This article underscores the dilemma posed by the exclusivist view of the tradition-modernity contrast for anyone interested in the project of returning and belonging to the African community. On the exclusivist view, tradition and modernity are irreconcilable. After discussing the tradition-modernity contrast in the fields of sociology and academic African philosophy, this article adopts an eclectic view of tradition as an alternative to the exclusivist view. The alternative view enables those interested in the project of returning and belonging to retrieve (...) those elements of tradition that have enduring values in order to utilize them creatively in various development projects. It is argued that this creative synthesis of traditional and modern elements is necessary to build viable contemporary African societies in which individuals feel a sense of belonging and identity. This paper presents the most relevant criteria considered in the face of a lack of resources and medical infrastructure to prioritize the treatment of patients affected by the COVID-19 pandemic. From a systematic review, points of view have been collected considering the medical and social fields. Multiple divergences were found in these views depending on the countries, resources, religious approaches, and political aspects that have been adapted according to the circumstances of each nation. Deep brain stimulation (DBS) is a developing technology. New generations of DBS technology are already in the pipeline, yet this particular fact has been largely ignored among ethicists interested in DBS. Focusing only on ethical concerns raised by the current DBS technology is, albeit necessary, not sufficient. Since current bioethical concerns raised by a specific technology could be quite different from the concerns it will raise a couple of years ahead, an ethical analysis should be sensitive to such alterations, or (...) it could end up with results that soon become dated. The goal of this analysis is to address these changing bioethical concerns, to think ahead on upcoming and future DBS concerns both in terms of a changing technology and changing moral attitudes. By employing the distinction between inherent and noninherent bioethical concerns we identify and make explicit the particular limits and potentials for change within each category, respectively, including how present and upcoming bioethical concerns regarding DBS emerge and become obsolete. Many of the currently identified ethical problems with DBS, such as stimulation-induced mania, are a result of suboptimal technology. These challenges could be addressed by technical advances, while for instance perceptions of an altered body image caused by the mere awareness of having an implant may not. Other concerns will not emerge until the technology has become sophisticated enough for new uses to be realized, such as concerns on DBS for enhancement purposes. We study probabilistic logic under the viewpoint of the coherence principle of de Finetti. In detail, we explore how probabilistic reasoning under coherence is related to model- theoretic probabilistic reasoning and to default reasoning in System . In particular, we show that the notions of g-coherence and of g-coherent entailment can be expressed by combining notions in model-theoretic probabilistic logic with concepts from default reasoning. Moreover, we show that probabilistic reasoning under coherence is a generalization of default reasoning in System (...) . That is, we provide a new probabilistic semantics for System , which neither uses infinitesimal probabilities nor atomic bound (or big-stepped) probabilities. These results also provide new algorithms for probabilistic reasoning under coherence and for default reasoning in System , and they give new insight into default reasoning with conditional objects. An icon is part of the visible world, moreover, of things that are visible in a second degree. It is not only a sensitive thing, but a sensitive image of a sensitive entity. As an eikon, it is located in a platonic sense among the lowest degree of the doxa, and within the lowest degree of the scale of being. However it is not a simple sensitive and illusory representation of God, such as one criticized from a Kantian point of (...) view. The profound sense of an icon lies in its opening towards the invisible. An icon tries to capture the invisible. How is this meeting point of the visible and the invisible entangled? The article argues that feminist emancipation, understood as practices and discourses of self-development and of solidarity as empowerment, has become entangled with the neoliberal project. Indeed, emancipation as self-improvement has become synonymous with moral regulation projects that seek to adapt women to global capitalism. The article explores the relation between emancipation and neoliberal regulation from a situated approach by addressing the experience of Latin American feminisms, with a particular focus on Chile. On occasion, I am appointed by our local probate court to help make health care decisions for patients who are no longer capable of making these decisions for themselves. I'll visit my client in the hospital and review his or her chart, and I'll have numerous opportunities to talk about the illness and treatment options with attending physicians, residents, and nurses. My phone calls to them will be returned promptly. If doctors arrive at the conclusion that nothing further can be (...) done for the patient, we'll discuss how best to proceed. This end‐of‐life talk never comes as a surprise to me because I will have been included in the team's decision‐making process, in the manner of professionals interacting with another professional. Last fall, I became a family surrogate decision‐maker after my mother was hospitalized over the course of a few months, for a number of reasons, in three hospitals in New York. I assumed I would manage her care as I did my clients’, with a sense of control and involvement in the process, but I quickly learned that I had in fact entered a kind of alternate universe as far as decision‐making was concerned. The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

The case of Charlie Gard sparked an ongoing public and academic debate whether in court decisions about medical treatment for children in England & Wales the best interests test should be replaced by a harm threshold. However, the literature has scantly considered (1) what the impact of such a replacement would be on future litigation and (2) how a harm threshold should be introduced: for triage or as standard for decision-making. This article directly addresses these gaps, by first analysing reported (...) cases in England & Wales about medical treatment in the context of a S31 order, thus using a harm threshold for triage and second comparing court decisions about medical treatment for children in England & Wales based on the best interest test with Dutch and German case law using a harm threshold. The investigation found that whilst no substantial increase of parental discretion can be expected an introduction of a harm threshold for triage would change litigation. In particular, cases in which harm is limited, currently only heard when there are concerns about parental decision-making, may be denied a court hearing as might cases in which the child has lost their capacity to suffer. Applying a harm threshold for triage in decisions about withholding or withdrawing life-sustaining treatment might lead to a continuation of medical treatment that could be considered futile. It is commonly thought that that the best system account of lawhood ((Mill (1843), Ramsey (1978)[fp. 1928], Lewis (1973)) makes available a nice explanation for why laws are ‘distinctively appropriate targets of scientific inquiry’ (Hall, 2015). The explanation takes the following general form: laws are especially valuable for agents like us because they efficiently encode a lot of valuable (non-nomic) information in a tractable format. The goal of this paper is to challenge this style of explanation: I argue that the (...) general principle it presupposes is in conflict with our best account of practical rationality. After considering and rejecting a number of proposals for dissolving the tension, I conclude that BSA proponents may need to scale back the explanatory ambitions of their theory; in particular, they may need to give up the hope of non-circular explanations of the value of nomic information. O filósofo da arte, Arthur Danto, propõe um sistema filosófico no qual a questão de saber o que é arte exerce uma função estrutural. No entanto, o que propomos aqui é uma espécie de recuo que se volta a uma questão de fundo: o que Danto entende por filosofia? Visto que o percurso, oferecido pelo autor, para responder à questão, passa pela aproximação entre filosofia e literatura, tentaremos explorar os limites entre essas duas práticas textuais e expor os passos argumentativos (...) através dos quais Danto pretende devolver à filosofia a complexidade que é aplainada pela prática acadêmica/filosófica da contemporaneidade, ao aproximar-se demasiadamente do modelo estabelecido pela prática científica. Para tanto, será necessário explorar – tanto na filosofia, quanto na literatura – o estatuto do estilo, o papel da semântica e a centralidade da figura do leitor, tomado como sujeito real no qual o texto realiza seu caráter transfigurativo. Por fim, não obstante a grande importância atribuída pelo autor à aproximação entre filosofia e literatura, a tarefa que se impõe é a de saber se restam, ainda, elementos característicos capazes de distingui-las. Abstract:Brain–computer interfaces (BCIs) can enable communication for persons in severe paralysis including locked-in syndrome (LIS); that is, being unable to move or speak while aware. In cases of complete loss of muscle control, termed “complete locked-in syndrome,” a BCI may be the only viable solution to restore communication. However, a widespread ignorance regarding quality of life in LIS, current BCIs, and their potential as an assistive technology for persons in LIS, needlessly causes a harmful situation for this cohort. In addition (...) to their medical condition, these persons also face social barriers often perceived as more impairing than their physical condition. Through social exclusion, stigmatization, and frequently being underestimated in their abilities, these persons are being locked out in addition to being locked-in. In this article, we (1) show how persons in LIS are being locked out, including how key issues addressed in the existing literature on ethics, LIS, and BCIs for communication, such as autonomy, quality of life, and advance directives, may reinforce these confinements; (2) show how these practices violate the United Nations Convention on the Rights of Persons with Disabilities, and suggest that we have a moral responsibility to prevent and stop this exclusion; and (3) discuss the role of BCIs for communication as one means to this end and suggest that a novel approach to BCI research is necessary to acknowledge the moral responsibility toward the end users and avoid violating the human rights of persons in LIS. Jean Mabillon and Richard Simon were both eminent seventeenth-century scholars who practiced contextualizing critical philology in order to forge unbeatable scientifical instruments against the skeptics and reinforce the authority of historical documents. But Simon’s work produced a mutation of the meaning of authenticity that would prove subversive and would generate outrage. His sociological and institutionalist understanding of the history of sacred texts not only merged both their production and their transmission into a common, ontologically homogenous historical process, but also included (...) a survey of the sociological and cultural circumstances that transformed the text into a real authority. Furthermore, this anti-essentialist understanding of the gradual formation of the text allowed a positive reevaluation of the tradition as a continuous practice aiming at keeping alive an already historical truth. Given the costs of litigation high-profile court cases about withdrawing life-sustaining medical treatment for seriously ill children in England & Wales tend to be followed by discussion about how to avoid similar cases in future. Whilst two proposals, mediation and replacing the best interests standard with a harm threshold, have received broad attention, a proposal to replace the court by a specialist review committee has not been further investigated. This article analyses the effects of a putative replacement of the courts (...) by a specialist review committee using the process enacted by the futility clauses in the Texas Advance Directives Act (TADA) as a model. Under TADA life-sustaining treatment may legally be withdrawn when a review committee deems it futile and no alternative healthcare provider can be identified. The investigation finds that installing a national review committee with the power to decide whether life-sustaining treatment is futile would have reduced the number of court cases about withdrawal thereof in England & Wales to a handful over the last 3 decades. In addition to shorter procedures and costs savings, a national review committee modelled after TADA would have advantages for both clinicians and parents. Advantages for clinicians are more limited exposure to delivery of clinical care that may cause moral distress and less exposure to adverse press and social media content. Advantages for parents are that the process would establish them as ethical decision makers and offer the possibility of a transfer of the care of the child provided an alternative healthcare provider can be found. As such decisions taken by a specialist review committee may be more acceptable for parents than those of the courts. (shrink)

In this article, I offer a reading of City of God 19.6 that is consonant with Augustine’s message to real judges. Often read as a suggestion that torture and execution are judicially necessary, I argue that 19.6 actually calls such necessities into question, though this is not its primary purpose; first and foremost, 19.6 is an indictment of Stoic apatheia. Situating 19.6 within Augustine’s larger polemic against the Stoics, I find that it presents the Stoic judge as a man who (...) lacks fellow feeling, and therefore, has only a parodic happiness, costly to himself and those judges. A new look at Augustine’s letters to judges confirms this reading, and shows that, for Augustine, the man of humanitas is the true model for the good judge, not the man of apatheia. (shrink)

Does home-based family involvement influence academic performance? To answer this question, a case study research was carried out with 96 children from all six levels of primary education at a public school, and their families. Data regarding home-based family involvement were collected using a questionnaire. Academic achievement was measured from school marks. The results reveal that, apart from two of the factors considered, home–family involvement as a whole is not significantly related to academic achievement. These two factors are access to (...) informal education resources and parents’ employment. Family involvement related to the access of children to informal education resources is significantly related to a better academic achievement. Those students with both parents working perform best, and those with none working, worst. Ethical clinical practice requires cultural competency. In the United States, Hispanics report stronger attitudinal barriers to drug abuse treatment than any other racial/ethnic group. Hispanics report feeling that drug abuse treatment providers do not understand their unique cultural needs and are unfamiliar with their experiences of discrimination and immigration. Using this case study to explore broader ethical and policy issues, this study investigates the extent to which US universities train counselors to address the culturally specific needs of Hispanic patients and (...) how this is reflected in practice in Los Angeles County. Based on a content analysis of the required courses, syllabi, and course descriptions at 30 universities related to culture/race/racism/ethnicity/diversity at the undergraduate and graduate levels on the addiction therapist track, and thematic analysis of eight in-depth interviews with counselors working in outpatient rehabilitation centers in Los Angeles, I argue that cultural competency education for drug abuse counselors is too surface level and infrequent to adequately prepare students for a career in addiction counseling for Hispanic clients. Significant changes must be made to how cultural diversity is valued and prioritized in the field of psychology to provide better care for Hispanic people with a substance use disorder and fulfill the moral obligation to eliminate this health disparity. Although this study focuses on counselors in Los Angeles, these findings are relevant for professionals and healthcare systems across the United States and beyond who seek to provide equitable and effective care for Hispanic patients. Right from the start of the Spanish Civil War, thousands of prisoners were executed by shooting. Today, many of them remain anonymous, but others, thanks to their writing, have passed into history. In the final hours before their execution, these men and women had the chance to write a few farewell letters to their nearest and dearest. These letters, known by historians as ?chapel letters,? passed either through official channels exercising prior censorship or else were sent clandestinely. In their farewell (...) letters, the condemned to death informed their families of their tragic fate and dedicated their last words to them. Genuine family relics, material and spiritual testaments, instruments of denunciation and propaganda, these chapel letters are regarded as the most sincere documents of any historical period. Since prisoners expressed in them their most intimate feelings and thoughts, they constitute the most exceptional testimony of all epistolary forms practised behind bars. By using an interdisciplinary approach this essay seeks to define the material and functional characteristics of this genre and to contextualise it in the framework of ordinary writings and scribal culture. We live in dangerous times, ruled by the imperatives of what Hannah Arendt calls “the catastrophic interiority of the selfish I” 1 which threatens the planet and the survival of humanity. But I believe, nevertheless, that it is possible to reinvent the world since, by and large, it is evident that its shape reflects our notions of reality and value, the way we weave together the various strands of existence. Antonio Gramsci may have had something like this in mind when (...) he wrote that it is only by “the conquest of greater consciousness” that we will be able to bring a different kind of culture into being because, “man is above all spirit,” a creature, that is, with imagina- tion, the ability to reconfigure the way we see ourselves and the world. Just as importantly, he argues that this may mean returning to some things we once knew but have now forgotten or ignored. Poetry or, to be more accurate, poetic ways of seeing, may be one of these things, to the extent that it generates ways of seeing beyond the merely rational. In this essay I therefore want to explore the work of Judith Wright and the ways in which it explores the possibilities of being ‘true to the earth’. 2. (shrink)
