Existing discussions of legal proof address a host of apparently disparate questions: What does it take to prove a fact beyond a reasonable doubt? Why is the reasonable doubt standard notoriously elusive, sometimes considered by courts to be impossible to define? Can the standard of proof by a preponderance of the evidence be defined in terms of probability thresholds? Why is statistical evidence often insufficient to meet the burden of proof? -/- This paper defends an account of proof that addresses (...) each of these questions. Where existing theories take a piecemeal approach to these puzzles, my theory develops an insight that unifies them—namely, the thesis that legal proof requires knowledge. Although this thesis may seem radical at first, I answer several common objections to it, and I argue that it does better than several competing accounts when it comes to making sense of our intuitions about what legal proof requires. This article enlarges classical syllogistic logic with assertions having to do with comparisons between the sizes of sets. So it concerns a logical system whose sentences are of the following forms: Allxareyand Somexarey, There are at least as manyxasy, and There are morexthany. Herexandyrange over subsets (not elements) of a giveninfiniteset. Moreover,xandymay appear complemented (i.e., as$\bar{x}$and$\bar{y}$), with the natural meaning. John R. Searle’s 1995 publication The Construction of Social Reality is the foundation of this collection of scholarly papers examining Searle's philosophical theories. Searle’s book sets out to reconstruct the ontology of the social sciences through an analysis of linguistic practices in the context of his celebrated work on intentionality. His book provided a stimulating account of institutional facts such as money and marriage and how they are created and replicated in everyday social life. The parameter-free part $$\textbf{PA}_2^*$$ of $$\textbf{PA}_2$$, second order Peano arithmetic, is considered. We make use of a product/iterated Sacks forcing to define an $$\omega $$ -model of $$\textbf{PA}_2^*+ \textbf{CA}(\Sigma ^1_2)$$, in which an example of the full Comprehension schema $$\textbf{CA}$$ fails. Using Cohen’s forcing, we also define an $$\omega $$ -model of $$\textbf{PA}_2^*$$, in which not every set has its complement, and hence the full $$\textbf{CA}$$ fails in a rather elementary way.

The small, the tiny, and the infinitesimal have been the object of both fascination and vilification for millenia. One of the most vitriolic reviews in mathematics was that written by Errett Bishop about Keisler’s book Elementary Calculus: an Infinitesimal Approach. This report of the roundtable that took place on 25 November 2021 at The Peoples’ Friendship University of Russia attempts to explain the obvious growth of interest in Neo-Kantian philosophy in general and the philosophy of the head of the Marburg School of Neo-Kantianism, Hermann Cohen, in particular. In their contributions, the participants in the discussion demonstrated that the current interest in Neo-Kantianism does not solely or even largely have to do with the history of philosophy but rather with the (...) relevance of many of the ideas of Marburg Neo-Kantianism for the modern theory of cognition, the philosophy of culture, ethics and the philosophy of religion. The course of the discussion highlighted the relevance of Cohen’s theory of cognition based on logic and rationality. The main outcome of the discussion was the conviction that the potential of many of Cohen’s ideas has yet to be fully tapped and there are grounds for considering them to be heralds of a new philosophy which, in many of its features, is only maturing. Mindfulness-based interventions have proved effective in reducing various clinical symptoms and in improving general mental health and well-being. The investigation of the mechanisms of therapeutic change needs methods for assessment of mindfulness. Existing self-report measures have, however, been strongly criticized on various grounds, including distortion of the original concept, response bias, and other. We propose a psychophysiological method for the assessment of the mindfulness learned through time-limited mindfulness-based therapy by people who undergo meditation training for the first time. We use (...) the individual pre-post-therapy changes (dERPi) in the event-related brain potentials (ERPs) recorded in a passive meditation task as a measure of increased mindfulness. dERPi is computed through multivariate assessment of individual participant's ERPs. We tested the proposed method in a group of about 70 recurrently depressed participants, randomly assigned in 1.7:1 ratio to mindfulness-based cognitive therapy (MBCT) or cognitive therapy (CT). The therapy outcome was measured by the long-term change (dDS) relative to baseline in the depression symptoms (DS) assessed weekly, for 60 weeks, by an online self-report questionnaire. We found a strong, highly significant, negative correlation (r = -0.55) between dERPi (mean = 0.4) and dDS (mean = -0.7) in the MBCT group. Compared to this result, the relationship between dDS and the other (self-report) measures of mindfulness we used was substantially weaker and not significant. So was also the relationship between dERPi and dDS in the CT group. The interpretation of dERPi as a measure of increased mindfulness was further supported by positive correlations between dERPi and the other measures of mindfulness. In this study, we also replicated a previous result, namely, the increase (dLCNV) of the late contingent negative variation (LCNV) of the ERP in the MBCT group, but not in the control group (in this case, CT). We interpreted dLCNV as a measure of increased meditative concentration. The relationship between dLCNV and dDS was, however, very week, which suggests that concentration might be relatively unimportant for the therapeutic effect of mindfulness. The proposed psychophysiological method could become an important component of a "mindfulness test battery" together with self-report questionnaires and other newly developed instruments. (shrink)

After two generations of emphasis on governmental inefficiency and the need for deregulation, we now see growing interest in the possibility of constructive governance, alongside public calls for new, smarter regulation. Yet there is a real danger that regulatory reforms will be rooted in outdated ideas. As the financial crisis has shown, neither traditional market failure models nor public choice theory, by themselves, sufficiently inform or explain our current regulatory challenges. Regulatory studies, long neglected in an atmosphere focused on deregulatory (...) work, is in critical need of new models and theories that can guide effective policy-making. This interdisciplinary volume points the way toward the modernization of regulatory theory. Its essays by leading scholars move past predominant approaches, integrating the latest research about the interplay between human behavior, societal needs and regulatory institutions. In the absence of new physics around \ GeV, the electroweak vacuum is at best metastable. This represents a major challenge for high scale inflationary models as, during the early rapid expansion of the universe, it seems difficult to understand how the Higgs vacuum would not decay to the true lower vacuum of the theory with catastrophic consequences if inflation took place at a scale above \ GeV. In this paper we show that the non-minimal coupling of the Higgs boson (...) to curvature could solve this problem by generating a direct coupling of the Higgs boson to the inflationary potential thereby stabilizing the electroweak vacuum. For specific values of the Higgs field initial condition and of its non-minimal coupling, inflation can drive the Higgs field to the electroweak vacuum quickly during inflation. (shrink)

This paper considers the correspondence theory from modal logic and obtains correspondence results for models as opposed to frames. The key ideas are to consider infinitary modal logic, to phrase correspondence results in terms of substitution instances of a given modal formula, and to identify bisimilar model-world pairs.

The political teachings of Thomas Hobbes and Carl Schmitt imply fundamental ontological structures that reflect the processes of the genesis, assertion, and destruction of political being. The article investigates similarities and differences between these political projects. The approach applied by the author is marked by a reliance on the theoretical analysis of the Leviathan's frontispiece and by employing the conceptual framework of Giorgio Agamben's Homo sacer project. The application of these theoretical optics helps to evaluate the political significance of the (...) present people (the people composed of living human beings) in Hobbes's and Schmitt's contexts and to detect the notable difference between the two projects. The article highlights that political existence presupposes the total depoliticization of the present people in the framework of Hobbes's philosophy. It is argued that the security of the present people's life becomes an underlying condition for the mentioned construction (and is therefore ontologically significant). The provision of security potentially saves the sovereign's own life and guarantees recognition by the subjects. An investigation of Schmitt's teaching reveals the political significance of the present people. Since - according to Schmitt - political will is understood only in the context of political enmity (the necessary "horizon” of which is armed confrontation), it is concluded that the political significance of the present people is closely associated with its members' readiness to die in the war. Due to the fact that political existence is generated through the decision on the public enemy (in which the present people might be involved via acclamation procedures), the resoluteness toward death that underlies this decision must be considered as the key factor of Carl Schmitt's political ontology. In light of this statement, it is argued that the project of Martin Heidegger's Being and Time could be considered as Carl Schmitt's "unwritten" ontology of the individual being. (shrink)

The problem of commensurability/incommensurability of different cultural codes is a key problem of modern civilizational development. This is the problem of the search for communicative unity in the world of cultural and biological diversity, which has to be protected, and the search for the cohesion of different Umwelten, of semiotically-defined artificial and natural environments, of ecological and cognitive niches, taking into account that each of them has their own identity and uniqueness. The purpose of the article is to draw attention (...) to the fact that the question of the so-called incommensurability of different conceptual schemes, paradigms, language consciousnesses is widely discussed not only in cross-cultural studies and philosophical problems of translation but also in connection with the problems of incommensurability between the language of classical physics and the language of relativistic quantum physics. Attention is drawn to the problem of the incommensurability and correlation of different languages that are used in debates about the foundations of quantum mechanics, its interpretation, comprehension and ontology. Two approaches stand out in this debate. The first approach is based on the language of the formed being, on the language of things localized in time and on the logic of Aristotle. The second approach is based on the language of the becoming, process and nonlocality, on the search for various processual-oriented temporal logics. In this regard, we discuss the processual approach to understanding quantum mechanics, proposed in the philosophical and physical works of D. Bohm. The authors argue that the experience of constructive understanding of the metaproblems of the interpretation of quantum mechanics, the critical reception of the legacy of such philosophers of the process as Peirce, Bergson and Whitehead, the deep reflection on the problems of commensurability/ incommensurability of linguistic consciousnesses of different cultures – will eventually create a common synergetic-interdisciplinary space of cooperation for the solutions of the above-mentioned issues. Focusing on three historical examples of a different understanding of Christian identity, the paper seeks to address the role of contemporary concepts of sex and gender in the creation of Christian identity. In the first case study, focused on the literary representations of the Christian martyrdom from the second and third centuries, special emphasis is placed on the demand for the?manly? or?masculine? way of witnessing faith. The second historical example relates to the creation of a wider ascetic movement in the (...) fourth-century Asia Minor, and its specific focus is on Macrina the Younger. In her Vita, Gregory of Nyssa distinguishes between Macrina?s gender identity based on her virginity on the one hand, and her social role as a widow, and?mother? and?father? of her monastic community on the other. Finally, the focus is shifted towards Dionysius the Areopagite and Maximus the Confessor, whose teachings about ecstasy, as a way to transcend oneself in the movement towards the loved one, provide the basis for establishing a theology of marriage and creating a Christian identity based not on sexual or gender roles, but on the uniqueness of human nature. Alan Baker argues that mathematical objects play an indispensable explanatory role in science. There are several examples cited in the literature as solid candidates for such a role. We discuss two such examples and show that they are very different in their strength and (im)perfection, although both are recognized by the scientific community as examples of the best scientific explanations of particular phenomena. More specifically, it will be shown that the explanation of the cicada case has serious shortcomings compared with (...) the explanation of the case of Königsberg’s bridges. We will argue that the latter is a perfectly reliable scientific explanation that employs mathematical reasoning whereas the former is not. (shrink)
