Physicians have an ethical responsibility to their patients to offer the best available medical care. This responsibility conflicts with their role as gatekeepers of the limited health care resources available for all patients collectively. It is ethically untenable to expect doctors to face this trade-off during each patient encounter; the physician cannot be expected to compromise the wellbeing of the patient in the office in favour of anonymous patients elsewhere. Hence, as in other domains of public policy where individual and (...) collective interests conflict, some form of collective solution is required. Collective solutions may take the form of placing explicit resource constraints on resources available to physicians, or clinical practice guidelines that recognise cost-effective care as acceptable. Such solutions will be politically and ethically sustainable only if patients as citizens of the larger population accept the need for rationing of limited resources in health care. (shrink)

Spinoza's heritage has been occluded by his incorporation into the single, western, philosophical canon formed and enforced by theologico-political condemnation, and his heritage is further occluded by controversies whose secular garb shields their religious origins. By situating Spinoza's thought in a materialist Aristotelian tradition, this book sheds new light on those who inherit Spinoza's thought and its consequences materially and historically rather than metaphysically. By focusing on Marx, Benjamin, and Adorno, Idit Dobbs-Weinstein explores the manner in which Spinoza's radical (...) critique of religion shapes materialist critiques of the philosophy of history. Dobbs-Weinstein argues that two radically opposed notions of temporality and history are at stake for these thinkers, an onto-theological future-oriented one and a political one oriented to the past for the sake of the present or, more precisely, for the sake of actively resisting the persistent barbarism at the heart of culture. In the following paper, Annemiek Richters of the University of Leiden in the Netherlands addresses the dilemmas faced by health professionals who are asked to evaluate and provide supporting documentation for those refugees who seek political asylum in the countries of Europe. It is in the politically charged arena of asylum applications, government regulations, and public policy where bioethics, human rights, and health converge. Despite the 1951 Convention on Refugees, a treaty signed by nations around the world to safeguard the (...) rights of those who are displaced, and other treaties that protect the rights of vulnerable populations, refugee and asylum policies have become increasingly strict in an effort to deter those who would seek safety. This tightening of borders in the countries of the West challenges physicians who find themselves caught between obligations to treat, to advocate, and to challenge policies that make treatment a potentially dangerous proposition. Hans Baron, Karl Popper, Leo Strauss and Erich Auerbach were among the many German-speaking Jewish intellectuals who fled continental Europe with the rise of Nazism in the 1930s. Their scholarship, though not normally considered together, is studied here to demonstrate how, despite their different disciplines and distinctive modes of working, they responded polemically in the guise of traditional scholarship to their shared trauma. Described as a “delirium” with the potential to “unleash (...) new ideas, new desires, and new imaginings” (Sholtz and Carr, 1), the editors adopt Deleuze and Guattari’s schizoanalysis as the basis for this methodology. They argue that this juxtaposition of feminist theory and schizoanalysis might synthesize and advance research on notions like becoming-woman, rhizomatics, deterritorialization, assemblage, immanence, and material vitalism (2) that have propelled feminist work on Deleuze and Guattari over the last several decades. Moreover, in the volume’s critical reevaluation of schizoanalysis, it strives to reimagine “the philosophical, ethical, aesthetic, and political” (1) by incorporating the evolution of feminist thought since Deleuze and Guattari’s time. The volume is, indeed, important reading for feminist continental philosophers in search of fruitful applications of Deleuzo-Guattarian thought to a wide, intersectional diversity of feminist theory.Citing Buchanan and Colebrook’s Deleuze and Feminist Theory (2000) as the origin of a productive and less skeptical feminist engagement with their work, the volume aims to advance a new generation of feminist Deleuzo-Guattarian thought that departs from a radically heterogeneous, schizoanalytic foundation [End Page 192] asking, “what can philosophical concepts do?” (2). The editors also mention the recent uptake of schizoanalysis as a methodology by reference to the Schizoanalytic Applications series in which the volume is published. There, its application “to contemporary issues and uses in critically oriented and socially engaged philosophical approaches” (4) is explored in a variety of otherwise targeted collections. They suggest that the relevance of schizoanalytic methodology “to feminist theory can be similarly situated in providing a new lens for critical and social engagement,” which the volume explores under the guise of discovering what this “new encounter” between feminism and schizoanalysis “might yield” (4). Thus, the collection is a dual-pronged, dynamic investigation, where one trajectory investigates the potentials for forging a feminist schizoanalytic framework and the other considers the ways that feminism might nuance or reshape the contours of schizoanalysis that were established across Deleuze and Guattari’s collaborative works (1).Furthermore, the editors cite the publication of Guattari’s Schizoanalytic Cartographies (2013) as additional inspiration. And it is, indeed, in part from Guattari’s visionary work that the joint project with Deleuze—including the articulations of schizoanalysis in Anti-Oedipus, Kafka, and A Thousand Plateaus— came into being (see: Guattari 2006). As Stephane Nadaud explains, their collaboration was designed to “counter... despotic, solitary enunciation—with their own collective one,” which transcends the Cartesian “unity of our ego—the famous I that thinks, and therefore... the cogito” (Guattari 2006, 19). It is, thus, curious that the volume’s title omits Guattari’s name (though other books in the series include it) and that contributors make scarce reference to his individual work. For, it is the very process of their collaboration, which entails their essential duality and the schizoanalytic becoming-imperceptible of their respective individualities, that becomes an archetype for schizoanalytic praxis.The aforementioned delirium, which is at the heart of schizoanalysis, originates from the split or break implied by the “schizo,” meaning that schizoanalysis seeks to locate then mobilize these breaks toward the creation of delirious, impersonal subjectivities. Merging desire and delirium, which he considers “in a deep sense” indistinguishable, Deleuze emphasizes that “desire-delirium is by its nature a libidinal investment of an entire historical milieu, of an entire social environment” (2004, 275). The schizoanalysis process, according to the editors, thus aspires to be a liberatory short-circuit of the rigidly enclosed “Oedipal constraints on the unconscious,” which, in turn, decouples “the unconscious libidinal investment[s]... from the preconscious investments of class and interest” (Shultz and Carr, 4). Experts play an important role in society, but there has been little investigation about the nature of expertise. I argue that there are two kinds of experts: those whose expertise is a function of what theyknow (epistemic expertise), or what theydo (performative expertise). Epistemic expertise is the capacity to provide strong justifications for a range of propositions in a domain, while performative expertise is the capacity to perform a skill well according to the rules and virtues of a practice. This paper discusses some philosophical aspects related to the recent publication of the experimental results of the 2017 black hole experiment, namely the first image of the supermassive black hole at the center of galaxy M87. In this paper I present a philosophical analysis of the 2017 Event Horizon Telescope (EHT) black hole experiment. I first present Hacking’s philosophy of experimentation. Hacking gives his taxonomy of elements of laboratory science and distinguishes a list of elements. I show that the EHT (...) experiment conforms to major elements from Hacking’s list. I then describe with the help of Galison’s Philosophy of the Shadow how the EHT Collaboration created the famous black hole image. Galison outlines three stages for the reconstruction of the black hole image: Socio-Epistemology, Mechanical Objectivity, after which there is an additional SocioEpistemology stage. I subsequently present my own interpretation of the reconstruction of the black hole image and I discuss model fitting to data. I suggest that the main method used by the EHT Collaboration to assure trust in the results of the EHT experiment is what philosophers call the Argument from Coincidence. I show that using this method for the above purpose is problematic. I present two versions of the Argument from Coincidence: Hacking’s Coincidence and Cartwright’s Reproducibility by which I analyse the EHT experiment. The same estimation of the mass of the black hole is reproduced in four different procedures. The EHT Collaboration concludes: the value we have converged upon is robust. I analyse the mass measurements of the black hole with the help of Cartwright’s notion of robustness. I show that the EHT Collaboration construe Coincidence/Reproducibility as Technological Agnosticism and I contrast this interpretation with van Fraassen’s scientific agnosticism. (shrink)

Gravestones and inscription stones, which are among the oldest indicators of the phenomenon of death engraved in the public memory with images and rituals, are the ancient interpreters of the consciousness of death, which is the redemption of human beings as conscious beings. The phenomenon of death or dying, which was domesticated through a natural spirituality in antiquity, and a monotheistic religiosity in the Middle Ages, loses its spirituality by becoming profaned in the hands of consumer culture and is brutalized (...) today in terms of lifestyle by being cut off from existence in positivist paradigm in epistemological terms. The study deals with the secular perception of death and the individual and social crises caused by this perception in the context of tradition and modernity. The purpose of the study is to draw attention to the spread of natural and materialist assumptions in the perception of death and the strengthening of the profane elements in mourning ceremonies and to make sense of the traces left by this process in the individual and society. It is seen in the study that the efforts to cover up and intimidate the deceased and the subject of loss bring existential crises, alienation, and violence against oneself or others. On the other hand, it is also understood that it is not a coincidence that the traces of the culture of reconciliation built between death and life by the traditional perception of death in the countryside as an alternative perception faced. The study has been conducted with the document analysis design method, which is a qualitative research type. The approaches to the phenomenon of death have been subjected to a chronological literature reading in the study, and the diagnoses of the 21st century attitudes of the death perception, which were reached by going back to early days, were tested in historical and semiotics terms with the films Making Ships from Watermelon Shell (2004) and Shattered (2021), which were chosen to represent two different paradigms as documentary data. The study is important in that it examined the changing perception of death and the culture of mourning in detail and created a current topography and contributes to the studies of the sociology of death, which is still a fresh field. In a number of recent discussions of non-standard, Philosophy programs vaarious ages have been identified as the focus for spontaneous or exceptional interest in philosophising. Such claims, supporting a particular population as naturally suited to philosophical inquiry, are based as often as not, on anecdotes that exhibit telling instances of philosophical activity. Needless to say, such motivated activity occurring spontaneously and outside of a formal classroom may occur in many contexts and at various ages. If professional educators egar to support (...) philsophical programs on the basis of the naturalness of the philosophical enterprise are to warrant their interest on the basis of claims to age-appropriateness, some reasonable attempt at gathering empirical data is required. Community of inquiry is most often seen as a dialogical procedure for the cooperative development of reasonable approaches to knowledge and meaning. This reflects a deep commitment to normatively based reasoning that is pervasive in a wide range of approaches to critical thinking and argument, where the underlying theory of reasoning is logic driven, whether formal or informal. The commitment to normative reasoning is deeply historical reflecting the fundamental distinction between reason and emotion. Despite the deep roots of the distinction (...) and its canonization in current educational thought, contemporary cognitive neuroscience presents a fundamental challenge to the viability of the distinction and thus to any effort that sees education for reasonable judgment to be based on the remediation of cognition in isolation from its roots in the emotions. Cognitive neuroscience looks at the deep connections between emotion and memory, information retrieval, and resistance to refutation. This conforms with earlier studies in experimental psychology, which showed resistance to changing beliefs in the face of evidence, including evidence based on personal experience. This paper will look at the recent research including speculations from neurological modeling that shows the depth of connection between, emotions, memory and reasoning. It will draw implications for dialogic thinking within a community of inquiry including systematic self-reflection as an essential aspect of critical thinking. (shrink)

This paper examines the undervalued role of Herbert Spencer in Sidgwick's thinking. Sidgwick recognized Spencer's utilitarianism, but criticized him on the ground that he tried to deduce utilitarianism from evolutionary theory. In analysing these criticisms, this paper concludes that Spencer's deductive methodology was in fact closer to Sidgwick's empiricist position than Sidgwick realized. The real source of Sidgwick's unhappiness withSpencer lies with the substance of Spencer's utilitarianism, namely its espousal of indefeasible moral rights.

Can we legitimately speak of ethicsexperts? Recent literature in philosophy and medical ethics addresses this important question but does not offer a satisfactory answer. Part of the problem is the absence of an examination of what it means to be an expert in general. I therefore begin by reviewing my analysis of expertise which appeared earlier in this journal. We speak of two kinds of experts: persons whose expertise is in virtue of what theyknow (epistemic expertise), or what theydo (performative (...) expertise). Applying this analysis to the domain of ethics, I argue that we may speak of ethical expertise in three epistemic senses: a) expertise indescriptive ethics, b) expertise inmetaethics, c) expertise innormative ethics, and in a performative sense: d) expertise inliving a good life. I conclude with a brief description of some social roles of ethics experts. (shrink)

This rich and provocative study assesses Herbert Spencer's pivotal contribution to the emergence of liberal utilitarianism and shows that Spencer, as much as J. S. Mill, provided liberal utilitarianism with its formative contours. Like Mill, Spencer tried to reconcile a principle of liberty and strong moral rights with a utilitarian, maximizing theory of good. In this powerful and sympathetic account, David Weinstein argues that Spencer's moral and political thought exhibits greater systematic integrity than received views of his thought acknowledge. (...) However, Weinstein also examines the problems and flaws in Spencer's version of liberal utilitarianism, and shows that, precisely because of these flaws, it is engaging and deserving of our critical attention. This paper discusses Spinoza's critique of religion as a visible moment of a radically occluded materialist Judeo-Arabic Aristotelian philosophical tradition. While the prevailing (Christo-Platonic) tradition begins with the familiar gesture to metaphysics as first philosophy, Spinoza's thought (and thus, this Other Tradition) takes politics as its point of departure with its concrete emphasis on a critique of dogma. This paper will show-by way of differing readings of Spinoza-how this materialist tradition becomes occluded by the prevailing tradition, even in the work (...) of such careful materialist Spinoza commentators as Etienne Balibar. Contrasting traditional and common forms of ethics consultation with bioethics mediation, I describe the case of a “second opinion” consultation in the care of a patient with advanced cancer for whom treatment was futile. While the initial ethics consultation, performed by a colleague, led to a recommendation that some may deem ethical, the process failed to involve key stakeholders and failed to explore the underlying values and reasons for the opinions voiced by various stakeholders. The process of mediation ultimately led (...) to creative solutions in which all stakeholders could reach consensus on a plan of care. (shrink)

Using the motif of the hipster to consider the arrival of the concept “Anthropocene” into the orbit of critical theory, this essay establishes the grave existential consequences that issue from the infatuation with, and rapid, uncritical uptake and circulation of, concepts in a philosophical market overcome by neoliberal pressures. These epistemic habits align with political commitments that unwittingly controvert the original intents of critique—and this paradox requires remediation. This essay, thus, argues for a recalibration of epistemic praxis by reclaiming a (...) retro, critical, vital form of philology—figured as both a scholarly practice and a way of life. The hope is to counter the stultifying force of the late-capitalist praxis of commodification, consumption, and hyper-production of concepts spawned by the fatal lure of progress narratives and the fetishization of innovation and originality they entail. Accordingly, we might resolve the tension between habits and politics and account for vital differences and resistances not revealed by the mutation of critique inherent in contemporary strategies. Thus, not only might epistemic politics evolve, but critical theory may also avert extinction by revitalizing it as a dynamic life practice. (shrink)
