne dass schon klar wäre, was sich im Einzelnen hinter diesem Schlagwort verbirgt und was daraus für die Praxis des Regierens und Verwaltens folgt. In diesem Band untersucht der Autor alle Bauteile dieser Konstruktion kritisch: das Paradigma der Offenheit, dem sich alles unterordnen soll, die drei Säulen Transparenz, Partizipation und Kollaboration, die das Ganze tragen sollen, aber auch die technischen und ideologischen Fundamente, auf denen das Modell ruht. (...) Im Zentrum steht dabei stets die Frage, was Open Government für Staat und Demokratie hierzulande bedeuten würde. Im Ergebnis zeigt sich, dass dieses Konstrukt technokratische Züge trägt und aus einer »kalifornischen Ideologie« hervorgeht, die es erst noch politisch zu bewerten gilt. Wenn sowohl die Giganten des Internets als auch emphatische Aktivisten Open Government massiv propagieren, darf kritische Reflexion nicht auf der Strecke bleiben. Wewer bezweifelt, dass Open Government als Leitbild für das digitale Zeitalter taugt, dem im Prinzip alle Länder dieser Welt nacheifern könnten. CSR has become an important element in the business strategy of a growing number of companies worldwide. A large number of initiatives have been developed that aim to support companies in developing, implementing, and communicating about CSR. The Global Compact (GC), initiated by the United Nations, stands out. Since its launch in 2000, it has grown to about 2900 companies and 3800 members in total. The GC combines several mechanisms to support CSR strategies: normative principles, networks for learning and co-operation, (...) and communication and transparency about CSR activities. However, up to now only a few empirical evaluations of the contribution of the GC to CSR strategies have been conducted that however have not differentiated between different types of companies (regarding type of industry or regarding the maturity of CSR). This paper aims to partly fill this knowledge gap by a case study examination of three frontrunner companies in the telecommunications industry. The results show that the GC is only one of the many initiatives that these companies employ in shaping, implementing, and reporting about their CSR strategies, and that its role is at most modest. There are two important reasons. One is that many of the CSR issues that these companies deal with are industry specific and are hence addressed in specific networks. The second reason is that the GC principles are perceived as minimum requirements that do not provide many incentives to the three case study companies to perform better. A differentiation of norms for GC members is expected to enhance the contribution of the GC to CSR strategy employment, not only for frontrunner companies but as well for other categories of companies. The increasing use of artificial intelligence (AI) by public actors has led to a push for more transparency. Previous research has conceptualized AI transparency as knowledge that empowers citizens and experts to make informed choices about the use and governance of AI. Conversely, in this paper, we critically examine if transparency-as-knowledge is an appropriate concept for a public realm where private interests intersect with democratic concerns. We conduct a practice-based design research study in which we prototype and (...) evaluate a transparent smart electric vehicle charge point, and investigate experts’ and citizens’ understanding of AI transparency. We find that citizens experience transparency as burdensome; experts hope transparency ensures acceptance, while citizens are mostly indifferent to AI; and with absent means of control, citizens question transparency’s relevance. The tensions we identify suggest transparency cannot be reduced to a product feature, but should be seen as a mediator of debate between experts and citizens. (shrink)

One of the major roadblocks in conducting Environmental Corporate Social Responsibility (ECSR) research is operationalization of the construct. Existing ECSR measurement tools either require primary data gathering or special subscriptions to proprietary databases that have limited replicability. We address this deficiency by developing a transparent ECSR measure, with an explicit coding scheme, that strictly relies on publicly available data. Our ECSR measure tests favorably for internal consistency and inter-rater reliability, as well as convergent and discriminant validity.

Transparency is an increasingly prominent area of research that offers valuable insights for organizational studies. However, conceptualizations of transparency are rarely subject to critical scrutiny and thus their relevance remains unclear. In most accounts, transparency is associated with the sharing of information and the perceived quality of the information shared. This narrow focus on information and quality, however, overlooks the dynamics of organizational transparency. To provide a more structured conceptualization of organizational transparency, this article unpacks (...) the assumptions that shape the extant literature, with a focus on three dimensions: conceptualizations, conditions, and consequences. The contribution of the study is twofold: On a conceptual level, we provide a framework that articulates two paradigmatic positions underpinning discussions of transparency, verifiability approaches and performativity approaches; on an analytical level, we suggest a novel future research agenda for studying organizational transparency that pays attention to its dynamics, paradoxes, and performative characteristics. Corruption in public administration is a serious problem that negatively affects society and the functioning of the State. It is essential to address this issue effectively to promote transparency, integrity and trust in government institutions. This research aims to review the existing literature on the evaluation of corruption and its effects on the effectiveness of public administration. Three research questions were posed following the PICO methodology (1) What is the effect of corruption on the population's trust in (...) class='Hi'>government institutions?, (2) What mechanisms to prevent and combat corruption in public administration have been implemented in different countries?, (3) What is the impact of corruption on government efficiency? The investigations were carried out using the Scopus database and Web of Science for which inclusion and exclusion criteria were applied to identification, screening and including 40 relevant articles. The results elucidate citizens' perception of corruption in public administration, as well as the sources that cause this scourge. In addition, the key findings of the review are presented, including the mechanisms to prevent and combat corruption implemented in different contexts. It is concluded that to combat corruption requires a joint effort from society, the government and entities in order to promote transparency and strengthen institutions, which in turn will contribute to building a more just and trustworthy society.
