The essays in this book exhibit a commendably high level of scholarship. They are written by an accomplished group of thinkers (some of them well-known and well-established and some of them relatively new and worth keeping in view). All the essays are new to this book (except the two on rights). The book is well produced (I noted only a dropped note superscript in Gaus’s chapter and a missing ‘not’ on p.

The role of intentions in motor planning is heavily weighted in classical psychological theories, but their role in generating eye movements, and our awareness of these oculomotor intentions, has not been investigated explicitly. In this study, the extent to which we monitor oculomotor intentions, i.e. the intentions to shift one’s gaze towards a specific location, and whether they can be expressed in conscious experience, is investigated. A forced-choice decision task was developed where a pair of faces moved systematically across a (...) screen. In some trials, the pair of faces moved additionally as soon as the participants attempted to gaze at one of the faces, preventing them from ever viewing it. The results of the experiment suggest that humans in general do not monitor their eye movement intentions in a way that allows for mismatches between planned gaze landing target and resulting gaze landing target to be consciously experienced during decision-making. Convinced of the importance of framing, many environmentalists have begun emphasizing positive visions of a happy and healthy green future rather than gloomy pictures of deprivation and sacrifice. ?Gloom and doom? discourses foster despair and resistance, they worry, instead of hope and motivation to change. While positive visions are crucial, though, it is ineffective to deny that living more sustainably will involve any loss. Since people value many incompatible things, living more sustainably will inevitably entail both sacrifice and reward. Environmentalists (...) must help articulate new possibilities of a greener future without dismissing the value of what must be given up. (shrink)

As the world's population ages, governments and non-governmental organizations in developed countries are promoting healthy cognitive ageing to reduce the rate of age-related cognitive decline and sustain economic productivity in an ageing workforce. Recommendations from the Productivity Commission, Dementia Australia, Government Office for Science, Presidential Commission for the Study of Bioethical Issues, Institute of Medicine, among others, are encouraging older adults to engage in mental, physical, and social activities. These lifestyle recommendations for healthy cognitive ageing are timely and well supported (...) by scientific evidence but they make implicit normative judgments about the responsibility of ageing individuals to prevent cognitive decline. Ethical tensions arise when this individual responsibility collides with social and personal realities of ageing populations. First, we contextualize the priority given to healthy cognitive ageing within the current brain-based medical and social discourses. Second, we explore the individual responsibility by examining the economic considerations, medical evidence and individual interests that relate to the priority given to healthy cognitive ageing. Third, we identify three key ethical challenges for policymakers seeking to implement lifestyle recommendations as an effective population-level approach to healthy cognitive ageing. The result is a prospectus for future in-depth analysis of ethical tensions that arise from current policy discussions of healthy cognitive ageing. (shrink)

This essay defends the view that inductive reasoning involves following inductive rules against objections that inductive rules are undesirable because they ignore background knowledge and unnecessary because Bayesianism is not an inductive rule. I propose that inductive rules be understood as sets of functions from data to hypotheses that are intended as solutions to inductive problems. According to this proposal, background knowledge is important in the application of inductive rules and Bayesianism qualifies as an inductive rule. Finally, I consider a (...) Bayesian formulation of inductive skepticism suggested by Lange. I argue that while there is no good Bayesian reason for judging this inductive skeptic irrational, the approach I advocate indicates a straightforward reason not to be an inductive skeptic. (shrink)

In this paper, I critically assess transhumanist philosophy and its influence in bioethics by turning to resources in the work of Michel Foucault. I begin by outlining transhumanism and drawing out some of the primary goals of transhumanist philosophy. In order to do so, I focus on the work of Nick Bostrom and Julian Savulescu, two prominent contributors to this thinking. I then move to explicate Foucault’s work, in the early iterations of the Abnormal lecture series, on the concept of (...) vile sovereignty. Foucault used the concept of vile sovereignty to critique psychiatric witnesses that had been utilized in mid twentieth-century French courts of law. Turning back to transhumanism, I analyze transhumanist discourse on the basis of Foucault’s vile sovereignty. Transhumanists promote human enhancement in a way that rejects the body—especially the disabled body—and pose the question of what lives are worth living, as well as attempt to answer it. I conclude that because of the undeserved influence and ableism of transhumanism, it is important for feminist philosophers, philosophers of disability, and other disability scholars, who collide at the nexus of bioethical debate (especially with regard to reproductive technology and the body), to work together to intervene upon transhumanist discourse. The United Nations (UN) Universal Declaration of Human Rights engenders important state commitments to respect, fulfill, and protect a broad range of socio-economic rights. In 2010, a milestone was reached when the UN General Assembly recognized the human right to safe and clean drinking water and sanitation. However, water plays an important role in realizing other human rights such as the right to food and livelihoods, and in realizing the Convention on the Elimination of All Forms of Discrimination against Women. (...) These broader water-related rights have been recognized but have not yet been operationalized. This paper unravels these broader water-related rights in a more holistic interpretation of existing international human rights law. By focusing on an emerging approach to water services provision—known as ‘domestic-plus’ services—the paper argues how this approach operationalizes a comprehensive range of socio-economic rights in rural and peri-urban areas. Domestic-plus services provide water for domestic and productive uses around homesteads, which challenges the widespread practice in the public sector of planning and designing water infrastructure for a single-use. Evidence is presented to show that people in rural communities are already using their water supplies planned for domestic uses to support a wide range of productive activities. Domestic-plus services recognize and plan for these multiple-uses, while respecting the priority for clean and safe drinking water. The paper concludes that domestic-plus services operationalize the obligation to progressively fulfill a comprehensive range of indivisible socio-economic rights in rural and peri-urban areas. Developmentally, adolescence sits in transition between childhood and adulthood. Involving adolescents in their medical decision-making prompts important and complex ethical questions. Originating in the UK, the concept of Gillick competence is a dominant framework for navigating adolescent medical decision-making from legal, ethical and clinical perspectives and is commonly treated as comprehensive. In this paper, we argue that its utility is far more limited, and hence over-reliance on Gillick risks undermining rather than promoting ethically appropriate adolescent involvement. We demonstrate that Gillick (...) only provides guidance in the limited range of cases where legal decisional authority needs to be clarified. The range of cases where use of Gillick actually promotes adolescent involvement is narrower still, because several features must be present for Gillick to be enacted. Each of these features can, and do, act as barriers to adolescent involvement. Within these limited situations, we argue that Gillick is not specific or strong enough and is reliant on ethically contestable principles. Moreover, in most situations in adolescent healthcare, Gillick is silent on the ethical questions around involving adolescents. This is because it focuses on decisional authority—having the final say in decision-making—which is one small subset of the many ways adolescents could be involved in decision-making. The implication of our analysis is that use of Gillick competence tends to limit or undermine adolescent involvement opportunities. We propose that those working with adolescents should be judicious in seeking Gillick’s guidance, instead drawing on and developing alternative frameworks that provide a comprehensive model for adolescent involvement. Indigenous communities have always cultivated social studies learning that is interactive, dynamic, and integrated with traditional knowledges. To confront the assimilative and deculturalizing education that accompanied European settlement of the Americas, Montana has adopted Indian Education for All (IEFA). This case study evaluates the Digital Storywork Partnership (DSP), which strives to advance the goals of IEFA within and beyond the social studies classroom through community-centered research and filmmaking. Results demonstrate the potential for DSP projects to advance culturally revitalizing education, community (...) connectedness, and identity-development. The DSP offers a model for social studies education that is not only culturally affirming and revitalizing for Indigenous communities, but also holds potential for use in all communities. We conclude with recommendations for educators, scholars, and community members engaged in similar efforts. (shrink)

Health insurance mandates have been a component of many recent health care reform proposals. Because a federal requirement that individuals transfer money to a private party is unprecedented, a number of legal issues must be examined. This paper analyzes whether Congress can legislate a health insurance mandate and the potential legal challenges that might arise, given such a mandate. The analysis of legal challenges to health insurance mandates applies to federal individual mandates, but can also apply to a federal mandate (...) requiring employers to purchase health insurance for their employees. There are no constitutional barriers for Congress to legislate a health insurance mandate as long as the mandate is properly designed and executed, as discussed below. This paper also considers the likelihood of any change in the current judicial approach to these legal questions. (shrink)

This paper questions the connection between vaginas and feminist embodiment in The Vagina Monologues and considers how the text both challenges and reinscribes systems of patriarchy, compulsory heterosexuality, and ableism. I use the Intersex Society of North America's critique as a point of departure and argue that the text offers theorists and activists in feminist, queer, and disability communities an opportunity to understand how power operates in both dominant discourses that degrade vaginas and strategies of feminist resistance that seek to (...) reclaim and celebrate them. Rho, a member of the Ras superfamily of small GTPases, has multiple biological roles: it regulates signal trasduction pathways linking extracellular growth factors to the assembly of actin stress fibres and focal adhesion complexes; it is required for G1 progression and activates the SRF transcription factor when quiescent fibroblasts are stimulated to grow; and it plays a role later in the cell cycle during cytokinesis. Two groups have recently succeeded in identifying downstream effectors of Rho that may mediate some of (...) these biological effects. This paper reports the social and medical characteristics of women resident in Aberdeen city who were sterilized in 195162 and 197152 women were offered sterilization, the majority being lower social class mothers with five or more children who were sterilized concurrently with abortion; the small number of upper social class women had one or two children and were sterilized for medical or obstetric reasons. What exactly is a genetic disease? For a phrase one hears on a daily basis, there has been surprisingly little analysis of the underlying concept. Medical doctors seem perfectly willing to admit that the etiology of disease is typically complex, with a great many factors interacting to bring about a given condition. On such a view, descriptions of diseases like cancer as genetic seem at best highly simplistic, and at worst philosophically indefensible. On the other hand, there is clearly some (...) practical value to be had by classifying diseases according to their predominant cause when this can be accomplished in a theoretically satisfactory manner. The question therefore becomes exactly how one should go about selecting a single causal factor among many to explain the presence of disease. When an attempt to defend such causal selection is made at all, the standard accounts offered (Koch's postulates, Hill's epidemiological criteria, manipulability) are all clearly inadequate. I propose, however, an epidemiological account of disease causation which walks the fine line between practical applicability and theoretical considerations of causal complexity and attempts to compromise between patientcentered and population-centered concepts of disease. The epidemiological account is the most basic framework consistent with our strongly held intuitions about the causal classification of disease, yet it avoids the difficulties encountered by its competitors. Although a great deal has been written concerning the verifiability of empirical, declarative sentences, yet some further clarification in this area seems possible and desirable. I think it is important to determine what sort of property ‘verified by’ is. Obviously it is a semiotical property. Only sentences, never matters of fact, are verified. But where, in the area of semiotics, is it to be placed? To use Charles Morris's useful and now somewhat traditional classification, is it a syntactic, semantic, or (...) pragmatic predicate? My answer is that it falls within semantics. Before developing this, however, I should like to point out why I do not place it in either of the other two subdivisions. (shrink)

This essay will examine the polemic and poetic means through which three Indigenous Australian writers discuss the repercussions and risks associated with nuclear power, waste and weaponry as an existential and material threat to the mythopoeic creation stories, totemic systems and landforms which sustain Indigenous Australian belief. This essay will follow the establishment of a media ecology through which discourses of technological harm in Oodgeroo Noonuccal's “No More Boomerang” lay the foundation for Australian Indigenous anti-nuclear activist poetics and highlights the (...) relationship between language, belief and technology. Oodgeroo's [Kath Walker] “No More Boomerang” will be read as a precursor to the experimental expression of Lionel Fogarty's “Foot Walking and Talking – Atomic Confusion” as well as the procedural methodologies behind Natalie Harkin's “Zero Tolerance.” It will be argued that Indigenous-led representations of nuclear weaponry as an ontologic-existential threat can only be properly critiqued when framed through the constructs of race, nationhood and the history of colonization in Australia. The concepts of joint probability as implied by the Copenhagen and realist interpretations of quantum mechanics are examined in relation to (a) the rules for manipulation of probabilistic quantities, and (b) the role of the Bell inequalities in assessing the completeness of standard quantum theory. Proponents of completeness of the Copenhagen interpretation are required to accept a modification of the classical laws of probability to provide a mechanism for complementarity. A new formulation of the locality postulate is given, not involving (...) factorizability or conditional probabilities, which clarifies the role of locality in the derivation of the Bell inequalities. According to the standard positivist picture of law, each legal system contains a master rule that specifies criteria of legality for primary rules.1 A central debate in legal philosophy during the past twenty-five years has concerned the content of the master rule. Exclusive positivists insist that the master rule can only make reference to social facts or sources: “pedigree” criteria.2 As Ronald Dworkin emphasizes, however, some rulings can’t be justified exclusively by reference to pedigreed legal norms.3 Judges sometimes exercise.

This book focuses on social phenomenon that impact the lives of adolescent females of color. The authors highlight the daily challenges that African-American, Chicana, and Puerto Rican teenage girls face with respect to peer and family influences, media stereotyping, body image, community violence, pregnancy, and education. The authors also emphasize the incredible resiliency that young women possess in countering many of the social barriers confronting them.
