The administration or recognition of religious courts is a form of religious accommodation present in many constitutional states today commonly analysed in legal pluralism terms. This article contributes to the further analysis of the relationship between legal pluralism and rights in religiously diverse societies by examining the status of state religious courts and their interaction with state non-religious courts. In particular, I examine what Cover calls “jurisdictional redundancies” between the courts and conceptualize the allocation of power between religious and non-religious (...) courts as a potentially productive site of interlegality. In doing so, I support concurrent jurisdictional allocations, arguing that exclusive jurisdiction could result in what I call an interlegal gap, whereby instead of inter-penetration of norms and production of reconciliatory principles, there is a justice gap whereby litigants may find themselves unable to obtain appropriate legal recourse including when neither court is willing to assume jurisdiction over the matter. This requires us to see the relationship between religious courts and non-religious courts through the more mundane but more practical lens of jurisdictional overlaps and competition, rather than through the more abstract framing of normative or even civilizational clashes. Accordingly, I argue that concurrent jurisdiction and interlegality have greater potential to strike a balance between individual and group rights and could be more protective of religious diversity. In other words, I argue for a closer, rather than a more separate, relationship between religious and non-religious courts, while denying that a hierarchical relationship where religious courts are subordinated to non-religious courts is the only way to protect rights. Research has shown that individuals with high levels of psychopathic personality traits are likely to cause harm to others in the workplace. However, there is little academic literature on the potentially adaptive outcomes of corporate psychopathy, particularly because the “boldness” psychopathy domain has largely been under-acknowledged in this literature. This study aimed to elaborate on past findings by examining the associations between psychopathy, as operationalized using scales from the relatively new triarchic model of psychopathy, and both adaptive and maladaptive workplace (...) behaviors. Participants were 343 working community adults who completed a series of self-report questionnaires that measured psychopathy and various workplace behaviors, including counterproductive work behaviors, tactics of influence, unethical decision-making, leadership strategies, team play, and creativity. Structural equation modeling was used to estimate the associations between latent constructs of boldness, meanness, and disinhibition, and the eight different constructs related to workplace behaviors. It was found that boldness preferentially predicted the use of soft tactics of influence, adaptive leadership, and team play, and negatively predicted passive leadership. Meanness predicted unethical decision-making, poor team play, and hard tactics of influence. Disinhibition positively predicted CWB and passive leadership. Meanness also moderated the association between disinhibition and CWB, in that greater scores on both psychopathy domains indicated greater levels of CWB. These findings provide conceptual support for the triarchic model, including the “boldness” domain, which measures adaptive aspects of psychopathy in addition to maladaptive ones, as well as suggest that not all individuals high on psychopathy would be an overt menace to the workplace. The different psychopathy traits may also interact with each other to predict different types or levels of workplace behaviors. (shrink)

Recently, a number of neuroscientists and philosophers have taken the so-called predictive coding approach to support a form of radical neuro-representationalism, according to which the content of our conscious experiences is a neural construct, a brain-generated simulation. There is remarkable similarity between this account and ideas found in and developed by German neo-Kantians in the mid-nineteenth century. Some of the neo-Kantians eventually came to have doubts about the cogency and internal consistency of the representationalist framework they were operating within. In (...) this paper, I will first argue that some of these concerns ought to be taken seriously by contemporary proponents of predictive coding. After having done so, I will turn to phenomenology. As we shall see, Husserl’s endorsement of transcendental idealism was partially motivated by his rejection of representationalism and phenomenalism and by his attempt to safeguard the objectivity of the world of experience. This confronts us with an intriguing question. Which position is best able to accommodate our natural inclination for realism: Contemporary neuro-representationalism or Husserl’s transcendental idealism? (shrink)

Guided by Basic Psychological Need Theory, we investigated the combined associations between need satisfaction and need frustration and their relations with theoretically relevant correlates including mindfulness, physical literacy, physical activity enjoyment, and physical activity. The participants were Singapore-based school students who completed a cross-sectional survey. The results of the latent profile analysis identified four distinct need profiles: profile 1–average satisfaction and frustration ; profile 2–low satisfaction, above average frustration; profile 3–very high satisfaction, very low frustration ; and profile 4–high satisfaction, (...) very high frustration. Among these, profile 3 was the most adaptive one; it had the highest levels of mindfulness, physical literacy, physical activity enjoyment, and moderate-to-vigorous physical activity. Experiences of need satisfaction countered the negative effects of need frustration on these correlates. These findings enhance our understanding of students’ psychological need experiences and highlight the need for investigating the combined associations between need satisfaction and need frustration. I examine Bernard Williams’s forceful challenge that evolutionary science has done away with the sort of teleological worldview that is needed in order to make sense of an Aristotelian virtue ethic perspective. I also consider Rosalind Hursthouse’s response to Williams and argue that it is not sufficient. My main task is to show what is needed in order to meet Williams’s challenge. First, I argue that we need a deeper exploration of the first-personal evaluative standpoint from within our human form (...) of life than we find in Hursthouse’s ethical naturalist perspective. In particular, we need to recognize the important role of “strong evaluation” for identifying what is noblest and best about us as human beings, for this will enable us to address the “mixed bag” problem of human nature. Second, I argue—contra John McDowell’s quietism—that in order to make sense of such a normative account of human nature we must overcome Williams’s tragic cosmic outlook according to which human life is seen as ultimately without meaning and purpose. Peirce's career as a logician spanned almost half a century, during which time he produced several increasingly complex sign systems. The best-known, from 1903, defined amongst other things a signifying process involving sign, object and interpretant, the universally-known icon-index-symbol division and a set of 10 distinct classes of signs. Peirce subsequently expanded this process to include 2 objects, the sign and 3 interpretants. Uncoincidentally, in the 5 years between 1903 and the final system of 1908, he introduced a number of (...) highly innovative semiotic concepts which he never developed. One such concept is hypoiconicity, which comprises 3 levels of isomorphism holding between sign and object and, in spite of the mutations these varieties of icon subsequently underwent, offers qualitative analysis as a complement to the traditional literal-figurative binarism in the discussion of verbal and nonverbal signs. Another is semiosis, which Peirce introduced and defined in 1907 but only rarely illustrated. Involving a complex combination of object, perception, interpretation and a medium, this is shown to be a far more complex signifying process than the one implicit in the three-correlate definition of the sign of 1903. Exploring the evolving theoretical background to the emergence of these new concepts and showing how they differ from certain contemporary conceptions of sign, mind and signification, the book proposes an introduction to, and explanations and illustrations of, these important developments. The neuroethics field emerged in the early 2000s in an effort to face important philosophical dilemmas and anticipate disruptive social changes linked to the use of neurotechnology (Safire, 2002). From very early on, this field grew out of two core issues, namely inquiries into the ethics of neuroscience –concerning the moral use of knowledge and technology– and inquiries into the neuroscience of ethics –on how new brain function evidence can change human self-understanding (Roskies 2002). Similarly, neurolaw is now on a (...) parallel path with two main pillars as Chandler (2018) suggested, (1) “self-reflexive inquiry” (the neuroscience of law) and (2) “inquiry into the development and use of brain science and technologies” (the law of neuroscience). In this paper, I suggest that these two lines of research are still excessively disconnected from one another and, to support this claim, I analyze the three potential point-of-no-return risks that Aldous Huxley associated with technological challenges, namely centralization of power, bureaucratic alienation, and scientific idealism. In addition, I show how Huxley shifted analysis of technological problems from a focus on the rights of potential victims to the duties of potential aggressors. Finally, I argue that Aldous Huxley’s view on how to build a bridge that brings pillars 1) and 2) closer together also helps prevent the technological point-of-no-return. According to Huxley, the key is found in paying particular attention to understanding contemplative activity, reinforcing its role in the study of reality, and, eventually, returning the romantic gaze updated to academia. This article recounts how Neo-Scholastic international lawyers navigated the complex political landscape of the 1920s and 30s, combining universalism, nationalism and religious belief. Participating in the contemporary re-engagement of Catholics with modern politics, they re-imagined the international legal order in Catholic terms. They argued that a universal morality, overruling the extremes of state sovereignty, was the only solid basis for just and stable global legal relations. While the contribution of Catholics to the establishment of the post-war world order and the (...) rise of human rights is widely acknowledged, the interwar genealogy of these developments is not. Reading these thinkers’ universalist legal tenets in conjunction with their political trajectories provides a relevant frame to understand the moral charge characterizing international law in the early years of the Cold War. This paper analyzes three contrasting strategies for modeling intentional agency in contemporary analytic philosophy of mind and action, and draws parallels between them and similar strategies of scientific model-construction. Gricean modeling involves identifying primitive building blocks of intentional agency, and building up from such building blocks to prototypically agential behaviors. Analogical modeling is based on picking out an exemplary type of intentional agency, which is used as a model for other agential types. Theoretical modeling involves reasoning about intentional agency in (...) terms of some domain-general framework of lawlike regularities, which involves no detailed reference to particular building blocks or exemplars of intentional agency. Given the contrasting procedural approaches that they employ and the different types of knowledge that they embody, the three strategies are argued to provide mutually complementary perspectives on intentional agency. This article addresses the notion of Latin American baroque, linking its aesthetic and interpretive dimension with the cognitive, to develop a located epistemology in Latin America, consistent with its tradition and cultural history. This exercise requires a transdisciplinary effort, therefore this article takes the form of notes, in the context of a broader research program focusing on the contribution of the sociologist Pedro Morandé and writers Pablo Rokha and José Lezama Lima, in a transdisciplinary perspective that assumes theories of knowledge (...) grounded in the identification of Baroque and Latin American appropriations as core of our cultural substrate and therefore epicenter of reflection on identity; developing emerging forms of writing grounded in a metalanguage that appeals to the neo-baroque as a foundation. En este artículo se aborda la noción de barroco latinoamericano, vinculando su dimensión estética e interpretativa con la cognoscitiva, para dar pistas en el desarrollo transdisciplinario de una forma de epistemología situada en Latinoamérica, coherente con su tradición e historia cultural. This article discusses some essential differences between the Cartesian and neo-Aristotelian conceptions of child development. It argues that we should prefer the neo-Aristotelian conception since it is capable of resolving the problems the Cartesian conception is confronted by. This is illustrated by discussing the neo-Aristotelian alternative to the Cartesian explanation of the development of volitional powers, and the neo-Aristotelian alternative to the Cartesian simulation theory and theory–theory account of the development of social cognition. In recent years, the self-representational theory of consciousness emerged as a trend that moves beyond the debates between first-order and higher-order theorists, and the HOP (higher-order perception) versus HOT (higher-order thought) debates among higher-order theorists. This theory seems to offer us a model of consciousness that is closer to truth, but it also has limitations. My study will particularly address these limitations and attempt to overcome them by developing a theory of consciousness that is deeply rooted in the Buddhist epistemological (...) tradition. I will illustrate the dual-aspect structure of consciousness and criticize the self-representational theory for collapsing the distinction between these aspects.
